(3) fails to do his utmost to prevent and suppress a mutiny or sedition being committed in his presence, or fails to take all reasonable means to inform his superior commissioned officer or commanding officer of a mutiny or sedition which he knows or has reason to believe is taking place, is guilty of a failure to suppress or report a mutiny or sedition.

(b) A person who is found guilty of attempted mutiny, mutiny, sedition, or failure to suppress or report a mutiny or sedition shall be punished by death or such other punishment as a court-martial may direct.

power (as defined in section 101(a) of the Foreign Intelligence Surveillance Act of 1978) of an individual acting as an agent of the United States and consequently in the death of that individual, or directly concerned nuclear weaponry, military spacecraft or satellites, early warning systems, or other means of defense or retaliation against large-scale attack; war plans; communications intelligence or cryptographic information; or any other major weapons system or major element of defense strategy.

(b) Whoever, in time of war, with intent that the same shall be communicated to the enemy, collects, records, publishes, or communicates, or attempts to elicit any information with respect to the movement, numbers, description, condition, or disposition of any of the Armed Forces, ships, aircraft, or war materials of the United States, or with respect to the plans or conduct, or supposed plans or conduct of any naval or military operations, or with respect to any works or measures undertaken for or connected with, or intended for the fortification or defense of any place, or any other information relating to the public defense, which might be useful to the enemy, shall be punished by death or by imprisonment for any term of years or for life.

(c) If two or more persons conspire to violate this section, and one or more of such persons do any act to effect the object of the conspiracy, each of the parties to such conspiracy shall be subject to the punishment provided for the offense which is the object of such conspiracy.

(d)
(1) Any person convicted of a violation of this section shall forfeit to the United States irrespective of any provision of State law—

(A) any property constituting, or derived from, any proceeds the person obtained, directly or indirectly, as the result of such violation, and

(B) any of the person’s property used, or intended to be used, in any manner or part, to commit, or to facilitate the commission of, such violation.

SLIGHTLY AMUSED, he peers out at us from behind heavy, plastic-frameglasses. He seems to be wondering why he is on the cover of Time in his V-necked sweater and rumpled button-down shirt, open at the collar. Perhaps it is is the pose that he finds funny. A floppy disk is magically balanced on one corner of his index finger. The disk, of course, is a symbolic explanation of why he is on the cover of Time. He is Bill Gates, chairman and co-founder of Microsoft, a computer software company whose 1984 revenues, according to Time, were $100 million.

Time also estimates Gates's personal worth at a $100 million and tells us he has a $750,000 home with a 30-foot indoor swimming pool and a view of Lake Washington. Gates is 28 years old.

Of all the things that computers have contributed to this generation, one of the more significant must be the image of the new breed of businessman, the under-30 entrepreneur who became a millionaire on his own. High-tech enterprises, especially software, required brains but very little capital investment - a few machines and a garage to work in. It was a business in which a graduate student - or a college dropout - with a good idea could become a millionaire virtually overnight.

This new business person was not a company man, a functionary loyally shuffling papers or working a territory until it was time to retire. He was self-propelled and blatantly self-interested, and he approached what he did as if it were the big game and he were the quarterback. He had strategies and tactics. He bought books on power lunching and learned to eat raw steak. And more and more often, he was a she.

The hot new degree became the master's in business administration. The M.B.A. programs became so popular that the more prestigious ones stopped admitting students right after college graduation. They had to have "significant business experience" first so that they "brought something to the table." Undergraduate business departments became impacted as 18-year-olds eagerly signed up for a future in making money. In 1966, 11.6 percent of entering freshmen planned to major in business. In 1982, the percentage had risen to 20.2. Similarly, 38,900 bachelor's degrees in business were confered in 1975. By 1980, the number had soared to 61,600. In the past few years, the value of the M.B.A. has fluctuated downward slightly as corporations question whether the degree is worth the salary it commands. But it is still very much the degree to get.

Perhaps these young people, like the Humphrey Bogart character who came to Casablanca for the waters, were just misinformed. When they couldn't get jobs or when the jobs they got turned out to be dead ends, they started thinking about going off on their own.

The highest calling in this brave new world was to be a risk-taker, to leave the security of the company and become an entrepreneur.

"There's no definition for that word," says Tom Omalia, a financial consultant who teaches in the University of Southern California's Entrepreneur Program. "The entrepreneur is the one who makes things happen."

Vichy France

Vichy France, or the Vichy regime are the common terms used to describe the government of France from July 1940 to August 1944. This government, which succeeded the Third Republic, officially called itself the French State (État Français), in contrast with the previous designation, "French Republic." Marshal Philippe Pétain proclaimed the government following the military defeat of France by Nazi Germany during World War II and the vote by the National Assembly on July 10, 1940. This vote granted extraordinary powers to Pétain, the last Président du Conseil (Prime Minister) of the Third Republic, who then took the additional title Chef de l'État Français ("Chief of the French State"). Pétain headed the reactionary program of the so-called "Révolution nationale", aimed at "regenerating the Nation."

Vichy France had legal authority in both the northern zone of France, which was occupied by the German Wehrmacht, and the unoccupied southern "free zone", where the regime's administrative centre of Vichy was located. The southern zone remained under Vichy control until the Allies landed in French North Africa in November 1942. Recent research by the historian Simon Kitson has shown that, in spite of extensive state collaboration, Vichy led an ultimately unsuccessful campaign to preserve the sovereignty of this southern zone by arresting German spies.

Pétain and the Vichy regime willfully collaborated with the German occupation to a high degree. The French police and the state Milice (militia) organised raids to capture Jews and others considered "undesirables" by the Germans in both the northern and southern zones.

The legitimacy of Vichy France and Pétain's leadership was challenged by General Charles de Gaulle, who claimed to instead represent the legitimacy and continuity of the French government. Following the Allies' invasion of France in Operation Overlord, de Gaulle proclaimed the Provisional Government of the French Republic (GPRF) in June, 1944. After the Liberation of Paris in August, the GPRF installed itself in Paris on August 31. The GPRF was recognized as the legitimate government of France by the Allies on October 23, 1944.

With the liberation of France in August and September, Vichy's officials and supporters moved to Sigmaringen in Germany and there established a government in exile, headed by Pétain, until April 1945. Many of the Vichy regime's prominent figures were subsequently tried by the GPRF and a number were executed. Pétain himself was sentenced to death for treason, but his sentence was commuted to life imprisonment.

1982: Argentine flag hoisted on S Georgia

A group of Argentines have landed at the British colony of the Falkland Islands in the south Atlantic and planted their nation's flag.

About 50 Argentines are reported to have arrived at Leith Harbour, on South Georgia, about 1,400 miles east of the Falklands archipelago off the Argentine coast.


In Context

The arrival of the Argentines on the island was not reported in Britain until two days later when the Foreign Office released a statement.

Government sources said it was most likely sponsored by a commercial company and not the Argentine Government.

But within days the situation escalated and on 2 April Argentine forces invaded the islands as the military Junta decided to use force instead of diplomacy to regain the territories.

Many did not expect Britain to retaliate but on 5 April a British task force set sail and 655 Argentines died along with 255 British servicemen in the ensuing war.

It ended on 14 June when the commander of the Argentine garrison at Port Stanley surrendered to British troops.

The Enterprise responds to a distress call from the planet Scalos but when Kirk and a landing party beam down to the planet, they find no living beings. It turns out that Scalosian live at a much higher rate of acceleration rendering them invisible to the human eye. One of the Scalosians, the beautiful and seductive Deela, accelerates Kirk so they can interact and tells him he cannot return to his normal life. For the crew, Kirk has virtually disappeared before their eyes. The Scalosians want to turn the Enterprise into a cryogenic storage facility for the crew. Kirk learns that at his current state of acceleration, they are subject to cellular degeneration and rapid aging should they suffer the slightest cut. He leaves a message for the crew but it is left to Mr. Spock to find a way to decipher it.

I had some kind of dream that was fairly clear but kind of fragmented and I am not certain when I had it during the time I was asleep. I can't remember when I fell asleep before just now getting out of bed. I think probably around 7 pm. In the dream, I seemed to be fighting in the Vietnam War and the Falklands Wars at the same time. I saw North Vietnamese soldiers but there was also a plot element about UK soldiers in a helicopter, one of whom was my uncle Prince Andrew, and I seemed to be talking to them on the radio to pick me up from my location. I didn't recognize the setting I was in. I feel that I was on land but I seemed to be inside somewhere and I can't decide if I was in a house or on a ship. There are other details I remember and I remember fighting hand-to-hand against North Vietnamese soldiers.

A group of Argentines have landed at the British colony of the Falkland Islands in the south Atlantic and planted their nation's flag.

About 50 Argentines are reported to have arrived at Leith Harbour, on South Georgia, about 1,400 miles east of the Falklands archipelago off the Argentine coast.

The Enterprise responds to a distress call from the planet Scalos but when Kirk and a landing party beam down to the planet, they find no living beings. It turns out that Scalosian live at a much higher rate of acceleration rendering them invisible to the human eye. One of the Scalosians, the beautiful and seductive Deela, accelerates Kirk so they can interact and tells him he cannot return to his normal life. For the crew, Kirk has virtually disappeared before their eyes. The Scalosians want to turn the Enterprise into a cryogenic storage facility for the crew. The A-6 Intruder is an American twin jet-engine, mid-wing attack aircraft


A-6 Intruders first saw action during the Vietnam War, where the craft were used extensively against targets in Vietnam. The aircraft's long range and heavy payload (18,000 lb/8,170 kg) coupled with its ability to fly in all weather made it invaluable during the war. However, its effectiveness in flying low and delivering its payload made it especially vulnerable to anti-aircraft fire and in the eight years the Intruder was used, the U.S. Navy and Marines lost 84 Intruders to all causes during the Vietnam War.

A-6A

The initial version of the Intruder was built around the complex and advanced DIANE (Digital Integrated Attack/Navigation Equipment), intended to provide a high degree of bombing accuracy even at night and in poor weather. DIANE consisted of multiple radar systems: the Norden AN/APQ-92 search radar and a separate AN/APQ-112 for tracking, AN/APN-141 radar altimeter, and AN/APN-153 Doppler to provide position updates to the AN/ASN-31 inertial navigation system. An air-data computer and ballistics computer integrated the radar information for the bombardier/navigator (BN) in the right-hand seat. TACAN and ADF were also provided for navigational use. When it worked, DIANE was perhaps the most capable nav/attack system of its era, giving the Intruder the ability to fly and fight in even very poor conditions (particularly important over Vietnam and Thailand during the Vietnam War). It suffered numerous teething problems, though, and it was several years before
its reliability was established.


A-6B

To provide Navy squadrons with a SEAD aircraft to attack enemy air defense and SAM systems--a mission dubbed "Iron Hand" in Navy parlance: 19 A-6As were converted to A-6B standard from 1967 to 1970. The A-6B had many of its standard attack systems removed in favor of special equipment to detect and track enemy radar sites and to guide AGM-45 Shrike and AGM-78 Standard anti-radiation missiles.

"War of the Gods" is a two-part episode of the original Battlestar Galactica television series.

Part I

While on patrol, four Viper pilots encounter mysterious orbs of light which move quickly among their formation. They are soon overtaken by a larger ship which disables the Viper instruments and emits a deafening sound. Aboard the Galactica, other pilots are engaged in a Triad match. Colonel Tigh calls a meeting where Commander Adama briefs the pilots on the Vipers' disappearance which occurred near a planet. Apollo, Starbuck, and Sheba go to investigate the oddly lit planet (the scenes for which were shot in infrared). They find the wreckage of a ship and a white-robed being named Count Iblis, whom they take back to the Galactica.

Iblis seems to have a strange effect on Sheba, as well as on other crew members. Adama is anxious to get to the bottom of the mystery and questions him about those whom Iblis terms his enemies. Iblis reveals his knowledge of the humans and his plans for leading the fleet to Earth. The crew members must speculate on the stranger’s origin as their instruments are ineffective in scanning him. Iblis is able to somehow read Sheba’s inner feelings and increases his captivating effects on her. The mysterious lights reappear around the fleet, and the Red Squadron of Vipers attempts to pursue them. They are overtaken by the same lighted ship as the first pilots.

Apollo and Starbuck threaten to take Iblis into custody if he does not accompany them to see Adama. Under Adama’s questioning, Iblis declares that he is an advanced being from another world, and that Adama should devise three tests so that he may prove his powers. Meanwhile, the mysterious lights also swarm around Baltar’s Cylon Basestar.

Sheba leads Count Iblis on a tour of the fleet, stopping on a ship where there is little to eat. He gains the support of the people by promising to improve their living conditions, and then he delivers on his promise by causing a great abundance of food to grow on the agro ship – a miracle to those in the fleet. Later, Iblis knows exactly what the three tests will be before they are even spoken. The first is to deliver the humans’ enemy, the second, to accurately plot a course to Earth, and the third is as of yet undecided on. At the end of Part I, their enemy, Baltar, does indeed decide to turn himself in to Galactica; he is delivered.

(a) Whoever, with intent or reason to believe that it is to be used to the injury of the United States or to the advantage of a foreign nation, communicates, delivers, or transmits, or attempts to communicate, deliver, or transmit, to any foreign government, or to any faction or party or military or naval force within a foreign country, whether recognized or unrecognized by the United States, or to any representative, officer, agent, employee, subject, or citizen thereof, either directly or indirectly, any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, note, instrument, appliance, or information relating to the national defense, shall be punished by death or by imprisonment for any term of years or for life, except that the sentence of death shall not be imposed unless the jury or, if there is no jury, the court, further finds that the offense resulted in the identification by a foreign
power (as defined in section 101(a) of the Foreign Intelligence Surveillance Act of 1978) of an individual acting as an agent of the United States and consequently in the death of that individual, or directly concerned nuclear weaponry, military spacecraft or satellites, early warning systems, or other means of defense or retaliation against large-scale attack; war plans; communications intelligence or cryptographic information; or any other major weapons system or major element of defense strategy.

(b) Whoever, in time of war, with intent that the same shall be communicated to the enemy, collects, records, publishes, or communicates, or attempts to elicit any information with respect to the movement, numbers, description, condition, or disposition of any of the Armed Forces, ships, aircraft, or war materials of the United States, or with respect to the plans or conduct, or supposed plans or conduct of any naval or military operations, or with respect to any works or measures undertaken for or connected with, or intended for the fortification or defense of any place, or any other information relating to the public defense, which might be useful to the enemy, shall be punished by death or by imprisonment for any term of years or for life.

(c) If two or more persons conspire to violate this section, and one or more of such persons do any act to effect the object of the conspiracy, each of the parties to such conspiracy shall be subject to the punishment provided for the offense which is the object of such conspiracy.

(d)
(1) Any person convicted of a violation of this section shall forfeit to the United States irrespective of any provision of State law—

(A) any property constituting, or derived from, any proceeds the person obtained, directly or indirectly, as the result of such violation, and

(B) any of the person’s property used, or intended to be used, in any manner or part, to commit, or to facilitate the commission of, such violation.

Racket (crime)

A racket is an illegal business, usually run as part of organized crime. Engaging in a racket is called racketeering.

Several forms of racket exist. The best-known is the protection racket, in which criminals demand money from businesses in exchange for the service of "protection" against crimes that the racketeers themselves instigate if unpaid (see extortion). A second well known example is the numbers racket, a form of illegal lottery.

Traditionally, the word racket to describe a business is based on the example of the "protection racket" and indicates that the speaker believes that the business is making money by selling a solution to a problem that it created (or that it intentionally allows to continue to exist), specifically so that continuous purchases of the solution are always needed. The test of greatness of any nation is how that nation pulls together in a time of crisis.

The only limits on what we can achieve are the limits we place on our hopes.

These three men reminded us of the limitlessness of our hopes.

There was a moment these past few days when we were all one people.

We were all hoping. We were all a little bit taller. A little bit prouder.

We were all feeling the same fears and the same exhilaration.

These three men brought us together.

We knew together that there are no goals we cannot reach if we just reach for them together.

There is no adequate way with which we can express our gratitude to the men themselves because they are no longer among us.

Thanksgiving Day is one of our most beloved holidays, an occasion set aside by Americans from earliest times to thank our Maker prayerfully and humbly for the blessings and the care He bestows on us and on our beautiful, bountiful land. Through the decades, through the centuries, in log cabins, country churches, cathedrals, homes, and halls, the American people have paused to give thanks to God, in times of peace and plenty or of danger and distress.

Acknowledgement of dependence on God's favor was, in fact, our fledgling Nation's very first order of business. When the delegates to the First Continental Congress met in Philadelphia in 1774, they overcame discord by uniting in prayer for our country. Despite the differences among them as they began their work, they found common voice in the 35th Psalm, which concludes with a verse of joyous gratitude, "And my tongue shall speak of thy righteousness and of thy praise all the day long."

This year, of course, our Thanksgiving Day celebration coincides with the Bicentennial of the Constitution. In 1789 the government established by that great charter of freedom, and "the civil and religious liberty with which we are blessed," were cited by George Washington in the first Presidential Thanksgiving Proclamation as among "the great and various favors" conferred upon us by the Lord and Ruler of Nations. As we thank the God our first President called "that great and glorious Being, who is the beneficent Author of all the good that was, that is, or that will be," we have even greater cause for gratitude than the fresh triumphs that inspired Washington's prose. We have seen the splendor of our natural resources spread across the tables of the world, and we have seen the splendor of freedom coursing with new vigor through the channels of history. The cause for which we give thanks, for which so many of our citizens through the years have given
their lives, has endured 200 years—a blessing to us and a light to all mankind.

On Thanksgiving Day, 1987, let us, in this unbroken chain of observance, dedicate ourselves to honor anew the Author of Liberty and to publicly acknowledge our debt to all those who have sacrificed so much in our behalf. May our gratitude always be coupled with petitions for divine guidance and protection for our Nation and with ready help for our neighbors in time of need.

The horror arrived in episodic bursts of chilling disbelief, signified first by trembling floors, sharp eruptions, cracked windows. There was the actual unfathomable realization of a gaping, flaming hole in first one of the tall towers, and then the same thing all over again in its twin. There was the merciless sight of bodies helplessly tumbling out, some of them in flames.

Finally, the mighty towers themselves were reduced to nothing. Dense plumes of smoke raced through the downtown avenues, coursing between the buildings, shaped like tornadoes on their sides.

Every sound was cause for alarm. A plane appeared overhead. Was another one coming? No, it was a fighter jet. But was it friend or enemy? People scrambled for their lives, but they didn't know where to go. Should they go north, south, east, west? Stay outside, go indoors? People hid beneath cars and each other. Some contemplated jumping into the river.

For those trying to flee the very epicenter of the collapsing World Trade Center towers, the most horrid thought of all finally dawned on them: nowhere was safe.

The Beverly Hillbillies is an American television series about a hillbilly family transplanted to Beverly Hills, California after finding oil on their land. A Filmways production, the series aired on CBS from September 26, 1962 – September 7, 1971 and comprises 274 episodes—106 in black-and-white (1962–1965) and 168 in color (1965–1971). At the beginning of The Beverly Hillbillies series, the OK Oil Company discovers oil in a swamp in the mountains of Tennessee owned by family patriarch Jed Clampett. This sequence of events was recapitulated in the title credits for each show and was described in the lyrics of the theme song, so that new viewers would easily understand who the Hillbillies were and why they were in Beverly Hills (although the credits and song portray Jed finding the oil while hunting as opposed to knowing the oil was there but being unaware of the value). Lasting nine seasons and accumulating 7 Emmy nominations, it remains in syndication on several cable stations including TV Land.


One constant throughout the series was that the Hillbillies, who were scrupulously honest, were surrounded by cynical, conniving and money-hungry "city-folk," whose plans were always foiled (usually unknowingly) by the Clampetts.

Racket (crime)

A racket is an illegal business, usually run as part of organized crime. Engaging in a racket is called racketeering.

Several forms of racket exist. The best-known is the protection racket, in which criminals demand money from businesses in exchange for the service of "protection" against crimes that the racketeers themselves instigate if unpaid (see extortion). A second well known example is the numbers racket, a form of illegal lottery.

Traditionally, the word racket to describe a business is based on the example of the "protection racket" and indicates that the speaker believes that the business is making money by selling a solution to a problem that it created (or that it intentionally allows to continue to exist), specifically so that continuous purchases of the solution are always needed. BELLEVUE, Wash. - A 210-foot construction crane collapsed Thursday evening in downtown Bellevue, striking several buildings and killing a man who lived in an apartment that was hit by the crane.

Bellevue Fire Department Lt. Bruce Kroon said the man's body was found in a fourth floor apartment of the Pinnacle Bell Center Building, which was hit by the falling crane. It appears no other people in the building were injured. A Microsoft Corp. spokesman identified the victim as Matthew Ammon, a 31-year-old intellectual property attorney with the company.

Ballmer: Linux users owe Microsoft

He says the open-source operating system infringes on his company's intellectual property

November 16, 2006 (Computerworld) -- In comments confirming the open-source community's suspicions, Microsoft Corp. CEO Steve Ballmer today declared his belief that the Linux operating system infringes on Microsoft's intellectual property.

In a question-and-answer session after his keynote speech at the Professional Association for SQL Server (PASS) conference in Seattle, Ballmer said Microsoft was motivated to sign a deal with SUSE Linux distributor Novell Inc. earlier this month because Linux "uses our intellectual property" and Microsoft wanted to "get the appropriate economic return for our shareholders from our innovation."


At the time, Microsoft officials, including Ballmer, were mum on whether the Linux kernel, which is governed by the General Public License and takes contributions from programmers all around the world, violated Microsoft's patents.

Ballmer was more open today.

"Novell pays us some money for the right to tell customers that anybody who uses SUSE Linux is appropriately covered," Ballmer said. This "is important to us, because [otherwise] we believe every Linux customer basically has an undisclosed balance-sheet liability."
