Judge Advocate General's Corps
Judge Advocate General's Corps, also known as JAG or JAG Corps, refers to the legal branch or speciality of any of the United States Armed Forces including the Air Force, Army, Coast Guard, Marine Corps, and Navy. Officers serving in the JAG Corps are typically called Judge Advocates. The Marine Corps, Coast Guard and Air Force do not maintain separate JAG Corps per se and judge advocates in those services maintain their line officer-status. In the Army and Navy, JAG officers only serve in legal positions.
Judge Advocates serve primarily as legal advisors to the command to which they are assigned. In this function, they can also serve as the personal legal advisor to their commander. Their advice may cover a wide range of issues dealing with administrative law, government contracting, civilian and military personnel law, law of war and international relations, environmental law, etc. (See below.) They also serve as prosecutors for the military when conducting courts-martial. They are charged with both the defense and prosecution of military law as provided in the Uniform Code of Military Justice. Highly experienced officers of the JAG Corps often serve as military judges in courts-martial and courts of inquiry.
Besides prosecuting, defending, and presiding over courts-martial, military attorneys advise commanders on issues involving a number of areas of law. Depending on the service, these areas may include the law of war, the rules of engagement and their interpretation, and other operational law issues, government contract law, administrative law, labor law, environmental law, international law, claims against the government (such as under the Federal Tort Claims Act), and information law (such as requests for information in the possession of the military under the Freedom of Information Act).

WASHINGTON (Army News Service, July 24, 2009) -- Sgt. 1st Class Jared Monti, who was killed in Afghanistan June 21, 2006, will receive the Medal of Honor for his valor in combat, the White House has announced.
President Barack Obama is scheduled to award Monti's Medal of Honor Sept. 17, to his parents in a White House ceremony. His father Paul Monti currently lives in Raynham, Mass., where his
son was born and raised.
Monti, 30, was assigned to 3rd Squadron, 71st Cavalry, 3rd Brigade Combat Team, 10th Mountain Division, when he was killed in Gowardesh, Afghanistan, in a battle with enemy forces using small arms fire and rocket-propelled grenades. He displayed immeasurable courage and uncommon valor, according to the White House release, which goes on to say he sacrificed his own life in an effort to save his comrade.

President Obama called Paul Monti, a retired school teacher, Tuesday evening at his home in Raynham, Mass., Monti said.

“President Obama called last night and expressed his regret and he apologized. He said that he did not intend to humiliate Special Olympics athletes or people with intellectual disabilities. He was sincere and heartfelt, and said that he is a fan of our movement and is ready to work with our athletes to make the United States a more accepting and welcoming country for all people with special needs.
“Words hurt and words matter. Words can cause pain and result in stereotypes that are unfair and damaging to people with intellectual disabilities. And using 'Special Olympics' in a negative or derogatory context can be a humiliating put-down to people with special needs.
“This is a teachable moment for our country. We are asking young people, parents and leaders from all walks of life to engage in conversation and help dispel negative caricatures about people with intellectual disabilities. We believe that it’s only through open conversation and dialogue about how stereotypes can cause pain that we can begin to work together to create communities of acceptance and inclusion for all.
“Special Olympics is not a program, but a worldwide movement operating 30,000 events a year in more than 180 countries. Jared Christopher Monti (September 20, 1975—June 21, 2006) was a soldier in the United States Army who was killed in action in Afghanistan on June 21, 2006 while trying to rescue a fellow soldier. WASHINGTON (Army News Service, July 24, 2009) -- Sgt. 1st Class Jared Monti, who was killed in Afghanistan June 21, 2006, will receive the Medal of Honor for his valor in combat, the White House has announced.
President Barack Obama is scheduled to award Monti's Medal of Honor Sept. 17, to his parents in a White House ceremony. His father Paul Monti currently lives in Raynham, Mass., where his
son was born and raised.
Monti, 30, was assigned to 3rd Squadron, 71st Cavalry, 3rd Brigade Combat Team, 10th Mountain Division, when he was killed in Gowardesh, Afghanistan, in a battle with enemy forces using small arms fire and rocket-propelled grenades. He displayed immeasurable courage and uncommon valor, according to the White House release, which goes on to say he sacrificed his own life in an effort to save his comrade.

§ 794. Gathering or delivering defense information to aid foreign government
(a) Whoever, with intent or reason to believe that it is to be used to the injury of the United States or to the advantage of a foreign nation, communicates, delivers, or transmits, or attempts to communicate, deliver, or transmit, to any foreign government, or to any faction or party or military or naval force within a foreign country, whether recognized or unrecognized by the United States, or to any representative, officer, agent, employee, subject, or citizen thereof, either directly or indirectly, any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, note, instrument, appliance, or information relating to the national defense, shall be punished by death or by imprisonment for any term of years or for life, except that the sentence of death shall not be imposed unless the jury or, if there is no jury, the court, further finds that the offense resulted in the identification by a foreign power (as defined in section 101(a) of the Foreign Intelligence Surveillance Act of 1978) of an individual acting as an agent of the United States and consequently in the death of that individual, or directly concerned nuclear weaponry, military spacecraft or satellites, early warning systems, or other means of defense or retaliation against large-scale attack; war plans; communications intelligence or cryptographic information; or any other major weapons system or major element of defense strategy.
(b) Whoever, in time of war, with intent that the same shall be communicated to the enemy, collects, records, publishes, or communicates, or attempts to elicit any information with respect to the movement, numbers, description, condition, or disposition of any of the Armed Forces, ships, aircraft, or war materials of the United States, or with respect to the plans or conduct, or supposed plans or conduct of any naval or military operations, or with respect to any works or measures undertaken for or connected with, or intended for the fortification or defense of any place, or any other information relating to the public defense, which might be useful to the enemy, shall be punished by death or by imprisonment for any term of years or for life.
(c) If two or more persons conspire to violate this section, and one or more of such persons do any act to effect the object of the conspiracy, each of the parties to such conspiracy shall be subject to the punishment provided for the offense which is the object of such conspiracy.
(d)
(1) Any person convicted of a violation of this section shall forfeit to the United States irrespective of any provision of State law—
(A) any property constituting, or derived from, any proceeds the person obtained, directly or indirectly, as the result of such violation, and
(B) any of the person’s property used, or intended to be used, in any manner or part, to commit, or to facilitate the commission of, such violation.

After I awoke from a nap this afternoon, I felt compelled to write about a dream I had just before I woke up but then did not write about it. I started feeling that need to write about it again but may have forgotten some details by now. I have started thinking that the dreams I have just before waking up mean something in their own right.
In the dream, I was wearing a Navy uniform. I didn’t have anywhere to go though and seemed to be just walking around what I guess was a Navy installation. I decided to go into a building to ask if another Commander was still there even though I knew he wasn’t there. I spoke to a Navy enlisted person who appeared to be an Airman judging by his three green stripes although I couldn’t make out his rating symbol. He asked me a question but I didn’t hear his question and I asked him to repeat it by saying “Sir?” to him with an inquisitive tone. He asked me how I could not know that the other Commander was already deployed and I said something about how I just did not know. I left and walked down and out on some kind of spiral staircase, although that part isn’t that clear and I find myself wondering about that part. There was another spiral staircase ahead of me, there seemed to be dual staircases on either side of the front door to that building, and a Lt. j.g. came down the other side. I want to say he was someone I should know but I can’t picture him as someone I knew. I want to say it was him that spoke something to me at that point but I also want to say the voice came from behind me. He said, or someone else said, something about me being “a little off.” I wondered if he meant that I was wrong about some of these details. Then I wondered if he meant I was a little crazy, but I think I started thinking that last one after I woke up. I think after he or someone said that, it made me start thinking about the uniform I was wearing. I found myself thinking after I awoke that it seemed to be a Marine Corps officers dress uniform. I seemed to be wearing the dark blue Marine uniform with white pants. But I am confused about one detail as it seemed I looked to my left shoulder and saw Navy shoulder boards with Captain stripes. Or was it just an epaulet, I am not sure, but there was a pair of sunglasses clipped under it. I was walking down the sidewalk and there were two people ahead of me. One may have been that Lt. j.g. Another was a female officer, Navy I guess. Somewhere along there I realized I had forgotten to wear the appropriate cover for that uniform and realized that I was still wearing a ball cap, although I had actually taken it off as I went outside. I realized I couldn’t return anyone’s salute. Then I started thinking that the ball cap had USS Wainwright printed on it but I don’t remember actually looking at it and I may remember that detail in the sense that someone was reading details to me, they were telling me what the name was on the cap. I also remember that it had a frayed bill just like the Nike cap I have now. I remember I was walking very slowly. It was hard to walk and I was limping. I have thought several times before that if I do start wearing the uniform again, I should use a cane until I get my leg back in better shape. Then I was in a parking garage and I had to cross a street into a parking lot, I guess to find my car.

Congresswoman Holt, Secretary Lehman, Admiral Watkins, General Davis, Admiral Larson, distinguished guests, members of the class of 1985, ladies and gentlemen: I am so proud and honored to be here and to have a 22-gun salute. [Laughter]
But it's an honor for any President to commemorate the graduation of new officers from our service academies, but today is a special privilege for me. I was reminded on the way up here that we have a lot in common. You were the first class to enter the Naval Academy during my term in office, and you might say we've finished a 4-year course together. Now we're both about ready for the real stuff. [Laughter] One thing bothers me, though. I still seem to be climbing that greased monument and you only had to do it once, 3 years ago. 1 [Laughter]

Well, looking out over your faces in this inspiring and historic setting gives reason for confidence in our nation's future. These last 4 years have been spent preparing you to assume responsibility for the protection of our country and all that we stand for. You're part of a noble tradition.
America's independence and freedom, since we were but 13 Colonies huddled along the Atlantic coast, have relied on the bravery, the good sense, and leadership of her officer corps. We've leaned heavily on men of the sea, on our Navy and Marine Corps. Your careers will be no less significant to future generations of Americans than those of past naval heroes.
You will hear during your career, as I've heard during times in my life, that maintaining the military at peak readiness-keeping our forces trained and supplied with the best weapons and equipment—is too costly. Well, I say it is too costly for America not to be prepared. As Presidents since Washington have noted: The way to prevent war is to be prepared for it.
And as obvious as that is, it's not always appreciated. There's a story about John Paul Jones' chief gunners mate. It was during the gore and thunder of that most historic battle. He was loading and firing cannon and carrying the wounded to the medical officer, cutting away the tangled rigging. And apparently in the midst of that first fight, John Paul Jones went below momentarily and changed into a new uniform. And as he emerged on deck a voice rang out through the smoke and fire—it was the British captain asking, "Have you struck your colors?" And the gunners mate, sweat and blood dripping from his body, turned and saw Jones now in his fresh uniform reply: "I have not yet begun to fight." And the gunners mate said, "There's always somebody who didn't get the word."

One man who sat where you do now and graduated from the Naval Academy in 1968 is another member of our administration-Assistant Secretary of Defense James Webb, the most decorated member of his class. James' gallantry as a marine officer in Vietnam won him the Navy Cross and other decorations, including two Purple Hearts. James wrote several books about American service men and women. In his book, "A Sense of Honor," he describes the life that you have chosen. He wrote:
"Servicemen are always in motion, in the air at more than the speed of sound, underwater at depths whales could only dream of, on the surface of the water cruising at 30 miles an hour through crashing seas with another ship almost touching theirs . . . replenishing their oil supplies. Or they are on the ground, in the dirt, testing and training weapons that may someday kill others but today may deal them that same irony. The smallest margin of error separates a live man from a dead man. And in war, of course, they are the first and usually the only ones to pay. The President and the Congress may suffer bad news stories. The military man suffers the deaths of his friends, early and often." End quote.
