SECNAV INSTRUCTION 1650.1H

From: Assistant Secretary of the Navy (Manpower and Reserve Affairs)

Subj: NAVY AND MARINE CORPS AWARDS MANUAL

1. Purpose. To provide guidance and regulations concerning awards available for recognizing individuals and units in the Naval Service.

2. Navy Cross

a. Authorization. 10 U.S.C. S6242.

b. Eligibility Requirements

(1) Awarded to individuals who, while serving in any capacity with the Navy or Marine Corps, distinguish themselves by extraordinary heroism, not justifying the award of the Medal of Honor.

(a) While engaged in an action against an enemy of the United States;

(b) While engaged in military operations involving conflict with an opposing foreign force; or

(c) While serving with friendly foreign forces engaged in an armed conflict against an opposing armed force, in which the United States is not a belligerent party.

(2) To warrant this distinctive decoration, the act or execution of duty must be performed in the presence of great danger, or at great personal risk, and must be performed in such a manner as to set individuals apart from their shipmates or fellow Marines. An accumulation of minor acts of heroism normally does not justify the award. The high standards SECNAVINST 1650.1H demanded must be borne in mind when recommending the award.

Gates shot! But don't worry, it's only a movie

By John Zebrowski

Seattle Times staff reporter

Brian Flemming says he has nothing against the world's richest man, and took no joy in killing him. But he had to get rid of Bill Gates to make a larger point.

"It was basically a means to an end," said Flemming, a Los Angeles filmmaker. "The assassin was trying to start a class war. With Bill Gates, he found his target."

A Gates lookalike is shot to death in the opening scenes of Flemming's movie "Nothing So Strange," which will debut this month at Slamdance, the alternative to the Sundance Film Festival in Park City, Utah. Go to one of the two dozen Web sites devoted to the low-budget digital film and the killing can be seen and heard in chilling detail.

A camera pans a park and a lake from above, with a bloody Gates lying on the ground.

Gates has been the target of mock murders before. In "South Park: Bigger Longer & Uncut," a cartoon Gates is killed by a general when his PowerPoint presentation takes too long to load.

He's been attacked in real life, too. In 1998, a prankster hit Gates in the face with a cream pie during a business meeting in Belgium. CBS anchor Dan Rather gave this somber report: "A cowardly sneak attack on one of the world's wealthiest men. The target was Microsoft Chairman Bill Gates." Flemming liked it so much he used Rather's voiceover on his Web site for "Nothing So Strange."

Microsoft spokesman Jim Desler declined to comment on the latest film. However, the firm is known to have elaborate security procedures in place to protect Gates, his firm and his family. Gates often is shadowed by bodyguards at public events.

"Nothing So Strange" is Flemming's second feature film. He also made a radio documentary of a debate between a rabbi and Hustler publisher Larry Flynt. He co-wrote an off-Broadway play called "Batboy: The Musical," and five years ago started an alternative to Slamdance called Slumdance.

He expects some people to lash out at him for "Nothing So Strange." But others might see the film just to watch the oft-criticized Gates get knocked around, he said.

While he defends his artistic right to off a capitalist icon on film, he said the work is about police and political corruption — not a personal slam against Gates.

"I think Bill Gates haters will be disappointed with it," he said.

Peter Baxter, co-founder of Slamdance, said despite the jarring shots of Gates (played by impersonator Steve Sires) lying bleeding on the ground, the movie is more concerned with the citizens trying to solve the movie murder.

"It would be a mistake to think this film was made to upset one person," he said.

The "mockumentary" begins with Gates' slaying in a Los Angeles park Dec. 2, 1999. From there, it tracks a small group of activists determined to find the truth behind the slaying. Much like the people who still argue over the assassination of John F. Kennedy, the group descends into a whirlwind of conspiracy theories they can't escape.

The film was made mostly in 2000. Flemming positioned actors at the actual hearings involving the so-called Rampart scandal in the Los Angeles Police Department, where he filmed them yelling at officers. Then, at the Democratic National Convention, held that summer in L.A., he filmed actors protesting police handling of the mock-Gates case as they stood next to real demonstrators protesting the impeachment of President Clinton.

No studio has yet signed to distribute "Nothing So Strange." But Flemming, with the help of the people who made "The Blair Witch Project," has drawn attention to the film through a series of Web sites that follow the activists, called Citizens for Truth, and their quest for answers.

One question they haven't answered: What will Bill Gates and Microsoft think of all this?

"We haven't heard anything from them," Baxter said. "But if they've got a problem with it, we're not going to cave."

CHAPTER 39

HARMONY

John Brightling's eyes reported the sudden blaze of light from the sitting room. He opened them and saw-

"What the hell are you doing here, Wil?"

"They brought me down, John."

"Who brought you down?"

"The people who captured me in Sydney," Gearing explained.

"What?" It was a little much for so early in the morning. Brightling stood and put on the robe next to the bed.

"John, what is it?" Carol asked from her side of the bed.

"Nothing, honey, just relax." John went to the sitting room, pulling the doors closed as he did so.

"What the fuck is going on, Wil?"

"They're here, John."

"Who's here?"

"The counterterror people, the ones who went to Australia, the ones who arrested me. They're here, John!" Gearing told him, looking around the room, thoroughly disoriented by all the traveling he'd done and not sure of much of anything at the moment.

"Here? Where? In the building?"

"No." Gearing shook his head. "They dropped me off by helicopter. Their boss is a guy named Clark. He said to tell you that you have to surrender-unconditional surrender, John."

"Or else what?" Brightling demanded.

"Or else they're going to come in and get us!"

"Really?" This was no way to be awakened. Brightling had spent two hundred million dollars to build this place - labor costs were low in Brazil - and he considered Project Alternate a fortress, and more than that, a fortress that would have taken months to locate. Armed men - here, right now - demanding his surrender? What was this?

Okay, he thought. First he called Bill Henriksen's room and told him to come upstairs. Next he lit up his computer. There was no e-mail telling him that anyone had spoken with his flight crews. So, nobody had told anyone where they were. So, how the hell had anyone found out? And who the hell was here? And what the hell did they want? Sending someone he knew in to demand their surrender seemed like something from a movie.

"What is it, John?" Henriksen asked. Then he looked at the other man in the room: "Wil, how did you get here?"

Brightling held up his hand for silence, trying to think while Gearing and Henriksen exchanged information. He switched off the room lights, looked out the large windows for signs of activity, and saw nothing at all.

"How many?" Bill was asking.

"Ten or fifteen soldiers," Gearing replied. "Are you going to do what they-are you going to surrender to them?" the former colonel asked.

"Hell, no!" John Brightling snarled. "Bill, what they're doing, is it legal?"

CHAPTER 32

BLOOD WORK

"Was that a good idea?" Brightling asked.

"I think so. Kirk was on the travel list anyway. We can have his coworkers tell anybody who asks that he was called out of town on company business," Henriksen said.

"What if the FBI agents go back to see him?"

"Then he's out of town, and they'll just have to wait," Henriksen answered. "Investigations like this last for months, but there won't be months, will there?"

Brightling nodded. "I suppose. How's Dmitriy doing out there?"

"Dave Dawson says he's doing okay, asking a lot of touristy questions, but that's all. He had his physical from Johnny Killgore, and he's gotten his `B' shot."

"I hope he likes being alive. From what he said, he might turn out to be our kind of people, you know?"

"I'm not so sure about that, but he doesn't know squat. and by the time he finds out, it'll be too late anyway. Wil Gearing is in place, and he says everything's going according to plan, John. Three more weeks, and then it'll all be under way. So, it's time to start moving our people to Kansas."

"Too bad. The longevity project's really looking good at the moment."

"Oh?"

"Well, it's pretty hard to predict breakthroughs, but the research threads all look very interesting at the moment, Bill."

"So we might have lived forever?…" Henriksen asked, with a wry smile. For all the time he'd been associated with Brightling and Horizon Corporation, he had trouble believing such predictions. The company had caused some genuine medical miracles, but this was just too much to credit.

"I can think of worse things to happen. I'm going to make sure that whole team gets the `B' shot," Brightling said.

"Well, take the whole team out there and put 'em to work in Kansas, for crying out loud," Bill suggested. "What about the rest of the company?"

Brightling didn't like that question, didn't like the fact that more than half of the Horizon employees would be treated like the rest of humanity-left to die at best, or to be murdered by the "A" vaccine at worst. John Brightling, M.D., Ph.D., had some lingering morality, part of which was loyalty to the people who worked for him-which was why Dmitriy Popov was in Kansas with the "B"class antibodies in his system. So, even the Big Boss wasn't entirely comfortable with what he was doing, Henriksen saw. Well, that was conscience for you. Shakespeare had written about the phenomenon.

"That's already decided," Brightling said, after a second's discomfort. He'd be saving those who were part of the Project, and those whose scientific knowledge would be useful in the future. Accountants, lawyers, and secretaries, by and large, would not be saved. That he'd be saving about five thousand people-as many as the Kansas and Brazil facilities could hold-was quite a stretch, especially considering that only a small fraction of those people knew what the Project was all about. Had he been a Marxist, Brightling would have thought or even said aloud that the world needed an intellectual elite to make it into the New World, but he didn't really think in those terms. He truly did believe that he was saving the planet, and though the cost of doing so was murderously high, it was a goal worth pursuing, though part of him hoped that he'd be able to live through the transition period without taking his own life from the guilt factor that was sure to assault him.

CHAPTER 27

TRANSFER AGENTS

But what did Brightling and his company do? Horizon Corporation and all of its numerous international subsidiaries were in the business of medical research. The company manufactured medicines, and spent a huge amount of money every year to invent new ones. It was the world leader in the field of medical research. It had Nobel Prize winners working in its labs, and, his Internet research had determined, it was working in some very exciting areas of potential medical advancement. Popov shook his head again. What did genetic engineering and pharmaceutical manufacturing have to do with terrorism?

The light bulb that went off over the Irish Sea reminded him that only a relatively few months before, America had been attacked with biological warfare. It had killed about five thousand people, and incurred the lethal wrath of the United States and her president. The dossier he'd been given said that the chief of this Rainbow group, Clark, and his son-in-law, Chavez, had played a quiet but very dramatic role in concluding that bloody little war.

Bio-war, Popov thought. It had given the entire world a reason to shudder. In the event it had proven to be an ineffective weapon of statecraft - especially since America had reacted with her customary speed and furious effectiveness on the battlefields of Saudi Arabia. As a result, no nation-state today dared even to contemplate an attack on America. Its armed forces strode the world like a frontier sheriff in a Western movie, respected and, more to the point, feared for their lethal capabilities.

Popov finished his wine, and fingered the empty glass in his hand as he looked down at the approaching green coastline of England. Bio-war. It had made the whole world shiver in fear and disgust. Horizon Corporation was deeply into cutting-edge research in medical science. So, surely, Brightling's business could well be involved with biological-warfare research-but to what possible end? Besides, it was a mere corporation, not a nation state. It had no foreign policy. It had nothing to gain from warlike activities. Corporations didn't make war, except, perhaps, on other corporations. They might try to steal trade secrets, but actually shed blood? Of course not. Again, Popov told himself, he had merely found a blank hard wall to smash his head against.

Seattle Genetics sells $49 million of stock in IPO

By Drew DeSilver

Seattle Times business reporter

Seattle Genetics sold $49 million worth of stock in an initial public offering yesterday. Whether that counts as a success or a disappointment depends on how you parse the deal.

On the upside, the Bothell-based biotechnology company was the first Puget Sound-area business to go public in nearly six months and only the 13th company in the country to do so this year.

The 7 million shares, which went public at $7 apiece, gained $1.25, or 17.9 percent, in their first day of trading. They rose an additional 28 cents after regular trading closed.

"We're really happy to get the deal done in a tough market and get the financing we need," said Peggy Pinkston, Seattle Genetics' investor-relations director. After fees and other expenses, the company netted $45.7 million.

On the downside, the $7 IPO price was a drastic cut from what Seattle Genetics had hoped to get.

Just a month ago, in a regulatory filing, the company estimated its shares would sell for $11 to $13 a share; at that time, it hoped to net $77 million. Even starting from the reduced price, the highest Seattle Genetics' shares got yesterday was $9.41.

And not all the shares in the "public" offering went to, well, the public. Cascade Investments, Microsoft Chairman Bill Gates' private investment firm, agreed to buy 850,000 shares; Cascade already owned 2.7 million shares, making it one of Seattle Genetics' largest stakeholders.

In addition, South San Francisco-based Genentech bought $2 million worth of the new shares, or 285,714 shares. Genentech, a biotech pioneer, licenses some of Seattle Genetics' drug candidates and has owned 680,272 shares since December 1999.

"It's just been a lousy market for IPOs in general and especially for development-stage companies that are a long way from profitability," said Bill Whitlow, who manages Safeco's $130 million Northwest Fund. "If they had brought this to market a year ago, I think it would have been very successful."

When Seattle Genetics announced its IPO in November, biotech stocks were one of the few technology sectors to have held up reasonably well during last year's shakeout. But since then, Whitlow said, investors have become even more risk-averse.

The Nasdaq Biotech Index closed at 921.03 yesterday, off 42.3 percent from its high of 1,596.53. The index hit that high just over a year ago, on March 6, 2000. It has plunged, recovered and fallen again since then.

Wall Street's tepid response to Seattle Genetics' offering further illustrates how much last year's overheated IPO market has cooled. By this time last year, 90 companies had gone public, including four Puget Sound businesses.

Seattle Genetics, which was formed in July 1997, researches and develops drugs based on monoclonal antibodies, proteins that bond to specific cells and other targets in the body. Like many other biotech companies, Seattle Genetics hopes to use monoclonal antibodies to develop drugs that home in on cancer cells and kill them without harming other cells.

The company has two candidate drugs in early and midstage clinical trials, with several others in earlier stages of research.

From 1998 to the end of 2000, Seattle Genetics had a cumulative loss of $12.8 million.

Thanks to previous rounds of private investment, the company had $24.6 million in working capital at the end of last year. To that will be added the $45.7 million raised in yesterday's IPO, as well as a concurrent $2 million stock sale to Princeton, N.J.-based Medarex, another partner.

That should be enough cash for Seattle Genetics' needs, Pinkston said. She declined to specify how the company planned to spend the money or how those plans would change given the smaller-than-anticipated IPO.

HISTORY

THIS DAY IN HISTORY

Nov 23, 1979:

IRA member sentenced for Mountbatten's assassination

Thomas McMahon, a member of the Irish Republican Army (IRA), is sentenced to life imprisonment for preparing and planting the bomb that killed Lord Louis Mountbatten and three others three months before.

On August 27, 1979, Lord Mountbatten was killed when McMahon and other IRA terrorists detonated a 50-pound bomb hidden on his fishing vessel Shadow V. Mountbatten, a World War II hero, elder statesman, and second cousin of Queen Elizabeth II, was spending the day with his family in Donegal Bay off Ireland's northwest coast when the bomb exploded. Three others were killed in the attack, including Mountbatten's 14-year-old grandson, Nicholas. Later that day, an IRA bombing attack on land killed 18 British paratroopers in County Down, Northern Ireland.

The assassination of Mountbatten was the first blow struck against the British royal family by the IRA during its long terrorist campaign to drive the British out of Northern Ireland and unite it with the Republic of Ireland to the south. The attack hardened the hearts of many Britons against the IRA and convinced Margaret Thatcher's government to take a hard-line stance against the terrorist organization.

The IRA immediately claimed responsibility for the Mountbatten attack, saying it detonated the bomb by remote control from the coast. It also took responsibility for the same-day bombing attack against British troops in County Down, which claimed 18 lives.

IRA member Thomas McMahon was later arrested and convicted for his role in the Mountbatten bombing. A near-legend in the IRA, he was a leader of the IRA's notorious South Armagh Brigade, which killed more than 100 British soldiers. He was one of the first IRA members to be sent to Libya to study detonators and timing devices and was an expert in explosives. Authorities believe the Mountbatten assassination was the work of many people, but McMahon was the only individual convicted. Sentenced to life in prison, he was released in 1998, along with other IRA and Unionist terrorists, under a controversial provision of the Good Friday Agreement, Northern Ireland's peace deal. McMahon claimed he had turned his back on the IRA and was becoming a carpenter.

July Plot

July Plot, abortive attempt on July 20, 1944, by German military leaders to assassinate Adolf Hitler, seize control of the government, and seek more favourable peace terms from the Allies.

During 1943 and early 1944, opposition to Hitler in high army circles increased as Germany’s military situation deteriorated. Plans for the coup, code-named Walküre (“Valkyrie”), were set late in 1943, but Hitler, increasingly suspicious, became more difficult to access and often abruptly changed his schedule, thus thwarting a number of earlier attempts on his life.

Seattle Genetics up 18%

Biotech firm has backing from Microsoft's Bill Gates and Paul Allen

NEW YORK (CNNfn) - Seattle Genetics Inc., a drug discovery firm backed by Microsoft co-founders Bill Gates and Paul Allen, climbed nearly 18 percent as the second IPO to begin trading this week.

Seattle Genetics gained $1.25 to $8.25 Wednesday on the Nasdaq. Stelmar Shipping Ltd., an international tanker operator, rose 2 percent in its New York Stock Exchange debut Tuesday.

Bothell, Wash.-based Seattle Genetics came in below expectations late Tuesday, raising $49 million. The biotech sold 7 million shares at $7 each via lead underwriters JP Morgan and CIBC World Markets.

Seattle Genetics cut its price range Tuesday to $8 to $10 from $11 to $13, a move that was viewed positively by many analysts.

"The price decrease shows a visible adjustment to current market conditions," said David Menlow, president of IPOfinancial.com.

The biotech develops monoclonal antibody-based drugs to treat cancer. Monoclonal antibodies, laboratory-produced substances that recognize and bind with cancer cells, are used to identify infectious agents.

Seattle Genetics has five drug candidates in preclinical trials.

Like most biotechs, Seattle Genetics is not profitable
