And God love them, they're with us. I've seen them all over the country, and just a few days ago I was at a high school in New Jersey. And the energy and optimism of this generation is infectious. And then, I tell you, earlier this month I visited some young marines going through boot camp in Parris Island, South Carolina. And they are really great. Their commanding officer, a general, will be retiring at the end of the month. And he told me that in all his years in the military, he has never seen young people of greater quality than those that are in the uniform today. And I found myself remembering -- and if you'll permit me to use a bit of profanity, but I'm quoting accurately -- back in World War II someone asked General George Marshall if we
had a secret weapon, and he said, ``Yes, the best damn kids in the world.'' Well, I can tell you, after what I've seen of today's youth and those in uniform today, the Commander in Chief can say the same thing that George Marshall said, and I do say it about those young people of ours. There's never been a higher quality in our military than we're seeing today.

Charleston Naval Shipyard
Charleston Naval Shipyard is on the Cooper River in the city of North Charleston, SC. Established in 1901, this yard hosted significant shipbuilding activities during World War II. An ammunition depot was located upriver. In 1945, the Navy Department reorganized the various activities at Charleston by creating Naval Base, Charleston. The navy yard became a component of the base. Much effort was spent in the early postwar years disposing of surplus materials. The base became a major decommissioning and storage location for returning ships. The ammunition depot was placed in maintenance status. However, Charleston remained active as an overhaul facility. In 1948, it was designated as a submarine repair and overhaul yard. The shipyard also activated numerous mothballed vessels for use during the Korean conflict. By 1951, the number of workers employed by the shipyard nearly doubled to over 8,000.
In the late 195Os, new facilities for a Naval Mine Craft Base, Mine Warfare School, and Fleet Training Center were located on the site of a former Naval Air Station just south of the main base. Also in the late 195Os, the Navy decided to move two destroyer squadrons to Charleston. The ammunition depot also became home to a Polaris missile submarine weapons facility. During the 197Os, the yard was cited for low productivity. Management efforts picked up the pace. The impact of the end of the Vietnam War was reduced as Charleston picked up work from the closed Boston Navy Yard.
The Charleston Naval Shipyard was a US Department of Navy facility that repaired, overhauled, and maintained Navy ships, including nuclear-powered ships. Drydocks, cranes, waste-handling facilities, and offices were located at the shipyard. Activities supporting nuclear propulsion systems were performed in accordance with the requirements and authority of the Naval Nuclear Propulsion Program (NNPP), a joint DOE and US Department of Navy program responsible for all activities relating to naval nuclear propulsion. Charleston Naval Shipyard closed in April 1996.

A Proclamation
Throughout American history our prisoners of war have been called upon to make uncommon sacrifices. In fulfilling their duty as citizens of the United States they have defended American ideals while suffering unimaginable indignities under the absolute control of the enemy. They remained steadfast even while their treatment contravened international understandings and violated elementary consideration of compassion and morality.
All Americans ought to recognize the special debt we owe to our fellow citizens who, in the act of serving our Nation, relinquished their freedom that we might enjoy the blessings of peace and liberty. Likewise, we must remember the unresolved casualties of war—our servicemen who are still missing. The pain and bitterness of war endure for their families, relatives and friends—and for all of us. Our Nation will continue to seek answers to the many questions that remain about their fate.
Now, Therefore, I, Ronald Reagan, President of the United States of America, do hereby proclaim Friday, July 17, 1981, as National P.O.W.-M.I.A. Recognition Day, a day dedicated to all former American prisoners of war, to those still missing, and to their families. I urge all Americans to join in honoring those who made the uncommon sacrifice of being held captive in war, and to honor as well their loved ones who have also suffered valiantly and patiently. I also call on appropriate officials of the Federal, State and local governments, as well as private organizations, to observe this day with appropriate ceremonies and activities.

Remarks on Signing a Resolution and a Proclamation Declaring National P.O.W.-M.I.A. Recognition Day, 1981

Ladies and gentlemen, welcome to what I think is a very important and worthwhile little signing ceremony here in the Rose Garden. I am pleased that I'm going to sign a joint resolution and a proclamation designating July 17th, 1981 National P.O.W.-M.I.A. Recognition Day.
The brave men and women who fought for our country should all know that America does remember and is grateful and will always be proud of their courage and honor on the battlefield. And it's fitting that we pay this special tribute to those who so heroically endured the hardships and torture of enemy captivity—unusual in any war in our history, because it was the longest period that American fighting men have ever been held in captivity. Just the thought of the terrible pain that they suffered and endured should be seared in our memories forever. And let us remember, too, that 6 years after American involvement in Vietnam, in the war, we still don't have a full accounting of our missing servicemen from that conflict, an accounting that was guaranteed in the Paris peace accords that brought the fighting there to an end, an agreement which has been violated.
Recently there have been reports that Americans are still being held captive in Indochina. None of these reports, I'm sorry to say, has been verified, but the world should know that this administration continues to attach the highest priority to the problem of those missing in action. We intend to seek the fullest possible account from the governments involved.
I'm grateful that we have with us here today one of America's outstanding heroes from the Vietnam war, one of the former prisoners of war, and now the Senator from Alabama, Jeremiah Denton, accompanied by his lovely wife Jane. July 17th, it is just 16 years—or that will be—to the day that he was shot down over Southeast Asia. Now, lest someone think that there's a little confusion there, he was shot down on July 18th, 1965, but when it was the 18th there, on this side of the dateline it was the 17th. Jeremiah Denton. Who will ever forget on that first night in that first plane that arrived at Clark Field in the Philippines, and he was the first man we saw come down the ramp from the plane, salute our flag, ask God's blessing on America, and then thank us for bringing them home.
They're joined here by leaders of the House and Senate, many of their colleagues, Cap Hollenbeck and Bob Dornan, John LeBoutillier and Bill Hendon and John Paul Hammerschmidt and Tom Lantos from the House, and Senators Dennis DeConcini and Bob Dole, along with Senator Jeremiah Denton.
And now, I'm going to have the happy task of signing the proclamation and the bill.

Operation Homecoming
Operation Homecoming was a series of diplomatic negotiations that in January 1973 made possible the return of 591 American prisoners of war held by North Vietnam. On Feb. 12, 1973, three C-141A transports flew to Hanoi, North Vietnam, and one C-9A aircraft was sent to Saigon, South Vietnam to pick up released prisoners of war. The first flight of 40 U.S. prisoners of war left Hanoi in a C-141A, later known as the "Hanoi Taxi" and now in a museum. From February 12 to April 4, there were 54 C-141 missions flying out of Hanoi, bringing the former POWs home.

Bill of attainder
A bill of attainder (also known as an act or writ of attainder) is an act of legislature declaring a person or group of persons guilty of some crime and punishing them without benefit of a trial. The United States Constitution forbids both the federal and state governments to enact bills of attainder, in Article 1, Sections 9 and 10, respectively. It was considered an excess or abuse of the British monarchy and Parliament.
The word "attainder", meaning "taintedness", is part of English common law. Under English law, a criminal condemned for a serious crime, whether treason or felony
Bills of attainder were used through the 18th century in England, and were applied to British colonies as well. One of the motivations for the American Revolution was anger at the injustice of attainder—though the Americans themselves used bills of attainder to confiscate the property of British loyalists (called Tories) during the revolution. American dissatisfaction with attainder laws motivated their prohibition in the Constitution (see the case of Parker Wickham). The provision forbidding state law bills of attainder reflects the importance that the framers attached to this issue, since the unamended constitution imposes very few restrictions on state governments' power.
Within the U.S. Constitution, the clauses forbidding attainder laws serve two purposes. First, they reinforced the separation of powers, by forbidding the legislature to perform judicial functions—since the outcome of any such acts of legislature would of necessity take the form of a bill of attainder. Second, they embody the concept of due process, which was later reinforced by the Fifth Amendment to the Constitution

Copyright infringement
'Copyright infringement' (or copyright violation) is the unauthorized use of material that is covered by copyright law, in a manner that violates one of the copyright owner's exclusive rights, such as the right to reproduce or perform the copyrighted work, or to make derivative works.
First element: establishing ownership of a valid copyright
A plaintiff establishes ownership by authorship (by the plaintiff itself or by one who assigned rights to the plaintiff) of (1) an original work of authorship that is (2) fixed in a tangible medium (e.g. a book or musical recording). Registration is not required for copyright itself, but in most cases is a jurisdictional requirement to bring the suit. Registration is also useful because it gives rise to the presumption of a valid copyright, and eliminates the innocent infringement defense, and (if timely made) it allows the plaintiff to elect statutory damages, and be eligible for a possible award of attorney fees.
Works that are not sufficiently original, or which constitute facts, a method or process cannot enjoy copy protection.. U.S. Courts do not recognize the "sweat of the brow" doctrine, which originally allowed protection for those who labored to collect and organize facts. To combat this, business which assemble databases of information have relied on contract law where copyright law offers no protection. For a work to be original, it must possess a "modicum of creativity", which is a "low threshold" although some creativity must exist.
Copyright protects the fixed expression of ideas, but not the ideas themselves. (Ideas are protected by patents). Nevertheless, an expression must exist in a fixed tangible medium. A movie script writer who discusses a plot idea which has not yet been written would not be protected if another heard his idea and wrote a screenplay himself. Whether RAM constitutes a "fixed medium" is a contentious issue in copyright litigation because of the transitory nature of RAM.
Second element: establishing actual copying
A plaintiff establishes actual copying with direct or indirect evidence. Direct evidence is satisfied either by a defendant's admission to copying or the testimony of witnesses who observed the defendant in the act. More commonly, a plaintiff relies on circumstantial or indirect evidence. A court will infer copying by a showing of a "striking similarity" between the copyrighted work and the alleged copy, along with a showing of both access and use of that access. A plaintiff may establish access by proof of distribution over a large geographical area, or by eyewitness testimony that the defendant owned a copy of the protected work. Access alone is not sufficient to establish infringement. The plaintiff must show a similarity between the two works, and the degree of similarity will affect the probability that illicit copying in fact occurred in the court's eyes. Even then, the plaintiff must show that the copying amounted to improper appropriation.
Indeed, the US Supreme Court has held that not all copying constitutes infringement and a showing of misappropriation is necessary.
Third element: establishing misappropriation
A copyrighted work may contain elements which are not copyrightable, such as facts, ideas, themes, or content in the public domain. A plaintiff alleging misappropriation must first demonstrate that what the defendant appropriated from the copyrighted work was protectible. Second, a plaintiff must show that the intended audience will recognize substantial similarities between the two works. The intended audience may be the general public, or a specialized field. The degree of similarity necessary for a court to find misappropriation is not easily defined. Indeed, "the test for infringement of a copyright is of necessity vague." Two methods are used to determine if unlawful appropriation has occurred: the subtractive method and the totality method.
The subtractive method, also known as the "abstraction/subtraction approach" seeks to analyze what parts of a copyrighted work are protectible and which are not. The unprotected elements are subtracted and the fact finder then determines whether substantial similarities exist in the protectible expression which remains. For instance, if the copyright holder for West Side Story alleged infringement, the elements of that musical borrowed from Romeo and Juliet would be subtracted before comparing it to the allegedly infringing work because Romeo and Juliet exists in the public domain.
The totality method, also known as the "total concept and feel" approach takes the work as a whole with all elements included when determining if a substantial similarity exists. The individual elements of the alleged infringing work may by themselves be substantially different from their corresponding part in the copyrighted work, but nevertheless taken together be a clear misappropriation of copyrightable material.
