Search for 2 Missing Boys Continues; Officials Baffled

UNION, S.C. — About 80 law officers and volunteers probed with sticks and trudged through woods dense with kudzu Friday, searching for any trace of two little boys said by their mother to have been snatched by a carjacker.
As that fruitless search was ending, another began: Tracking dogs, helicopters and deputies in bulletproof vests swarmed over another wooded area after a child reported seeing a man matching the suspect's description.
Once again, in a case that has baffled authorities and residents of this rural town, nothing came of it.
"The breaks have not been coming like we thought they would. It's unbelievable," Sheriff Howard Wells said of the investigation into the disappearance of 3-year-old Michael Smith and 14-month-old Alex Smith.
On Tuesday, their mother, Susan Smith, 23, said a man with a gun forced his way into her car at a traffic light and then after a few miles forced her out in an isolated area, driving away with her sons still in their safety seats.
Through a family spokeswoman, she and the boys' father, David Smith, appealed again Friday for the return of the children and thanked the searchers.
Addressing the missing boys, the spokeswoman, Margaret Gregory, added: "We miss you, we love you, and we want you home."
Susan Smith filed for divorce last month, though the sheriff said he did not consider that a factor in the case.
Sheriff's investigators questioned David Smith on Friday. Asked why, Wells replied: "We are looking for a possible motive for a crime of this type. At present we haven't had a ransom demand, we have not had a motive where someone would be mad at the family."
While pursuing the case as a carjacking and abduction, he said: "We are not ruling out anything."
Earlier Friday, four teams of searchers were assembled at the thickly wooded spot where Susan Smith said she last saw her sons, a road about 10 miles outside Union. She had run to a house nearby to report being forced from the car.
The teams fanned out over the four square miles near a lake that had already been searched by divers for Susan Smith's car, a burgundy 1990 Mazda Protege.
Hiking up a slope with his breath frosting the air after overnight temperatures in the 30s, volunteer John Phillips voiced everyone's hope that the boys were somewhere else and safe. "I hope we don't find anything," he said.
What they did find was very little. A state agent said an article of children's clothing that was picked up was the wrong size.
Searchers were scrambled yet again after a 12-year-old girl called the sheriff's office to report that she had just seen a man matching the suspect's description emerging from woods behind a shopping mall on the opposite side of town.

John G. Roberts, nominated in July to replace retiring Supreme Court Associate Justice Sandra Day O’Connor, was named by President Bush September 5 to replace the late William H. Rehnquist as chief justice of the United States.
Rehnquist died September 3 at age 80, after a long battle with thyroid cancer. (See related article.)
If confirmed, the 50-year-old Roberts would likely lead the U.S. Supreme Court for decades to come.
The U.S. Senate, which must approve nominations made by the president for the Supreme Court, had been scheduled to begin confirmation hearings for Roberts on September 6. (See related article.)
The president said a new nomination for O’Connor’s replacement would be presented “in a timely manner.”

Report: Boehner's bartender planned to poison him

Washington (CNN)John Boehner's former bartender once made plans to slip poison into the House speaker's drink, or shoot him and drive away, authorities say.
Among the reasons driving the alleged assassination plot: Michael Hoyt heard voices that told him Boehner was evil. He thought the Ohio Republican was the devil. He blamed Boehner for the Ebola outbreak. And he thought the speaker was mean to him.
Asked about the threats Wednesday, Boehner turned away from television cameras and said: "Can't make this stuff up."
The 44-year-old Butler County, Ohio, man was indicted last week on charges that he planned to murder Boehner -- a plan that he made after being fired from the Wetherington Golf & Country Club in West Chester.
House Majority Leader Kevin McCarthy (R-California) said Wednesday that Boehner hadn't mentioned Hoyt's threats to his colleagues.
McCarthy told reporters that "in society where we live, it's a sad situation that -- I think this individual needs a great deal of help, but the speaker also needs to be protected."
The story of Hoyt's arrest was first reported by WCPO in Cincinnati. According to a complaint filed in federal court in Cincinnati and obtained by CNN, police learned the details of his alleged plans after Hoyt called officers on Oct. 29.
"Hoyt told the officer he was Jesus Christ and he was going to kill Boehner because Boehner was mean to him at the country club and because Boehner is responsible for Ebola," United States Capitol Police Special Agent Christopher Desrosiers reported. "Hoyt advised he had a loaded Beretta .380 automatic and he was going to shoot Boehner and take off."
Police said Hoyt also emailed Boehner's wife, Debbie, twice.
"If I had any intention of hurting Mr. Boehner, I could have poisoned his wine at Wetherington many, many times," police said he wrote in one of his emails.
Police said Hoyt told them he heard voices that told him Boehner is evil, and that he wanted to expose the Ohio Republican as the devil. He blamed Boehner for the Ebola outbreak and believed the speaker was among a group of country club patrons who complained about his service and cost him his job.
He said he hoped sharing his threats with law enforcement officers would prompt Boehner to apologize, and force him to discuss the issue of Ebola.
Police seized guns and ammunition from the man's home. They said he kept a notebook that contained the words "John Boehner" and "Ebola," and that Hoyt had been treated for a psychotic episode about two years ago. Police placed Hoyt on a 72-hour psychiatric ward hold.
Boehner's spokesman, Michael Steel, issued a brief statement acknowledging the report Tuesday evening.
"Speaker Boehner is aware of this situation, and sincerely thanks the FBI, the Capitol Police and local authorities in Ohio for their efforts," he said.
A source familiar with the situation said Boehner and some of his key staff members have known about Hoyt since November, but didn't know the timing of the indictment.
Boehner and his wife also had a "level of awareness" of Hoyt, since the country club is near their home and he had worked there for several years, the source said.

The monopoly on the legitimate use of violence (Gewaltmonopol des Staates, also known as monopoly on legitimate violence and monopoly on violence) is the definition of the state expounded by Max Weber in Politics as a Vocation, and has been predominant in philosophy of law and political philosophy in the twentieth century. It defined a single entity, the state, exercising legitimate authority or violence over a given territory as territory was also deemed by Weber a characteristic of state. Monopoly on the simple use of violence, as discussed below, is different.
Generally speaking, those who support the existence of the state believe that there should be a monopoly on the use of violence, or at least a near monopoly. That is, they believe private violence should be prevented or punished unless it is used solely in immediate self-defence from violence. Supporters of the state monopoly argue that if a monopoly on the use of violence does not exist, private individuals or groups will, inevitably, arm themselves and use violence against each other and others; thus they claim that anarchy results in more violence than found in even the most violent state (though this is by definition implausible, as any successful use of violence will, with only the most wildly improbable of hypothetical exceptions, immediately result in at least momentary hierarchy — the very antithesis of anarchy). In support of such reasoning, supporters sometimes point to areas and periods where, on their reading of events, this monopoly did not exist (or, in some sense, where there existed close to a "free market" in violence and security), such as modern Somalia, or Europe during the Dark Ages. They contend that such instances show that the attainment by any government of a monopoly on violence would have improved the lives of the inhabitants.
The philosopher Thomas Hobbes strongly supported a centralized practitioner of force, as he believed that that is the only way an orderly society could be maintained. As Hobbes writes in The Leviathan:
For the laws of nature, as justice, equity, modesty, mercy, and, in sum, doing to others as we would be done to, of themselves, without the terror of some power to cause them to be observed, are contrary to our natural passions, that carry us to partiality, pride, revenge, and the like. And covenants, without the sword, are but words and of no strength to secure a man at all. Therefore, notwithstanding the laws of nature (which every one hath then kept, when he has the will to keep them, when he can do it safely), if there be no power erected, or not great enough for our security, every man will and may lawfully rely on his own strength and art for caution against all other men.
