AWOL MARINE CHARGED IN DEATHS OF PARENTS, BROTHER

ASHDOWN, ARK. ASHDOWN, Ark. (AP) _ A 21-year-old man who was absent without leave from the Marine Corps has been charged with capital murder in the shooting deaths of his parents and younger brother, whose bodies were found in their fire-gutted home, authorities say.

Marine Cpl. Thomas Dewayne Dinger was arrested about 1:20 a.m. today when he showed up at the house on foot, wearing a backpack and carrying a fishing rod, said Prosecutor Jim Bob Steel.

State police and Little River County deputies were at the house three miles south of Ashdown because members of the Ashdown Volunteer Fire Department had discovered three bodies when they responded to a fire call late Tuesday, Sheriff Dallas Keller said.

The sheriff identified those killed as James Thomas Dinger, 41; his wife, Shirley Dinger, about 40; and their 14-year-old son, Brian Dinger.

According to Keller, Dinger told police his younger brother was shot first, in a bedroom, with a .22-caliber pistol, and then Mrs. Dinger was shot with the pistol. Their bodies were found inside the house.

The sheriff said the senior Dinger was wounded with a shotgun outside the house as he arrived home from work for a painting contractor, and then was shot several times with the pistol.

An empty gasoline can was found atop the 14-year-old's body in the bedroom, the sheriff said, adding the house had apparently been set afire shortly after the elder Dinger was shot.

Steel said Dinger was being held in the county jail at Ashdown, and an arraignment was scheduled today.

Neither Steel nor Keller knew where Dinger had been stationed with the Marine Corps. Officials said he had been AWOL for about 10 days.

Steel said Dinger told authorities he had been planning to leave home yesterday and turn himself in to Marine officials.

''We figure the argument was over him leaving,'' Keller said. ''His daddy said he was going back.''

Now to the WorldCom accounting scandal. It is hitting Americans like a punch in the face. From workers with dwindling 401(k)s and Enron fatigue to the president of the United States. The disclosure that the telecommunications giant falsely reported almost $4 billion in profits is enough alone to generate outrage, and to prompt a slew of investigations.

Adding to the fallout, WorldCom's plan to layoff 17,000 workers by this Friday. And the fact that the company had the same accounting firm as Enron, Arthur Andersen. And perhaps it's no wonder then that Mr. Bush joined the chorus of WorldCom critics, while attending the G- 8 summit in Canada. (BEGIN VIDEO CLIP)

GEORGE W. BUSH, PRESIDENT OF THE UNITED STATES: Today, the revelations that WorldCom has misaccounted $3.4 billion is outrageous. We will fully investigate, and hold people accountable for misleading not only shareholders, but employees as well.

He was not even asked a question about WorldCom today. He raised it himself first and he promised a very thorough federal investigation and he said Americans have every right to be worried about the stock market because he said some companies, and he said relatively few, but some companies are lying about their finances.

WOODRUFF: John, when the president says there is going to be an investigation, what exactly does he mean by that?

KING: Well, the Securities and Exchange Commission already is having an investigation, and Democrats criticize that agency. But the president says the SEC will have a very thorough investigation of WorldCom specifically, and the broader issue of whether accounting rules need to be changed.

And the president suggesting today that the Justice Department will look into this as well.

I have the video paused after the International explodes. That is what they told me happened to Joseph Wayne Burgess. I traveled from South Carolina back to Arkansas and then to Oklahoma for his funeral. I stood there on the deserted country road in Oklahoma where they told me he crashed and then burned to death. I went to the funeral wearing my United States Navy dress blue uniform that summer in August in Oklahoma and I sit there looking at the closed casket for him and then I went to the graveyard when they buried him and I remembered that a few years ago when I found a photo on the internet of that cemetery they buried him at in Noble County Oklahoma at the Morrison Cemetery.

The premiere date of that film is the day after they told me my step-brother had been killed in a car wreck when I was home in Arkansas on leave from the United States Navy.

Standing there on Hicks Road later that day I believed everything they told me about what had happened to him.

I saw his body in the funeral home - when was that? A couple days later? I don't recall.

I thought often about that night and I know I've written before about those memories. I was home on leave from the US Navy. I had completed US Navy Fire Controlman "A" School and I was on leave before attending US Navy Fire Controlman Guided Missile Fire Control Computer Complex School in Virginia. That was November 1986. There was nobody else around there I knew to hang around with. Michael's father, still married to my (suurogate) mother at the time, was the supervisor at the gravel pit in Wilton. Michael had graduated high school in 1985 and he was working at the gravel pit in the nights as the night watchman, thanks to his father. I don't recall if Michael had any real plans for the future. He was always in remedial classes in high school so I doubt college was ever a real plan.

That reminds me of something else I have been thinking about lately. I have been wondering if Denzil was illiterate. That's a real possibility. As best I recall he went to school only through the 4th grade. There was a story I heard often back then about how when he was younger and working at the gravel pit he was seriously injured by electrocution. So I guess he learned how to read those words. I have wondered about that because of something I did when we were all living together on Hicks Road. Denzil raised hunting dogs and I was planning on get my own hunting dog, a breed I cannot now recall, and raise it for hunting. I told Denzil I was going to name it "deeohgee". He came back to later and told me that stupid. Perhaps that was after he relayed to his buddy Ambrus Chauncy about my choice for a name. At some point Ambrus started always calling me "Einstein". Denzil was often calling me "stupid".

So anyway, that night of 24 November 1986 Michael was supposed to be working as nightwatchman at the gravel pit but instead I was riding around with him and I was drinking beer. He drove me out to Oklahoma at least twice that night so I could buy beer, being on leave as I was having just graduated my second school in the US Navy Advanced Electronics Field school curriculum. At one point late at night we were back at the sprawling gravel pit along the river and riding in his pickup truck and he drove far away from the front office, a trailer where the weight scales were recorded, and he tried driving his small pickup truck over a massive sandpile. As I warned and as I knew he should have known, he got the vehicle stuck in the sand. He and I had to walk a long ways back the equipment shed to get one of the heavy equipment vehicles to pull it out. I don't recall how far away that was but I would now guess that was over a mile and maybe two miles. In the dark with only flashlights out there in the middle of nowhere.

And he did that three times that night. Three times he drove onto that sandpile and three times we had to walk back to get the front-end loader or whatever it was, that could tow his pickup truck out of the sand.

On one of those long walks back that night, possibly after midnight passed into 25 November 1986, was when he have me the shotgun shells.

my step-brother who was killed that night in November 1986 when I was back in southern Arkansas on leave from my assignment in the United States Navy. I always think of how I believed everything they showed me about that crash site where they say he died. He had been driving me around in that same pickup truck just within minutes, probably five or ten minutes earlier, before he was killed. He was killed just a mile or two down the road from where I was staying with my mother and his father where I had lived when I was in high school. I knew the stretch of road as if it was in front of our house. I used to go deer hunting and squirrel hunting nearby and I drove by there many times and I walked through there many times and I rode my bicycle through there many times and I walked around there on 25 November 1986 and I listened to who ever was telling me about what was the cause for why he crashed and how he hit his head on the passenger-side door

Appropriateness of Civil Penalties To Be Decided by the Court At a Later Date

Securities and Exchange Commission v. WorldCom, Inc., Civil Action No. 02 CV 4963 (JSR)

The Securities and Exchange Commission announced that a judgment of permanent injunction was entered today in its pending civil enforcement action against WorldCom, Inc. This judgment settles part, but not all, of the Commission's action against WorldCom.

The judgment, signed by U.S. District Judge Jed S. Rakoff of the Southern District of New York: (1) imposes the full injunctive relief sought by the Commission, (2) orders an extensive review of the company's corporate governance systems, policies, plans, and practices, (3) orders an extensive review of the company's internal accounting control structure and policies, (4) orders that WorldCom provide reasonable training and education to certain officers and employees to minimize the possibility of future violations of the federal securities laws, and (5) provides that civil money penalties, if any, will be decided by the Court at a later date. The court reaffirmed the role of its appointed Corporate Monitor and retained jurisdiction for all purposes, including the imposition of further equitable relief and sanctions as may be determined following a hearing. WorldCom consented, without admitting or denying the allegations in the Commission's complaint, to the entry of the judgment.

The Commission's investigation into matters related to WorldCom's financial fraud is continuing.

The Commission's amended complaint alleges that WorldCom misled investors from at least as early as 1999 through the first quarter of 2002, and further states that the company has acknowledged that during that period, as a result of undisclosed and improper accounting, WorldCom materially overstated the income it reported on its financial statements by approximately $9 billion.

The judgment entered today enjoins WorldCom from violating the antifraud provisions of the federal securities laws (specifically, Section 17(a) of the Securities Act of 1933, Section 10(b) of the Securities Exchange Act of 1934 ("Exchange Act"), and Exchange Act Rule 10b-5), the reporting provisions (Section 13(a) of the Exchange Act and Rules 13a-1, 13a-13 and 12b-20 thereunder), and the books and records and internal controls provisions (Sections 13(b)(2)(A) and 13(b)(2)(B) of the Exchange Act).

The judgment further orders that the report currently being prepared by WorldCom's Special Investigative Committee be transmitted to the Corporate Monitor, Richard Breeden, upon its completion, and that Mr. Breeden shall then review the adequacy and effectiveness of WorldCom's corporate governance systems, policies, plans, and practices. This review will include but is not limited to inquiries into (1) whether WorldCom is complying with recognized standards of "best practices" with respect to corporate governance; (2) whether WorldCom has sufficient policies and safeguards in place (a) to ensure that WorldCom's Board of Directors and all committees of WorldCom's Board of Directors (including without limitation the audit committee and the compensation committee) have appropriate powers, structure, composition, and resources and (b) to prevent self-dealing by management; (3) whether WorldCom has an adequate and appropriate code of ethics and business conduct, and related compliance mechanisms; and (4) whether WorldCom has appropriate safeguards in place to prevent further violations of the federal securities laws. Following his receipt of the report of the Special Investigative Committee, the Corporate Monitor shall submit to WorldCom's Board of Directors, the Court and the Commission a report setting forth his recommendations with respect to the corporate governance issues he has reviewed. Within 60 days of the receipt of the report of the Corporate Monitor with respect to corporate governance, WorldCom's Board of Directors shall report to the Court and the Commission with respect to the decisions and actions taken as a result of each of the recommendations made by the Corporate Monitor.

The judgment further orders that WorldCom shall retain a qualified consultant, acceptable to the Commission, to perform a review of the effectiveness of WorldCom's material internal accounting control structure and policies, including those related to line costs, reserves, and capital expenditures, as well as the effectiveness and propriety of WorldCom's processes, practices and policies for ensuring that the Company's financial data is accurately reported in its public financial statements. The consultant must, within 30 days, develop a proposal for the review that is acceptable to the Commission. Any disagreements about the proposal will be resolved by the Corporate Monitor. Within 120 days after approval of the proposal, the consultant shall complete its review and submit to WorldCom's Board of Directors, the Court and the Commission, a report fully documenting the findings of its review and making specific recommendations. Within 60 days of the submission of the report, WorldCom's Board of Directors shall report to the Court and Commission with respect to the decisions and actions taken as a result of each of the recommendations made by the consultant.

The judgment further orders that WorldCom shall provide reasonable training and education to certain of its officers and employees to minimize the possibility of future violations of the federal securities laws. Completion of such training shall be mandatory for WorldCom officers and employees involved in its corporate level accounting and financial reporting functions; for those officers and employees involved in financial reporting at WorldCom's major divisions and subsidiaries (including, specifically, those officers and employees responsible for closing the books in their area of responsibility at the end of a quarterly or annual reporting period); and for senior operational officers at WorldCom's corporate, divisional and subsidiary levels. Such training and education shall include, at a minimum, components covering the following subjects: the obligations imposed by the federal securities laws; proper internal accounting controls and procedures; recognizing indications of non-GAAP (generally accepted accounting principles) accounting practices or fraud most relevant to WorldCom's business endeavors; and the obligations incumbent upon, and the responses expected of, WorldCom officers and employees upon learning of illegal or potentially illegal acts concerning the company's accounting and financial reporting. WorldCom shall consult with the Commission in designing its training and education program, and shall submit to the Commission a detailed proposal within 60 days after entry of this judgment, which describes the content and implementation of the training and education program, in a form that is acceptable to the Commission. WorldCom shall commence providing initial training and education sessions within 60 days thereafter, and shall continue to provide such training and education on an annual basis, for a minimum period of three years after entry of this judgment.

The judgment further provides that the amount of the civil penalty, if any, to be paid by WorldCom shall be determined by the Court in light of all the relevant facts and circumstances, following a hearing. At that hearing, the issues will be limited to determining the appropriateness and amount of any such civil penalty, WorldCom will be precluded from arguing that it did not violate the federal securities laws as alleged in the Commission's amended complaint, and the allegations of the complaint will be accepted as true by the Court.

The Commission filed its initial complaint against WorldCom on June 26, 2002
