Sen. Chuck Grassley (R-Iowa), the chair of the Senate Judiciary Committee, said on Tuesday that he received notice from the Justice Department (DOJ) that former special counsel Jack Smith's team "secretly obtained" text messages from lawmakers as part of a probe into President Trump.
Grassley said he was one of the 44 lawmakers whose communications with White House personnel were reviewed during probes under former President Biden into Trump's alleged role in the Jan. 6, 2021 attack on the U.S. Capitol and classified documents found at the president's Mar-a-Lago estate.
Smith oversaw both cases, which he later dropped following Trump's 2024 election win.
In a joint report with Sen. Ron Johnson (R-Wisc.), the chair of the Senate Permanent Subcommittee on Investigations, Grassley said the lawmakers requested these DOJ records after receiving whistleblower tips.
Assistant Attorney General Patrick Davis said in a letter to Grassley that Smith's investigative team "apparently bypassed" a document filtering team and "directly accessed these text messages."
"Jack Smith's criminal investigation of President Trump was a runaway train that had no brakes," Grassley said in a statement.
"Based on the information that's been produced to me and Senator Johnson, Biden DOJ and FBI investigators apparently ignored their own routine investigative protocols to obtain and review work-related messages from me and dozens of my Republican and Democrat colleagues who were outside the scope of the government's investigation," the chair continued.
Grassley and Johnson published a list of all the lawmakers whose communications were allegedly reviewed in this investigation, which included current and former Republican and Democratic members of Congress.
Johnson called this report "another grotesque example of the Biden administration's weaponization" of the DOJ in a statement.
"Jack Smith's team acted with impunity as they disregarded their own protocols to obtain and access White House text messages, including messages to and from 44 Members of Congress," he continued. "At this point, no one should be shocked by Jack Smith's recklessness and blatant abuse of power, but they should be outraged."
Sen. Rick Scott (R-Fla.), one of the lawmakers whose communications were allegedly reviewed in Smith's investigation, called the news "outrageous" but not "remotely surprising" in a statement shared on social media.
"The fact that Jack Smith swept up dozens of lawmakers in his witch hunt is just the latest addition to a long train of abuses that we've seen from Democrats' decades-long weaponization of government," he said.

An anonymous affidavit by "Tiffany Doe" said that Epstein had paid her directly from 1991 to 2000 "to attract adolescent women" to parties at his mansion (Herbert N. Straus House). In the summer of 1994, she lured a minor who expressed interest in modeling. In her affidavit, she said that both "Mr. Trump and Mr. Epstein were advised that she was 13 years old. I personally witnessed four sexual encounters" between Trump and the 13-year-old. In one of the alleged incidents, a 12-year-old girl was simultaneously victimized, and in another, Trump continued assaulting the 13-year-old "despite her pleas to stop". She said that Epstein likewise attempted to rape the 13-year-old on two occasions that she witnessed or learned of. "Tiffany Doe" said she personally witnessed both Trump and Epstein threaten to kill the 13-year-old if she were to tell anyone what had happened and that Trump further warned the victim that he was "capable of having her whole family killed". She signed the affidavit in 2016.

Unclean hands, sometimes called the clean hands doctrine or the dirty hands doctrine, is an equitable defense in which the defendant argues that the plaintiff is not entitled to obtain an equitable remedy on account of the fact that the plaintiff is acting unethically or has acted in bad faith with respect to the subject of the complaint—that is, with "unclean hands". The defendant has the burden of proof to show the plaintiff is not acting in good faith. The doctrine is often stated as "those seeking equity must do equity" or "equity must come with clean hands".
A defendant's unclean hands can also be claimed and proven by the plaintiff to claim other equitable remedies and to prevent that defendant from asserting equitable affirmative defenses. In other words, 'unclean hands' can be used offensively by the plaintiff as well as defensively by the defendant.
Relation to equitable remedies
Equitable remedies are generally remedies other than the payment of damages. This would include such remedies as obtaining an injunction, or requiring specific performance of a contract.

That was sometime in 2002 when my manager at Microsoft, Kirk Tavener, showed me that pornographic video title "Priceless" in the privacy of his office at Microsoft and during salary negotiations. The video had two people talking about oral sex and about returning favors.
His manager told me she got him to give her a copy of the video. She sent it to me in email.

Several years ago, while an employee of Microsoft, my manager showed me a pornographic video. I was in a performance review meeting with Kirk Tavener and I gave him details about the compensation increases that I was requesting. His immediate response was to show me a video where a guy was asking for sexual favors. The title of the video was “Priceless.”
I want to know why this happened to me. I still have not received a satisfactory answer from Microsoft. I have tried very hard to get Microsoft management to take this issue seriously. The only conclusion I can reach is that advancement at Microsoft is not based on merit, but rather on secret favors. I can only conclude that the incident with Kirk Tavener was standard operating procedure with Microsoft management and was no anomaly.
I want to know when I can expect to receive an answer. I want to know how much more damage to my personal and professional life I will have to suffer through as a result of that incident.
I want a full accounting of the investigation Microsoft conducted, or did not conduct. I want to know every single detail that was compiled on this issue. I want every single detail about this issue that Microsoft is keeping from me.
I want to know why Microsoft was watching me at work with hidden cameras. I want to know why people at Microsoft were gossiping about my personal life. I want to know why Microsoft was spying on my personal life as well as in my home. I want to know when it will end. I want to know when I will get my life back.

Effectively, I have been in more than 99% isolation since my first day after quitting voluntarily at my own initiative as a full-time employee of Microsoft Corporation on 02/06/2004. A few days ago, the thought occurred to me that the Microsoft Corporation official board of directors knew about my clandestine presence there from 1998 to 2004
