Fox News' Peter Doocy asked Biden outside the White House whether he thought the conviction would help Trump in the presidential election, to which the president responded, "I have no idea."

"Are you worried this could happen to you someday?" Doocy then asked. "Somebody comes up with some charges and tries to bring you into court after your term?"

"Not at all," Biden responded. "I didn't do anything wrong. The system still works."

Over the course of seven public hearings related to Donald Trump's classified documents case, a picture has emerged of Judge Aileen Cannon sometimes appearing prepared for legal questions but at other times having difficulty comprehending even the simplest concepts.

In the view of prosecutors and several legal experts, her tendency to repeatedly ask the same question or miss the point of an argument is proof that the Trump-appointed judge is ill-suited to handle a trial that has already been delayed, repeatedly, by her willingness to grant hearings over the Trump team's most far-fetched requests. The case's slow progress, they argue, plays into Trump's strategy of pushing it past Election Day, and then, if elected, stopping it from ever happening.

In one exchange, prosecutor Jay Bratt invoked a common legal concept known as the Pinkerton rule, which holds that all parties to a conspiracy are liable for their co-conspirators' crimes.

Lloyd jumped. “What? What the hell do you mean, I’m in deep shit? By the way, I thought you handled ole fatty there real good. He looked mad enough to chew nails and spit out—”

“Listen to me, Sylvester, and listen very carefully.”

“My name’s not—”

“You don’t have the slightest idea how big a jam you’re in, Sylvester.” Devins’s gaze never faltered. His voice was soft and intense. His hair was blond and crewcut, hardly more than a fuzz. His scalp shone through pinkly. There was a plain gold wedding band on the third finger of his left hand and a fancy fraternity ring on the third finger of his right. He knocked them together and they made a funny little click that set Lloyd’s teeth on edge. “You’re going to trial in just nine days, Sylvester, because of a decision the Supreme Court handed down four years ago.”

“What was that?” Lloyd was more uneasy than ever.

“It was the case of Markham vs. South Carolina,” Devins said, “and it had to do with the conditions under which individual states may best administer swift justice in cases where the death penalty is requested.”

“Death penalty!” Lloyd cried, horror-struck. “You mean the lectric chair? Hey, man, I never killed anybody! Swear to God!”

“In the eyes of the law, that doesn’t matter,” Devins said. “If you were there, you did it.”

“What do you mean, it don’t matter?” Lloyd nearly screamed. “It does so matter! It better fuckin matter! I didn’t waste those people, Poke did! He was crazy! He was—”

“Will you shut up, Sylvester?” Devins inquired in that soft, intense voice, and Lloyd shut. In his sudden fear he had forgotten the cheers for him in Maximum, and even the unsettling possibility that he might lose a tooth. He suddenly had a vision of Tweety Bird running a number on Sylvester the Cat. Only in his mind, Tweety wasn’t bopping that dumb ole puddy-tat over the head with a mallet or sticking a mousetrap in front of his questing paw; what Lloyd saw was Sylvester strapped into Old Sparky while the parakeet perched on a stool by a big switch. He could even see the guard’s cap on Tweety’s little yellow head.

This was not a particularly amusing picture.

Smiling a little, the guard with the cold opened the door and the other led Lloyd inside, where his court-appointed lawyer was sitting at a metal table, looking at papers from his briefcase.

The lawyer looked up. He was hardly old enough to be shaving yet, Lloyd judged, but what the hell? Beggars couldn’t be choosers. They had him cold-cocked anyway, and Lloyd figured to get twenty years or so: When they had you nailed, you just had to close your eyes and grit your teeth.

“Thank you very—”

“That guy,” Lloyd said, pointing to the door-guard. “He called me a scumbag. And when I said something back to him, he said he was gonna have some guy knock out one of my teeth! How’s that for police brutality?”

The lawyer passed a hand over his face. “Any truth to that?” he asked the door-guard.

The door-guard rolled his eyes in a burlesque My God, can you believe it? gesture. “These guys, counselor,” he said, “they should write for TV. I said hi, he said hi, that was it.”

“That’s a fuckin lie!” Lloyd said dramatically.

“I keep my opinions to myself,” the guard said, and gave Lloyd a stony stare.

“I’m sure you do,” the lawyer said, “but I believe I’ll count Mr. Henreid’s teeth before I leave.”

A slight, angry discomfiture passed over the guard’s face, and he exchanged a glance with the two that had brought Lloyd in. Lloyd smiled. Maybe the kid was okay at that. The last two CAs he’d had were old hacks; one of them had come into court lugging a colostomy bag, could you believe that, a fucking colostomy bag? The old hacks didn’t give a shit for you. Plead and leave, that was their motto, let’s get rid of him so we can get back to swapping dirty stories with the judge. But maybe this guy could get him a straight ten, armed robbery. Maybe even time served. After all, the only one he’d actually pokerized was the wife of the guy in the white Connie, and maybe he could just roll that off on ole Poke. Poke wouldn’t mind.

He folded his hands on the pile of papers he had taken from his briefcase. “There is no such thing as an accessory when it comes to first-degree murder committed during a felony crime,” he said. “The state has three witnesses who will testify that you and Andrew Freeman were together. That pretty well fries your skinny butt. Do you understand?”

“I—”

“Good. Now to get back to Markham vs. South Carolina. I am going to tell you, in words of one syllable, how the ruling in that case bears on your situation. But first, I ought to remind you of a fact you doubtless learned during one of your trips through the ninth grade: the Constitution of the United States specifically forbids cruel and unusual punishment.”

“Like the fucking lectric chair, damn right,” Lloyd said righteously.

Devins was shaking his head. “That’s where the law was unclear,” he said, “and up until four years ago, the courts had gone round and round and up and down, trying to make sense of it. Does ‘cruel and unusual punishment’ mean things like the electric chair and the gas chamber? Or does it mean the wait between sentencing and execution? The appeals, the delays, the stays, the months and years that certain prisoners—Edgar Smith, Caryl Chessman, and Ted Bundy are probably the most famous—were forced to spend on various Death Rows? The Supreme Court allowed executions to recommence in the late seventies, but Death Rows were still clogged, and that nagging question of cruel and unusual punishment remained. Okay—in Markham vs. South Carolina, you had a man sentenced to the electric chair for the rape-murder of three college co-eds. Premeditation was proved by a diary this fellow, Jon Markham, had kept. The jury sentenced him to death.”

“Bad shit,” Lloyd whispered.

Devins nodded, and gave Lloyd a slightly sour smile. “The case went all the way to the Supreme Court, which reconfirmed that capital punishment was not cruel and unusual under certain circumstances. The court suggested that sooner was better… from a legal standpoint. Are you beginning to get it, Sylvester? Are you beginning to see?”

Lloyd didn’t.

“Do you know why you’re being tried in Arizona rather than New Mexico or Nevada?”

Lloyd shook his head.

“Because Arizona is one of four states that has a Capital Crimes Circuit Court which sits only in cases where the death penalty has been asked for and obtained.”

“I don’t follow you.”

“You’re going to trial in four days,” Devins said. “The state has such a strong case that they can afford to empanel the first twelve men and women that get called to the box. I’ll drag it out as long as I can, but we’ll have a jury on the first day. The state will present its case on the second day. I’ll try to take up three days, and I’ll filibuster on my opening and closing statements until the judge cuts me off, but three days is really tops. We’ll be lucky to get that. The jury will retire and find you guilty in about three minutes unless a goddamned miracle happens. Nine days from today you’ll be sentenced to death, and a week later, you’ll be dead as dogmeat. The people of Arizona will love it, and so will the Supreme Court. Because quicker makes everybody happier. I can stretch the week—maybe—but only a little.”

“Jesus Christ, but that’s not fair!” Lloyd cried.

“It’s a tough old world, Lloyd,” Devins said. “Especially for ‘mad dog killers,’ which is what the newspapers and TV commentators are calling you. You’re a real big man in the world of crime. You’ve got real drag. You even put the flu epidemic back East on page two.”

“I never pokerized nobody,” Lloyd said sulkily. “Poke, he did it all. He even made up that word.”

“It doesn’t matter,” Devins said. “That’s what I’m trying to pound through your thick skull, Sylvester.

But, Creighton thought, if his suspicion about the phone call was correct, the real crash had already occurred.

“Len,” Starkey said, as if surprised. “Good of you to come in.”

“De nada,” Creighton said with a slight smile.

“You know who that was on the phone.”

“It was really him, then?”

First lady Dr. Jill Biden on Wednesday urged Americans to “choose good over evil” by backing her spouse come November and defended her husband against concerns about his age.

The first lady also offered a preview of Biden’s upcoming campaign travel during an interview on ABC’s “The View,” attempting to tamp down concerns amid dismal polling numbers and low enthusiasm for her husband’s reelection campaign.

“We are going to meet people where they are. We’re going to go to college campuses, we’re going to go to just every state that we can get into — I’ve been traveling every single day, Joe has been traveling as much as possible, and we’re not going to take anything for granted,” she said.

“And those polls are going to turn, I’m confident of it, because as time goes on, as people start to focus a little bit more about what’s at stake and start to become educated on the issues and the differences between them — the two men — I believe that Americans are going to choose good over evil.”

“Don’t let me lead you, Lloyd,” Devins said. “I don’t want to do that. You might think I was suggesting that Poke was stoned almost all the time—”

“He was! We both was!”

“No. You weren’t, but he was. And he got crazy when he got stoned—”

“Boy, you’re not shitting.” In the halls of Lloyd’s memory, the ghost of Poke Freeman cried Whoop! Whoop! merrily and shot the woman in the Burrack general store.

“And he held a gun on you at several points in time—”

“No, he never—”

“Yes he did. You just forgot for a while. In fact, he once threatened to kill you if you didn’t back his play.”

“Well, I had a gun—”

“I believe,” Devins said, eyeing him closely, “that if you search your memory, you’ll remember Poke telling you that your gun was loaded with blanks. Do you remember that?”

“Now that you mention it—”

“And nobody was more surprised than you when it actually started firing real bullets, right?”

“Sure,” Lloyd said. He nodded vigorously. “I bout damn near had a hemorrhage.”

“And you were about to turn that gun on Poke Freeman when he was cut down, saving you the trouble.”

Lloyd regarded his lawyer with dawning hope in his eyes.

“Mr. Devins,” he said with great sincerity, “that’s just the way the shit went down.”

He was in the exercise yard later that morning, watching a softball game and mulling over everything Devins had told him, when a large inmate named Mathers came over and yanked him up by the collar. Mathers’s head was shaved bald, à la Telly Savalas, and it gleamed benignly in the hot desert air.

“Now wait a minute,” Lloyd said. “My lawyer counted every one of my teeth. Seventeen. So if you—”

“Yeah, that’s what Shockley said,” Mathers said. “So, he told me to—”

Mathers’s knee came up squarely in Lloyd’s crotch, and blinding pain exploded there, so excruciating that he could not even scream. He collapsed in a hunching, writhing pile, clutching his testicles, which felt crushed. The world was a reddish fog of agony.

After a while, who knew how long, he was able to look up. Mathers was still looking at him, and his bald head was still gleaming. The guards were pointedly looking elsewhere. Lloyd moaned and writhed, tears squirting out of his eyes, a red-hot ball of lead in his belly.

“Nothing personal,” Mathers said sincerely. “Just business, you understand. Myself, I hope you make out. That Markham law’s a bitch.”

He strode away and Lloyd saw the door-guard standing atop the ramp in the truck-loading bay on the other side of the exercise yard. His thumbs were hooked in his Sam Browne belt and he was grinning at Lloyd. When he saw he had Lloyd’s complete, undivided attention, the door-guard shot him the bird with the middle fingers of both hands. Mathers strolled over to the wall, and the door-guard threw him a pack of Tareytons. Mathers put them in his breast pocket, sketched a salute, and walked away. Lloyd lay on the ground, his knees drawn up to his chest, hands clutching his cramping belly, and Devins’s words echoed in his brain: It’s a tough old world, Lloyd, it’s a tough old world.

Nick doodled aimlessly on his pad for a moment and then wrote, “How much do you know about the dark man? Do you know who he is?”

I saw a document that indicated I was being inducted to the United States Marine Corps with the officer grade of Chief Warrant Officer 2. I saw in the dream another document associated with my induction and that document indicated I had been assigned the informal name "Salesman."

I have sometimes gone back and corrected obvious errors made by me in my past journal entries. Sometimes I have noted that it's corrected, many other times, I have not.

Lately, I have found myself reluctant to continue that practice for the specific reason that most are from Epoch 4 (currently Epoch 5.11) {later modified by me to designation Epoch 5.2} and since those from Epoch 4 were created by my hypothetical predecessor then I must assume the possibility of *deliberate* error

In this present day, I still find myself making simple errors (many others do that also, I have comforted myself by observing patterns by other people) and most errors by me are caused by two reasons: one, my creative mind. Two, I don't like proofreading until after making the actual post, otherwise I have to read it twice and that's tedious and I've been bored with this process for so many, many years. But must not let myself squander this opportunity!

He had no clocks so he spent almost all his time, which was probably more than fifty years, trying to find a way to measure time. There were no people in that world but sometimes he would see mannequins positioned around and sometimes those mannequins would be positioned around where he had been trying to measure time, such as by chiseling marks into rock, which the mannequins were then standing in front of and that [chronology activity site] had been sabotaged.

Freshman year, second semester, I took a course called “Introduction to Relativity and Quantum Mechanics” in which we discussed an experiment performed by David Frisch and James Smith in 1963. Frisch and Smith were looking to measure the effect of time dilation on mu-meson particles. Time dilation, an effect of special relativity, basically describes what happens if you throw a clock fast enough: It will start to run slow. The factor of this time change is generally pretty small because it relates the object’s velocity to the speed of light (3*10^8 m/s). The only way to have a significant time difference is for the object to be moving incredibly fast — generally around 0.9 times the speed of light.

A variety of different factors motivated people to propose other evolutionary mechanisms as alternatives to natural selection, some of them dating back before Darwin's Origin of Species. Natural selection, with its emphasis on death and competition, did not appeal to some naturalists because they felt it was immoral, and left little room for teleology or the concept of progress in the development of life. Some of these scientists and philosophers, like St. George Jackson Mivart and Charles Lyell, who came to accept evolution but disliked natural selection, raised religious objections. In the distant future, the spaceship Hunter-Gratzner is transporting passengers in cryostasis.

Micrometeoroids rupture the ship's hull, killing the captain and sending the ship off course. The ship's first officer, Owens, and the docking pilot, Carolyn Fry, attempt to land the ship on a nearby planet. As the ship falls apart, Fry decides to dump the passenger section to reduce weight, but Owens stops her. The vessel crashes into the planet's surface, most of the passengers are killed

The survivors explore their surroundings, noticing that the planet's three suns keep it in perpetual daylight. They find an abandoned geological research settlement, with a water well and a dropship that lacks power to fly.

An orrery shows that an eclipse is imminent and the creatures will be free to hunt above ground. They realize the geologists must have been all killed by the creatures during the last eclipse.

The group returns to the crash site on a solar-powered sand truck to salvage more power cells for the dropship before the eclipse, but it begins as they get there. Creatures pour out of the ground and devour Shazza and another pilgrim.

One of the most effective monster movies species in recent decades are the photosensitive "bioraptors" from 2000's Pitch Black

Taking place 500 years in the future, the space horror film concerns the survivors of the Hunter-Gratzner, a freighter-transport starship that crash lands on the desert planet M6-117 after the hull is ruptured by cosmic debris. Due to it's galactic position in a system with three large stars, the sun-baked barren planet exists in a state of perpetual bright daylight, except for those times when the triple suns align in a total eclipse which can last anywhere from months to decades. During these rare eclipses, which occur roughly every twenty two years, almost all life on the planet is wiped out.

The survivors seek refuge in a dark cave. Exploring it, they stumble upon a long abandoned geological research settlement, along with a derelict shuttle that could be their salvation. But they are soon set upon by the bioraptors, highly photosensitive animalistic alien creatures that live in the pitch dark cave systems beneath the sun-scorched surface above.

the eyeless, somewhat xenomorph-like bioraptors have thin streamlined bodies with large anchor shaped heads and forked tails. Their blood is a viscous blue-black color and their wings grant them limited flight. The cannibalistic monsters exist almost entirely underground and survive by feeding on their own. They emerge during the planet's rare eclipses which plunge the surface of M6-117 into darkness to massacre all other life on the planet.

Bioraptor

Bioraptors are highly aggressive and animalistic creatures capable of flight and are incredibly photosensitive, with even an artificial flashlight beam capable of severely burning their bodies. They are assumed to be native to the planet M6-117 in the M-344/G System and are implied to be responsible for the extinction of most life on the planet.

Roughly every 22 years, the planet undergoes a several month long planet-wide eclipse caused by an aligning of the surrounding planets and stars. It is during this time that the bioraptors emerge from their underground dwellings and engage in mass-feeding reminiscent of locust swarms.

Their blood is thick and blue, possibly due to a concentration of copper-based hemoprotein (as opposed to iron-based hemoglobin). They have thin, streamlined bodies covered in what appears to be thick and leathery skin, wings capable of supporting limited flight, and a twin-forked tail with sharp points at the end. Hidden in both of their legs are bonespears, that they use for grabbing their opponents. Their distinctive heads seem to be made of a hard, chitinous material reminiscent of that surrounding most arthropods. Due to the nature of their total-dark environments they have no eyes, but instead have incredibly sensitive ultrasonic sensor organs capable of picking up on the most minute of sounds and giving them a detailed "view" of their environment.

It is unknown why or how a light-sensitive species evolved on a planet in a trinary star system with virtually constant and planet-wide illumination. It is possible that they were an invasive species brought to the planet by mistake or as a bio-weapon. Perhaps the planet is home to a massive planet spanning cave systems or burrows, where they evolved, which would explain their sensitivity to light.

The Infants

When the lights go out, these are the first to emerge from the massive "chimneys" leading into their system of tunnels. An immense number of these appear at the onset of the solar eclipse and tend to fly around in flocks. Alone they are only passably dangerous, but combined they represent a proverbial cloud of blades, as their strength in numbers can lift and literally tear a person to pieces,

The Adults

Often referred to as "big boys", these beasts emerge from underground shortly after the infants. The long stalks on either side of their head supporting their ultrasonic sensors have developed to be roughly 2 meters (6.5 ft) long combined. Due to how widely their sensor organs are spaced, there is a blind spot directly between them and inches away from their mouth (as Riddick discovers). They have long tails that split into two ends like a fork. Their wrists conceal spike feelers that extend longer than the Bioraptor itself to strike its prey, these wrist tentacles end in knife-like points. Their two feet are lizard-like with 4 monstrous talons radiating towards the front. They are stronger than an average human (Riddick was able to kill a single one on his own, albeit with great effort, using only his hands)

Surviving Underground

As most other preferable food sources seem to be dead, the Bioraptors seem to survive by consuming each other. The adults seem to prefer eating their young, but will swarm other adults when they cannot be caught. It is unknown whether or not there are more organisms underground.

Mutationism was the idea that new forms and species arose in a single step as a result of large mutations. It was seen as a much faster alternative to the Darwinian concept of a gradual process of small random variations being acted on by natural selection. It was popular with early geneticists such as Hugo de Vries, who along with Carl Correns helped rediscover Gregor Mendel's laws of inheritance in 1900, William Bateson a British zoologist who switched to genetics, and early in his career, Thomas Hunt Morgan.

The 1901 mutation theory of evolution held that species went through periods of rapid mutation, possibly as a result of environmental stress, that could produce multiple mutations, and in some cases completely new species, in a single generation. Its originator was the Dutch botanist Hugo de Vries. De Vries looked for evidence of mutation extensive enough to produce a new species in a single generation and thought he found it with his work breeding the evening primrose of the genus Oenothera, which he started in 1886. The plants that de Vries worked with seemed to be constantly producing new varieties with striking variations in form and color, some of which appeared to be new species because plants of the new generation could only be crossed with one another, not with their parents. DeVries himself allowed a role for natural selection in determining which new species would survive, but some geneticists influenced by his work, including Morgan, felt that natural selection was not necessary at all. De Vries's ideas were influential in the first two decades of the 20th century, as some biologists felt that mutation theory could explain the sudden emergence of new forms in the fossil record; research on Oenothera spread across the world. However, critics including many field naturalists wondered why no other organism seemed to show the same kind of rapid mutation.

During the period 1916–1932, the discipline of population genetics developed largely through the work of the geneticists Ronald Fisher, J.B.S. Haldane, and Sewall Wright. Their work recognized that the vast majority of mutations produced small effects that served to increase the genetic variability of a population rather than creating new species in a single step as the mutationists assumed. They were able to produce statistical models of population genetics that included Darwin's concept of natural selection as the driving force of evolution.

Developments in genetics persuaded field naturalists such as Bernhard Rensch and Ernst Mayr to abandon neo-Lamarckian ideas about evolution in the early 1930s. By the late 1930s, Mayr and Theodosius Dobzhansky had synthesized the ideas of population genetics with the knowledge of field naturalists about the amount of genetic diversity in wild populations, and the importance of genetically distinct subpopulations (especially when isolated from one another by geographical barriers) to create the early 20th century modern synthesis. In 1944 George Gaylord Simpson integrated paleontology into the synthesis by statistically analyzing the fossil record to show that it was consistent with the branching non-directional form of evolution predicted by the synthesis, and in particular that the linear trends cited by earlier paleontologists in support of Lamarckism and orthogenesis did not stand up to careful analysis. Mayr wrote that by the end of the synthesis natural selection together with chance mechanisms like genetic drift had become the universal explanation for evolutionary change.

In natural populations, genetic drift and natural selection do not act in isolation; both phenomena are always at play, together with mutation and migration. Neutral evolution is the product of both mutation and drift, not of drift alone. Similarly, even when selection overwhelms genetic drift, it can only act on variation that mutation provides.

While natural selection has a direction, guiding evolution towards heritable adaptations to the current environment, genetic drift has no direction and is guided only by the mathematics of chance. As a result, drift acts upon the genotypic frequencies within a population without regard to their phenotypic effects. In contrast, selection favors the spread of alleles whose phenotypic effects increase survival and/or reproduction of their carriers, lowers the frequencies of alleles that cause unfavorable traits, and ignores those that are neutral.

The law of large numbers predicts that when the absolute number of copies of the allele is small (e.g., in small populations), the magnitude of drift on allele frequencies per generation is larger. The magnitude of drift is large enough to overwhelm selection at any allele frequency when the selection coefficient is less than 1 divided by the effective population size. Non-adaptive evolution resulting from the product of mutation and genetic drift is therefore considered to be a consequential mechanism of evolutionary change primarily within small, isolated populations. The mathematics of genetic drift depend on the effective population size, but it is not clear how this is related to the actual number of individuals in a population. Genetic linkage to other genes that are under selection can reduce the effective population size experienced by a neutral allele. With a higher recombination rate, linkage decreases and with it this local effect on effective population size. This effect is visible in molecular data as a correlation between local recombination rate and genetic diversity, and negative correlation between gene density and diversity at noncoding DNA regions. Stochasticity associated with linkage to other genes that are under selection is not the same as sampling error, and is sometimes known as genetic draft in order to distinguish it from genetic drift.

Low allele frequency makes alleles more vulnerable to being eliminated by random chance, even overriding the influence of natural selection. For example, while disadvantageous mutations are usually eliminated quickly within the population, new advantageous mutations are almost as vulnerable to loss through genetic drift as are neutral mutations. Not until the allele frequency for the advantageous mutation reaches a certain threshold will genetic drift have no effect.

And, while I am not sure when this divergence happened, I am reasonably certain it was before I turned 33. So I must have been a pretty busy guy. A few minutes ago I started thinking that maybe I started at Princeton University in 1972. I would have been 13 at the time as Thomas Ray. I remember that Kerry Burgess started first grade in 1972. But then I decided that I probably started Princeton earlier than 1972 and maybe 1972 was the year I completed my first major degree. Or 1972 doesn’t really mean anything in particular to Thomas Ray; rather it is there for continuity sake for the life of Kerry Burgess.

I saw myself going through an induction process in the United States Marine Corps and I woke up understanding that I was dreaming of my actual experience in 1990. I saw a document that indicated I was being inducted to the United States Marine Corps with the officer grade of Chief Warrant Officer 2. I saw in the dream another document associated with my induction and that document indicated I had been assigned the informal name "Salesman."
