(a) Whoever, with intent or reason to believe that it is to be used to the injury of the United States or to the advantage of a foreign nation, communicates, delivers, or transmits, or attempts to communicate, deliver, or transmit, to any foreign government, or to any faction or party or military or naval force within a foreign country, whether recognized or unrecognized by the United States, or to any representative, officer, agent, employee, subject, or citizen thereof, either directly or indirectly, any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, note, instrument, appliance, or information relating to the national defense, shall be punished by death or by imprisonment for any term of years or for life, except that the sentence of death shall not be imposed unless the jury or, if there is no jury, the court, further finds that the offense resulted in the identification by a foreign
power (as defined in section 101(a) of the Foreign Intelligence Surveillance Act of 1978) of an individual acting as an agent of the United States and consequently in the death of that individual, or directly concerned nuclear weaponry, military spacecraft or satellites, early warning systems, or other means of defense or retaliation against large-scale attack; war plans; communications intelligence or cryptographic information; or any other major weapons system or major element of defense strategy.
(b) Whoever, in time of war, with intent that the same shall be communicated to the enemy, collects, records, publishes, or communicates, or attempts to elicit any information with respect to the movement, numbers, description, condition, or disposition of any of the Armed Forces, ships, aircraft, or war materials of the United States, or with respect to the plans or conduct, or supposed plans or conduct of any naval or military operations, or with respect to any works or measures undertaken for or connected with, or intended for the fortification or defense of any place, or any other information relating to the public defense, which might be useful to the enemy, shall be punished by death or by imprisonment for any term of years or for life.
(c) If two or more persons conspire to violate this section, and one or more of such persons do any act to effect the object of the conspiracy, each of the parties to such conspiracy shall be subject to the punishment provided for the offense which is the object of such conspiracy.
(d)
(1) Any person convicted of a violation of this section shall forfeit to the United States irrespective of any provision of State law—
(A) any property constituting, or derived from, any proceeds the person obtained, directly or indirectly, as the result of such violation, and
(B) any of the person’s property used, or intended to be used, in any manner or part, to commit, or to facilitate the commission of, such violation.

Microsoft, IBM agree to end operating system feud

NEW YORK -- Two of the giants of the computer world, software house Microsoft Corp. and International Business Machines Corp., said Sunday they have agreed to end a long-running feud over their competing software operating systems.
The two companies said they reached agreements on royalties and licenses related to IBM's OS/2 and Microsoft's Windows operating systems, which will basically allow the two companies to go their separate ways.
"Basically we're agreeing on how to unravel ourselves from the (September 1990) contract," Steve Ballmer, executive vice president of worldwide sales for Microsoft, told Reuters.
The 1990 contract governed plans by IBM and Microsoft to jointly build an operating system that goes beyond the MS/DOS system, which was introduced in 1981 for the IBM personal computer.
A computer's operating system provides the basic rules for how a computer functions. Microsoft, whose software controlled the first IBM PCs in the early 1980s, has become the dominant force in such software.
In the agreement, IBM and Microsoft said they will agree to license each other for operating system patents currently held by the other. Microsoft will also make an undisclosed cash payment to Armonk, N.Y.-based IBM.
David Wu, an analyst with SG Warburg, said the breakup will not hurt IBM or Microsoft.
"Looking down the road, a formal divorce after September 1993 would not be harmful to either party," he said.

E-3 SENTRY (AWACS)
Mission
The E-3 Sentry is an airborne warning and control system, or AWACS, aircraft with an integrated command and control battle management, or C2BM, surveillance, target detection, and tracking platform. The aircraft provides an accurate, real-time picture of the battlespace to the Joint Air Operations Center. AWACS provides situational awareness of friendly, neutral and hostile activity, command and control of an area of responsibility, battle management of theater forces, all-altitude and all-weather surveillance of the battle space, and early warning of enemy actions during joint, allied, and coalition operations.
The radar and computer subsystems on the E-3 Sentry can gather and present broad and detailed battlefield information. This includes position and tracking information on enemy aircraft and ships, and location and status of friendly aircraft and naval vessels. The information can be sent to major command and control centers in rear areas or aboard ships. In time of crisis, this data can also be forwarded to the president and secretary of defense in the United States.
In support of air-to-ground operations, the Sentry can provide direct information needed for interdiction, reconnaissance, airlift and close-air support for friendly ground forces. It can also provide information for commanders of air operations to gain and maintain control of the air battle.
As an air defense system, E-3s can detect, identify and track airborne enemy forces far from the boundaries of the United States or NATO countries. It can direct fighter-interceptor aircraft to these enemy targets. Experience has proven that the E-3 Sentry can respond quickly and effectively to a crisis and support worldwide military deployment operations.
AWACS may be employed alone or horizontally integrated in combination with other C2BM and intelligence, surveillance, and reconnaissance elements of the Ground Theater Air Control System. It supports decentralized execution of the air tasking order/air combat order. The system provides the ability to find, fix, track and target airborne or maritime threats and to detect, locate and ID emitters. It has the ability to detect threats and control assets below and beyond the coverage of ground-based command and control or C2, and can exchange data with other C2 systems and shooters via datalinks.

Microsoft, IBM agree to end operating system feud

NEW YORK -- Two of the giants of the computer world, software house Microsoft Corp. and International Business Machines Corp., said Sunday they have agreed to end a long-running feud over their competing software operating systems.
The two companies said they reached agreements on royalties and licenses related to IBM's OS/2 and Microsoft's Windows operating systems, which will basically allow the two companies to go their separate ways.
"Basically we're agreeing on how to unravel ourselves from the (September 1990) contract," Steve Ballmer, executive vice president of worldwide sales for Microsoft, told Reuters.
The 1990 contract governed plans by IBM and Microsoft to jointly build an operating system that goes beyond the MS/DOS system, which was introduced in 1981 for the IBM personal computer.
A computer's operating system provides the basic rules for how a computer functions. Microsoft, whose software controlled the first IBM PCs in the early 1980s, has become the dominant force in such software.
In the agreement, IBM and Microsoft said they will agree to license each other for operating system patents currently held by the other. Microsoft will also make an undisclosed cash payment to Armonk, N.Y.-based IBM.
David Wu, an analyst with SG Warburg, said the breakup will not hurt IBM or Microsoft.
"Looking down the road, a formal divorce after September 1993 would not be harmful to either party," he said.

Microsoft, IBM agree to end operating system feud

NEW YORK -- Two of the giants of the computer world, software house Microsoft Corp. and International Business Machines Corp., said Sunday they have agreed to end a long-running feud over their competing software operating systems.
The two companies said they reached agreements on royalties and licenses related to IBM's OS/2 and Microsoft's Windows operating systems, which will basically allow the two companies to go their separate ways.
"Basically we're agreeing on how to unravel ourselves from the (September 1990) contract," Steve Ballmer, executive vice president of worldwide sales for Microsoft, told Reuters.
The 1990 contract governed plans by IBM and Microsoft to jointly build an operating system that goes beyond the MS/DOS system, which was introduced in 1981 for the IBM personal computer.
A computer's operating system provides the basic rules for how a computer functions. Microsoft, whose software controlled the first IBM PCs in the early 1980s, has become the dominant force in such software.
In the agreement, IBM and Microsoft said they will agree to license each other for operating system patents currently held by the other. Microsoft will also make an undisclosed cash payment to Armonk, N.Y.-based IBM.
David Wu, an analyst with SG Warburg, said the breakup will not hurt IBM or Microsoft.
"Looking down the road, a formal divorce after September 1993 would not be harmful to either party," he said.

Gates seeks electronic art for home

SEATTLE - More than half a century ago, William Randolph Hearst was searching the world for art to put in the palatial home he built near San Simeon, Calif.
Now computer software magnate William H. Gates III is conducting a similar search for art to put on computer discs for the $5 million home he is building on the shore of Lake Washington.
A published report said his goal is to compile 10,000 images of paintings and photographs that could be displayed on huge, high-definition television screens at the push of a button.
Gates, 35, worth an estimated $4 billion as co-founder and chairman of Microsoft Corp., already has bought electronic rights to 1,000 artworks from the Seattle Art Museum, director Jay Gates (no relation) said.
Jay Gates refused to give financial details but said through a spokesman the deal was fair to both sides.
The agreement was reported in editions of The Seattle Times.
Helen Abbott, museum publications and media manager, said the deal was signed March 27 for non-exclusive rights to a representative sampling of the 18,000 objects in the collection.
Gates also is the founder and sole owner of Interactive Home Systems. Terry Lipscomb, manager of the company, says the palatial mansion will be used to test ideas on computerized living.
Besides state-of-the-art video games and systems, the house is being built with a reception hall to serve 120 people, a theater and a beach pavilion.
Interactive Home Systems has been negotiating with museums and individuals nationwide to buy electronic rights to artwork and still images. Any artwork that can be photographed can be digitized by a computer scanner.
TV screens at the house will be hooked up to advanced computers tapping into a huge database containing images, Lipscomb said. The company is researching ways to use the images and make it easy for a person to call up data.

The Postponed Generation/Reality of corporate jobs shakes all illusions

SLIGHTLY AMUSED, he peers out at us from behind heavy, plastic-frameglasses. He seems to be wondering why he is on the cover of Time in his V-necked sweater and rumpled button-down shirt, open at the collar. Perhaps it is is the pose that he finds funny. A floppy disk is magically balanced on one corner of his index finger. The disk, of course, is a symbolic explanation of why he is on the cover of Time. He is Bill Gates, chairman and co-founder of Microsoft, a computer software company whose 1984 revenues, according to Time, were $100 million.
Time also estimates Gates's personal worth at a $100 million and tells us he has a $750,000 home with a 30-foot indoor swimming pool and a view of Lake Washington. Gates is 28 years old.
Of all the things that computers have contributed to this generation, one of the more significant must be the image of the new breed of businessman, the under-30 entrepreneur who became a millionaire on his own. High-tech enterprises, especially software, required brains but very little capital investment - a few machines and a garage to work in. It was a business in which a graduate student - or a college dropout - with a good idea could become a millionaire virtually overnight.
This new business person was not a company man, a functionary loyally shuffling papers or working a territory until it was time to retire. He was self-propelled and blatantly self-interested, and he approached what he did as if it were the big game and he were the quarterback. He had strategies and tactics. He bought books on power lunching and learned to eat raw steak. And more and more often, he was a she.
The hot new degree became the master's in business administration. The M.B.A. programs became so popular that the more prestigious ones stopped admitting students right after college graduation. They had to have "significant business experience" first so that they "brought something to the table." Undergraduate business departments became impacted as 18-year-olds eagerly signed up for a future in making money. In 1966, 11.6 percent of entering freshmen planned to major in business. In 1982, the percentage had risen to 20.2. Similarly, 38,900 bachelor's degrees in business were confered in 1975. By 1980, the number had soared to 61,600. In the past few years, the value of the M.B.A. has fluctuated downward slightly as corporations question whether the degree is worth the salary it commands. But it is still very much the degree to get.
Perhaps these young people, like the Humphrey Bogart character who came to Casablanca for the waters, were just misinformed. When they couldn't get jobs or when the jobs they got turned out to be dead ends, they started thinking about going off on their own.
The highest calling in this brave new world was to be a risk-taker, to leave the security of the company and become an entrepreneur.
"There's no definition for that word," says Tom Omalia, a financial consultant who teaches in the University of Southern California's Entrepreneur Program. "The entrepreneur is the one who makes things happen."

My fellow Americans:
There's a memorable bit of dialog between Claude Rains and Humphrey Bogart in the movie "Casablanca." Rains, playing the Vichy French police inspector, asked Bogart why he came to Casablanca; and Bogart says it was for "the waters." "But this is the desert," replies Rains, "there are no waters here." And Bogart, unflappable as ever, responds, "I was misinformed."
Now, I'd like to turn for a moment to events this past week in the Persian Gulf. The actions that our forces took in the Gulf were a measured response to Iran's resumption of mine-laying and continued aggression against nonbelligerents.
I am extremely proud of the courage and resourcefulness of our military personnel in the Persian Gulf. Their performance under very difficult circumstances has been superb. We're also very pleased with the role that the European allies are playing in a cooperative effort to counter the Iranian mining threat and to help protect freedom of navigation. Such cooperative efforts, supported by our Gulf Arab friends, offer the best means of deterring Iran and enhancing Gulf security. Working together, we can also put new life into the U.N. Security Council's efforts to end the increasingly bloody, inhumane Iran-Iraq war and remove the root cause of tensions in the Gulf. Our role in this war is neutral, and we do not seek to confront Iran. However, its leaders must understand that continued military and terrorist attacks against nonbelligerents and refusal to negotiate an end to the war will be very costly to Iran and its people.

Thanksgiving Day is one of our most beloved holidays, an occasion set aside by Americans from earliest times to thank our Maker prayerfully and humbly for the blessings and the care He bestows on us and on our beautiful, bountiful land. Through the decades, through the centuries, in log cabins, country churches, cathedrals, homes, and halls, the American people have paused to give thanks to God, in times of peace and plenty or of danger and distress.
Acknowledgement of dependence on God's favor was, in fact, our fledgling Nation's very first order of business. When the delegates to the First Continental Congress met in Philadelphia in 1774, they overcame discord by uniting in prayer for our country. Pentagon officials said that lookouts on the frigate that was damaged, the Samuel B. Roberts, had sighted several mines in the water just before the explosion. The ship tried unsuccessfully to avoid the mines, the officials said.
Previously, Pentagon officials had said there was no direct evidence to show that the blast was caused by a mine, although this seemed the most likely possibility. Ten crew members were injured, two of them seriously.

The Postponed Generation/Reality of corporate jobs shakes all illusions

SLIGHTLY AMUSED, he peers out at us from behind heavy, plastic-frameglasses. He seems to be wondering why he is on the cover of Time in his V-necked sweater and rumpled button-down shirt, open at the collar. Perhaps it is is the pose that he finds funny. A floppy disk is magically balanced on one corner of his index finger. The disk, of course, is a symbolic explanation of why he is on the cover of Time. He is Bill Gates, chairman and co-founder of Microsoft, a computer software company whose 1984 revenues, according to Time, were $100 million.
Time also estimates Gates's personal worth at a $100 million and tells us he has a $750,000 home with a 30-foot indoor swimming pool and a view of Lake Washington. Gates is 28 years old.
Of all the things that computers have contributed to this generation, one of the more significant must be the image of the new breed of businessman, the under-30 entrepreneur who became a millionaire on his own. High-tech enterprises, especially software, required brains but very little capital investment - a few machines and a garage to work in. It was a business in which a graduate student - or a college dropout - with a good idea could become a millionaire virtually overnight.
This new business person was not a company man, a functionary loyally shuffling papers or working a territory until it was time to retire. He was self-propelled and blatantly self-interested, and he approached what he did as if it were the big game and he were the quarterback. He had strategies and tactics. He bought books on power lunching and learned to eat raw steak. And more and more often, he was a she.
The hot new degree became the master's in business administration. The M.B.A. programs became so popular that the more prestigious ones stopped admitting students right after college graduation. They had to have "significant business experience" first so that they "brought something to the table." Undergraduate business departments became impacted as 18-year-olds eagerly signed up for a future in making money. In 1966, 11.6 percent of entering freshmen planned to major in business. In 1982, the percentage had risen to 20.2. Similarly, 38,900 bachelor's degrees in business were confered in 1975. By 1980, the number had soared to 61,600. In the past few years, the value of the M.B.A. has fluctuated downward slightly as corporations question whether the degree is worth the salary it commands. But it is still very much the degree to get.
Perhaps these young people, like the Humphrey Bogart character who came to Casablanca for the waters, were just misinformed. When they couldn't get jobs or when the jobs they got turned out to be dead ends, they started thinking about going off on their own.
The highest calling in this brave new world was to be a risk-taker, to leave the security of the company and become an entrepreneur.
"There's no definition for that word," says Tom Omalia, a financial consultant who teaches in the University of Southern California's Entrepreneur Program. "The entrepreneur is the one who makes things happen."

The Arecibo message was beamed into space a single time (not repeated) via frequency modulated radio waves at a ceremony to mark the remodeling of the Arecibo radio telescope on 16 November 1974. It was aimed at the globular star cluster M13 some 25,000 light years away because M13 was a large and close collection of stars that was available in the sky at the time and place of the ceremony. The message consisted of 1679 binary digits, approximately 210 bytes, transmitted at a frequency of 2380 MHz and modulated by shifting the frequency by 10 Hz, with a power of 1000 kW. The "ones" and "zeroes" were transmitted by frequency shifting at the rate of 10 bits per second. The total broadcast was less than three minutes.
Because it will take 25,000 years for the message to reach its intended destination of stars (and an additional 25,000 years for any reply), the Arecibo message was more a demonstration of human technological achievement than a real attempt to enter into a conversation with extraterrestrials. In fact, the stars that the message was aimed at will no longer be there when it arrives. According to the Cornell News press release of November 12, 1999, the real purpose of the message was not to make contact, but to demonstrate the capabilities of newly installed equipment.

Pentagon officials said that lookouts on the frigate that was damaged, the Samuel B. Roberts, had sighted several mines in the water just before the explosion. The ship tried unsuccessfully to avoid the mines, the officials said.
Previously, Pentagon officials had said there was no direct evidence to show that the blast was caused by a mine, although this seemed the most likely possibility. Ten crew members were injured, two of them seriously.

Microsoft settles license lawsuit

SEATTLE - Microsoft Corp. said late Monday it has agreed to pay Seattle Computer Products Inc. nearly $1 million in an out-of-court settlement, ending jury deliberations in a $60 million licensing fraud lawsuit.
Microsoft, one of the nation's largest software manufacturers, will purchase back the seven license agreements it had with Seattle Computer, including any license for Microsoft operating systems products and high-level languages.
Seattle Computers, which has been virtually shut down, sued Microsoft over a 1981 agreement that Seattle Computers said was not intended to give Microsoft exclusive use of its program design and subsequent improvements.

Microsoft settles license lawsuit

SEATTLE - Microsoft Corp. said late Monday it has agreed to pay Seattle Computer Products Inc. nearly $1 million in an out-of-court settlement, ending jury deliberations in a $60 million licensing fraud lawsuit.
Microsoft, one of the nation's largest software manufacturers, will purchase back the seven license agreements it had with Seattle Computer, including any license for Microsoft operating systems products and high-level languages.
Seattle Computers, which has been virtually shut down, sued Microsoft over a 1981 agreement that Seattle Computers said was not intended to give Microsoft exclusive use of its program design and subsequent improvements.

Organized crime
Organized crime or criminal organizations are groups or operations run by criminals, most commonly for the purpose of generating a monetary profit. The Organized Crime Control Act (U.S., 1970) defines organized crime as "The unlawful activities of ... a highly organized, disciplined association...".
In order for a criminal organization to prosper, some degree of support is required from the society in which it lives. Thus, it is often necessary to corrupt some of its respected members, most commonly achieved through bribery, blackmail, and the establishment of symbiotic relationships with legitimate businesses. Judicial and police officers and legislators are especially targeted for control by organized crime via bribes.

Vietnam War
The Vietnam War was a military conflict that occurred in Vietnam, Laos and Cambodia from 1959 to 30 April 1975. The war was fought between the communist North Vietnam, supported by its communist allies, and the government of South Vietnam, supported by the United States and other member nations of the Southeast Asia Treaty Organization (SEATO).
The Viet Cong, the lightly armed South Vietnamese communist insurgency, largely fought a guerrilla war against anti-communist forces in the region. The North Vietnamese Army engaged in a more conventional war, at times committing large-sized units into battle.
Insurgency in the South, 1956–1960

The Sino-Soviet split led to a reduction in the influence of PRC, which had insisted in 1954 that the Viet Minh accept a division of the country. Truong Chinh, North Vietnam's pro-PRC party first secretary, was demoted and Hanoi authorized communists in South Vietnam to begin a low level insurgency in December 1956. This insurgency in the south had begun in response to Diem's Denunciation of Communists campaign, in which thousands of local Viet Minh cadres and supporters had been executed or sent to concentration camps, and was in violation of the Northern Communist party line which had enjoined them not to start an insurrection, but rather engage in a political campaign, agitating for a free all-Vietnam election in accordance with the Geneva accords. Ho Chi Minh stated, "Do not engage in military operations; that will lead to defeat. Do not take land from a peasant. Emphasize nationalism rather than communism. Do not antagonize anyone if you can avoid
it. Be selective in your violence. If an assassination is necessary, use a knife, not a rifle or grenade. It is too easy to kill innocent bystanders with guns and bombs, and accidental killing of the innocent bystanders will alienate peasants from the revolution. Once an assassination has taken place, make sure peasants know why the killing occurred." This strategy was referred to as "armed propaganda." Soon afterward, Le Duan, a communist leader who had been working in the South, returned to Hanoi to accept the position of acting first secretary, effectively replacing Truong. Duan urged a military line and advocated increased assistance to the insurgency.
Four hundred government officials were assassinated in 1957 alone, and the violence gradually increased. While the terror was originally aimed at local government officials, it soon broadened to include other symbols of the status quo, such as schoolteachers, health workers, and agricultural officials. According to one estimate, 20 percent of South Vietnam's village chiefs had been assassinated by the insurgents by 1958. (The village chiefs were Diem appointees from outside the villages and were hated by the peasantry for their corruption and abuse.) The insurgency sought to completely destroy government control in South Vietnam's rural villages and replace it with a shadow government.

Blazers are sold to Seattle man

PORTLAND, Ore. - The NBA's Portland Trail Blazers were sold Tuesday to Seattle businessman Paul Allen, longtime owner Larry Weinberg said.
Details of the sale were not disclosed. Weinberg said he expected the NBA to approve the deal within two to three weeks.
Portland was granted a franchise by the NBA in 1970, and won its only league championship in 1977.
"The decision to sell was one of the most agonizing decisions of my life," said Weinberg, one of the original three owners of the team. "However, there comes a time when it's appropriate to move on."
Weinberg, 62, of Los Angeles became majority owner and president of the team in 1975. He said he was impressed with Allen, 35, who will be the team's sole owner.
"He is, first of all, a fan," Weinberg said. "Unless you're a fan, nothing else counts in this ownership.
"He also has the financial backing to do what needs to be done," Weinberg said. "Third, he's from the Northwest and he's committed to keeping the franchise in this area."
Allen is president and chief executive officer of Asymetrix Corp., a computer software company based in Bellevue, Wash. He also is one of the founders of another software company, Microsoft of Redmond, Wash., which he left in 1983 to form Asymetrix.
