Economic Espionage Act of 1996

The Economic Espionage Act of 1996 (18 U.S.C. § 1831–1839) makes the theft or misappropriation of a trade secret a federal crime. Unlike Espionage, which is governed by Title 18 U.S. Code Sections 792 - 799, the offense involves commercial information, not classified or national defense information.

This law contains two sections criminalizing two sorts of activity. The first, 18 U.S.C. § 1831(a), criminalizes the misappropriation of trade secrets (including conspiracy to misappropriate trade secrets and the subsequent acquisition of such misappropriated trade secrets) with the knowledge or intent that the theft will benefit a foreign power. Penalties for violation are fines of up to US$500,000 per offense and imprisonment of up to 15 years for individuals, and fines of up to US$10 million for organizations,

The second section, 18 U.S.C. § 1832, criminalizes the misappropriation of trade secrets related to or included in a product that is produced for or placed in interstate (including international) commerce, with the knowledge or intent that the misappropriation will injure the owner of the trade secret. Penalties for violation of section 1832 are imprisonment for up to 10 years for individuals (no fines) and fines of up to US$5 million for organizations.

In addition to these specific penalties, section 1834 of the EEA also requires criminal forfeiture of (1) any proceeds of the crime and property derived from proceeds of the crime and (2) any property used, or intended to be used, in commission of the crime.

NASA TO OBSERVE AND PUBLISH IMAGES OF COMET HYAKUTAKE

NASA is conducting a variety of activities designed to study the approaching Comet C/1996 B2 Hyakutake and will share this information, and on-going amateur and student observations of the comet, with the general public.

Discovered on January 30 by Japanese amateur comet hunter Yuji Hyakutake using powerful binoculars, the comet is expected to be as bright or brighter than the stars of the Big Dipper. The comet will make its closest approach to Earth on March 25 at a distance of about 9.3 million miles. It should be visible (weather and light pollution permitting) as a dimly glowing cloud in the northern night sky to the left of the handle of the Big Dipper, as seen from North America.

Comet Hyakutake

Comet Hyakutake ( formally designated C/1996 B2) is a comet discovered on January 30, 1996, which passed very close to Earth in March of that year. It was dubbed The Great Comet of 1996; its passage near the Earth was one of the closest cometary approaches of the previous 200 years. Hyakutake appeared very bright in the night sky and was widely seen around the world. The comet temporarily upstaged the much anticipated Comet Hale-Bopp, which was approaching the inner solar system at the time.

Scientific observations of the comet led to several discoveries. Most surprising to cometary scientists was the first discovery of X-ray emission from a comet, believed to have been caused by ionised solar wind particles interacting with neutral atoms in the coma of the comet. The Ulysses spacecraft unexpectedly crossed the comet's tail at a distance of more than 500 million km from the nucleus, showing that Hyakutake had the longest tail known for a comet.

Hyakutake is a long-period comet. Before its most recent passage through the solar system, its orbital period was about 17,000 years, but the gravitational influence of the giant planets has increased this period to 100,000 years.

A newly discovered comet has appeared in the sky, and astronomers say it may become the brightest one in two decades. It is already so bright that experts are betting that it will soon be easily visible to the naked eye in places where the sky is relatively unpolluted by outdoor lighting.

The comet, C/1996 b2 (Hyakutake), named for its discoverer, Yuji Hyakutake, caught astronomers by surprise; its existence was unknown until Hyakutake, an amateur comet hunter in Japan, spotted it through powerful binoculars on Jan. 30. Since then, the comet has steadily brightened as it speeds toward the sun, and it has developed tails of ionized gas and dust that are becoming visible to the unaided eye.

Scientific misconduct

Scientific misconduct is the violation of the standard codes of scholarly conduct and ethical behavior in professional scientific research. A Lancet review on Handling of Scientific Misconduct in Scandinavian countries provides the following sample definitions:

Danish Definition: "Intention(al) or gross negligence leading to fabrication of the scientific message or a false credit or emphasis given to a scientist"

Swedish Definition: "Intention(al) distortion of the research process by fabrication of data, text, hypothesis, or methods from another researcher's manuscript form or publication; or distortion of the research process in other ways."

The consequences of scientific misconduct can be severe at a personal level for both perpetrators and any individual who exposes it. In addition there are public health implications attached to the promotion of medical or other interventions based on dubious research findings.

Motivation to commit scientific misconduct

According to David Goodstein of Caltech, there are three main motivators for scientists to commit misconduct, which are briefly summarised here.

Career pressure

Science is still a very strongly career-driven discipline. Scientists depend on a good reputation to receive ongoing support and funding; and a good reputation relies largely on the publication of high-profile scientific papers. Hence, there is a strong imperative to "publish or perish". Clearly, this may motivate desperate (or fame-hungry) scientists to fabricate results.

To this category may also be added a paranoia that there are other scientists out there who are close to success in the same experiment, which puts extra pressure on being the first one. It is suggested as a cause of the fraud of Hwang Woo-Suk. A main source of detection comes when other research teams in fact fail or get different results.

Pride

Even on the rare occasions when scientists do falsify data, they almost never do so with the active intent to introduce false information into the body of scientific knowledge. Rather, they intend to introduce a fact that they believe is true, without going to the trouble and difficulty of actually performing the experiments required.

The ability to get away with it

In many scientific fields, results are often difficult to reproduce accurately, being obscured by noise, artifacts and other extraneous data. That means that even if a scientist does falsify data, they can expect to get away with it - or at least claim innocence if their results conflict with others in the same field. There is no "scientific police" which is trained to fight scientific crimes, all investigations are made by experts in science but amateurs in dealing with criminals. It is relatively easy to cheat.

Money

There is the additional incentive of money. If one has a promising proposal in area where federal or other grant money or funding is available especially in new technologies where there is no existing standard against which to compare, the submission of preliminary data cannot be confirmed until further research is done.

Ideology

While perhaps the least common incentive, it is still there. The classic example would be anti-abortionists claiming sonograms show the silent scream of an aborted fetus demonstrates the fetus is alive with feeling, while pro-abortionists would submit demographic studies showing that woman who considered abortion but later decided against it are doomed to life of dependency on welfare, lower socio-economic status, relationship abuse, child abuse, drug abuse, etc.

Forms of scientific misconduct

fabrication – the publication of deliberately false or misleading research, often subdivided into:

Obfuscation - The Omission of critical data or results. Example: Only reporting positive outcomes and not adverse outcomes.

Fabrication – the actual making up of research data and (the intent of) publishing them, sometimes referred to as "drylabbing".

Falsification – manipulation of research data and processes in order to reflect or prevent a certain result.

bare assertions - making entirely unsubstantiated claims

Another form of fabrication is where references are included to give arguments the appearance of widespread acceptance, but are actually fake, and/or do not support the argument.

plagiarism – the act of taking credit (or attempting to take credit) for the work of another. A subset is citation plagiarism – willful or negligent failure to appropriately credit other or prior discoverers, so as to give an improper impression of priority. This is also known as, "citation amnesia", the "disregard syndrome" and "bibliographic negligence". Arguably, this is the most common type of scientific misconduct. Sometimes it is difficult to guess whether authors intentionally ignored a highly relevant cite or lacked knowledge of the prior work. Discovery credit can also be inadvertently reassigned from the original discoverer to a better-known researcher. This is a special case of the Matthew effect.

self-plagiarism – or Multiple publication of the same content with different titles and/or in different journals is sometimes also considered as misconduct; scientific journals explicitly ask authors not to do this. It is refererred to as "salami" in in the jargon of medical journal editors.(MJE) (many identical slices) According to some MJE This includes publishing the same article in a different language.

the violation of ethical standards regarding human and animal experiments – such as the standard that a human subject of the experiment must give informed consent to the experiment.

ghostwriting – the phenomenon where someone other than the named author(s) makes a major contribution. Typically, this is done to mask contributions from drug companies. It incorporates plagiarism and has an additional element of financial fraud.

Conversely, research misconduct is not limited to NOT listing authorship, but also includes the conferring authorship on those that have not made substantial contributions to the research. This is done by senior researcher who muscle their way onto the papers of inexperienced junior researchers as well as others that stack authorship in an effort to guarantee publication. This is much harder to prove due to a lack of consistency in defining "authorship" or "substantial contribution".

Misappropriation of data - Literally stealing the work and results of others and publishing as to make it appear the author had performed all the work under which the data was obtained.

In addition, some academics consider suppression--the failure to publish significant findings due to the results being adverse to the interests of the researcher or his/her sponsor(s)--to be a form of misconduct as well; this is discussed below.

In some cases, scientific misconduct may also constitute violations of the law, but not always. Being accused of the activities described in this article is a serious matter for a practicing scientist, with severe consequences should it be determined that a researcher intentionally or carelessly engaged in misconduct.

Three percent of the 3,475 research institutions that report to the US Department of Health and Human Services' Office of Research Integrity, indicate some form of scientific misconduct. (Source: Wired Magazine, March 2004) However the ORI will only investigate allegations of impropriety where research was funded by federal grants. They routinely monitor such research publication for red flags.

Other private organizations like the Committee of Medical Journal Editors (COJE) can only police their own member-journals.

The validity of the methods and results of scientific papers are often scrutinized in journal clubs. In this venue, members can decide amongst themselves with the help of peers if a scientific paper's ethical standards are met.

The U.S. National Science Foundation defines three types of research misconduct: fabrication, falsification, and plagiarism. Fabrication is making up results and recording or reporting them. Falsification is manipulating research materials, equipment, or processes or changing or omitting data or results such that the research is not accurately represented in the research record. Plagiarism is the appropriation of another person’s ideas, processes, results, or words without giving appropriate credit.

Battle of Ia Drang

Date November 14–18, 1965

The Battle of Ia Drang was one of the first major battles between the United States Army and the People's Army of Vietnam (PAVN) during the Vietnam War. The two-part battle took place between November 14 and November 18, 1965, at two landing zones (LZs) northwest of Plei Me in the Central Highlands of South Vietnam. The battle derives its name from the Drang River which runs through the valley northwest of Plei Me, in which the engagement took place. "Ia" means "river" in the local Montagnard language.

Representing the American forces were elements of the 1st Battalion, 7th Cavalry, the 2nd Battalion, 7th Cavalry, and the 2nd Battalion, 5th Cavalry of the United States Army. The Vietnamese forces included the 33rd, 66th, and 320th Regiments of the PAVN, as well National Liberation Front (NLF) of the H15 Battalion. Both sides suffered heavy losses and both claimed victory. The U.S. lost 234 dead, with 242 wounded; November 17 was the deadliest ambush for Americans in the entire Vietnam War, with 155 killed and 126 wounded.

The battle is the subject of the critically acclaimed book We Were Soldiers Once… And Young by Harold G. Moore and Joseph L. Galloway. In 2002, Randall Wallace depicted the first part of the battle in the film We Were Soldiers starring Mel Gibson.
