Duke Cunningham
Randall Harold Cunningham (born December 8, 1941), usually known as Randy or Duke, was a Republican member of the United States House of Representatives from California's 50th Congressional District from 1991 to 2005.
Cunningham resigned from the House on November 28, 2005 after pleading guilty to accepting at least $2.4 million in bribes and underreporting his income for 2004. He pled guilty to federal charges of conspiracy to commit bribery, mail fraud, wire fraud, and tax evasion. On March 3, 2006, he received a sentence of eight years and four months in prison and an order to pay $1.8 million in restitution. Prior to his political career, he was an officer in the United States Navy for 21 years during which time he became a flying ace for actions during the Vietnam War.

Rep. Cunningham resigns, admits tax evasion, bribes

WASHINGTON — Rep. Randy "Duke" Cunningham, R-Calif., resigned from Congress on Monday after tearfully confessing to evading taxes and conspiring to pocket $2.4 million in bribes, including a Rolls-Royce, a yacht and a 19th-century Louis-Philippe commode.
The decorated Vietnam-era fighter pilot, 63, entered his guilty plea to a federal court in San Diego and then choked up as he said: "I broke the law, concealed my conduct and disgraced my high office. I know that I will forfeit my freedom, my reputation, my worldly possessions, and most importantly, the trust of my friends and family."
Prosecutors said Cunningham, a decorated Vietnam-era fighter pilot and eight-term House member, "demanded, sought and received" illicit payments in the form of cash, house payments, furnishings, cars and vacations from four co-conspirators, including two defense contractors, over the past five years.
U.S. Attorney Carol Lam told reporters that Cunningham, a member of the influential House Appropriations defense subcommittee and the intelligence committee, "did the worst thing an elected official can do: He enriched himself through his position and violated the trust of those that put him there."
The plea agreement, which Cunningham signed the day before Thanksgiving, said he must forfeit his house in Rancho Santa Fe, Calif.; as well as $1,851,508 in cash and a long list of furniture and carpets.
Sentencing was set for Feb. 27.

ONE million dollars for a house down payment. Two thousand for a daughter's graduation bash. Thousands more shelled out for rugs, yacht trips, nice furniture and holidays. In all, the price tag for Rep. Randy "Duke" Cunningham, R-Calif., came to $2.4 million - a trifle for two defense contractors whose business soared to $163 million after the congressman began to take their bribes.
The whole outsize scenario seems like a throwback to another time. In fact, the scandal is special only in its lack of subtlety.
After falsely denying the charges, a weepy Cunningham 'fessed up Monday and resigned. His crimes could earn him 10 years behind bars when he is sentenced Feb. 27. "He did the worst thing he could do," U.S. Attorney Carol Lam commented. "He enriched himself through his position and violated the trust of those who put him there."
In the era of the Robber Barons, such blatant cash-for-influence was common. Captains of industry listed congressmen and senators on their payrolls, doling out cash at regular intervals. Businesses would bankroll judges, who sometimes issued dueling injunctions to thwart patrons' arrests.

Tsar Bomba, literally "Tsar-bomb", is the nickname for the AN602 hydrogen bomb (codenamed "Ivan"[citation needed] by its developers) — the largest, most powerful nuclear weapon ever detonated, and currently the most powerful explosive ever detonated in human history.

Kurchatov and Beria watched from a bunker several kilometers away. When the site was cleared and everything was ready, Kurchatov ordered his team to begin the countdown. After several minutes, the automatic system detonated the bomb.

King County, Washington

Twenty years after the King County Council renamed the county for the Rev. Dr. Martin Luther King Jr., the council voted today to change the county logo from a crown to a likeness of the slain civil rights leader.
Council Chairman Larry Phillips, D-Seattle, said the county's current crown logo is an inappropriate "symbol of monarchy and royalty."

Confusing similarity
In trademark law, confusing similarity is a test used during the examination process to determine whether a trademark conflicts with another, earlier mark, and also in trademark infringement proceedings to determine whether the use of a mark infringes a registered trade mark.
In many jurisdictions this test has been superseded by the concepts of similarity and likelihood of confusion, due to the harmonizing effects of the Agreement on Trade-Related Aspects of Intellectual Property Rights.
Where mark X is not identical to a registered trademark, the use of mark X may still amount to an infringement if it is "confusingly similar" to the registered trademark. Mark X may share elements of spelling or style that would lead a reasonable observer to believe the trademarks were related.
For example, in the computer industry, Microsoft has become such a well known trade name and trade mark that other businesses in the industry may want to use the term "micro" or "soft" in their names. As Microsoft generally does not hold exclusive rights in these terms, it would need to establish that any trade names or trademarks which include these terms is confusingly similar to "Microsoft". The reputation attaching to a trademark is also significant, such that "Microsafe" or "Micro Software", although clearly not identical, could potentially be confusingly similar and amount to an infringement.
In addition, the style of a trade mark, such as a logo or font, can become relevant. For example, Microsoft products are distinguished in the marketplace by a consistent font. Competitors may not use the same font on their product, particularly when using a name which would not be confusingly similar except for the use of the font. For example, a brand called "Microsystems" would most likely not be confused with Microsoft. However if Microsystems used the same font as Microsoft, it would be confusingly similar. Some styles, like the script used on Coca-Cola products, are so well known that even a completely different name in a similar script could be held to be confusingly similar.
Cases of this type can be proven by using surveys which show that members of the public who are likely to use the services or goods protected by the trade mark have been confused by it. However, courts can also take judicial notice that an infringing mark is confusingly similar if it is obvious to even a casual observer.

In law, especially criminal law, a motive is the cause that moves people to induce a certain action. Motive in itself is seldom an element of any given crime; however, the legal system typically allows motive to be proven in order to make plausible the accused's reasons for committing a crime, at least when those motives may be obscure or hard to identify with.
The law technically distinguishes between motive and intent. "Intent" in criminal law is synonymous with mens rea, which means no more than the specific mental purpose to perform a deed that is forbidden by a criminal statute, or the reckless disregard of whether the law will be violated.[citation needed] "Motive" describes instead the reasons in the accused's background and station in life that are supposed to have induced the crime.
Motive is particularly important in prosecutions for homicide. First, murder is so drastic a crime that most people recoil from the thought of being able to do it; proof of motive explains why the accused did so desperate an act.

With a stroke of a pen, King County officially became Martin Luther King Junior County today, as Governor Christine Gregoire signed Senate Bill 5332 into law at the King County Courthouse. About 100 citizens, community leaders and local and state elected leaders attended the bill signing that came 19 years after the King County Council voted to rename the county to honor civil rights leader and Nobel Peace Prize winner the Reverend Dr. Martin Luther King Jr.

I'm especially pleased to be here today because—well, it's not often that I get to go to a birthday party for something that's older than I am. [Laughter]
But to subject you to a second speech here— [laughter] —you know, I keep thinking of a story of ancient Rome, where, on a Saturday afternoon, the hungry lions were turned loose on the little group of people there on the floor of the Coliseum, and they came charging toward them. And one individual stepped out of the group, said something very quietly, and the lions all laid down. Well, the crowd was enraged and horrified that they're going to be denied the show. And Caesar sent for the man who had spoken to the lions. And they brought him, and he said, "What did you say to them that made them act like that?" I thought that I was going to come in with the dean, and with his reputation, I'd been afraid that the good news was that we might perch on the backstage rafters and rappel in— [laughter] —and the bad news, that we'd jump from 10,000 feet. [Laughter] But it's a pleasure to be here to welcome you the graduates of this the West Point and Annapolis and Colorado Springs for physicians into your new profession as military and Public Health Service doctors.
When I hear about the can-do spirit of America's doctors in uniform, it reminds me of a story about a group of marines. I hope those of you in the other services will forgive me for telling this, but the get-it-done spirit applies to all of America's physicians in uniform. These marines had been sent to the Army airborne school for training. And came the day for the first jump, the training officer told them that the planes would come in at 1,500 feet, they would jump from the plane, hit the ground, and move south. The marines seemed a little disturbed by this, and they went into a huddle. Then one of them as a spokesman for the group went to the officer and asked couldn't the plane come in at 500 feet instead of 1,500? And the officer explained that if they took the plane in too low, it wouldn't give them time for the parachutes to open. And he said, "Oh, you mean we're wearing parachutes?" [Laughter]
A quarter century ago, Douglas MacArthur gave his farewell address to the Long Gray Line, the cadets of West Point. He stood in the vast hall of the academy, below the balcony they call the poop deck, and spoke about the soul, not just of the Army but of all the services that you now enter. State law changed to rename King County
With a stroke of a pen, King County officially became Martin Luther King Junior County today, as Governor Christine Gregoire signed Senate Bill 5332 into law at the King County Courthouse. About 100 citizens, community leaders and local and state elected leaders attended the bill signing that came 19 years after the King County Council voted to rename the county to honor civil rights leader and Nobel Peace Prize winner the Reverend Dr. Martin Luther King Jr.

§ 794. Gathering or delivering defense information to aid foreign government
(a) Whoever, with intent or reason to believe that it is to be used to the injury of the United States or to the advantage of a foreign nation, communicates, delivers, or transmits, or attempts to communicate, deliver, or transmit, to any foreign government, or to any faction or party or military or naval force within a foreign country, whether recognized or unrecognized by the United States, or to any representative, officer, agent, employee, subject, or citizen thereof, either directly or indirectly, any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, note, instrument, appliance, or information relating to the national defense, shall be punished by death or by imprisonment for any term of years or for life, except that the sentence of death shall not be imposed unless the jury or, if there is no jury, the court, further finds that the offense resulted in the identification by a foreign
power (as defined in section 101(a) of the Foreign Intelligence Surveillance Act of 1978) of an individual acting as an agent of the United States and consequently in the death of that individual, or directly concerned nuclear weaponry, military spacecraft or satellites, early warning systems, or other means of defense or retaliation against large-scale attack; war plans; communications intelligence or cryptographic information; or any other major weapons system or major element of defense strategy.
(b) Whoever, in time of war, with intent that the same shall be communicated to the enemy, collects, records, publishes, or communicates, or attempts to elicit any information with respect to the movement, numbers, description, condition, or disposition of any of the Armed Forces, ships, aircraft, or war materials of the United States, or with respect to the plans or conduct, or supposed plans or conduct of any naval or military operations, or with respect to any works or measures undertaken for or connected with, or intended for the fortification or defense of any place, or any other information relating to the public defense, which might be useful to the enemy, shall be punished by death or by imprisonment for any term of years or for life.
(c) If two or more persons conspire to violate this section, and one or more of such persons do any act to effect the object of the conspiracy, each of the parties to such conspiracy shall be subject to the punishment provided for the offense which is the object of such conspiracy.
(d)
(1) Any person convicted of a violation of this section shall forfeit to the United States irrespective of any provision of State law—
(A) any property constituting, or derived from, any proceeds the person obtained, directly or indirectly, as the result of such violation, and
(B) any of the person’s property used, or intended to be used, in any manner or part, to commit, or to facilitate the commission of, such violation.

Rep. Cunningham resigns, admits tax evasion, bribes

WASHINGTON — Rep. Randy "Duke" Cunningham, R-Calif., resigned from Congress on Monday after tearfully confessing to evading taxes and conspiring to pocket $2.4 million in bribes, including a Rolls-Royce, a yacht and a 19th-century Louis-Philippe commode.
The decorated Vietnam-era fighter pilot, 63, entered his guilty plea to a federal court in San Diego and then choked up as he said: "I broke the law, concealed my conduct and disgraced my high office. I know that I will forfeit my freedom, my reputation, my worldly possessions, and most importantly, the trust of my friends and family."
Prosecutors said Cunningham, a decorated Vietnam-era fighter pilot and eight-term House member, "demanded, sought and received" illicit payments in the form of cash, house payments, furnishings, cars and vacations from four co-conspirators, including two defense contractors, over the past five years.
U.S. Attorney Carol Lam told reporters that Cunningham, a member of the influential House Appropriations defense subcommittee and the intelligence committee, "did the worst thing an elected official can do: He enriched himself through his position and violated the trust of those that put him there."
The plea agreement, which Cunningham signed the day before Thanksgiving, said he must forfeit his house in Rancho Santa Fe, Calif.; as well as $1,851,508 in cash and a long list of furniture and carpets.
Sentencing was set for Feb. 27.

King County, Washington
King County is located in the U.S. state of Washington. The population in the 2000 census was 1,737,034, and in 2006 was an estimated 1,835,300. By population, King is the largest county in Washington, and the 14th largest in the United States. It is one of the most heavily educated counties in the nation, with approximately half of the population holding advanced degrees.

Twenty years after the King County Council renamed the county for the Rev. Dr. Martin Luther King Jr., the council voted today to change the county logo from a crown to a likeness of the slain civil rights leader.
Council Chairman Larry Phillips, D-Seattle, said the county's current crown logo is an inappropriate "symbol of monarchy and royalty."

Cunningham sentenced to 8 years, 4 months for taking bribes

SAN DIEGO, California (CNN) -- Former GOP Congressman Randy "Duke" Cunningham was sentenced Friday to eight years and four months in federal prison for taking $2.4 million in bribes from at least three defense contractors.
The sentence is the highest ever for a former member of Congress, prosecutor Jason Forge said. Cunningham was taken into custody after sentencing, he said.
The 64-year-old Cunningham, a former U.S. representative from California, pleaded guilty November 28 to conspiracy to commit bribery, mail fraud, wire fraud and tax evasion. He also pleaded guilty to a separate tax-evasion violation for failing to disclose income in 2004.
Hours after entering the pleas, Cunningham resigned from Congress in tears.
He could have been sentenced to 10 years in prison, but U.S. District Judge Larry Burns shortened his time because of Cunningham's military service, age and health, Forge said. If he continues to cooperate with authorities, his sentence could be reduced further, the prosecutor said.
Cunningham is a former Navy fighter pilot who shot down five MiGs during the Vietnam War.
"We're absolutely satisfied," said Forge, adding that he hoped the sentence "will help restore the public's confidence in our system and respect for our laws."
Cunningham sat on the powerful subcommittee that approves spending for defense programs. He has admitted accepting cash and gifts aimed at influencing the Defense Department while serving in that capacity.
House Speaker and fellow Republican Dennis Hastert issued a statement after Cunningham's sentencing stating that he hopes the congressman's prison term sends "a strong message" that nobody is above the law.

WASHINGTON - The two lawyers who were defending President Clinton before the House Judiciary Committee beginning today know what it is like to represent a politician who is in some degree of peril.
For Charles Ruff, the politician was Sen. Charles Robb, D-Va., who five years ago faced a grand-jury investigation of his office's possession of an illegally recorded tape of a 1988 phone call by Democrat Douglas Wilder, who was then Virginia's lieutenant governor. The grand jury did not return an indictment against Robb.
For Gregory Craig, the politician was a former boss, Sen. Edward Kennedy, D-Mass. Kennedy was accused of no wrongdoing, but Craig guided him through televised testimony in the 1991 Palm Beach, Fla., rape trial of his nephew, William Kennedy Smith.
Craig began his law career at Williams & Connolly. His cases included being part of the team that developed a successful insanity defense for John Hinckley Jr. after Hinckley's attempt to assassinate President Ronald Reagan.
But the world of politics and government has now three times pulled Craig away from the practice of law, first as Kennedy's top foreign-policy adviser in the late 1980s, then as director of policy planning in the State Department early in Clinton's second term, and now as a member of the White House staff.

WASHINGTON -- The deputy White House counsel, a close friend of President Clinton and Hillary Rodham Clinton, was found dead of an apparently self-inflicted gunshot wound Tuesday night at a park in northern Virginia.
Vincent W. Foster Jr., 48, was a senior partner at the Rose law firm in Little Rock, Ark., until earlier this year when he moved to Washington to join the Clinton administration. Clinton and Foster shared the same home town of Hope and attended the same elementary school.

WASHINGTON - The Navy's top admiral died in an apparent suicide Thursday just before a news magazine was preparing to question him about whether he was wearing combat decorations to which he was not entitled, Pentagon officials said.
Adm. Jeremy Michael Boorda, chief of naval operations apparently shot himself in the chest at his home at the Washington Navy Yard, using a .38-caliber pistol that belonged to his son-in-law, according to Pentagon officials. He was pronounced dead on arrival at District of Columbia General Hospital.
But Navy officials said Thursday that they still were not certain that the admiral's death was related to the medals issue. Two notes were found at Boorda's residence; they were sealed by investigating police.
However, the Washington Post reported in today's editions that the notes, one of which was written to Boorda's wife, expressed concern about the disgrace resulting from an impending disclosure questioning whether he had earned that two Vietnam-era decorations he had once worn. He had wrongly thought he was entitled to them, he said, but worried that some would never see his action as an honest mistake. The New York Times said the notes suggested Boorda had been driven to take his life by fear that the reputation of the Navy, already battered by a series of scandals, would be further harmed by the disclosures about his medals.
Pentagon officials said that Boorda had worn the Combat V until about a year ago and then took it off, but they were unable to explain the change. They said that the interview initially had been scheduled for 1 p.m., but scheduling problems forced Boorda to postpone it to 2:30 p.m.
Rear Adm. Kendell Pease, who was with Boorda shortly before the shooting, said that when he told Boorda about the subject of the interview, the admiral abruptly announced that he was going home for lunch instead of eating the meal that had been brought to his office.

The Navy said today that it had no plans to make public the two suicide notes left by Adm. Jeremy M. Boorda, the Chief of Naval Operations, who shot himself last week after questions were raised about the legitimacy of two Vietnam War combat decorations that he had worn.
Defense Department officials said that Admiral Boorda's wife and children considered the letters to be family property and had decided to keep them private, even though one was addressed not to the family but to "the sailors."
The Navy is not prepared to release the notes at this time," said Rear Adm. Kendell Pease, the Navy's chief spokesman. "We just don't feel it's appropriate." Asked whether the family had made the decision not to release the letters, the admiral said he had no comment.
Admiral Boorda, the Navy's highest-ranking officer, shot himself in the chest outside his Washington home on May 16, shortly after being told that Newsweek magazine had requested an interview with him to ask about two tiny "V" pins that he had worn on his ribbons until last year. The pins signify combat experience; his war service was on ships off the coast of Vietnam.
Navy officials have said that while Admiral Boorda might have been embarrassed by publicity over the medals, they still found it difficult to believe that the issue by itself would have been enough to lead him to suicide. Many had hoped that the letters would be made public to help end the speculation about the cause of Admiral Boorda's death.
Defense Department officials said one of the notes was a love letter to his wife, Bettie, and would probably never be made public.
The other, typewritten letter, they said, was addressed to "the sailors" and outlined Admiral Boorda's fear that the dispute over the medals would further damage the reputation of the Navy after a series of scandals in recent years.

§ 333. Major public emergencies; interference with State and Federal law
(a) Use of Armed Forces in Major Public Emergencies.—
(1) The President may employ the armed forces, including the National Guard in Federal service, to—
(A) restore public order and enforce the laws of the United States when, as a result of a natural disaster, epidemic, or other serious public health emergency, terrorist attack or incident, or other condition in any State or possession of the United States, the President determines that—
(i) domestic violence has occurred to such an extent that the constituted authorities of the State or possession are incapable of maintaining public order; and
(ii) such violence results in a condition described in paragraph (2); or
(B) suppress, in a State, any insurrection, domestic violence, unlawful combination, or conspiracy if such insurrection, violation, combination, or conspiracy results in a condition described in paragraph (2).
(2) A condition described in this paragraph is a condition that—
(A) so hinders the execution of the laws of a State or possession, as applicable, and of the United States within that State or possession, that any part or class of its people is deprived of a right, privilege, immunity, or protection named in the Constitution and secured by law, and the constituted authorities of that State or possession are unable, fail, or refuse to protect that right, privilege, or immunity, or to give that protection; or
(B) opposes or obstructs the execution of the laws of the United States or impedes the course of justice under those laws.
(3) In any situation covered by paragraph (1)(B), the State shall be considered to have denied the equal protection of the laws secured by the Constitution.

WASHINGTON - The two lawyers who were defending President Clinton before the House Judiciary Committee beginning today know what it is like to represent a politician who is in some degree of peril.
For Charles Ruff, the politician was Sen. Charles Robb, D-Va., who five years ago faced a grand-jury investigation of his office's possession of an illegally recorded tape of a 1988 phone call by Democrat Douglas Wilder, who was then Virginia's lieutenant governor. The grand jury did not return an indictment against Robb.
For Gregory Craig, the politician was a former boss, Sen. Edward Kennedy, D-Mass. Kennedy was accused of no wrongdoing, but Craig guided him through televised testimony in the 1991 Palm Beach, Fla., rape trial of his nephew, William Kennedy Smith.
Craig began his law career at Williams & Connolly. His cases included being part of the team that developed a successful insanity defense for John Hinckley Jr. after Hinckley's attempt to assassinate President Ronald Reagan.
But the world of politics and government has now three times pulled Craig away from the practice of law, first as Kennedy's top foreign-policy adviser in the late 1980s, then as director of policy planning in the State Department early in Clinton's second term, and now as a member of the White House staff.

Vietnam War
The Vietnam War was a military conflict that occurred in Vietnam, Laos and Cambodia from 1959 to 30 April 1975. The war was fought between the communist North Vietnam, supported by its communist allies, and the government of South Vietnam, supported by the United States and other member nations of the Southeast Asia Treaty Organization (SEATO).
The Viet Cong, the lightly armed South Vietnamese communist insurgency, largely fought a guerrilla war against anti-communist forces in the region. The North Vietnamese Army engaged in a more conventional war, at times committing large-sized units into battle.
Insurgency in the South, 1956–1960

The Sino-Soviet split led to a reduction in the influence of PRC, which had insisted in 1954 that the Viet Minh accept a division of the country. Truong Chinh, North Vietnam's pro-PRC party first secretary, was demoted and Hanoi authorized communists in South Vietnam to begin a low level insurgency in December 1956. This insurgency in the south had begun in response to Diem's Denunciation of Communists campaign, in which thousands of local Viet Minh cadres and supporters had been executed or sent to concentration camps, and was in violation of the Northern Communist party line which had enjoined them not to start an insurrection, but rather engage in a political campaign, agitating for a free all-Vietnam election in accordance with the Geneva accords. Ho Chi Minh stated, "Do not engage in military operations; that will lead to defeat. Do not take land from a peasant. Emphasize nationalism rather than communism. Do not antagonize anyone if you can avoid
it. Be selective in your violence. If an assassination is necessary, use a knife, not a rifle or grenade. It is too easy to kill innocent bystanders with guns and bombs, and accidental killing of the innocent bystanders will alienate peasants from the revolution. Once an assassination has taken place, make sure peasants know why the killing occurred." This strategy was referred to as "armed propaganda." Soon afterward, Le Duan, a communist leader who had been working in the South, returned to Hanoi to accept the position of acting first secretary, effectively replacing Truong. Duan urged a military line and advocated increased assistance to the insurgency.
Four hundred government officials were assassinated in 1957 alone, and the violence gradually increased. While the terror was originally aimed at local government officials, it soon broadened to include other symbols of the status quo, such as schoolteachers, health workers, and agricultural officials. According to one estimate, 20 percent of South Vietnam's village chiefs had been assassinated by the insurgents by 1958. (The village chiefs were Diem appointees from outside the villages and were hated by the peasantry for their corruption and abuse.) The insurgency sought to completely destroy government control in South Vietnam's rural villages and replace it with a shadow government.
