Crime victims, survivors, and witnesses

RCW 7.69.010

In recognition of the severe and detrimental impact of crime on victims, survivors of victims, and witnesses of crime and the civic and moral duty of victims, survivors of victims, and witnesses of crimes to fully and voluntarily cooperate with law enforcement and prosecutorial agencies, and in further recognition of the continuing importance of such citizen cooperation to state and local law enforcement efforts and the general effectiveness and well-being of the criminal justice system of this state, the legislature declares its intent, in this chapter, to grant to the victims of crime and the survivors of such victims a significant role in the criminal justice system. The legislature further intends to ensure that all victims and witnesses of crime are treated with dignity, respect, courtesy, and sensitivity; and that the rights extended in this chapter to victims, survivors of victims, and witnesses of crime are honored and protected by law enforcement agencies, prosecutors, and judges in a manner no less vigorous than the protections afforded criminal defendants.

§ 3771. Crime victims’ rights

§ 3771. Crime victims’ rights

(a) Rights of Crime Victims.— A crime victim has the following rights:
(1) The right to be reasonably protected from the accused.
(2) The right to reasonable, accurate, and timely notice of any public court proceeding, or any parole proceeding, involving the crime or of any release or escape of the accused.
(3) The right not to be excluded from any such public court proceeding, unless the court, after receiving clear and convincing evidence, determines that testimony by the victim would be materially altered if the victim heard other testimony at that proceeding.
(4) The right to be reasonably heard at any public proceeding in the district court involving release, plea, sentencing, or any parole proceeding.
(5) The reasonable right to confer with the attorney for the Government in the case.
(6) The right to full and timely restitution as provided in law.
(7) The right to proceedings free from unreasonable delay.
(8) The right to be treated with fairness and with respect for the victim’s dignity and privacy.

(b) Rights Afforded.— In any court proceeding involving an offense against a crime victim, the court shall ensure that the crime victim is afforded the rights described in subsection (a). Before making a determination described in subsection (a)(3), the court shall make every effort to permit the fullest attendance possible by the victim and shall consider reasonable alternatives to the exclusion of the victim from the criminal proceeding. The reasons for any decision denying relief under this chapter shall be clearly stated on the record.

(c) Best Efforts To Accord Rights.—
(1) Government.— Officers and employees of the Department of Justice and other departments and agencies of the United States engaged in the detection, investigation, or prosecution of crime shall make their best efforts to see that crime victims are notified of, and accorded, the rights described in subsection (a).
(2) Advice of attorney.— The prosecutor shall advise the crime victim that the crime victim can seek the advice of an attorney with respect to the rights described in subsection (a).
(3) Notice.— Notice of release otherwise required pursuant to this chapter shall not be given if such notice may endanger the safety of any person.

All enemies, foreign and domestic

Microsoft/Corbis has been trying to get me killed in what would seem to be an accident so they can start selling the images, etc. they have been collecting about me for decades. But they also know that all that information will serve to document their crimes. If I turn up dead, it has to look like an accident because when they start selling information about my life, they will demonstrate their profit motive for seeing me dead. My family won’t be able to do anything about it because Microsoft/Corbis and their politician-protected lawyers will claim that my family can’t prove that any of those photos are the result of Microsoft/Corbis stalking me.

What they will do is attach phony names to the photos and pretend they bought them from people that just happened to take photos of me. I suspect that Microsoft secretly turned a spotlight on me to provide cover for their strategy to start selling photos of me. The hard part is proving it when all these zombies are deceiving me. All they have to do is tell me where all the discussion has been taking place. I have to know where all these people are getting details about me. It is that forum that is Microsoft/Corbis’s cover. Their strategy is to turn me into a public figure, which then gives them more leeway to sell the images and intellectual property they have stolen from me. Since all these people across the country and the world have already heard of me in all these secret forums, they aren’t going to question where Microsoft/Corbis got all those details about my life they stole from me in order to make a profit.

Microsoft/Corbis secretly revealed details about my covert military activities in order to tell the terrorists where I was so they could kill me in revenge. The terrorist's strike of September 11, 2001, was one result. The earlier strike on the USS Cole was another result of Microsoft/Corbis revealing details about my covert military activities. Microsoft/Corbis and their politician-protectors have been gambling that my amnesia was permanent or that I would get killed by terrorists before my memory came back.

The chief executive of Corbis, the Bill Gates-owned company that is creating computerized artwork, is stepping down at the same time the company is delaying a highly touted CD-ROM about Ansel Adams.

Corbis has put off the only CD-ROM project it was producing this year, a biography of the famous photographer Ansel Adams. The company will pursue its main business, selling images online to publishers and graphic artists.

The moves raise questions about the direction and future for "the other company" owned by Microsoft Chairman Bill Gates. Founded in 1989 as Interactive Home Systems, Corbis has gone through a few incarnations, each with a separate management team, and still has not made a profit.

Davis and Rojas said Gates told them he wants the company to continue building its archive of photos and fine-art images on computer, but he emphasized he wants more focus on finding customers for the online images.

In recent years, Corbis has become known for high-quality, PBS-documentary-style CD-ROMs covering famous people such as Leonardo da Vinci and Franklin Roosevelt and topics including volcanoes and the atomic bomb.

Corbis executives have said they made CD-ROMs to build their reputation, not necessarily to make a huge profit. But they, as others, have suffered from a glut in the CD-ROM market and a lack of demand, losing more money than expected on their CD-ROMs. Rowan said four of the company's six products have lost money and two just broke even.

"Throughout (the company's) changes. . . Bill's vision surprisingly hasn't changed much at all," Davis said. The overriding idea, he said, is for Corbis to "be the place for pictures in the 21st century."

Federal Judge Blasts Microsoft -- Company Accused Of Defaming Expert, Acting In Bad Faith

WASHINGTON - The federal judge in the government's case against Microsoft has accused the software giant of defaming an expert he appointed to oversee the case and acting in bad faith in his court.

In a three-page order, Judge Thomas Penfield Jackson said yesterday that Microsoft's attempts to disqualify a special master by "questioning (his) integrity and impartiality" were based only on innuendo.

These tactics led the judge to consider imposing contempt sanctions on the company's lawyers.

Jackson stopped just short of accusing the company of deceiving the court, saying he found it significant that Microsoft had elected not to make any of its claims about the special master under oath.

Microsoft lawyers were rankled when the special master was appointed in December because the judge did not consult either the company or the Department of Justice about the move.

Lessig was appointed to gather facts in the government case contending Microsoft is illegally using its near-monopoly in operating-system software to force computer-makers to also install its Internet Explorer Web browser, a device that navigates the Internet.

§ 1512. Tampering with a witness, victim, or an informant

(1) Whoever kills or attempts to kill another person, with intent to—
(A) prevent the attendance or testimony of any person in an official proceeding;
(B) prevent the production of a record, document, or other object, in an official proceeding; or
(C) prevent the communication by any person to a law enforcement officer or judge of the United States of information relating to the commission or possible commission of a Federal offense or a violation of conditions of probation, parole, or release pending judicial proceedings;
shall be punished as provided in paragraph (3).

(b) Whoever knowingly uses intimidation, threatens, or corruptly persuades another person, or attempts to do so, or engages in misleading conduct toward another person, with intent to—
(1) influence, delay, or prevent the testimony of any person in an official proceeding;
(2) cause or induce any person to—
(A) withhold testimony, or withhold a record, document, or other object, from an official proceeding;
(B) alter, destroy, mutilate, or conceal an object with intent to impair the object’s integrity or availability for use in an official proceeding;
(C) evade legal process summoning that person to appear as a witness, or to produce a record, document, or other object, in an official proceeding; or
(D) be absent from an official proceeding to which such person has been summoned by legal process; or
(3) hinder, delay, or prevent the communication to a law enforcement officer or judge of the United States of information relating to the commission or possible commission of a Federal offense or a violation of conditions of probation [1] supervised release,,[1] parole, or release pending judicial proceedings;
shall be fined under this title or imprisoned not more than ten years, or both.

Most of these people involved would probably commit a crime that produced 10 years in prison in exchange for a certain dollar amount. For example, Microsoft would probably pay Kirk Tavener a million dollars to keep his mouth shut and go to prison for ten years, for which he would see that as a good deal, especially because he would gamble that he wouldn’t even have to serve the full ten years. Microsoft could easily pay 1,000 people a million dollars to keep quiet and that would only cost the company a billion dollars. Bill Gates probably clears more than that every year with his Bill And Melinda Gates Foundation scam.

This is what Laura Longcore was trying to do when she told me to watch what I say when I told her that our group had a problem with recording accurate labor, which prompted me to quit in protest:

Intimidating a witness.
(1) A person is guilty of intimidating a witness if a person, by use of a threat against a current or prospective witness, attempts to:

(a) Influence the testimony of that person;

(b) Induce that person to elude legal process summoning him or her to testify;

(c) Induce that person to absent himself or herself from such proceedings; or

(d) Induce that person not to report the information relevant to a criminal investigation

(26) "Threat" means to communicate, directly or indirectly the intent:

(h) To take wrongful action as an official against anyone or anything, or wrongfully withhold official action, or cause such action or withholding;

(j) To do any other act which is intended to harm substantially the person threatened or another with respect to his health, safety, business, financial condition, or personal relationships;

This means if one person in this crime can be sentenced to life imprisonment or the death penalty, any person associated with these crimes can be sentenced to life imprisonment or the death penalty. If there is any discussion going on my anyone in the government as to whether the death penalty is available, it is because they have been bought off by Microsoft.

§ 1512. Tampering with a witness, victim, or an informant

(j) If the offense under this section occurs in connection with a trial of a criminal case, the maximum term of imprisonment which may be imposed for the offense shall be the higher of that otherwise provided by law or the maximum term that could have been imposed for any offense charged in such case.

(k) Whoever conspires to commit any offense under this section shall be subject to the same penalties as those prescribed for the offense the commission of which was the object of the conspiracy.

RCW 9A.28.020
Criminal attempt.
(1) A person is guilty of an attempt to commit a crime if, with intent to commit a specific crime, he or she does any act which is a substantial step toward the commission of that crime.

(2) If the conduct in which a person engages otherwise constitutes an attempt to commit a crime, it is no defense to a prosecution of such attempt that the crime charged to have been attempted was, under the attendant circumstances, factually or legally impossible of commission.

(3) An attempt to commit a crime is a:

(a) Class A felony when the crime attempted is murder in the first degree,

(1) A person is guilty of murder in the first degree when:

(a) With a premeditated intent to cause the death of another person, he or she causes the death of such person or of a third person; or

(b) Under circumstances manifesting an extreme indifference to human life, he or she engages in conduct which creates a grave risk of death to any person, and thereby causes the death of a person; or

(c) He or she commits or attempts to commit the crime of either (1) robbery in the first or second degree, (2) rape in the first or second degree, (3) burglary in the first degree, (4) arson in the first or second degree, or (5) kidnapping in the first or second degree, and in the course of or in furtherance of such crime or in immediate flight therefrom, he or she, or another participant, causes the death of a person other than one of the participants

The primary reason they have not yet been charged with treason and terrorism is because I have been suffering from amnesia for about 10 years. Only in the past few months has my amnesia receded enough for me to begin consciously recognizing details about my real identity. It is as though I can read a printed-word book about my real identity with my eyes closed. The challenge is that I don't know if what I am "reading" is actually in the book or if it is just imagination. But I am confident that the details I have been recording in my journal about my real identity are correct.

A key clue that I remembered a few days ago is a conversation in email with a coworker at Microsoft sometime in 1999 or 2000. It may have been in 2001, but I feel certain it was in 1999 or 2000. At one point, I'm not sure which came first, she told me out loud one day at her cubicle that she wanted to spend the night with me at a motel. Then she told me in email that she was going to write down everything I said. That made sense to me because I felt as though I said a lot of smart stuff. I responded light-heartedly to ask her if she was now working for the Department of Justice, as the antitrust trial against Microsoft was in the news a lot. She responded with something similar to "No, I work for the Russian mafia." I felt like playing along so I responded with something similar to, "Oh crap! How did they find me?" I think the conversation ended at that point with her response, "Your birthmark." As with a lot of similar strange comments people made to me at Microsoft, I puzzled over that one for a while, especially because I don't have any birthmarks.

As my memory of my real identity has started to return, I understand precisely now what she meant. It is about numbers. My "birthmark" is not something on my body, as most people interpret such a reference, rather my "birthmarks" are numbers that are encoded into certain organizations, such as the U.S. Navy and into Hollywood. An example is the recent new television series "Battlestar Galactica." The first episode was titled "33" and that is one of my "birthmarks."

I believe that comment by my coworker at Microsoft demonstrates that Microsoft was determined to reveal the covert military activities of my real identity because Microsoft believed I was working undercover at Microsoft in support of the governments efforts to prosecute Microsoft for anti-competitive activities. That theory is supported by this news article published on my first day of employment at Microsoft in 1998:

Gates attacked David Boies, the U.S. Department of Justice's lead attorney in the case.

"I answered truthfully every single question that was put forth," Gates said. "You have to understand that Mr. Boies made it clear in the negotiations leading up to the case that he is really out to destroy Microsoft. He is really out to make all the good work we've done - and make us look very bad. He's a lawyer asking questions using ambiguous terms."

That occured on my first day of employment at Microsoft, which coincidentally is the day we recognize as Pearl Harbor Day. It was also on that day, 12/7/98, that the state I had just moved away from, South Carolina, announced they were dropping out of the anti-trust trial against Microsoft.

It is my theory, as I have written, that Microsoft revealed that I was one of the F-16 pilot's who bombed the non-fueled nuclear reactor in Iraq on 6/7/81. I don't actually remember any of that but I believe I was there. As Microsoft knows, participating in that mission was a death sentence for the pilots and that is why they revealed that I was part of it. The attack on the USS Cole DDG-67 reflects that Microsoft's activities were working, as that ship also has some personal connection to me, although I still puzzle over precisely what is that connection. I believe that I was actually the first Commanding Officer of the Cole but I still can't actually remember any of that.

The most recent clue that this identity I know as Kerry Burgess is false is on my DD-214 form from the U.S. Navy. The section for "nearest relative" lists a person name "Thedia." Several months ago, I started to realized that the names of my step-father and my mother were clues. His initials were "D.D." and her initials were "T.N." I decided those were clues for "Defense Department" and "The Navy," as they are my parent organizations. A few days ago, I narrowed that clue down even farther. I decided that my "mother's" name "Thedia" wasn't even real itself. It stands for "The D.I.A.," or The Defense Intelligence Agency.

I can't go home until Microsoft, Dave Reichert, George W. Bush, and accomplices are charged with treason and acts of terrorism, of which they are guilty.
