'Copyright infringement' (or copyright violation) is the unauthorized use of material that is covered by copyright law, in a manner that violates one of the copyright owner's exclusive rights, such as the right to reproduce or perform the copyrighted work, or to make derivative works.
First element: establishing ownership of a valid copyright
A plaintiff establishes ownership by authorship (by the plaintiff itself or by one who assigned rights to the plaintiff) of (1) an original work of authorship that is (2) fixed in a tangible medium (e.g. a book or musical recording). Registration is not required for copyright itself, but in most cases is a jurisdictional requirement to bring the suit. Registration is also useful because it gives rise to the presumption of a valid copyright, and eliminates the innocent infringement defense, and (if timely made) it allows the plaintiff to elect statutory damages, and be eligible for a possible award of attorney fees.
Works that are not sufficiently original, or which constitute facts, a method or process cannot enjoy copy protection.. U.S. Courts do not recognize the "sweat of the brow" doctrine, which originally allowed protection for those who labored to collect and organize facts. To combat this, business which assemble databases of information have relied on contract law where copyright law offers no protection. For a work to be original, it must possess a "modicum of creativity", which is a "low threshold" although some creativity must exist.
Copyright protects the fixed expression of ideas, but not the ideas themselves. (Ideas are protected by patents). Nevertheless, an expression must exist in a fixed tangible medium. A movie script writer who discusses a plot idea which has not yet been written would not be protected if another heard his idea and wrote a screenplay himself. Whether RAM constitutes a "fixed medium" is a contentious issue in copyright litigation because of the transitory nature of RAM.
Second element: establishing actual copying
A plaintiff establishes actual copying with direct or indirect evidence. Direct evidence is satisfied either by a defendant's admission to copying or the testimony of witnesses who observed the defendant in the act. More commonly, a plaintiff relies on circumstantial or indirect evidence. A court will infer copying by a showing of a "striking similarity" between the copyrighted work and the alleged copy, along with a showing of both access and use of that access. A plaintiff may establish access by proof of distribution over a large geographical area, or by eyewitness testimony that the defendant owned a copy of the protected work. Access alone is not sufficient to establish infringement. The plaintiff must show a similarity between the two works, and the degree of similarity will affect the probability that illicit copying in fact occurred in the court's eyes. Even then, the plaintiff must show that the copying amounted to improper appropriation.
Indeed, the US Supreme Court has held that not all copying constitutes infringement and a showing of misappropriation is necessary.
Third element: establishing misappropriation
A copyrighted work may contain elements which are not copyrightable, such as facts, ideas, themes, or content in the public domain. A plaintiff alleging misappropriation must first demonstrate that what the defendant appropriated from the copyrighted work was protectible. Second, a plaintiff must show that the intended audience will recognize substantial similarities between the two works. The intended audience may be the general public, or a specialized field. The degree of similarity necessary for a court to find misappropriation is not easily defined. Indeed, "the test for infringement of a copyright is of necessity vague." Two methods are used to determine if unlawful appropriation has occurred: the subtractive method and the totality method.
The subtractive method, also known as the "abstraction/subtraction approach" seeks to analyze what parts of a copyrighted work are protectible and which are not. The unprotected elements are subtracted and the fact finder then determines whether substantial similarities exist in the protectible expression which remains. For instance, if the copyright holder for West Side Story alleged infringement, the elements of that musical borrowed from Romeo and Juliet would be subtracted before comparing it to the allegedly infringing work because Romeo and Juliet exists in the public domain.
The totality method, also known as the "total concept and feel" approach takes the work as a whole with all elements included when determining if a substantial similarity exists. The individual elements of the alleged infringing work may by themselves be substantially different from their corresponding part in the copyrighted work, but nevertheless taken together be a clear misappropriation of copyrightable material.

John Ogonowski
John A. Ogonowski (February 24, 1949 – September 11, 2001) was a pilot and an agricultural activist. A resident of Dracut, Massachusetts, Ogonowski was a leading figure on behalf of farming in Massachusetts, particularly for immigrant farmers from Cambodia, whom he assisted as part of the New Entry Sustainable Farming Project.
He was a pilot in the U. S. Air Force for seven years. From 1978 to the end of his life, Ogonowski flew airplanes for American Airlines. He died on September 11, 2001, when the airplane he was flying, American Airlines Flight 11 was hijacked and crashed into the World Trade Center.
It is believed that he was stabbed to death before the plane had crashed into the North Tower of the World Trade Center. Before dying, he managed to engage the aircraft's radio system to allow air traffic control to listen to the terrorists' conversations in the aircraft's cabin.

Protection racket
A protection racket is an extortion scheme whereby a powerful entity or individual coerces other less powerful entities or individuals to pay protection money which allegedly serves to purchase "protection" services against various external threats.
Those who do not buy into the protection plan are often targeted by criminals existing inside or outside of the organization. These crimes are typically thought to originate from the organization itself. When a business refuses to pay for protection, word is put out that they are outside of the local organization's protection (these organizations often exist in the absence of a trusted police force) and that the business in question is therefore free game for freelance criminals or the organization itself.
The protection money is typically collected by a "bag man". Although the organization might be particularly coercive in obtaining protection money, it is usually careful to shelter its "mark" from attacks by competitor organizations that similarly attempt to solicit or threaten the targeted individuals or businesses. Disputes between organizations concerning territory consequently arise from two competing predators attempting to extort from the same "clients."

Drop Dead Fred is a 1991 comedy film released by New Line Cinema. and directed by Ate de Jong. Elizabeth "Lizzie" Cronin (Phoebe Cates) is a repressed young woman (with "wallflower" tendencies) who lets others walk all over her. One day she loses her money, her car, her job, and her husband within the same lunch hour. Following this turn of events, Lizzie's domineering mother Polly (Marsha Mason) forces her to return and live in her childhood home.
Returning to her old bedroom, Lizzie finds a jack-in-the-box in the cupboard. She opens it and releases Drop Dead Fred (Rik Mayall): her imaginary friend from childhood, whom only Lizzie can see. Through a series of flashbacks it is revealed that as a child, Lizzie was tormented by the overbearing Polly, who drove away Lizzie's father Nigel. It was Fred alone who made Lizzie happy and gave her an outlet for her frustrations, though Fred was a troublemaker who wreaked havoc wherever he went, always shifting the blame to Lizzie for his tricks. Fred was eventually sealed in the jack-in-the-box by Polly. Upon being released by an adult Lizzie, he is disappointed that she has grown up and lost her zest for life.
Fred promises to make Lizzie happy again. She says that will happen only if she is reunited with her husband Charles (Tim Matheson), who cheats on her. Fred helps out as only he can, which gets Lizzie into even more trouble with her friends, and with Polly. Then Lizzie is reunited with her childhood crush Mickey Bunce (Ron Eldard), who is now a recently-divorced single parent. Although Mickey would love to resume his friendship with Lizzie, she is bent on saving her marriage to Charles.
Lizzie has a "makeover" at the behest of Polly. With this new look, Lizzie woos back her husband. She also lets Polly take her to a psychiatrist (Alycia Lutz), who prescribes drugs which will rid Lizzie of Fred. Just before Lizzie takes the last of these pills, she learns that Charles is still cheating on her. Heartbroken, Lizzie turns back to Fred.
In a dream sequence, Fred helps Lizzie face the two demons of her life: Charles and Polly. In her old room, Lizzie finds her childhood self strapped to her bed. Lizzie unstraps her young self and, in the process, frees her present adult self. Fred tells the reluctant Lizzie that, after all these years, she no longer needs him. He kisses her goodbye and disappears.
Lizzie returns to the real world and dumps Charles for good. Then she collects her belongings from Polly's house, including Fred's jack-in-the-box. Lizzie tells her mother how she feels about the way Polly has always treated her. Lizzie also tells Polly what she thinks of how Polly treated Nigel...who, as a result, finally walked out on them despite his love for Lizzie. Now it's Lizzie's turn to walk out on her mother, which leaves Polly well and truly alone.
Lizzie goes to Mickey and makes peace with him. She also hits it off with his daughter, whom Mickey explains is quite a handful. As they approach Mickey's house, his daughter nearly runs into them. Mickey's live-in nanny claims the "young lady" has made a terrible mess, which the girl blames on Drop Dead Fred. Lizzie realizes that Fred has not truly gone; he is now the imaginary friend of Mickey's daughter.

Opportunity Rover Begins Standing Up
NASA's Opportunity rover has untucked its front wheels and latched its suspension system in place - key steps in preparing to drive off its lander and onto Martian soil. Opportunity has also begun using its infrared sensing instrument to detect the composition of rocks and soils from its current, stationary position. This information will help scientists determine which targets of interest should be examined when the rover begins moving. Meanwhile, halfway around Mars, Opportunity's twin, Spirit, continues on the mend from a computer memory problem that struck it a week ago.
With both Spirit and Opportunity now on Mars, researchers with NASA's Mars Exploration Rover mission can now begin to search for clues about the history of water on Mars. Because life as we know it requires water to survive, understanding the history of water on Mars can tell scientists a great deal about the potential for past or present life on the Red Planet.

Thank you all very much. And Secretary Weinberger, Chairman Olch, Dean Sanford, members of the graduating class, and ladies and gentlemen, I must tell you before I start how relieved I was when Dean Sanford told me that I was going to walk on after the procession. I thought that I was going to come in with the dean, and with his reputation, I'd been afraid that the good news was that we might perch on the backstage rafters and rappel in— [laughter] —and the bad news, that we'd jump from 10,000 feet. [Laughter] But it's a pleasure to be here to welcome you the graduates of this the West Point and Annapolis and Colorado Springs for physicians into your new profession as military and Public Health Service doctors.
When I hear about the can-do spirit of America's doctors in uniform, it reminds me of a story about a group of marines. I hope those of you in the other services will forgive me for telling this, but the get-it-done spirit applies to all of America's physicians in uniform. These marines had been sent to the Army airborne school for training. And came the day for the first jump, the training officer told them that the planes would come in at 1,500 feet, they would jump from the plane, hit the ground, and move south. The marines seemed a little disturbed by this, and they went into a huddle. Then one of them as a spokesman for the group went to the officer and asked couldn't the plane come in at 500 feet instead of 1,500? And the officer explained that if they took the plane in too low, it wouldn't give them time for the parachutes to open. And he said, "Oh, you mean we're wearing parachutes?" [Laughter]
A quarter century ago, Douglas MacArthur gave his farewell address to the Long Gray Line, the cadets of West Point. He stood in the vast hall of the academy, below the balcony they call the poop deck, and spoke about the soul, not just of the Army but of all the services that you now enter. "The Long Gray Line," he said, "has never failed us. Were you to do so, a million ghosts in olive drab, in brown khaki, in blue and gray would rise from their white crosses thundering those magic words: duty, honor, country."
Duty, honor, country—the motto of West Point. And like the men and women of West Point and all of our military institutions, our physicians in uniform have never failed us. They've been ready when called; ready for hardship and sacrifice, for adventure and exploration; ready to extend the hand of compassion and healing care; ready, if called, to give the last full measure of their devotion. And you now join that company. You now enter the service of your country in one of the world's most honored professions: that of physician.
