Levels of courts-martial
Three levels of courts-martial can be convened depending on the severity of the offense(s): Summary (which can confine junior enlisted to up to 30 days), Special (which, depending on the charges, can confine an accused up to a year and give a bad-conduct discharge to enlisted) and General (which, depending on the charges, can sentence an accused to death or life imprisonment, and give a bad-conduct or dishonorable discharge or a dismissal to officers). Officers are not tried at summary courts-martial and enlisted members have an absolute right to refuse summary court.
Unlike federal courts established under Article III of the U.S. Constitution, a court-martial is established under Article I and does not exist until its creation is ordered by a commanding officer. Such officers are called court-martial convening authorities. The legally operative document that a convening authority uses to create a court-martial is called a court-martial convening order.
General courts-martial require an investigating officer, with at least the rank of captain (naval lieutenant), to hold a hearing to review government evidence which outlines the elements of the alleged crime. These investigations are referred to as Article 32 hearings because they are described in article 32 of the Uniform Code of Military Justice (UCMJ). In the Air Force and Navy the Investigating Officer is usually a JAG officer, in the Army it is usually a non-lawyer. The accused is present and has an attorney to examine evidence and testimony. The Article 32 hearing is a major discovery tool for the defense. The investigating officer then sends the report with recommendations to the convening authority, who may then refer the case for court-martial.

It is a federal offense which carries a punishment of prison time and/or a fine; the scope previously covered only the Medal of Honor.
The Act was first introduced into the United States Congress's House of Representatives on July 19, 2005 by Representative John Salazar, a Democrat from Colorado, as H.R. 3352.[2][3] It was introduced into the Senate by Senator Kent Conrad, a Democrat from North Dakota, on November 10, 2005 as S. 1998.[4][5] The Senate version was passed unanimously on September 7, 2006.[5][6] The Senate version then went to the same House Judiciary Committee that held the House version. The Act briefly stalled, but the House subsequently passed the Senate version, S. 1998, on December 6, 2006.[7]
The purpose of the Act is to strengthen the provisions of 18 U.S.C. § 704 by broadening its scope and strengthening penalties. Specific new provisions in the Act include: granting more authority to Federal law enforcement officers, extending scope beyond the Medal of Honor, broadening the law to cover false claims whereas previously an overt act had to be committed, covering mailing and shipping of medals, and protecting the reputation and meaning of military heroism medals.[3][5]
The need for the Act came about because of large numbers of fake military heroes in the United States. For example, as of June 2, 2006 there were only 120 living Medal of Honor recipients, but there were far more known imposters. McGreevey's homeland security adviser Golan Cipel received criticisms about his lack of qualifying experience for the position. He also could not gain a security clearance from the federal government, given that he was not a U.S. citizen, but an Israeli citizen whom McGreevey met during a trip to Israel in 2000.[30]
According to McGreevey in The Confession, The Record was the first newspaper to break the news of a relationship between McGreevey and Cipel that was to lead to McGreevey's resignation. McGreevey brought up Cipel's name six weeks into his administration in a February 14, 2002, interview with The Record's editorial board at its offices saying:
“ We will not skimp on security. We actually brought on a security adviser from the Israel Defense Forces, probably the best in the world.[31] ”
The interview prompted news investigation into Cipel's background and, on February 21, The Record published a profile of Cipel, calling him a "sailor" and a "poet". The article stated “Democrats close to the administration say McGreevey and Cipel have struck up a close friendship and frequently travel together”, prompting McGreevey's own mother to confront him about his sexual orientation. B. Procedural Background
On September 25, 1978, a grand jury in San Juan County, New Mexico, district court indicted petitioner Chapman of first degree murder, felony murder, and armed robbery. Chapman had made a pretrial statement to police in which he stated "I did not kill Terry Sanders and ah--I was with the people involved under fear for my own life." On the basis that he received ineffective assistance of pretrial counsel, Chapman moved to suppress that statement, which the trial court denied. A jury found Chapman guilty of robbery and felony murder and he was sentenced to life imprisonment.
The New Mexico Supreme Court affirmed Chapman's convictions on direct appeal. Relying on State v. Harrison, Chapman argued that the trial court's failure to instruct the jury on the dangerousness of the underlying felony violated state law. 564 P.2d at 1324. The New Mexico Supreme Court rejected this argument.

The first Gulf of Sidra incident, August 19, 1981, was an incident in which two Libyan Sukhoi Su-22 Fitter fighter jets engaged two US F-14 Tomcats off of the Libyan coast.

The Fitters were heading towards the Tomcats and the lead Fitter fired an AA-2 Atoll short range heat seeking missile at the Tomcats. The Tomcats evaded and were cleared to return fire.

The Grumman F-14 Tomcat is a supersonic, twin-engine, two-seat, variable geometry wing aircraft. The F-14 was the United States Navy's primary maritime air superiority fighter, fleet defense interceptor and tactical reconnaissance platform from 1972 to 2006. It later performed precision strike missions once it was integrated with LANTIRN.[2] It was developed after the collapse of the F-111B project, and was the first of the American teen-series fighters which were designed incorporating the experience of air combat in Vietnam against MiGs.

The F-5A/B Freedom Fighter and F-5E/F Tiger II are part of a family of widely used light supersonic fighter aircraft, designed and built by Northrop in the United States, beginning in 1960s.
The USAF made a combat evaluation of the F-5A under the Skoshi Tiger program in 1965. 12 aircraft were delivered for trials to the 4503rd Tactical Fighter Wing (subsequently the 10th Fighter Commando Squadron), redesignated F-5C. They performed combat duty in Vietnam, flying more than 3,500 sorties from the 3rd Tactical Fighter Wing at Bien Hoa in South Vietnam. Two aircraft were lost in combat. The program was short-lived, more a political gesture than a serious consideration of the type for U.S. service.

The Fairchild-Republic A-10 Thunderbolt II is a single-seat, twin-engine jet aircraft designed to provide air interdiction and close air support (CAS) of ground forces by attacking tanks, armored vehicles, and other ground targets. With the ill-fated 1972 Watergate break-in and its tragic aftermath--culminating in the President's 1974 resignation--as its focus, NIXON examines its subject's complex life, including his difficult youth in Southern California and often troubled relationship with wife Pat. The President. Your Royal Highnesses, Sir Oliver and Lady Wright, and Ambassador and Mrs. Price, ladies and gentlemen, Nancy and I are deeply honored to welcome the Prince and Princess of Wales to the White House. Permit me to add our congratulations to Prince Charles on his birthday, just 5 days away, and express also our great happiness that we have been able to have this affair with Princess Diana, here on her first trip to the United States—that we should be able to share in that first trip.
In his 1941 address before a Joint Session of the United States Congress, Prime Minister Churchill remarked, "I cannot help reflecting that if my father had been American and my mother British, instead of the other way around, I might have got here on my own." [Laughter] But Your Royal Highnesses, the reception you've received here suggests that if you had been American, you might well have gotten to this house on your own. [Laughter]
Our two countries are bound together by innumerable ties of ancient history and present friendship. Our language, our law, our democratic system of government, our fierce belief in the God-given right of men to be free—all of these we owe to you. We've stood together through two great world conflicts. Today we go on, shoulder to shoulder, in an alliance to protect freedom and democracy.
This evening we've gathered on a happy occasion, a celebration of the "Treasure Houses of Britain," perhaps the most magnificent exhibition ever mounted and five centuries of British achievement, five centuries of elegance, beauty, and charm; I should add, wit. When Nancy and I toured the exhibition, we were struck by a settee from Balmoral Castle, constructed almost entirely of deer antlers. I've been wondering ever since whether something like that could be done with cattle horns out on the ranch. [Laughter] But one misadventure in the corral one day has taught me that it might be more painful than pleasant, so— [laughter] . The "Treasure Houses of Britain" truly is a great gift from the houses' owners, the British people, and you, the exhibition's patrons. I speak for all Americans when I say a heartfelt "thank you."
Your Royal Highnesses, in the eyes of my countrymen, you and your family hold a place of high honor; your devotion to duty commands our esteem. Americans join our British cousins in looking upon you with affection and respect. And in that same 1941 address, Winston Churchill said: "It is not given to us to peer into the future. Still I avow my hope and faith, sure and inviolate, that in the days to come, the British and American people will, for their own safety and for the good of all, walk together in majesty, in justice, and in peace." And today that noble hope is a glorious reality.
Would you please join me in a toast to Her Majesty, the Queen. To the Queen.
Prince Charles. Mr. President, Mrs. Reagan, ladies and gentlemen, if I may say so, Mr. President, you really have touched both my wife and myself most deeply this evening by your extremely kind words. And we can't possibly, both of us, thank you enough for your immense hospitality and your great kindness in having us here this evening and in making us feel so unbelievably welcome.
I would think one of the most marvelous things about coming to the United States is that you have this extraordinary gift for making people feel welcome. And apart from the friendliness with which you greet everybody, it really does warm the heart to come here and be made to feel welcome. I can't tell you what it means to us both. It really does. As you know, we've flown in hesitant stages from Australia and tried to stop on the way in order to regain our strength. And all that's happened is we're suffering terribly from jet lag. [Laughter] And I've yet to discover a foolproof method for actually getting one over the problems of this particular affliction.
However, we are greatly looking forward to the opportunity of seeing this exhibition, the "Treasure Houses of Britain," which we are both very proud to be patrons of. And we hear from all sides just how stupendous this particular exhibition is. I think if you go and look at most of the country houses in Britain at the moment, you'll find them completely empty— [laughter] —of all the furniture and pictures, some emptier than others and, no doubt, with rather dirty marks on the walls where the pictures were. I only hope that they manage to get them all back in the right place at the right time. [Laughter]
I'm also very much looking forward, myself, to going to the Congress Library on Monday and discussing something about the Constitution, of which I know you celebrate the bicentenary in 1987. And I was very intrigued to discover that of the 55 delegates that came to the Federal convention in 1787, nearly all of them were in their thirties, which just goes to show what an extremely good age the mid-thirties is. [Laughter] I keep telling myself that because you reminded me about my birthday, and I'm not sure I need reminding. [Laughter]
I would also just like to say that coming, as we have, down from Australia, it is one of the more interesting aspects, I think, of the pioneering spirit of the English-speaking peoples. That here were two great continents—Australia and the United States of America, the former having developed about 150 years later than this great country-and in many ways there are similarities between the two. And I think that one of the things that becomes most obvious about Australia and America is that personal independence becomes a very dominant feature, particularly, I think, in American life. And one Englishman observed in 1796 that Americans tend to pass their lives without any regard to the smiles or frowns of men in power. However, in your case, Mr. President, I'm sure it's completely different.
So, if I may, finally, again say what an enormous pleasure it gives both of us to be here and how proud we are to be able to represent Britain here in America. As you say, it does, I think, emphasize the very strong links that do exist between our two countries—always have done, and I'm sure always will. And in the end, that bond between our two peoples is one of the most important and enduring features of this Earth.
Mr. President, thank you very much.
