The look on Stuart's face was all the response either man needed.

"You tell our friends that if we don't get off on this one, we start talking."

The jail guards had already told both men in loving detail what fate had in store for them. One had even shown Ram n a poster of the chair itself with the caption REGULAR OR EXTRA CRISPY. Though a hard man and a brutal one, the idea of being strapped into a hard-backed wooden chair, then having a copper band affixed to his left leg, and a small metal cap set on a bald spot that the prison barber would shave on his head the day before, and the small sponge soaked in a saline solution to facilitate electrical conductivity, the leather mask to keep his eyes from flying out of his head... Ram n was a brave man when he had the upper hand, and that hand held a gun or a knife directed at an unarmed or bound person. Then he was quite brave. It had never occurred to him that one day he might be the helpless one. Ram n had lost five pounds in the preceding week. His appetite was virtually nil and he took an inordinate interest in light bulbs and wall sockets. He was afraid, but more than that he was angry, at himself for his fear, at the guards and police for giving him that fear, and at his former associates for not getting him free of this mess.

"It does not matter. I have spoken with the federales , and they do not care what you know. The U.S. Attorney claims to have no interest in what you might tell him."

"That is ridiculous. They always trade for information, they always -"

"Not here. The rules have changed."

"What do you tell us?"

"I will do my best for you." I'm supposed to tell you to die like men , Stuart could not say. "There are many things that can happen in the next few weeks."

The attorney was rewarded with skeptical expressions not entirely devoid of hope. He himself had no hope at all. The U.S. Attorney was going to handle this one himself, the better to get his face on the 5:30 and 11:00 Eyewitness News broadcasts. This would be a very speedy trial, and a U.S. Senate seat would be available in just over two years. So much the better that the prosecutor could point to his law-and-order record. Frying some druggie-pirate-rapist-murderers would surely appeal to the citizens of the sovereign state of Alabama, Stuart knew. The defense attorney objected to capital punishment on principle, and had spent much of his time and money working against it. He'd successfully taken one case to the Supreme Court and on a five-to-four decision managed to get his client a new trial, where the death sentence had been bargained down to life plus ninety-nine years. Stuart regarded that as a victory even though his client had survived precisely four months in the prison's general population until someone who disliked child-murderers had put a shank into his lumbar spine. He didn't have to like his clients - and most often he didn't. He was occasionally afraid of them, especially the drug runners. They quite simply expected that in return for however much cash - it was generally cash - they paid for his services they would get their freedom in return. They did not understand that in law there are no guarantees, especially for the guilty. And these two were guilty as hell. But they did not deserve death. Stuart was convinced that society could not afford to debase itself to the level of... his clients. It was not a popular opinion in the South, but Stuart had no ambition to run for public office.

In any case, he was their lawyer, and his job was to provide them with the best possible defense. He'd already explored the chances of a plea-bargain; life imprisonment in exchange for information. He'd already examined the government's case. It was all circumstantial - there were no witnesses except his own clients, of course - but the physical evidence was formidable, and that Coast Guard crew had scrupulously left the crime scene intact except for removing some evidence, all of which had been carefully locked up for a proper chain-of-evidence. Whoever had briefed and trained those people had done it right. Not much hope there. His only real hope, therefore, was to impeach their credibility. It was a slim hope, but it was the best he had.

Supervisory Special Agent Mark Bright was also working late. The crew had been busy. For starters there had been an office and a home to search, a lengthy procedure that was just the opening move in a process to last months, probably, since all the documents found, all the phone numbers scribbled in any of eleven places, all the photographs on desks and walls, and everything else found would have to be investigated. Every business acquaintance of the deceased would be interviewed, along with neighbors, people whose offices adjoined his, members of his country club, and even parishioners at his church. For all that, the major break in the case had come in the second hour of the fourth home search, fully a month after the case had begun. Something had told them all that there had to be something else. In his den, the deceased had a floor safe - with no record of its purchase or installation - neatly hidden by an untacked segment of the wall-to-wall carpeting. Discovering it had required thirty-two days. Tickling it open took nearly ninety minutes, but an experienced agent had done it by first experimenting with the birthdays of the deceased's whole family, then playing variations on the theme. It turned out that the three-element combination came from taking the month of the man's birth and adding one, taking the day of his birth and adding two, then taking the year of his birth and adding three. The door of the expensive Mosler came open with a whisper as it rubbed against the rug flap.

No money, no jewels, no letter to his attorney. Inside the safe had been five computer disks of a type compatible with the businessman's IBM personal computer. That told the agents all they wanted. Bright had at once taken the disks and the deceased's computer to his office, which was also equipped with IBM-compatible machines. Mark Bright was a good investigator, which meant that he was a patient one. His first move had been to call a local computer expert who assisted the FBI from time to time. A freelance software consultant, he'd first protested that he was busy, but he'd only needed to hear that there was a major criminal investigation underway to settle that. Like many such people who informally assist the FBI, he found police work most exciting, though not quite exciting enough to take a full-time job for the FBI Laboratory. Government service didn't come close to paying what he earned on the outside. Bright had anticipated his first instruction: bring in the man's own computer and hard-disk.

CAPE CANAVERAL, Fla. — A Washington budget official renowned as a cost-cutter and supporter of President Bush's efforts to rein in space-station spending was nominated yesterday as NASA's next administrator.

Bush chose Sean O'Keefe, 45, deputy director of the Office of Management and Budget. He must be approved by the Senate.

O'Keefe, who served briefly as Navy secretary for Bush's father, also worked for Vice President Dick Cheney when Cheney was defense secretary in the 1990s.

Lloyd Henreid, who had been tagged “the baby-faced, unrepentant killer” by the Phoenix papers, was led down the hallway of the Phoenix municipal jail’s maximum security wing by two guards. One of them had a runny nose, and they both looked sour. The wing’s other occupants were giving Lloyd their version of a tickertape parade. In Max, he was a celebrity.

“Heyyy, Henreid!”

“Go to, boy!”

“Tell the DA if he lets me walk I won’t letya hurt im!”

“Rock steady, Henreid!”

“Right on, brother! Rightonrightonrighton! ”

“Cheap mouthy bastards,” the guard with the runny nose muttered, and then sneezed.

Lloyd grinned happily. He was dazzled by his new fame. It sure wasn’t much like Brownsville had been. Even the food was better. When you got to be a heavy hitter, you got some respect. He imagined that Tom Cruise must feel something like this at a world premiere.

At the end of the hall they went through a doorway and a double-barred electric gate. He was frisked again, the guard with the cold breathing heavily through his mouth as if he had just run up a flight of stairs. Then they walked him through a metal detector for good measure, probably to make sure he didn’t have something crammed up his ass like that guy Papillon in the movies.

“Okay,” the one with the runny nose said, and another guard, this one in a booth made of bulletproof glass, waved them on. They walked down another hall, this one painted industrial green. It was very quiet in here; the only sounds were the guards’ clicking footfalls (Lloyd himself was wearing paper slippers) and the asthmatic wheeze from Lloyd’s right. At the far end of the hall, another guard was waiting in front of a closed door. The door had one small window, hardly more than a loophole, with wire embedded in the glass.

“Why do jails always smell so pissy?” Lloyd asked, just to make conversation. “I mean, even the places where no guys are locked up, it smells pissy. Do you guys maybe do your wee-wees in the corners?” He snickered at the thought, which was really pretty comical.

“Shut up, killer,” the guard with the cold said.

“You don’t look so good,” Lloyd said. “You ought to be home in bed.”

“Shut up,” the other said.

Lloyd shut up. That’s what happened when you tried to talk to these guys. It was his experience that the class of prison corrections officers had no class.

“Hi, scumbag,” the door-guard said.

“How ya doin, fuckface?” Lloyd responded smartly. There was nothing like a little friendly repartee to freshen you up. Two days in the joint and he could feel that old stir-stupor coming on him already.

“You’re gonna lose a tooth for that,” the door-guard said. “Exactly one, count it, one tooth.”

“Hey, now, listen, you can’t—”

“Yes I can. There are guys on the yard who would kill their dear old mothers for two cartons of Chesterfields, scumbucket. Would you care to try for two teeth?”

Lloyd was silent.

“That’s okay, then,” the door-guard said. “Just one tooth. You fellas can take him in.”

Smiling a little, the guard with the cold opened the door and the other led Lloyd inside, where his court-appointed lawyer was sitting at a metal table, looking at papers from his briefcase.

“Here’s your man, counselor.”

The lawyer looked up. He was hardly old enough to be shaving yet, Lloyd judged, but what the hell? Beggars couldn’t be choosers. They had him cold-cocked anyway, and Lloyd figured to get twenty years or so: When they had you nailed, you just had to close your eyes and grit your teeth.

“Thank you very—”

“That guy,” Lloyd said, pointing to the door-guard. “He called me a scumbag. And when I said something back to him, he said he was gonna have some guy knock out one of my teeth! How’s that for police brutality?”

The lawyer passed a hand over his face. “Any truth to that?” he asked the door-guard.

The door-guard rolled his eyes in a burlesque My God, can you believe it? gesture. “These guys, counselor,” he said, “they should write for TV. I said hi, he said hi, that was it.”

“That’s a fuckin lie!” Lloyd said dramatically.

“I keep my opinions to myself,” the guard said, and gave Lloyd a stony stare.

“I’m sure you do,” the lawyer said, “but I believe I’ll count Mr. Henreid’s teeth before I leave.”

A slight, angry discomfiture passed over the guard’s face, and he exchanged a glance with the two that had brought Lloyd in. Lloyd smiled. Maybe the kid was okay at that. The last two CAs he’d had were old hacks; one of them had come into court lugging a colostomy bag, could you believe that, a fucking colostomy bag? The old hacks didn’t give a shit for you. Plead and leave, that was their motto, let’s get rid of him so we can get back to swapping dirty stories with the judge. But maybe this guy could get him a straight ten, armed robbery. Maybe even time served. After all, the only one he’d actually pokerized was the wife of the guy in the white Connie, and maybe he could just roll that off on ole Poke. Poke wouldn’t mind. Poke was just as dead as old Dad’s hatband. Lloyd’s smile broadened a little. You had to look on the sunny side. That was the ticket. Life was too short to do anything else.

He became aware that the guard had left them alone and that his lawyer—his name was Andy Devins, Lloyd remembered—was looking at him in a strange way. It was the way you might look at a rattlesnake whose back has been broken but whose deadly bite is probably still unimpaired.

“You’re in deep shit, Sylvester!” Devins exclaimed suddenly.

Lloyd jumped. “What? What the hell do you mean, I’m in deep shit? By the way, I thought you handled ole fatty there real good. He looked mad enough to chew nails and spit out—”

“Listen to me, Sylvester, and listen very carefully.”

“My name’s not—”

“You don’t have the slightest idea how big a jam you’re in, Sylvester.” Devins’s gaze never faltered. His voice was soft and intense. His hair was blond and crewcut, hardly more than a fuzz. His scalp shone through pinkly. There was a plain gold wedding band on the third finger of his left hand and a fancy fraternity ring on the third finger of his right. He knocked them together and they made a funny little click that set Lloyd’s teeth on edge. “You’re going to trial in just nine days, Sylvester, because of a decision the Supreme Court handed down four years ago.”

“What was that?” Lloyd was more uneasy than ever.

“It was the case of Markham vs. South Carolina,” Devins said, “and it had to do with the conditions under which individual states may best administer swift justice in cases where the death penalty is requested.”

“Death penalty!” Lloyd cried, horror-struck. “You mean the lectric chair? Hey, man, I never killed anybody! Swear to God!”

“In the eyes of the law, that doesn’t matter,” Devins said. “If you were there, you did it.”

“What do you mean, it don’t matter?” Lloyd nearly screamed. “It does so matter! It better fuckin matter! I didn’t waste those people, Poke did! He was crazy! He was—”

“Will you shut up, Sylvester?” Devins inquired in that soft, intense voice, and Lloyd shut. In his sudden fear he had forgotten the cheers for him in Maximum, and even the unsettling possibility that he might lose a tooth. He suddenly had a vision of Tweety Bird running a number on Sylvester the Cat. Only in his mind, Tweety wasn’t bopping that dumb ole puddy-tat over the head with a mallet or sticking a mousetrap in front of his questing paw; what Lloyd saw was Sylvester strapped into Old Sparky while the parakeet perched on a stool by a big switch. He could even see the guard’s cap on Tweety’s little yellow head.

This was not a particularly amusing picture.

Perhaps Devins saw some of this in his face, because he looked moderately pleased for the first time. He folded his hands on the pile of papers he had taken from his briefcase. “There is no such thing as an accessory when it comes to first-degree murder committed during a felony crime,” he said. “The state has three witnesses who will testify that you and Andrew Freeman were together. That pretty well fries your skinny butt. Do you understand?”

“I—”

“Good. Now to get back to Markham vs. South Carolina. I am going to tell you, in words of one syllable, how the ruling in that case bears on your situation. But first, I ought to remind you of a fact you doubtless learned during one of your trips through the ninth grade: the Constitution of the United States specifically forbids cruel and unusual punishment.”

“Like the fucking lectric chair, damn right,” Lloyd said righteously.

Devins was shaking his head. “That’s where the law was unclear,” he said, “and up until four years ago, the courts had gone round and round and up and down, trying to make sense of it. Does ‘cruel and unusual punishment’ mean things like the electric chair and the gas chamber? Or does it mean the wait between sentencing and execution? The appeals, the delays, the stays, the months and years that certain prisoners—Edgar Smith, Caryl Chessman, and Ted Bundy are probably the most famous—were forced to spend on various Death Rows? The Supreme Court allowed executions to recommence in the late seventies, but Death Rows were still clogged, and that nagging question of cruel and unusual punishment remained. Okay—in Markham vs. South Carolina, you had a man sentenced to the electric chair for the rape-murder of three college co-eds. Premeditation was proved by a diary this fellow, Jon Markham, had kept. The jury sentenced him to death.”

“Bad shit,” Lloyd whispered.

Devins nodded, and gave Lloyd a slightly sour smile. “The case went all the way to the Supreme Court, which reconfirmed that capital punishment was not cruel and unusual under certain circumstances. The court suggested that sooner was better… from a legal standpoint. Are you beginning to get it, Sylvester? Are you beginning to see?”

Lloyd didn’t.

“We’re going to switch on at noon, and I’d like to have every one of you at home and ready. Ready for what? Four things. Listen up now, this is important. First, turn off every light and electrical appliance in your own house that you’re not using. Second, do the same for the unoccupied houses around yours. Third, if you smell gas, track down the smell and shut off whatever is on. Fourth, if you hear a fire siren, go to the source of the sound… but go safely and sanely. Let’s not have any necks broken in motorcycle accidents. Now—are there any questions?”

There were several, all of them reconfirming Brad’s original points. He answered each one patiently, the only sign of nervousness the way he bent his little black notebook ceaselessly back and forth in his hands.

When the questions had slowed to a trickle, Brad said: “I want to thank the folks who busted their humps getting us going again. And I want to remind the Power Committee that it isn’t disbanded. There are going to be lines down, power outages, oil supplies to track down in Denver and haul up here. I hope you’ll all stick with it. Mr. Glen Bateman says we may have ten thousand people here by the time the snow flies, and a lot more next spring. There’s power stations in Longmont and Denver that are going to have to come on line before next year’s done with—”

“Not if that hardcase gets his way!” someone shouted out hoarsely in the back of the hall.

There was a moment of dead silence. Brad stood with his hands clutching the lectern in a deathgrip, his face pasty white. He’s not going to be able to finish, Stu thought, and then Brad did go on, his voice amazingly even:

“My business is power, whoever said that. But I think we’ll be here long after that other guy’s dead and gone. If I didn’t think that, I’d be wrapping motors over on his side. Who gives a shit for him?”

Brad stepped away front the podium and someone else bellowed, “You’re goddam right!”

This time the applause was heavy and hard, nearly savage, but there was a note to it Stu didn’t like. He bad to pound with his gavel a long time to get the meeting back under control.

“The next thing on the agenda—”

“Fuck your agenda!” a young woman yelled stridently. “Let’s talk about the dark man! Let’s talk about Flagg! It’s long overdue, I’d say!”

Roars of approval. Shouts of “out of order!” Disapproving babble at the young woman’s choice of words. Rumble of side-chatter.

Stu whacked at the block on the podium so hard that the mallet-head flew off his gavel. “This is a meeting here!” he shouted. “You’re going to get a chance to talk about whatever you want to talk about, but while I’m chairing this meeting, I want… to have… some ORDER!” He bellowed the last word so loudly that feedback cut through the auditorium like a boomerang, and they quieted at last.

“Now,” Stu said, his voice purposely low and calm, “the next thing is to report to you on what happened up at Ralph’s on the night of September second, and I guess that falls to me, since I’m our elected law enforcement officer.”

Senna Threatens To Run Away With Grand Prix

PHOENIX — He doesn`t wear black, nor does he wear a perpetual scowl. But Ayrton Senna is every bit ``the Intimidator`` in Formula One racing that Dale Earnhardt is in Winston Cup.

It was not so much that Senna won the pole Saturday for Sunday`s U.S. Grand Prix that cast such an ominous pall over the other contenders for the world championship.

After all, it was the 53rd pole of the Brazilian`s meteoric career, 20 more than any other driver in history. But it came at the outset of a year when the rest of the field felt the domination of Senna`s McLaren-Honda team just might be ending.

And it came when McLaren`s new chassis and Honda V12 engine were virtually untested.

``The two cars our drivers drove yesterday had never turned a wheel before,`` said team manager Ron Dennis. ``There was not one glitch. What we`ve got, I think, is a car we can win the world championship with.


Senna is defending champion, though the course has been altered, making it shorter and faster. He always has done well in the U.S. Grand Prix, no matter where, winning four of the last five and never failing to win a race in which his car finished.

He has raced this weekend with a heavy cold, but that isn`t going to stop him, he vows.

The big question now is: If that won`t stop him, what-or who-will?
