The Washington State Department of Ecology (Ecology) has drafted a legal agreement for a final environmental cleanup of the former Unocal Bulk Marketing Terminal site, located at Elliott Avenue and Broad Street near Pier 70 in Seattle, Washington.
The legal agreement, called a Prospective Purchaser Consent Decree (Decree) is between Ecology and the Seattle Art Museum (SAM). The Decree settles any liability, with some exceptions, SAM would have for environmental cleanup at the former Unocal site when SAM purchases the property from Unocal this year. The Decree requires SAM to contribute substantial new resources to facilitate and expedite the cleanup of this site in accordance with the Cleanup Action Plan. SAM proposes to redevelop the site as an outdoor sculpture park.

THE COURT: Okay, we're on dangerous grounds.
MR. ALBERT: I know, we're treading on very thin wire at this point.
THE COURT: Why are you doing it?
MR. ALBERT: Well, Judge, we had an in camera hearing, and this came as somewhat — I was somewhat surprised by the answers originally by the officer here in open court about that he made some innocuous statement, and that they put him in the police car. I was under the impression that the Defendant had waived his right to remain silent, and had agreed to talk to the officer. So that answer somewhat surprised me. And at that point we were into it, and I'm trying now to salvage it.
THE COURT: You can't salvage it; you're going deeper and deeper. You have dug yourself into a hole, and now you have even emphasized that he is not answering to the Miranda Warning, make any statement at all.
MR. ALBERT: All right, I have no further questions of this witness. (Tr. 201).
12 Nevertheless, the court again denied the motion for a mistrial.
13 Appellant cites Dungan v. State, 651 P.2d 1064 (Okl.Cr. 1982) for the assertion that this case should be reversed because of the comments. In Dungan the only question asked was, "Did he wish to speak to you at that time?" The witness answered, "No, sir. He stated he did not." Id. at 1065. This Court found that the question and answer constituted reversible error, even though there was no contemporaneous objection. The Court noted the "lack of probative value of the evidence in question" and "its extreme prejudicial consequences." Due to the highly circumstantial nature of the prosecutor's evidence in regard to intent, the Court was unable to determine beyond a reasonable doubt that the comment was harmless. Notwithstanding Dungan, had the evidence been strong and had the prosecutor stopped after the first question, it might have constituted harmless error.

But the story of Bush's career in oil, which began following his graduation from Harvard Business School in the summer of 1975 and ended when he sold out to Harken and headed for Washington, is mostly about his failure to succeed, despite the sterling connections his lineage and Ivy League education brought him.
Thanks to his and his family's ties to wealthy investors around the country, including prominent Republicans, Bush was repeatedly able to raise money to invest in oil drilling, especially when prices were booming and tax breaks were inviting in the late 1970s. But connections could not help with the tricky business of picking profitable holes to drill, and Bush never made a big score.
In fact, Bush lost money for most of his well-connected investors. At the same time, the management fees and other expenses he collected from them kept him in business and enabled him to buy oil reserves for his company's own account, including the reserves that eventually attracted Harken's attention.
