First element: establishing ownership of a valid copyright

Copyright protects the fixed expression of ideas, but not the ideas themselves. (Ideas are protected by patents). Nevertheless, an expression must exist in a fixed tangible medium. A movie script writer who discusses a plot idea which has not yet been written would not be protected if another heard his idea and wrote a screenplay himself. Whether RAM constitutes a "fixed medium" is a contentious issue in copyright litigation because of the transitory nature of RAM.


Second element: establishing actual copying

A plaintiff establishes actual copying with direct or indirect evidence. Direct evidence is satisfied either by a defendant's admission to copying or the testimony of witnesses who observed the defendant in the act. More commonly, a plaintiff relies on circumstantial or indirect evidence. A court will infer copying by a showing of a "striking similarity" between the copyrighted work and the alleged copy, along with a showing of both access and use of that access. A plaintiff may establish access by proof of distribution over a large geographical area, or by eyewitness testimony that the defendant owned a copy of the protected work. Access alone is not sufficient to establish infringement. The plaintiff must show a similarity between the two works, and the degree of similarity will affect the probability that illicit copying in fact occurred in the court's eyes. Even then, the plaintiff must show that the copying amounted to improper appropriation.
Indeed, the US Supreme Court has held that not all copying constitutes infringement and a showing of misappropriation is necessary.


Third element: establishing misappropriation

A copyrighted work may contain elements which are not copyrightable, such as facts, ideas, themes, or content in the public domain. A plaintiff alleging misappropriation must first demonstrate that what the defendant appropriated from the copyrighted work was protectible. Second, a plaintiff must show that the intended audience will recognize substantial similarities between the two works. The intended audience may be the general public, or a specialized field. The degree of similarity necessary for a court to find misappropriation is not easily defined. Indeed, "the test for infringement of a copyright is of necessity vague." Two methods are used to determine if unlawful appropriation has occurred: the subtractive method and the totality method.

The subtractive method, also known as the "abstraction/subtraction approach" seeks to analyze what parts of a copyrighted work are protectible and which are not. The unprotected elements are subtracted and the fact finder then determines whether substantial similarities exist in the protectible expression which remains. For instance, if the copyright holder for West Side Story alleged infringement, the elements of that musical borrowed from Romeo and Juliet would be subtracted before comparing it to the allegedly infringing work because Romeo and Juliet exists in the public domain.

The totality method, also known as the "total concept and feel" approach takes the work as a whole with all elements included when determining if a substantial similarity exists. The individual elements of the alleged infringing work may by themselves be substantially different from their corresponding part in the copyrighted work, but nevertheless taken together be a clear misappropriation of copyrightable material.

Possible motivations for this can include obtaining payment that is worth more than the value of the property destroyed, or to destroy and subsequently receive payment for goods that could not otherwise be sold. According to Alfred Manes, the majority of property insurance crimes involve arson. One reason for this is that any evidence that a fire was started by arson is often destroyed by the fire itself.


According to the Coalition Against Insurance Fraud, a former business executive from Chicago resorted to insurance fraud to pay off his debt of over $672,000. He set fire to his own home in order to collect insurance money on it. In order to disguise this act of arson, he trapped his ninety year old mother in the basement while the house was burning so that the fire would appear to be a suicide. He received about $600,000 in insurance money, but was eventually convicted on several charges and sentenced to 190 years in federal prison.

FILM REVIEW; A Major Star Date In Enterprise History

Thirteen "Star Trek" books are sold every minute, and that's just on the planet Earth. The Trekkie phenomenon is so indefatigable that there's even a volume ("Trek: The Lost Years," by Edward Gross) about a time period when the television show was off the air. In the face of such enthusiasm, a "Star Trek" film needn't do more than exist to generate sighs of contentment among die-hard fans. But a couple of them ("II" and "IV") have had legitimate crossover potential, bridging the entertainment gap between the Starship Enterprise and the real world.

"Star Trek Generations" is the series' most ambitious film, if only because it mixes the casts of two "Star Trek" television series with the help of "some sort of a temporal flux." For readers who find it baffling that there even are two television series (actually there are three, with a fourth on the way), the question is obvious. How much interest does this new installment hold for general audiences, for "Trek"-resistant moviegoers who turn elsewhere for their religious experiences and wouldn't know a main deflector shield from a satellite dish? What can "Generations" really say to the jargon-impaired?

The urbane Canadian-born broadcaster delivered the nightly news to Americans over five decades. He was there for every big story, be it war or weather.

Skinner's Sense of Snow is the eighth episode from season twelve of the animated TV series The Simpsons. This episode originally aired on December 17, 2000


While the Simpsons attend a French Canadian circus, a freak blizzard (specifically, a "classic nor'easter meeting a classic sou'wester") hits Springfield, turning it into a winter wonderland overnight. However, Springfield Elementary School stays open regardless on the day before Christmas break. Only some students from both Bart and Lisa's classes show up while Skinner and Willie are the only faculty members to still be working. To pass the time, Skinner plays the ultra-boring movie "The Christmas That Almost Wasn't, But Then Was". While they are watching the movie, the snow piles up and traps everyone in the school.

Skinner, whose incompetence in not closing the school due to the blizzard caused everyone inside the school to be trapped, quickly determines that they will be unable to get out and will have to remain there for the duration of the storm. The kids complain about things they have to go home for, but Skinner firmly declares that no one can escape. The kids are forced to eat relish and mayonnaise. After Nelson fails in an escape attempt, the kids begin to go beyond Skinner's control. Reminded of when he could maintain order in his army days, he dons his old uniform. Meanwhile, Homer and Ned set off to rescue the kids. When Homer decides to use Ned's car with Ned's (sawed off) roof in front as a wedge to clear the snow, Ned protests by asking what happened to Mr. Plow, Homer's old snow removal service; Homer is oblivious, despite wearing the jacket, and humming the jingle. While driving, they hit a fire hydrant, encasing their car in ice. This allows carbon
monoxide to enter the car, causing them to black out from the fumes and Homer to hallucinate that he's being pampered by exotic belly dancers.

In the middle of the night, Bart tries to dig a tunnel to get everyone out. He gets caught by Skinner, who orders Willie to destroy the tunnel. Willie refuses, and when Skinner insults him, he quits. Skinner decides to destroy it himself, but he again messes up and gets trapped in the cavern. The kids take advantage of this and take over the school, wreaking havoc and burning books in the school library (Bart, ironically, burns a copy of Johnny Tremain, which he fondly read in the episode Whacking Day). Skinner uses the school hamster, Nibbles, to roll in his ball to get a message to the outside world. Nibbles makes it to Ned and Homer crashing through the car window, and they break the ice and get free them. Homer releases the wheel after turning on the car's cruise control, causing the car to lose control and crash into a salt silo. However, Homer's blunder fortunately releases a massive amount of salt that melts the snow around the school, freeing the
kids, but rusting the car's body completely. During the drive home, the carbon monoxide makes Homer hallucinate again; this time, Lisa is seen as a braying camel and Bart is a belly dancer that Homer tries to kiss. Before the credits roll, Lisa (still as a camel) wishes everyone a Merry Christmas.
