(B) suppress, in a State, any insurrection, domestic violence, unlawful combination, or conspiracy if such insurrection, violation, combination, or conspiracy results in a condition described in paragraph (2).

(2) A condition described in this paragraph is a condition that—

(A) so hinders the execution of the laws of a State or possession, as applicable, and of the United States within that State or possession, that any part or class of its people is deprived of a right, privilege, immunity, or protection named in the Constitution and secured by law, and the constituted authorities of that State or possession are unable, fail, or refuse to protect that right, privilege, or immunity, or to give that protection; or

(B) opposes or obstructs the execution of the laws of the United States or impedes the course of justice under those laws.

(3) In any situation covered by paragraph (1)(B), the State shall be considered to have denied the equal protection of the laws secured by the Constitution.

Dog's Dna May Be Key In Murder Trial -- Evidence Likely To Set Court Precedent

For the first time in King County - and possibly the country - DNA from a dog may be used as evidence in a murder trial.

King County Superior Court Judge Richard Jones has given preliminary approval for prosecutors to admit DNA blood tests from a pit bull that was shot and killed - along with its two owners - at a South Seattle house in 1996.

Prosecutors say the dog's DNA is crucial to their case.

Except for identical twins, no two people have the same genetic fingerprint that's found in the DNA in every cell of their bodies. Increasingly, courts are using DNA tests in criminal trials as evidence to link defendants to crime scenes

The murder trial of two men accused of fatally shooting a couple and their pit bull began this morning with a prosecutor telling jurors he would take them back in time to the scene of a brutal crime.

"I promise you, it will not be pleasant, but it will be compelling," Senior Deputy Prosecutor Tim Bradshaw said in an opening statement.

The King County Superior Court trial is unusual on several fronts. So violent is defendant Kenneth Leuluaialii - officials say he has attacked jail inmates and guards - that he's being wheeled to and from the courtroom strapped to a low-riding, metal restraining chair.

The case is also believed to be the first time that DNA from a dog is being used as evidence in this country. Prosecutors say the pit bull's blood spattered on jackets both defendants were wearing, placing the men at the scene of the crime.

"The irony will be that the witness who could not speak when he was alive may be the most eloquent witness" of all, Bradshaw said, referring to Chief, the slain dog.

Chief, a pit bull mix, was fatally shot in a barrage of bullets that killed his two owners at their South Park home during a botched drug deal in 1996.

Two suspects were arrested and charged in the slayings. But both pleaded innocent.

Making the case against them could have been exceedingly difficult if - as King County prosecutors allege - Chief's blood had not splattered on one of the suspects, 23-year-old ((age)) Kenneth John Leuluaialii.

Those flecks of blood have set the stage for a murder trial opening today in King County Superior Court, where it is believed that for the first time in the United States, DNA from a dog will be used as evidence in a criminal murder proceeding.

``This would be the first time animal DNA would actually go to trial in a U.S. criminal court case," said Stephen Judd, product manager for PE AgGen, a DNA testing services company that analyzed Chief's blood on a jacket allegedly belonging to Leuluaialii.

Judd said several U.S. courts have accepted DNA evidence from animals, but those cases have not made it to trial because suspects change their tune in the shadow of formidable scientific evidence or their attorneys' rush to cut a deal.


Janet Hightower, Johnson's aunt, said: ``I hope they put these criminals away. The family deserves justice."

They hope DNA will help - and that a dead dog can tell tales.

Judd, whose company has done work for the Royal Canadian Mounted Police and the FBI, said DNA technology has evolved to pinpoint accuracy.

He said there are 52 million dogs in the United States and that DNA testing can distinguish one dog in 100 million.

He said that attorneys trying to attack DNA testing in court usually focus on the ``chain of custody" of the DNA sample. ``They focus on where the sample came from, who collected it and how did it get to the laboratory," he said.

During pretrial hearings, Leuluaialii has been brought to the courtroom strapped in a special security chair because of his violent acts in jail and court.

During a pretrial hearing last winter, Leuluaialii overturned the defense table and spit at the judge. He also has fought with corrections officers in the jail.

The jury hearing the trial was seated late yesterday afternoon. Opening statements are scheduled for this morning.

Chief, a pit bull mix, was fatally shot in a barrage of bullets that killed his two owners at their South Park home during a botched drug deal in 1996.

Two suspects were arrested and charged in the slayings. But both pleaded innocent.

Making the case against them could have been exceedingly difficult if - as King County prosecutors allege - Chief's blood had not splattered on one of the suspects, 23-year-old ((age)) Kenneth John Leuluaialii.

Those flecks of blood have set the stage for a murder trial opening today in King County Superior Court, where it is believed that for the first time in the United States, DNA from a dog will be used as evidence in a criminal murder proceeding.

``This would be the first time animal DNA would actually go to trial in a U.S. criminal court case," said Stephen Judd, product manager for PE AgGen, a DNA testing services company that analyzed Chief's blood on a jacket allegedly belonging to Leuluaialii.

Judd said several U.S. courts have accepted DNA evidence from animals, but those cases have not made it to trial because suspects change their tune in the shadow of formidable scientific evidence or their attorneys' rush to cut a deal.


Janet Hightower, Johnson's aunt, said: ``I hope they put these criminals away. The family deserves justice."

They hope DNA will help - and that a dead dog can tell tales.

Judd, whose company has done work for the Royal Canadian Mounted Police and the FBI, said DNA technology has evolved to pinpoint accuracy.

He said there are 52 million dogs in the United States and that DNA testing can distinguish one dog in 100 million.

He said that attorneys trying to attack DNA testing in court usually focus on the ``chain of custody" of the DNA sample. ``They focus on where the sample came from, who collected it and how did it get to the laboratory," he said.

During pretrial hearings, Leuluaialii has been brought to the courtroom strapped in a special security chair because of his violent acts in jail and court.

During a pretrial hearing last winter, Leuluaialii overturned the defense table and spit at the judge. He also has fought with corrections officers in the jail.

The jury hearing the trial was seated late yesterday afternoon. Opening statements are scheduled for this morning.

SEATTLE - A genetic sample from puppy blood is part of a complex web of evidence that proves two men killed the dog's owners, a prosecutor said yesterday in closing arguments in a King County Superior Court case.

The trial of Kenneth Leuluaialii and George Tuilefano, which began July 9, is believed to be the first time animal DNA has been introduced as evidence in criminal proceedings in the United States.

Prosecutors contend blood from the dog, Chief, a Labrador-pit bull mix, was found on clothing worn by the defendants. The two men, both 24, are accused in the Dec. 9, 1996, shooting deaths of Jay Johnson, 22, and Raquel Rivera, 20, in their home.

Prosecutors have said Johnson and Rivera were killed in a fruitless search for cash and marijuana and that there was a dispute over ownership of the dog.

Testimony showed Rivera was shot with a gun placed in her mouth and that Johnson was shot once in one leg and twice in the other before being killed with two shots to the abdomen. The dog also was killed.

Man Sentenced In `Dog Dna' Case

SEATTLE - The second of two men convicted in what is believed to have been the first criminal case to use DNA from a dog as evidence was sentenced yesterday to 26 years, eight months in prison by King County Superior Court Judge Richard Jones.

George Tuilefano, 25, was found guilty of two counts of first-degree murder in September in the deaths of a South Park couple and their dog in December 1996.

Kenneth Leuluaialii, 23, a co-defendant, was sentenced in October to two life sentences without the possibility of parole.

Tuilefano and Leuluaialii were convicted for the deaths of Raquel Rivera and Jay Johnson, both 22, who were shot and killed inside their home on Dec. 9, 1996.

DNA taken from the dog helped identify both men as the killers.

Court disallows use of dog DNA

SEATTLE — The state Court of Appeals ruled yesterday that animal DNA cannot be presented as evidence in a murder trial in the same way that human DNA evidence can be used. Nevertheless, the court upheld the convictions of two men accused of killing a South Park couple and their dog eight years ago.

In what was believed to have been the first criminal case involving dog DNA, prosecutors presented evidence of blood from a dog found on clothing worn by defendants George Tuilefano and Kenneth Leuluaialii.

The two were convicted in 1998 for the 1996 deaths of Raquel Rivera and Jay Johnson, both 22. The couple's dog, Chief, had also been slain.

The appeals court ruled that while there was clear and sufficient evidence of the men's guilt, the science of animal DNA is not as advanced or reliable as the science of human DNA. Therefore the trial court should not have allowed testimony about a match between the canine blood sample and a specific dog, the court said.

The court also found Tuilefano should not have been given the exceptionally light sentence of 26 years in prison. The court will return the case to King County Superior Court, where Tuilefano will be resentenced. Leuluaialii's sentence of two life terms without the possibility of parole will stand.

Court disallows use of dog DNA

SEATTLE — The state Court of Appeals ruled yesterday that animal DNA cannot be presented as evidence in a murder trial in the same way that human DNA evidence can be used. Nevertheless, the court upheld the convictions of two men accused of killing a South Park couple and their dog eight years ago.

In what was believed to have been the first criminal case involving dog DNA, prosecutors presented evidence of blood from a dog found on clothing worn by defendants George Tuilefano and Kenneth Leuluaialii.

The two were convicted in 1998 for the 1996 deaths of Raquel Rivera and Jay Johnson, both 22. The couple's dog, Chief, had also been slain.

The appeals court ruled that while there was clear and sufficient evidence of the men's guilt, the science of animal DNA is not as advanced or reliable as the science of human DNA. Therefore the trial court should not have allowed testimony about a match between the canine blood sample and a specific dog, the court said.

The court also found Tuilefano should not have been given the exceptionally light sentence of 26 years in prison. The court will return the case to King County Superior Court, where Tuilefano will be resentenced. Leuluaialii's sentence of two life terms without the possibility of parole will stand.

Survivor: Borneo was the first season of the United States reality show Survivor. It was originally broadcast under the name Survivor but its official title has been changed to Survivor: Borneo to distinguish it from subsequent installments of the series. Before the change to Survivor: Borneo, the season was known universally as Survivor: Pulau Tiga, but it was changed again to its present title to avoid confusion with the tenth season, Survivor: Palau. The show began filming on March 31, 2000 and ended on April 20, 2000. It aired later that year on CBS. It was set in the South China Sea on the remote Malaysian island of Pulau Tiga in the state of Sabah, about 6 miles (9.7 km) off the north coast of Borneo, Malaysia. The sixteen contestants were initially separated into two tribes, named Tagi and Pagong, which represented the name of their beaches. When ten players remained, the contestants merged into one tribe, named Rattana. While Tagi and Pagong's names and makeups were picked by the producers, Rattana was named by contestants Sean Kenniff and Jenna Lewis, because of the large amounts of Rattan wood on the island. After 39 days of competition, corporate trainer Richard Hatch was named the Sole Survivor, defeating whitewater rafting guide Kelly Wiglesworth in a 4–3 jury vote. In 2006, it was revealed that Hatch failed to declare his winnings, among other earnings, in his tax return and was sentenced to 51 months imprisonment.

SEATTLE - A genetic sample from puppy blood is part of a complex web of evidence that proves two men killed the dog's owners, a prosecutor said yesterday in closing arguments in a King County Superior Court case.

The trial of Kenneth Leuluaialii and George Tuilefano, which began July 9, is believed to be the first time animal DNA has been introduced as evidence in criminal proceedings in the United States.

Prosecutors contend blood from the dog, Chief, a Labrador-pit bull mix, was found on clothing worn by the defendants. The two men, both 24, are accused in the Dec. 9, 1996, shooting deaths of Jay Johnson, 22, and Raquel Rivera, 20, in their home.

Prosecutors have said Johnson and Rivera were killed in a fruitless search for cash and marijuana and that there was a dispute over ownership of the dog.

Testimony showed Rivera was shot with a gun placed in her mouth and that Johnson was shot once in one leg and twice in the other before being killed with two shots to the abdomen. The dog also was killed.

Double-Murder Trial Involving Labrador's Dna Nears End

SEATTLE - A genetic sample from puppy blood is part of a complex web of evidence that proves two men killed the dog's owners, a prosecutor said yesterday in closing arguments in a King County Superior Court case.

The trial of Kenneth Leuluaialii and George Tuilefano, which began July 9, is believed to be the first time animal DNA has been introduced as evidence in criminal proceedings in the United States.

Prosecutors contend blood from the dog, Chief, a Labrador-pit bull mix, was found on clothing worn by the defendants. The two men, both 24, are accused in the Dec. 9, 1996, shooting deaths of Jay Johnson, 22, and Raquel Rivera, 20, in their home.

Prosecutors have said Johnson and Rivera were killed in a fruitless search for cash and marijuana and that there was a dispute over ownership of the dog.

Testimony showed Rivera was shot with a gun placed in her mouth and that Johnson was shot once in one leg and twice in the other before being killed with two shots to the abdomen. The dog also was killed.

Ridgway lawyer asks to double his team

One of four attorneys assigned to defend Gary Leon Ridgway in four Green River serial killings wants to double the number of defense attorneys and add more private investigators.

If the defense team isn't increased, Tony Savage said after a King County Superior Court hearing yesterday, there's no hope of Ridgway getting his constitutionally guaranteed speedy trial.

That being said, Savage noted that it may be many years before Ridgway comes before a jury.

Ridgway, an Auburn truck painter, has been charged with murdering four women whose deaths in the early 1980s have long been attributed to the Green River killer.



Savage predicted it would take two years to wade through the documents, which include police reports, old search warrants and investigation notes.

More documents are being generated as King County sheriff's deputies continue to investigate Ridgway in the other 45 deaths attributed to the Green River killer.


Earlier yesterday, Savage and his three co-counsels met with Jeff Baird and Patricia Eakes, senior deputy prosecutors, and Superior Court Judge Richard Jones to set up monthly conferences in the case.

Ridgway lawyer asks to double his team

Seattle Times staff reporter

One of four attorneys assigned to defend Gary Leon Ridgway in four Green River serial killings wants to double the number of defense attorneys and add more private investigators.

If the defense team isn't increased, Tony Savage said after a King County Superior Court hearing yesterday, there's no hope of Ridgway getting his constitutionally guaranteed speedy trial.

That being said, Savage noted that it may be many years before Ridgway comes before a jury.

Ridgway, an Auburn truck painter, has been charged with murdering four women whose deaths in the early 1980s have long been attributed to the Green River killer.



Savage predicted it would take two years to wade through the documents, which include police reports, old search warrants and investigation notes.

More documents are being generated as King County sheriff's deputies continue to investigate Ridgway in the other 45 deaths attributed to the Green River killer.


Earlier yesterday, Savage and his three co-counsels met with Jeff Baird and Patricia Eakes, senior deputy prosecutors, and Superior Court Judge Richard Jones to set up monthly conferences in the case.

Criminal conversion

Criminal conversion, in criminal law, is usually defined as the crime of exerting unauthorized use or control of someone else's property. It differs from theft in that it does not include the element of intending to deprive the owner of the possession of that property. As such, it is a lesser included offense of the crime of theft.

Bat*21

Bat*21 is a 1988 movie directed by Peter Markle, and adapted from the book by William Charles Anderson. Set during the Vietnam War, the film is based on the true, costly, and controversial rescue of a U.S. navigator officer whose Douglas EB-66 electronics aircraft is hit by a SAM.

The film stars Gene Hackman as Lt. Colonel Iceal E. "Gene" Hambleton, the downed navigator (EWO) officer, and Danny Glover as Captain Bartholomew Clark, a FAC pilot who flies a Cessna Skymaster. The film is based on the real-life rescue of Lt. Col. Hambleton by U.S. Navy SEAL Thomas R. Norris and team member Nguyen Van Kiet, a South Vietnamese SEAL.

Ridgway lawyer asks to double his team

One of four attorneys assigned to defend Gary Leon Ridgway in four Green River serial killings wants to double the number of defense attorneys and add more private investigators.

If the defense team isn't increased, Tony Savage said after a King County Superior Court hearing yesterday, there's no hope of Ridgway getting his constitutionally guaranteed speedy trial.

That being said, Savage noted that it may be many years before Ridgway comes before a jury.

Ridgway, an Auburn truck painter, has been charged with murdering four women whose deaths in the early 1980s have long been attributed to the Green River killer.



Savage predicted it would take two years to wade through the documents, which include police reports, old search warrants and investigation notes.

More documents are being generated as King County sheriff's deputies continue to investigate Ridgway in the other 45 deaths attributed to the Green River killer.


Earlier yesterday, Savage and his three co-counsels met with Jeff Baird and Patricia Eakes, senior deputy prosecutors, and Superior Court Judge Richard Jones to set up monthly conferences in the case.

Dog's Dna May Be Key In Murder Trial -- Evidence Likely To Set Court Precedent

For the first time in King County - and possibly the country - DNA from a dog may be used as evidence in a murder trial.

King County Superior Court Judge Richard Jones has given preliminary approval for prosecutors to admit DNA blood tests from a pit bull that was shot and killed - along with its two owners - at a South Seattle house in 1996.

Prosecutors say the dog's DNA is crucial to their case.

Except for identical twins, no two people have the same genetic fingerprint that's found in the DNA in every cell of their bodies. Increasingly, courts are using DNA tests in criminal trials as evidence to link defendants to crime scenes

Defendant Enters Court In Restraints -- Dog Dna May Be Evidence In Trial Of Combative Suspect

The murder trial of two men accused of fatally shooting a couple and their pit bull began this morning with a prosecutor telling jurors he would take them back in time to the scene of a brutal crime.

"I promise you, it will not be pleasant, but it will be compelling," Senior Deputy Prosecutor Tim Bradshaw said in an opening statement.

The King County Superior Court trial is unusual on several fronts. So violent is defendant Kenneth Leuluaialii - officials say he has attacked jail inmates and guards - that he's being wheeled to and from the courtroom strapped to a low-riding, metal restraining chair.

The case is also believed to be the first time that DNA from a dog is being used as evidence in this country. Prosecutors say the pit bull's blood spattered on jackets both defendants were wearing, placing the men at the scene of the crime.

"The irony will be that the witness who could not speak when he was alive may be the most eloquent witness" of all, Bradshaw said, referring to Chief, the slain dog.

LOS ANGELES -- Former football star O.J. Simpson was ordered to stand trial Friday in the murders of his ex-wife and her friend after Simpson's own blood emerged as perhaps the most damning piece of evidence against him.

The man whose athletic prowess and good looks made him a sports hero, television commentator and actor now faces the specter of a lengthy murder trial and if convicted, possibly the death penalty.

Municipal Court Judge Kathleen Kennedy-Powell ruled that Simpson, who turns 47 today, be held without bail. Arraignment was set for July 22 in Superior Court, and he could stand trial in as little as 60 days.

"The court feels there is ample evidence to establish strong suspicions of the guilt of the accused," Kennedy-Powell said. In the six-day hearing, the prosecution was required only to show probable cause and not guilt.

Lance Ito

Lance Allan Ito (born August 2, 1950 in Los Angeles, California) is an American Los Angeles County Superior Court judge, best known for his presiding role during the O. J. Simpson murder trial.


Ito became familiar to American television viewers when he presided over the 1995 murder trial of O.J. Simpson at which Simpson was acquitted.

Some judges[who?] disliked Ito's handling of the Simpson case because they felt he allowed his courtroom to be turned into part of the media circus to the point where Ito would invite attorneys and courtroom staff into his chambers to watch the previous night's Jay Leno footage; however, Ito and others present in the courtroom[who?] dispute this characterization, challenging critics to identify a proceeding that was not under control. Because the jury was sequestered, an attorney gag order would not have been supported by any appellate court, leading to often chaotic scenes outside the courthouse. Ito allowed a jury field trip through O.J. jury was handled, bowing to defense team pressure to dismiss juror Francine Florio-Bunten late in the trial. Lance Ito

Lance Allan Ito (born August 2, 1950 in Los Angeles, California) is an American Los Angeles County Superior Court judge, best known for his presiding role during the O. J. Simpson murder trial.


Ito became familiar to American television viewers when he presided over the 1995 murder trial of O.J. Simpson at which Simpson was acquitted.

Some judges[who?] disliked Ito's handling of the Simpson case because they felt he allowed his courtroom to be turned into part of the media circus to the point where Ito would invite attorneys and courtroom staff into his chambers to watch the previous night's Jay Leno footage; however, Ito and others present in the courtroom[who?] dispute this characterization, challenging critics to identify a proceeding that was not under control. Because the jury was sequestered, an attorney gag order would not have been supported by any appellate court, leading to often chaotic scenes outside the courthouse. Ito allowed a jury field trip through O.J. Simpson's home after it had been stage dressed by the defense team, in one case replacing an artistic nude painting of Simpson's girlfriend with a reproduction of Norman Rockwell's painting of Ruby Bridges being escorted to school in the Little Rock desegregation struggle. Ito was also criticized for the way that the
jury was handled, bowing to defense team pressure to dismiss juror Francine Florio-Bunten late in the trial. Outrage by Vincent Bugliosi illustrates a broad range of judicial incompetence attributed to Ito. For his part Judge Ito notes that his demeanor in his trials was a result of the Japanese way of shikata ga nai, or "it can't be helped".

Dog's Dna May Be Key In Murder Trial -- Evidence Likely To Set Court Precedent

For the first time in King County - and possibly the country - DNA from a dog may be used as evidence in a murder trial.

King County Superior Court Judge Richard Jones has given preliminary approval for prosecutors to admit DNA blood tests from a pit bull that was shot and killed - along with its two owners - at a South Seattle house in 1996.

Prosecutors say the dog's DNA is crucial to their case.

Except for identical twins, no two people have the same genetic fingerprint that's found in the DNA in every cell of their bodies. Increasingly, courts are using DNA tests in criminal trials as evidence to link defendants to crime scenes

Defendant Enters Court In Restraints -- Dog Dna May Be Evidence In Trial Of Combative Suspect

The murder trial of two men accused of fatally shooting a couple and their pit bull began this morning with a prosecutor telling jurors he would take them back in time to the scene of a brutal crime.

"I promise you, it will not be pleasant, but it will be compelling," Senior Deputy Prosecutor Tim Bradshaw said in an opening statement.

The King County Superior Court trial is unusual on several fronts. So violent is defendant Kenneth Leuluaialii - officials say he has attacked jail inmates and guards - that he's being wheeled to and from the courtroom strapped to a low-riding, metal restraining chair.

The case is also believed to be the first time that DNA from a dog is being used as evidence in this country. Prosecutors say the pit bull's blood spattered on jackets both defendants were wearing, placing the men at the scene of the crime.

"The irony will be that the witness who could not speak when he was alive may be the most eloquent witness" of all, Bradshaw said, referring to Chief, the slain dog.
