(a) Whoever, with intent or reason to believe that it is to be used to the injury of the United States or to the advantage of a foreign nation, communicates, delivers, or transmits, or attempts to communicate, deliver, or transmit, to any foreign government, or to any faction or party or military or naval force within a foreign country, whether recognized or unrecognized by the United States, or to any representative, officer, agent, employee, subject, or citizen thereof, either directly or indirectly, any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, note, instrument, appliance, or information relating to the national defense, shall be punished by death or by imprisonment for any term of years or for life, except that the sentence of death shall not be imposed unless the jury or, if there is no jury, the court, further finds that the offense resulted in the identification by a foreign
power (as defined in section 101(a) of the Foreign Intelligence Surveillance Act of 1978) of an individual acting as an agent of the United States and consequently in the death of that individual, or directly concerned nuclear weaponry, military spacecraft or satellites, early warning systems, or other means of defense or retaliation against large-scale attack; war plans; communications intelligence or cryptographic information; or any other major weapons system or major element of defense strategy.

(b) Whoever, in time of war, with intent that the same shall be communicated to the enemy, collects, records, publishes, or communicates, or attempts to elicit any information with respect to the movement, numbers, description, condition, or disposition of any of the Armed Forces, ships, aircraft, or war materials of the United States, or with respect to the plans or conduct, or supposed plans or conduct of any naval or military operations, or with respect to any works or measures undertaken for or connected with, or intended for the fortification or defense of any place, or any other information relating to the public defense, which might be useful to the enemy, shall be punished by death or by imprisonment for any term of years or for life.

(c) If two or more persons conspire to violate this section, and one or more of such persons do any act to effect the object of the conspiracy, each of the parties to such conspiracy shall be subject to the punishment provided for the offense which is the object of such conspiracy.

(d)
(1) Any person convicted of a violation of this section shall forfeit to the United States irrespective of any provision of State law—

(A) any property constituting, or derived from, any proceeds the person obtained, directly or indirectly, as the result of such violation, and

(B) any of the person’s property used, or intended to be used, in any manner or part, to commit, or to facilitate the commission of, such violation.

A Proclamation

From America's earliest hours as a free Nation, we have known that the cost of liberty is steep. The bill has been paid in full by the courageous members of our Armed Forces. We owe a great debt to all who have served so faithfully and sacrificed so much for our land. Among their ranks are former prisoners of war and those still missing in action, including men known to be alive after the end of hostilities. We will never forget these gallant Americans, or their brave families, or our obligations to them.

We have a deep moral responsibility in this regard—a duty to make every possible effort to account for and return missing Americans to their homeland and to their loved ones. Until the P.O.W./M.I.A. issue is resolved, this issue stays, and will stay, among our Nation's highest priorities.

Similarly, our country has recognized the prolonged and acute suffering of the families of those who remain missing or unaccounted for. We pledge again our unflagging determination to obtain the fullest possible accounting of those still missing, to repatriate all recoverable American remains, and to relieve the suffering and uncertainty of their families.

We will also continue our intelligence efforts to confirm reports of Americans still held in captivity in Southeast Asia. Each of these reports is investigated thoroughly, and both the Executive branch and the Congress scrutinize them. We have not yet been able to confirm such reports; but, if we do, I have pledged to take decisive action to return our men. We have raised this issue repeatedly in negotiations with governments involved, despite their denials.

Our search for the truth is bound up closely with our heritage as a Nation that respects the inherent dignity and worth of every individual. Our liberty is secure because every life is precious to us; we, therefore, can write no final chapter to the story of those who answered their country's call and did not return. They gave without limit, and we owe them, and their families, no less.

To symbolize our continuing national commitment, the P.O.W./M.I.A. Flag will fly over the White House, the Departments of State and Defense, the Veterans Administration, the Selective Service System headquarters, and the Vietnam Veterans Memorial on September 16, 1988. It will also fly over the Vietnam Veterans Memorial on Memorial Day and Veterans Day.

In recognition of the special debt of gratitude all Americans owe to those who sacrificed their freedom in the service of our country and to their courageous families, the Congress, by House Joint Resolution 453, has designated September 16, 1988, as "National POW/MIA Recognition Day" and authorized and requested the President to issue a proclamation in observance of this occasion.

That dream I wrote of recently about being on a boat and Phoebe was there. I have been wondering about that again today and I think it has been lingering just below my conscious awareness. That was the dream, and I can still visualize these details, where I was looking through the sights of a gun as I was shooting at an aircraft. Then a large aircraft flew by with smoke streaming out of it. Then I was shooting a machine gun at some kind of large gun emplacement, which I later started thinking was actually a tank, and I was trying to hit the hydraulic lines to disable to gun turret. I am wondering if the reason I saw Phoebe in that dream is because I was with her on a boat not long after that combat action. For instance, I was out there there in combat somewhere far away and then I saw Phoebe in the dream because I went home on leave and we were together. I'm not sure why I dreamed all that and that is a curious thought in itself. I have the strangest
dreams. Not just the details in the dreams but I puzzle over something about the dreams that I cannot begin to articulate.

NEW ORLEANS - Questions about the military service of Indiana Sen. Dan Quayle renewed memories Thursday of the agonizing choices young men made during the Vietnam era.

Vietnam represented not only conflict overseas but conflict at home. During the Vietnam War - 1964 to 1973 - more than 26 million American men faced the possibility of being drafted and hard choices about whether to participate in the nation's military.

More than 2 million men and women went to Vietnam, of whom 153,300 were wounded and 58,153 were killed. But an estimated 90,000 young men refused induction into the service or fled the draft by moving to Canada and other countries. Thousands of others opted to continue their personal lives and reduce the risk of seeing combat by joining armed forces reserves and the National Guard.

In 1969, a year when 283,586 young men were drafted, 22-year-old Danny Quayle graduated from DePauw University and lost his draft deferment. He wanted to go on to law school, so he joined the Indiana National Guard.

Now that he has become Vice President George Bush's choice for a GOP presidential running mate, questions occurred about whether Quayle, the heir of a newspaper fortune and a conservative advocate of a strong national defense, used undue family influence to avoid the draft by obtaining a hard-to-get spot in the National Guard.

"The thing that's important, I want you all to remember: He did not go to Canada," said the vice president's son George W. Bush. "Let's keep it in generational perspective."

According to the Online Etymology Dictionary, the word "coward" comes from an Old French word coart (modern French couard), a combination of the word for "tail" and an agent noun suffix. It would therefore have meant "one with a tail" — perhaps one in the habit of turning it, or it may be derived from the dog's habit of putting its tail between its legs when it is afraid.
