§ 3005. Counsel and witnesses in capital cases
Whoever is indicted for treason or other capital crime shall be allowed to make his full defense by counsel; and the court before which the defendant is to be tried, or a judge thereof, shall promptly, upon the defendant’s request, assign 2 such counsel, of whom at least 1 shall be learned in the law applicable to capital cases, and who shall have free access to the accused at all reasonable hours. In assigning counsel under this section, the court shall consider the recommendation of the Federal Public Defender organization, or, if no such organization exists in the district, of the Administrative Office of the United States Courts. The defendant shall be allowed, in his defense to make any proof that he can produce by lawful witnesses, and shall have the like process of the court to compel his witnesses to appear at his trial, as is usually granted to compel witnesses to appear on behalf of the prosecution.

(a) Each armed force has court-martial jurisdiction over all persons subject to this chapter. The exercise of jurisdiction by one armed force over personnel of another armed force shall be in accordance with regulations prescribed by the President.
(b) In all cases, departmental review after that by the officer with authority to convene a general court-martial for the command which held the trial, where that review is required under this chapter, shall be carried out by the department that includes the armed force of which the accused is a member.

"*Stargazer* is a specially modified Lockheed Martin L-1011 TriStar jumbo jet that's based at Meadows Field in Bakersfield," stated Jim Spellman, executive director for the National Space Society's Western Spaceport Chapter in Kern, Santa Barbara and San Luis Obispo county.
"It was named by OSC team members in honor of the first 'starship' commanded by fictional character Captain Jean-Luc Picard from the *Star Trek: The Next Generation* television series," Spellman added. The aircraft serves as the "first stage" by carrying the Pegasus XL rocket up to its 40,000 foot release point over the Pacific Ocean near Vandenberg AFB in Santa Barbara county.

SPECIAL Prosecutor Patrick Fitzgerald has informed White House political strategist Karl Rove that he won't seek criminal charges against him. The news is good for the administration - and for Rove. As politicians and associates of crooked lobbyist Jack Abramoff are being charged or pleading guilty left and right, Rove is one of the few people in Washington who can say with certainty that he is not about to be indicted.
The contrasting examples of Rove and former vice presidential chief of staff I. Lewis "Scooter" Libby confirm the Washington truism that it is not what you do but the effort to cover it up that leads to downfall. Like Libby, Rove leaked the identity of CIA agent Valerie Plame to the press. Unlike Rove, Libby stands accused of lying about the incident to federal investigators.
Rove was sufficiently straightforward with FBI agents and the grand jury, before which he appeared five times, to avoid criminal liability. But he deliberately misled President Bush and the public by repeatedly and falsely denying his involvement in the leaking of Plame's occupation.
Rove and Libby both assured White House press secretary Scott McLellan that they had nothing to do with the leaks, though it turned out that Rove and Libby had everything to do with them. McClellan's loss of credibility helped to drive him from the White House, while Rove remains at the president's side.
Plame, no longer at the CIA, is married to former diplomat and administration critic Joseph Wilson. Rove and Libby leaked her identity to the press in an attempt to discredit Wilson, who had challenged the White House line that Saddam Hussein was seeking African uranium. In doing so, Rove and Libby had no compunction about ruining the career of a valued expert on nuclear proliferation, the most dangerous threat to national security.
Now that Rove has been cleared of criminal liability after a three-year investigation, he is free to concentrate on crafting Republican strategy for the midterm congressional elections in November. If he is successful, he will have supplied fresh evidence that politics is no longer a place for people with a highly refined sense of honor or healthy regard for the truth, and that nice guys finish somewhere between second and last.

WASHINGTON - Cleared of any allegations of criminal wrongdoing in the leak of a CIA agent's identity, White House political strategist Karl Rove is free to take an aggressive role in this year's election campaigns, officials said Tuesday, but Democrats will continue to criticize him over the case.
"It's a chapter that has ended," President Bush told reporters as he returned to Washington from Baghdad, Iraq.
Rove attorney Robert Luskin said Tuesday that he learned from special prosecutor Patrick Fitzgerald that no indictment will be sought against Rove in the case.
Rove, who recently had his policy duties at the White House scaled back, had no direct comment and was "relieved and elated and gratified for the support he has gotten," White House spokesman Mark Corallo said.
Democrats said their rhetoric about Rove, whom Bush has called the architect of his 2004 re-election campaign, is unchanged.
"His biggest accomplishment to date has been staying out of jail," Democratic Congressional Campaign Committee spokesman Bill Burton said.
Rove, formerly based in Austin, helped launch Bush's political career and was a close adviser for both presidential campaigns as well for Republican congressional campaigns.
Fitzgerald's decision was seen as an important boost to the GOP's political fortunes, which have been declining along with Bush's popularity.
"It is a huge political plus for Republicans to go from having their major strategist facing jail time to having his mind freed up to concentrate on the elections," said Marshall Wittmann, an analyst with the Democratic Leadership Council, which represents centrists in the party.
Rove had faced the prospect of resigning in disgrace if indicted, Wittmann said. Now he will be the designer of Republican's efforts to avoid election setbacks in November.
"Every Democrat was looking forward to seeing Karl Rove frog-marched to jail, and instead he is marching over to Republican headquarters," Wittman said.
On Monday night, shortly after learning from Fitzgerald's office that he was not in legal jeopardy, Rove gave a rousing speech to a GOP group in New Hampshire, saying Republicans "were absolutely right" in deposing Saddam Hussein and accusing Democrats of wanting to "cut and run." He made no reference to his legal situation.
Fitzgerald's spokesman declined to discuss the latest turn in the investigation. The 30-month probe into the disclosure of former CIA agent Valerie Plame's identity has yielded charges only against I. Lewis "Scooter" Libby, a top aide to Vice President Dick Cheney accused of lying to federal investigators.
Plame's identity was leaked to the press while she was still with the agency in the summer of 2003. Plame is the wife of Joseph Wilson, a former diplomat who in 2003 published an account of a trip he took to Africa for the CIA.
He said the Bush administration had charged that Saddam sought to buy nuclear weapons material in Niger even though Wilson had found no evidence to support the claim. Soon afterward, columnist Robert Novak published Plame's name, provoking calls for an investigation into whether that leak was an illegal effort to smear Plame and Wilson.
Rove appeared five times before a federal grand jury impaneled by Fitzgerald. He admitted talking to Novak about the fact that Wilson was married to a CIA officer.
He initially did not mention a second conversation with a reporter, Time magazine's Matt Cooper.
Fitzgerald had been investigating whether the omission was an intentional attempt to obstruct a federal investigation. Rove's attorney has said Rove simply forgot the conversation with Cooper.
Lawyers involved in the case said Rove could be called as a witness in Libby's case and could be sued in civil court by Plame and Wilson.

This happened, for example during the prosecution of the so-called "Labour Peasant Party", a party invented by NKVD, which, in particular, assigned the notable economist Alexander Chayanov to it.
The first solid public evidence of what really happened during the Moscow Trials came to the West through the Dewey Commission. After the collapse of the Soviet Union, more information became available. This discredited Walter Duranty, who claimed that these trials were actually fair.
Eastern Bloc party show trials
Following some dissent within ruling communist parties throughout the Eastern Bloc, especially after the 1948 Tito-Stalin split, several party purges occurred, with several hundred thousand members purged in several countries. In addition to rank-and-file member purges, prominent communists were purged, with some subjected to public show trials. These were more likely to be instigated, and sometimes orchestrated, by the Kremlin or even Stalin himself, as he had done in the earlier Moscow Trials.

Cop was shot once before; suspect held

Renton police Officer Larry Strauss can consider himself lucky. Then again, maybe he's unlucky.
On Sunday, for the second time in his 20-year career, Strauss was shot in the line of duty. Police officials can't recall a single other Washington case in which an officer endured multiple shootings.
After the first shooting, in 1991, Strauss was awarded a Medal of Valor, becoming the only Renton police officer to earn that honor.
Strauss, 49, was listed in serious condition Monday afternoon in the intensive-care unit of Seattle's Harborview Medical Center, suffering from a bullet wound in his neck.
"I believe he is doing as well as can be expected under the circumstances," said Penny Bartley, spokeswoman for the Renton Police Department.
A suspect was arrested early Monday morning after a nearly seven-hour manhunt.
According to Bartley, Strauss saw a group of men dart across four lanes of traffic on Rainier Avenue around 7:45 p.m. Sunday and get into a van.
Strauss approached the van, which was parked in a strip-mall lot near the Renton Municipal Airport.
Bartley said so far there is no evidence that the men were fleeing a crime scene as they ran across the busy road. Nonetheless, as Strauss approached, one man ran.
According to Bartley, the suspect turned and fired, hitting Strauss in the neck. The officer returned fire and called for help, but by the time backup arrived, the suspect was gone.

The widespread disregard for nuclear weapons safety standards by airmen at Minot and Barksdale Air Force bases led to the unprecedented “Bent Spear” incident in which six nuclear warheads were mistakenly loaded onto a B-52 and flown from North Dakota to Louisiana on Aug. 29-30, Air Force officials said Friday after an intensive six-week investigation.
The Air Force relieved the 5th Munitions Squadron commander at Minot immediately after the incident. On Friday, it announced that three more commanders have been sacked.
Five steps to failure
Using the same briefing presented to Secretary of Defense Robert Gates earlier Friday, Newton summarized the five mistakes made by airmen that led to the incident and offered a timeline of events.
The first mistake occurred at the beginning of an operation to transport 12 Advanced Cruise Missiles on a B-52 Stratofortress bomber from Minot to Barksdale, part of a Defense Department program to decommission 400 of these missiles in the U.S. stockpile.
On the morning of Aug. 29, airmen assigned to the Minot weapons storage area were supposed to pick up and transport two pylons to a B-52 assigned to Barksdale. Each pylon is a self-contained package of six cruise missiles that can be quickly mounted to the wing of a Stratofortress. But the pylon had not been properly prepared, and the airmen failed to examine all the warheads on the missiles mounted to the pylons.

NEW YORK - A B-52 bomber mistakenly armed with live nuclear missiles flew straight across the heartland where millions of Americans live - and the crew had no clue what they were carrying.
An Air Force spokesman insisted "there was never a danger to the American public" and called the missile mishap last Thursday an "isolated incident."
"Air Force standards are very exacting when it comes to munitions handling," Lt. Col. Ed Thomas said. "The weapons were always in our custody."
The B-52 was loaded with cruise missiles carrying nuclear warheads ranging from 5 to 150 kilotons in destructive force, mounted onto pylons on the bomber's wings, according to the Military Times newspaper, which broke the story.
"You can wipe out a good-sized city with a 5-kiloton blast," said Jim Riccio, a nuclear policy analyst for Greenpeace. "A 150-kiloton warhead is 10 times the size of what they dropped on Hiroshima."

Slain deputy had become White Center's "Superman"

Giving up a successful career in law is an unusual route to becoming a beat cop.
But King County Sheriff's Deputy Steve Cox was an unusually idealistic man, say those who knew him. Frustrated with criminals beating the legal system, he left his job as a deputy prosecutor to patrol the streets in White Center, the high-crime neighborhood near where he grew up.
To business owners and residents, he became a "Superman" who was single-handedly making the streets safer and the neighborhood better. He became so deeply involved in community issues that he was elected president of the local council. To his family, he was a man who had found new joy since he and his wife, Maria, adopted a baby, Bronson, who turned 1 in October.
Now the neighborhood is mourning after Cox, 46, was shot and killed early Saturday.
Local bartender Cheryl Moss said Cox did more than anyone else to clean up drug dealing and prostitution: "He was our Superman. And now our Superman's dead."

Sheriff's deputy shot and killed

A 46-year-old King County sheriff's deputy and community activist died today after he was shot while investigating a shooting in White Center.
Deputy Steve Cox, a nine-year veteran of the sheriff's office, was shot in the head during an interview with a suspect and died at Harborview Medical Center around 6 a.m.
Cox was a longtime White Center resident, a former deputy prosecuting attorney, the president of a local community group and the married father of a baby boy.
The incident began around 1:30 a.m., when officers responded to a call reporting gunfire near the intersection of S.W. 106th and 12th Ave S.W. They found the driver of a pick-up beaten and suffering from a non-life threatening gunshot wound.
As part of their investigation, five deputies questioned more than a dozen people at a party at a nearby residence. Cox began interviewing people one by one in the bedroom. Other deputies heard shots from that direction, and headed toward the bedroom, only to be met with a fusillade of gunfire.
At least one of the deputies returned fire. In the bedroom, they found the suspect dead from their gunshots. Cox had been shot in the head by the suspect. He was taken to Harborview and later died.
For the past 3 1/2 years, Cox was assigned to the Sheriff's Office White Center Storefront, patrolling the neighborhood where he lived. He was a committed community activist, the president of the North Highline Unincorporated Area Council.
Before his career with the Sheriff's office, Cox served as a deputy prosecuting attorney in King, Franklin and Adams counties.

Star Trek: First Contact (1996)
Watching again now the DVD for this 1996 film, I have so far gained a sense of awareness of three new ideas about different element so the film and one is the scene that follows the dialog referenced below. I find myself wondering if that scene of outer space as the "Enterprise" is in orbit of the Earth in its past, but our future relative to this present time, is supposed to represent a satellite view of the Hurricane Hugo just before it made landfall near the Charleston Naval Station in Charleston South Carolina. The only image I can find, since stopping the DVD to examine closer that notion, has some comparable details to the scene, but then there is also a distinct difference on the western edges of both images. But then yet I think about how the images are close, using my imagination, and I wonder if such an appearance was present, for instance, two days before that image, although that is probably too far back. Could such an appearance have existed
twelve hours before the time of that actual image of the storm? I, Tom Reagan, would have certainly been keeping a close watch over that storm, with everything considered that I have described recently, and I would have had personal access to the resources to make such observations.

Did I not note that incident about Kerry Burgess being shot in the shoulder by gunfire from a fugitive in 1993? I can't find it in my journal. I could have sworn I recorded those thoughts. I thought it over extensively several weeks ago.

I guess not. I could have sworn that I wrote about how the scene of Wesley Snipes characters firing a shot at that one US Marshal who is later killed in that 1998 film made me think of that line of thought. I was standing in that lobby and the fugitive came back down the stairwells and I saw his legs and I knew he had a gun but I could not recognize him and we fired about the same time and I killed him while he hit me in the shoulder. I could have sworn I recorded in my journal about being transported out in the ambulance.

Now I just remembered the scene from the recent "NCIS" episode and I think of the similarities of that gunfire scene. But the fugitive was at the top of the stairs and that fugitive hit Kerry Burgess by gunfire but Kerry Burgess killed the fugitive by his return gunfire.
