§ 794. Gathering or delivering defense information to aid foreign government
(a) Whoever, with intent or reason to believe that it is to be used to the injury of the United States or to the advantage of a foreign nation, communicates, delivers, or transmits, or attempts to communicate, deliver, or transmit, to any foreign government, or to any faction or party or military or naval force within a foreign country, whether recognized or unrecognized by the United States, or to any representative, officer, agent, employee, subject, or citizen thereof, either directly or indirectly, any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, note, instrument, appliance, or information relating to the national defense, shall be punished by death or by imprisonment for any term of years or for life, except that the sentence of death shall not be imposed unless the jury or, if there is no jury, the court, further finds that the offense resulted in the identification by a foreign power (as defined in section 101(a) of the Foreign Intelligence Surveillance Act of 1978) of an individual acting as an agent of the United States and consequently in the death of that individual, or directly concerned nuclear weaponry, military spacecraft or satellites, early warning systems, or other means of defense or retaliation against large-scale attack; war plans; communications intelligence or cryptographic information; or any other major weapons system or major element of defense strategy.
(b) Whoever, in time of war, with intent that the same shall be communicated to the enemy, collects, records, publishes, or communicates, or attempts to elicit any information with respect to the movement, numbers, description, condition, or disposition of any of the Armed Forces, ships, aircraft, or war materials of the United States, or with respect to the plans or conduct, or supposed plans or conduct of any naval or military operations, or with respect to any works or measures undertaken for or connected with, or intended for the fortification or defense of any place, or any other information relating to the public defense, which might be useful to the enemy, shall be punished by death or by imprisonment for any term of years or for life.
(c) If two or more persons conspire to violate this section, and one or more of such persons do any act to effect the object of the conspiracy, each of the parties to such conspiracy shall be subject to the punishment provided for the offense which is the object of such conspiracy.
(d)
(1) Any person convicted of a violation of this section shall forfeit to the United States irrespective of any provision of State law—
(A) any property constituting, or derived from, any proceeds the person obtained, directly or indirectly, as the result of such violation, and
(B) any of the person’s property used, or intended to be used, in any manner or part, to commit, or to facilitate the commission of, such violation.

felony murder doctrine
a rule of criminal statutes that any death which occurs during the commission of a felony is first degree murder, and all participants in that felony or attempted felony can be charged with and found guilty of murder. A typical example is a robbery involving more than one criminal, in which one of them shoots, beats to death or runs over a store clerk, killing the clerk. Even if the death were accidental, all of the participants can be found guilty of felony murder, including those who did no harm, had no gun, and/or did not intend to hurt anyone.

NOTE: Discovery allowed under Federal Rule of Civil Procedure 26 is far-reaching. With some exceptions, a party may obtain discovery of any relevant information as long as it is not privileged, including information that itself would not be admissible at trial but that is likely to lead to the discovery of admissible evidence. Criminal discovery, however, has been more controversial. Under Federal Rule of Criminal Procedure 16, a defendant may obtain discovery of his or her own written or recorded statements or confessions, results of examinations and tests, his or her recorded testimony before a grand jury, and testimony to be given by the prosecution's expert witnesses. A defendant may also inspect the prosecution's books, documents, photographs, objects, and other items of evidence. Under Federal Rule of Criminal Procedure 12.1, the prosecution must also disclose the names of witnesses that will be called to rebut the defendant's alibi defense. The defendant must also permit the prosecution to inspect books, documents, photographs, and objects and must disclose reports of examinations or tests and testimony of expert witnesses.

Rule 236. Admission of Business Records in Evidence
(a) Any writing or record, whether in the form of any entry in a book or otherwise, made as a memorandum or record of any act, transaction, occurrence, or event, shall be admissible as evidence of the act, transaction, occurrence, or event, if made in the regular course of any business, and if it was the regular course of the business to make such a memorandum or record at the time of such an act, transaction, occurrence, or event or within a reasonable time thereafter. All other circumstances of the making of the writing or record, including lack of personal knowledge by the entrant or maker, may be shown to affect its weight, but shall not affect its admissibility. The term "business," as used in this rule, includes business, profession, occupation, and calling of every kind.

Paragraph (a)
Paragraph (a) of this rule is a revision without change in substance of subsection 1732(a) of title 28 of the United States Code, generally known as the Federal Business Records Act. This act reflects the modern approach to the admissibility of business records as evidence.
In Illinois, the trend has been similar. In People v. Small, 319 Ill. 437, 477, 150 N.E. 435 (1926), the Supreme Court held bank records admissible on the basis of a foundation laid by the officers in charge of the records, stating, "The business of this great commercial country is transacted on records kept in the usual course of business and vouched for by the supervising officer, and such evidence ought to be competent in a court of justice. Modern authority sustains this view."

Electoral fraud
Electoral fraud is illegal interference with the process of an election. Acts of fraud tend to involve affecting vote counts to bring about a election result, whether by increasing the vote share of the favored candidate, depressing the vote share of the rival candidates or both. What electoral fraud is under law varies from country to country; methods which are illegal in one country may not be in another. Many kinds of voter fraud are outlawed in electoral legislation but others are in violation of general laws such as those banning assault, harassment or libel. Although technically the term 'electoral fraud' covers only those acts which are illegal, the term is sometimes used to describe acts which although legal, are considered to be morally unacceptable, outside the spirit of electoral laws or in violation of the principles of democracy. Show elections, in which only one candidate can win, are sometimes considered to be electoral fraud although they
may comply with the law.
In national elections, successful electoral fraud can have the effect of a coup d'état or corruption of democracy. In a narrow election a small amount of fraud may be enough to change the result. If the result is not affected, fraud can still have a damaging effect if not punished, as it can reduce voters' confidence in democracy. Even the perception of fraud can be damaging as it makes people less inclined to accept election results. This can lead to the breakdown of democracy and the establishment of a dictatorship.
Electoral fraud is not limited to political polls and can happen in any election where the potential gain is worth the risk for the cheater; as in elections for labor union officials, student councils, sports judging, and the awarding of merit to books, films, music or television programmes.
Despite many instances of electoral fraud, it remains a difficult phenomenon to study. This follows from its inherent illegality. Harsh penalties aimed at deterring electoral fraud make it likely that individuals who perpetrate fraud do so with the expectation that it either will not be discovered or will be excused.
Prosecution
In countries with strong laws and effective legal systems, lawsuits can be brought against those who have allegedly committed fraud; but determent with legal prosecution would not be enough. Although the penalties for getting caught may be severe, the rewards for succeeding are likely to be worth the risk. The rewards range from benefits in contracting to total control of a country.

Motive (law)
In law, especially criminal law, a motive is the cause that moves people to induce a certain action. Motive in itself is seldom an element of any given crime; however, the legal system typically allows motive to be proven in order to make plausible the accused's reasons for committing a crime, at least when those motives may be obscure or hard to identify with.
The law technically distinguishes between motive and intent. "Intent" in criminal law is synonymous with mens rea, which means no more than the specific mental purpose to perform a deed that is forbidden by a criminal statute, or the reckless disregard of whether the law will be violated.[citation needed] "Motive" describes instead the reasons in the accused's background and station in life that are supposed to have induced the crime.
Motive is particularly important in prosecutions for homicide. First, murder is so drastic a crime that most people recoil from the thought of being able to do it; proof of motive explains why the accused did so desperate an act.
