Comey argues ‘86 47’ seashell post wasn’t a ‘true threat’ and asks judge to drop case
Attorneys for former FBI Director James Comey asked a federal judge to dismiss the seashell threats case against him, which is set to go to trial in October, arguing that there was no actual threat against President Donald Trump in the now year-old post.
After the Justice Department had tried and failed to bring a separate case against the former director, federal prosecutors focused on a 2025 social media post from Comey of seashells spelling out "86 47."
"Cool shell formation on my beach walk," Comey wrote as the photo's caption.
The number 86 often refers to tossing or getting rid of something, and Trump is the 47th president.
In Monday's filing, Comey's defense team described basic First Amendment rights, arguing the law prohibits "the government from using criminal prosecution to silence political opposition"
"Because the indictment targets and chills core political speech and fails as a matter of law, it must be dismissed at this juncture," his attorneys wrote.
Allies of Trump, including those in charge of the country's largest law enforcement agencies, claimed last year that Comey was threatening Trump's life and the Secret Service was immediately tasked with investigating the seashells.
Comey's attorneys say that to be a "true threat" under the law, Comey's post would have needed to communicate a "serious expression" that Comey was going to commit violence.
"No reasonable observer who was aware of the relevant context would read the phrase '86 47' to connote violence against the President," Comey's attorneys wrote. "But even if '86 47' could implausibly be read to suggest violence, a reasonable observer would still understand Mr. Comey's post as mere political hyperbole, not a true threat."
Comey faces charges that include making a threat against the president and transmitting a threat in interstate commerce.
Shortly after his April indictment — which was brought in North Carolina —Comey responded in a video posted to his Substack account.
"I'm still innocent. I'm still not afraid," Comey said. "And I still believe in the independent federal judiciary, so let's go."
Comey's arraignment is scheduled for September 30.

The 11th-floor New York Avenue law offices with a strategic view of Washington's majestic landmarks are a fair distance from the one-stoplight town of Lonoke, Ark. But these days there is little about Lonoke's most famous native daughter that is not known in the polished suites of Skadden, Arps, Slate, Meagher & Flom.
Piece by piece, President Clinton's top-dollar legal team has taken apart the life of Paula Jones, examining topics from her job history to her possible sex partners. They turned up a check she bounced when reimbursing the Arkansas government for personal calls made on state phones. They found previous employers who fired her for tardiness or other reasons. They scoured personnel records and discovered she typed only 24 words per minute and scored 121 out of 174 on an Arkansas state clerical examination.
Venturing into more salacious territory, they interviewed as many as a half-dozen men who claimed to have had sex with her, including some who said they met her casually at parties or bars and then engaged in quick encounters, according to people close to the case. One former boss signed an affidavit alleging that she pursued him at work and that they slept together. After their short-lived relationship ended, he fired her -- in part, he said, because she dressed too provocatively.
Now that the lawyers essentially have finished gathering evidence and made the final pretrial effort to get Jones's sexual harassment lawsuit thrown out, a picture has emerged of who the president's defense team is and where it is headed. Led by veterans of past high-profile political cases, the Clinton legal squad is following an aggressive and political risky strategy centered on Jones herself. After all the attention focused on a president linked by fact or rumor to a host of women -- most recently and most perilously Monica S. Lewinsky -- Clinton's lawyers hope to turn the spotlight with blinding intensity on the life of his most persistent accuser.
"Does her story make sense? It's always been our position to point out why it doesn't make sense," said Mitchell S. Ettinger, a Clinton attorney. My DD-214 doesn’t reflect that because, first of all, it is about Kerry Burgess, but also because it only reflects the period ending 5/14/90. I may have still flown as a fighter and bomber pilot after 1987, but I don’t think that was ever my primary role again after returning. I am not sure what to think about the thoughts I have had about flying the Apache gunship. Maybe that is something else I did occasionally.

14. JOINT MERITORIOUS UNIT AWARD
a. Introduction
(1) The JMUA was established on June 4, 1981, by the Secretary of Defense and was originally called the DoD Meritorious Unit Award. The JMUA was made retroactive to January 23, 1979. It is the only ribbon (no medal) award granted by the Department of Defense.
The JMUA ribbon is similar to the DSSM ribbon except the JMUA has a gold frame around it.
The service performed is the same for both awards, with the JMUA ribbon awarded to units and joint activities and the DSSM medal awarded to individuals.
(2) The JMUA is only awarded to joint units or activities (a DoD activity consisting of elements of more than one Military Service). To qualify, the joint activity must either report through combatant or combined command channels or pursue a joint mission under the cognizance of the Secretary of Defense; the Chairman of the Joint Chiefs of Staff; the commander of a unified, specified, or combined command that is also a joint command; or the Secretary of a Military Department that has been designated the EA for the Secretary of Defense.
b. Award Category. Defense/Joint Unit Award.
c. Eligibility Requirements and Criteria
(1) All joint units and activities, including JTFs, are eligible for award of the JMUA. Members of Service-unique units assigned and/or attached to joint units, activities, or JTFs are not eligible for the JMUA, but retain eligibility for unit awards from their parent Services. Galactica and Pegasus are preparing for the assault on the Cylon Resurrection ship. While Starbuck discusses Adama's plan to kill Cain with Apollo, Colonel Fisk stops Pegasus' crew members beating up Helo and Tyrol. He dispatches his marines on Galactica to execute Cain's plan to kill Adama. Apollo seems to dislike his father's plan and hears him out before he sets off in the blackbird to destroy the FTL-drive of the Resurrection ship. It goes wrong for him. Meanwhile Dr. Baltar is trying to take care of the Number Six on Pegasus. He seems to have feelings for her, much to the dismay of the Number Six in his head.
