§ 333. Major public emergencies; interference with State and Federal law
(a) Use of Armed Forces in Major Public Emergencies.—
(1) The President may employ the armed forces, including the National Guard in Federal service, to—
(A) restore public order and enforce the laws of the United States when, as a result of a natural disaster, epidemic, or other serious public health emergency, terrorist attack or incident, or other condition in any State or possession of the United States, the President determines that—
(i) domestic violence has occurred to such an extent that the constituted authorities of the State or possession are incapable of maintaining public order; and
(ii) such violence results in a condition described in paragraph (2); or
(B) suppress, in a State, any insurrection, domestic violence, unlawful combination, or conspiracy if such insurrection, violation, combination, or conspiracy results in a condition described in paragraph (2).
(2) A condition described in this paragraph is a condition that—
(A) so hinders the execution of the laws of a State or possession, as applicable, and of the United States within that State or possession, that any part or class of its people is deprived of a right, privilege, immunity, or protection named in the Constitution and secured by law, and the constituted authorities of that State or possession are unable, fail, or refuse to protect that right, privilege, or immunity, or to give that protection; or
(B) opposes or obstructs the execution of the laws of the United States or impedes the course of justice under those laws.
(3) In any situation covered by paragraph (1)(B), the State shall be considered to have denied the equal protection of the laws secured by the Constitution.

Bid to name courthouse after war hero is in Congress

The grass-roots campaign to name Seattle's Federal Courthouse after Medal of Honor winner William Kenzo Nakamura has reached the nation's capital.
Democratic U.S. Rep. Jim McDermott and Sen. Patty Murray today plan to introduce bills naming the courthouse after the 22-year-old military hero, who was killed in action during World War II.
"It's a fitting tribute to Mr. Nakamura primarily because his story has been hidden for so long," McDermott said in a telephone interview. "This would put an exclamation point on how we treated him and other Japanese Americans."

Ruling gives Microsoft an edge

WASHINGTON - The U.S. Supreme Court decisively rejected a speedy review of the Microsoft antitrust case yesterday, leaving a lower court to decide whether to uphold a judge's landmark order to split the world's largest software maker in two.
The 8-1 ruling is likely to delay a final decision for as long as two years and marks a significant setback for the Justice Department and 19 states, which had sought to put their case against Microsoft on the fast track. It was the first time in 16 years that the U.S. solicitor general had asked the high court for an expedited antitrust review and the first time the justices said no.
The decision elated officials at Microsoft, which has fared well in the lower court before.

Court documents say federal agents arrested Charles Alan Wilson in Yakima on Tuesday.
An FBI agent's probable cause statement says Murray's office in Seattle reported the threats, which were left on voice mail from a blocked telephone number. Agents say they traced the calls to Wilson's home in Selah, near Yakima.
Murray's office told the FBI that it had been receiving harassing messages from the caller for months, but they became more threatening as Congress was voting on health care legislation.
Excerpts of the expletive-laced messages transcribed in court documents show the caller saying he wanted to kill the senator, and it would just take one piece of lead.

A Yakima County man pleaded guilty Thursday in U.S. District Court in Seattle to making threats against U.S. Sen. Patty Murray over her support of health-care overhaul.
Charles Alan Wilson was arrested at his Selah home April 6. He was released from custody after posting $20,000 bond days later.
According to the charges, staffers in Murray's office in the Jackson Federal Building in downtown Seattle had become concerned over phone calls by an unknown man in recent months. The calls came from a blocked number and often were made at night or on weekends.
Usually, according to a staffer, the calls were merely vulgar and harassing.
But on March 22, "the caller began to make overt threats to kill and/or injure Senator Murray," according to the complaint signed by FBI Agent Carolyn Woodbury.
In that call, a man the FBI says it has identified as Wilson stated: "I hope you realize there's a target on your back now ... Kill the [expletive] senator! I'll donate the lead."
In several other vulgar and profanity-laced messages left over the next week, the caller repeatedly threatened the Democratic senator's life and said he "hopes somebody kills" President Obama as well, according to portions of transcripts in the complaint.
In a call on April 4, according to charging documents filed in federal court, Wilson made reference to being in a group of protesters outside the Red Lion Hotel in Yakima a week earlier when Murray was in town to speak at a Chamber of Commerce event. Local tea-party activists participating in the demonstration held signs protesting the health-care overhaul and equating Obama's agenda with socialism.
"Yeah, we were outside waiting for you," Wilson said in his voice-mail message, records show.
Joe Ray, organizer of Tea Party Patriots of Yakima Valley, told the Yakima-Herald newspaper he'd never heard of Wilson as a participant in the loosely organized coalition of groups billed as Yakima Freedom Partners, which has sponsored recent rallies and events.
Wilson faces up to 10 years in prison and a $250,000 fine when sentenced by U.S. District Judge John Coughenour on Oct. 8.

A Washington state man has been charged with threatening to kill Democratic Sen. Patty Murray over her support for health care reform, leaving voicemail messages at her office saying she had a target on her back and "it only takes one piece of lead."
Federal agents arrested Charles Alan Wilson, 63, without incident in Yakima, Wash., on Tuesday.
Murray's office in Seattle reported the threats amid a rash of ugliness aimed at lawmakers who supported the sweeping federal health care legislation. Some lawmakers have been spit on and several have reported receiving threatening calls.
FBI spokesman Bill Carter said Wilson is believed to be the first person in the country arrested for such threats.
The messages to Murray were left on voicemail from a blocked telephone number, FBI Special Agent Carolyn W. Woodbury wrote in a probable cause statement. Agents said they traced the calls to Wilson's home in Selah, near Yakima.
Wilson has a .38-caliber revolver registered to him and has a concealed weapons permit, Woodbury wrote.
To confirm Wilson was the caller, one agent telephoned him and posed as a member of a group working to repeal the health care legislation, the statement said.
According to an excerpt of the conversation, Wilson confirmed he repeatedly called Murray as well as Washington's other Democratic senator, Maria Cantwell. He then stated: "I do pack, and I will not blink when I'm confronted. ... It's not a threat, it's a guarantee."
Murray's office told the FBI it had been receiving harassing messages from the caller for months, but they became more threatening as Congress was voting on the health care legislation.
"There's a target on your back now," said one message on March 22. "It only takes one piece of lead. Kill the (expletive) senator! ... Now that you've passed your health-care bill, let the violence begin."
In other rambling messages over the next several days, the caller said, "I hope somebody puts a (expletive) bullet between your (expletive) eyes," and "I do believe that every one of you (expletive) socialist democratic progressive (expletive) need to be taken out."
And, he said, "I want to (expletive) kill you."
Wilson made an initial appearance at federal court in Yakima on Tuesday on one count of threatening a federal official.

Cowardice
Cowardice describes a personality trait which is typically viewed as a negative characteristic and has been generally frowned upon (see norms) within most, if not all global cultures, while courage, typically viewed as its direct opposite, is generally rewarded and encouraged.
"Cowardice" can be difficult to define outside of specific social contexts. In general terms, it is the perceived failure to demonstrate sufficient bravery in the face of an adverse situation. Cowards are usually seen to have avoided or refused to engage in a confrontation or struggle which has been deemed good or righteous by the wider culture in which they live.
On a more mundane level, the label may be applied to those who are regarded as too frightened to defend their rights or those of others from aggressors in their lives.
Etymology
According to the Online Etymology Dictionary, the word "coward" comes from an Old French word coart (modern French couard), a combination of the word for "tail" and an agent noun suffix. It would therefore have meant "one with a tail" — perhaps one in the habit of turning it, or it may be derived from the dog's habit of putting its tail between its legs when it is afraid.

(a) It shall be unlawful for any person who has received any income derived, directly or indirectly, from a pattern of racketeering activity or through collection of an unlawful debt in which such person has participated as a principal within the meaning of section 2, title 18, United States Code, to use or invest, directly or indirectly, any part of such income, or the proceeds of such income, in acquisition of any interest in, or the establishment or operation of, any enterprise which is engaged in, or the activities of which affect, interstate or foreign commerce.

§ 1963. Criminal penalties
Whoever violates any provision of section 1962 of this chapter shall be fined under this title or imprisoned not more than 20 years (or for life if the violation is based on a racketeering activity for which the maximum penalty includes life imprisonment), or both, and shall forfeit to the United States, irrespective of any provision of State law—
(1) any interest the person has acquired or maintained in violation of section 1962;
(2) any—
(A) interest in;
(B) security of;
(C) claim against; or
(D) property or contractual right of any kind affording a source of influence over;
any enterprise which the person has established, operated, controlled, conducted, or participated in the conduct of, in violation of section 1962; and

§ 2388. Activities affecting armed forces during war
(a) Whoever, when the United States is at war, willfully makes or conveys false reports or false statements with intent to interfere with the operation or success of the military or naval forces of the United States or to promote the success of its enemies; or Whoever, when the United States is at war, willfully causes or attempts to cause insubordination, disloyalty, mutiny, or refusal of duty, in the military or naval forces of the United States, or willfully obstructs the recruiting or enlistment service of the United States, to the injury of the service or the United States, or attempts to do so— Shall be fined under this title or imprisoned not more than twenty years, or both.
(b) If two or more persons conspire to violate subsection (a) of this section and one or more such persons do any act to effect the object of the conspiracy, each of the parties to such conspiracy shall be punished as provided in said subsection (a).
(c) Whoever harbors or conceals any person who he knows, or has reasonable grounds to believe or suspect, has committed, or is about to commit, an offense under this section, shall be fined under this title or imprisoned not more than ten years, or both.
(d) This section shall apply within the admiralty and maritime jurisdiction of the United States, and on the high seas, as well as within the United States.

Deviance describes actions or behaviors that violate cultural norms including formally-enacted rules (e.g., crime)
Primary and secondary deviation
Edwin Lemert developed the idea of primary and secondary deviation as a way to explain the process of labeling. Primary deviance is any general deviance before the deviant is labeled as such. Secondary deviance is any action that takes place after primary deviance as a reaction to the institutions.
When an actor commits a crime (primary deviance), however mild, the institution will bring social penalties down on the actor. However, punishment does not necessarily stop crime, so the actor might commit the same primary deviance again, bringing even harsher reactions from the institutions. At this point, the actor will start to resent the institution, while the institution brings harsher and harsher repression. Eventually, the whole community will stigmatize the actor as a deviant and the actor will not be able to tolerate this, but will ultimately accept his or her role as a criminal, and will commit criminal acts that fit the role of a criminal.
Primary And Secondary Deviation is what causes people to become harder criminals. Primary deviance is the time when the person is labeled deviant through confession or reporting. Secondary deviance is deviance before and after the primary deviance. Retrospective labeling happens when the deviant recognizes his acts as deviant prior to the primary deviance, while prospective labeling is when the deviant recognizes future acts as deviant. The steps to becoming a criminal are:
Primary deviation.
Social penalties.
Secondary deviation.
Stronger penalties.
Further deviation with resentment and hostility towards punishers.
Community stigmatizes the deviant as a criminal. Tolerance threshold passed.
Strengthening of deviant conduct because of stigmatizing penalties.
Acceptance as role of deviant or criminal actor.

According to a criminal Complaint unsealed today, on or about February 12, 2004, Microsoft learned that significant portions of the source code for both Windows NT 4.0 and Windows 2000 – which Microsoft considers the "crown jewels" of the company – were misappropriated (the "Stolen Source Code") and unlawfully released onto, and distributed over, the Internet without its authorization. That same day, according to the Complaint, GENOVESE posted a message on his Web site, "illmob.org," which announced that he had obtained a copy of the Stolen Source Code and was offering it for sale.

Hope faded Thursday of finding 11 missing offshore workers alive as the sun set on a second day of searching and the massive drilling rig that exploded into flames late Tuesday night sank into the Gulf of Mexico.
With the fire doused and the rig submerged, the Coast Guard launched a sweeping effort to clean up petroleum spewed into the water and seal off a well at the sea floor that may have still been leaking oil.
As it did, investigations began and questions continued to swirl about the cause of the accident at the Deepwater Horizon, a half-billion-dollar rig owned and operated by Swiss-based Transocean that was under lease to BP.

Radioactive contamination
Radioactive contamination, also called radiological contamination, is the uncontrolled distribution of radioactive material in a given environment. The amount of radioactive material released in an accident is called the source term.
Sources of contamination
Radioactive contamination is typically the result of a spill or accident during the production or use of radionuclides (radioisotopes), an unstable nucleus which has excessive energy. Contamination may occur from radioactive gases, liquids or particles. For example, if a radionuclide used in nuclear medicine is accidentally spilled, the material could be spread by people as they walk around. Radioactive contamination may also be an inevitable result of certain processes, such as the release of radioactive xenon in nuclear fuel reprocessing.
Nuclear fallout is the distribution of radioactive contamination by a nuclear explosion.

Radiation poisoning
Radiation poisoning, radiation sickness or a creeping dose, is a form of damage to organ tissue caused by excessive exposure to ionizing radiation. The term is generally used to refer to acute problems caused by a large dosage of radiation in a short period, though this also has occurred with long term exposure. The clinical name for radiation sickness is acute radiation syndrome (ARS) as described by the CDC. A chronic radiation syndrome does exist but is very uncommon; this has been observed among workers in early radium source production sites and in the early days of the Soviet nuclear program. A short exposure can result in acute radiation syndrome; chronic radiation syndrome requires a prolonged high level of exposure.
Radiation exposure can also increase the probability of developing some other diseases, mainly cancer, tumours, and genetic damage. These are referred to as the stochastic effects of radiation, and are not included in the term radiation sickness.
The use of radionuclides in science and industry is strictly regulated in most countries (in the U.S. by the Nuclear Regulatory Commission). In the event of an accidental or deliberate release of radioactive material, either evacuation or sheltering in place are the recommended measures.
Signs and symptoms
Radiation sickness is generally associated with acute (a single large) exposure. Nausea and vomiting are usually the main symptoms. The amount of time between exposure to radiation and the onset of the initial symptoms may be an indicator of how much radiation was absorbed. Symptoms appear sooner with higher doses of exposure. The symptoms of radiation sickness become more serious (and the chance of survival decreases) as the dosage of radiation increases. A few symptom-free days may pass between the appearance of the initial symptoms and the onset of symptoms of more severe illness associated with higher doses of radiation. Nausea and vomiting generally occur within 24–48 hours after exposure to mild (1–2 Gy) doses of radiation. Headache, fatigue, and weakness are also seen with mild exposure. Moderate (2–3.5 Gy of radiation) exposure is associated with nausea and vomiting beginning within 12–24 hours after exposure. In addition to the symptoms
of mild exposure, fever, hair loss, infections, bloody vomit and stools, and poor wound healing are seen with moderate exposure. Nausea and vomiting occur in less than 1 hour after exposure to severe (3.5–5.5 Gy) doses of radiation, followed by diarrhea and high fever in addition to the symptoms of lower levels of exposure. Very severe (5.5–8 Gy of radiation) exposure is followed by the onset of nausea and vomiting in less than 30 minutes followed by the appearance of dizziness, disorientation, and low blood pressure in addition to the symptoms of lower levels of exposure. Severe exposure is fatal about 50% of the time.
Nuclear warfare and bomb tests
Nuclear warfare and bomb tests are more complex because a person can be irradiated by at least three processes. The first (the major cause of burns) is not caused by ionizing radiation.
Thermal burns from infrared heat radiation
Beta burns from shallow ionizing beta radiation (this would be from fallout particles; the largest particles in local fallout would be likely to have very high activities because they would be deposited so soon after detonation and it is likely that one such particle upon the skin would be able to cause a localised burn); however, these particles are very weakly penetrating and have a short range.
Gamma burns from highly penetrating gamma radiation. This would likely cause deep gamma penetration within the body, which would result in uniform whole body irradiation rather than only a surface burn. In cases of whole body gamma irradiation (circa 10 Gy) caused by accidents involving medical product irradiators, some of the human subjects have developed injuries to their skin between the time of irradiation and death.
There is also the risk of internal radiation poisoning by ingestion of fallout particles.
