Remarks on Signing the Dodd-Frank Wall Street Reform and Consumer Protection Act

The President. Thank you. Everybody, please have a seat. Have a seat. Well, good morning, everyone.
Audience members. Good morning.
The President. We are gathered in the heart of our Nation's Capital, surrounded by memorials to leaders and citizens who served our Nation in its earliest days and in its days of greatest trial. Now, today is such a time for America.
Over the past 2 years, we have faced the worst recession since the Great Depression. Eight million people lost their jobs. Tens of millions saw the value of their homes and retirement savings plummet. Countless businesses have been unable to get the loans they need, and many have been forced to shut their doors. And although the economy is growing again, too many people are still feeling the pain of the downturn.
Now, while a number of factors led to such a severe recession, the primary cause was a breakdown in our financial system. It was a crisis born of a failure of responsibility, from certain corners of Wall Street to the halls of power in Washington. For years, our financial sector was governed by antiquated and poorly enforced rules that allowed some to game the system and take risks that endangered the entire economy.
Unscrupulous lenders locked consumers into complex loans with hidden costs. Firms like AIG placed massive, risky bets with borrowed money. And while the rules left abuse and excess unchecked, they also left taxpayers on the hook if a big bank or financial institution ever failed.
Now, even before the crisis hit, I went to Wall Street and I called for commonsense reforms to protect consumers and our economy as a whole. And soon after taking office, I proposed a set of reforms to empower consumers and investors, to bring the shadowy deals that caused this crisis into the light of day, and to put a stop to taxpayer bailouts once and for all.
Today, thanks to a lot of people in this room, those reforms will become the law of the land. For the last year, Chairmen Barney Frank and Chris Dodd have worked day and night--[applause]--Barney and Chris have worked day and night to bring about this reform. And I am profoundly grateful to them. I would be remiss if I didn't also express my appreciation to Senator Harry Reid and Speaker Nancy Pelosi for their leadership. It wouldn't have happened without them.
Passing this bill was no easy task. To get there, we had to overcome the furious lobbying of an array of powerful interest groups and a partisan minority determined to block change. So the Members who are here today, both on the stage and in the audience, they have done a great service in devoting so much time and expertise to this effort, to looking out for the public interests and not the special interests. And I also want to thank the three Republican Senators who put partisanship aside, judged this bill on the merits, and voted for reform. We're grateful to them and the Republican House Members. Good to see you, Joe.
Now, let's put this in perspective. The fact is, the financial industry is central to our Nation's ability to grow, to prosper, to compete, and to innovate. There are a lot of banks that understand and fulfill this vital role, and there are a whole lot of bankers out there who want to do right--and do right--by their customers. This reform will help foster innovation, not hamper it. It is designed to make sure that everybody follows the same set of rules so that firms compete on price and quality, not on tricks and not on traps. It demands accountability and responsibility from everyone. It provides certainty to everybody, from bankers to farmers to business owners to consumers. And unless your business model depends on cutting corners or bilking your customers, you've got nothing to fear from reform.
Now, for all those Americans who are wondering what Wall Street reform means for you, here's what you can expect. If you've ever applied for a credit card, a student loan, or a mortgage, you know the feeling of signing your name to pages of barely understandable fine print. What often happens as a result is that many Americans are caught by hidden fees and penalties or saddled with loans they can't afford. That's what happened to Robin Fox, hit with a massive rate increase on her credit card balance, even though she paid her bills on time. That's what happened to Andrew Giordano, who discovered hundreds of dollars in overdraft fees on his bank statement, fees he had no idea he might face. And both are here today. Well, with this law, unfair rate hikes, like the one that hit Robin, will end for good, and we'll ensure that people like Andrew aren't unwittingly caught by overdraft fees when they sign up for a checking account.
With this law, we'll crack down on abusive practices in the mortgage industry. We'll make sure that contracts are simpler, putting an end to many hidden penalties and fees in complex mortgages, so folks know what they're signing. With this law, students who take out college loans will be provided clear and concise information about their obligations. And with this law, ordinary investors, like seniors and folks saving for retirement, will be able to receive more information about the costs and risks of mutual funds and other investment products so that they can make better financial decisions as to what will work for them.
So all told, these reforms represent the strongest consumer financial protections in history--in history. And these protections will be enforced by a new consumer watchdog with just one job: looking out for people--not big banks, not lenders, not investment houses--looking out for people as they interact with the financial system.
And that's not just good for consumers; that's good for the economy. Because reform will put a stop to a lot of the bad loans that fueled a debt-based bubble. And it will mean all companies will have to seek customers by offering better products instead of more deceptive ones.
Now, beyond the consumer protections I've outlined, reform will also rein in the abuse and excess that nearly brought down our financial system. It will finally bring transparency to the kinds of complex and risky transactions that helped trigger the financial crisis. Shareholders will also have a greater say on the pay of CEOs and other executives, so they can reward success instead of failure.
And finally, because of this law, the American people will never again be asked to foot the bill for Wall Street's mistakes. There will be no more tax-funded bailouts, period. If a large financial institution should ever fail, this reform gives us the ability to wind it down without endangering the broader economy. And there will be new rules to make clear that no firm is somehow protected because it is too big to fail, so we don't have another AIG.
That's what this reform will mean. Now, it doesn't mean our work is over. For these new rules to be effective, regulators will have to be vigilant. We may need to make adjustments along the way as our financial system adapts to these new changes and changes around the globe. No law can force anybody to be responsible; it's still incumbent on those on Wall Street to heed the lessons of this crisis in terms of how they conduct their businesses.
The fact is, every American, from Main Street to Wall Street, has a stake in our financial system. Wall Street banks and firms invest the capital that makes it possible for startups to sell new products. They provide loans to businesses to expand and to hire. They back mortgages for families purchasing a new home. That's why we'll all stand to gain from these reforms. We all win when investors around the world have confidence in our markets. We all win when shareholders have more power and more information. We all win when consumers are protected against abuse. And we all win when folks are rewarded based on how well they perform, not how well they evade accountability.
In the end, our financial system only works, our market is only free when there are clear rules and basic safeguards that prevent abuse, that check excess, that ensure that it is more profitable to play by the rules than to game the system. And that's what these reforms are designed to achieve, no more, no less. Because that's how we will ensure that our economy works for consumers, that it works for investors, that it works for financial institutions, that it works for all of us. This is the central lesson not only of this crisis but of our history.
Ultimately, there's no dividing line between Main Street and Wall Street. We rise or fall together as one Nation. So these reforms will help lift our economy and lead all of us to a stronger, more prosperous future.
And that's why I'm so honored to sign these reforms into law, and I'm so grateful to everybody who worked so hard to make this day possible. Thank you very much, everybody.

Statement on the Death of Ralph David Abernathy

Barbara and I were deeply saddened to learn of the death of the Rev. Ralph David Abernathy. In recalling Ralph Abernathy's life, we inevitably recall the great campaigns for civil rights for black Americans in which he played such a signal part. From his father's farm in Alabama, he joined the ministry and became pastor of the First Baptist Church in Montgomery. Responding to Rosa Parks' refusal to sit in the back of a segregated bus, he and the Rev. Dr. Martin Luther King, Jr., began the Montgomery Improvement Association to ensure the success of the boycott which led in turn to the desegregation of buses in that city. Later, he and Dr. King organized the Southern Christian Leadership Conference, of which he originally served as secretary-treasurer.
Throughout, Rev. Abernathy was committed to the principle of nonviolence. As he said, "Violence is the weapon of the weak, and nonviolence is the weapon of the strong." Barbara and I join with all Americans to mourn the passing of the Rev. Ralph Abernathy, a great leader in the struggle for civil rights for all Americans and a tireless campaigner for justice.

Popov was still trying to learn more about his employer, but finding nothing to enlighten himself. The combination of the New York Public Library and the Internet had turned up reams of information, but nothing that gave the slightest clue as to why he'd employed the former KGB officer to dig up terrorists and turn them loose upon the world. It was as likely that a child would conspire a murder plot against a loving parent. It wasn't the morality of the event that troubled him. Morality had little place in intelligence operations. As a trainee at the KGB academy outside Moscow, the subject had never come up, except insofar as he and his classmates had always been given to understand that the State Was Never Wrong. "You will occasionally be ordered to do things you may find personally upsetting," Colonel Romanov had said once. "Such things will be done, because the reasons, unknown to you or not, will always be proper ones. You do have the right to question something for tactical reasons-as the officer in the field, how you do the mission will generally be your affair. But to refuse an assignment is not acceptable." And that had been that. Neither Popov nor his classmates had even made notes on the issue. It was understood that orders were orders. And so, once he accepted employment, Popov had done the jobs assigned…
… but as a servant of the Soviet Union he'd always known the overall mission, which was to get vital information to his country, because his country needed the information either for itself or to assist others whose actions would be of real benefit to his country. Even dealing with Il'ych Ramirez Sanchez, Popov had thought at the time, had served some special interest. He knew better now, of course. Terrorists were like wild dogs or rabid wolves that one tossed into someone's back garden just to create a stir, and, yes, perhaps that had been strategically useful-or had been thought so by his masters, in the service of a state now dead and gone. But, no, the missions had not really been useful, had they? And as good as KGB had once been-he still thought them the best espionage agency the world had ever seen-it had ultimately been a failure. The Party for which the Committee for State Security had been the Sword and Shield was no more. The Sword had not slain the Party's enemies, and the Shield had not protected against the West's various weapons. And so, had his superiors really known what they'd needed to do?
Probably not, Popov admitted to himself, and because of that, perhaps every mission he'd been assigned had been to some greater or lesser degree a fool's errand. The realization would have been a bitter one, except that his training and experience were paying off now with a lavish salary, not to mention the two suitcases of cash he'd managed to steal-but for doing what? Getting terrorists killed off by European police forces? He could just as easily, if not so profitably, have fingered them to the police and allowed them to be arrested, tried, and imprisoned like the criminal scum they were, which would actually have been far more satisfying. A tiger in a cage, pacing back and forth behind his bars and waiting for his daily five kilos of chilled horsemeat, was far more entertaining than one stuffed in a museum, and just as helpless. He was some sort of Judas goat, Dmitriy Arkadeyevich thought, but if so, serving what sort of abattoir?
The money was good. Several more missions like the first two and he could take his money, his false identity papers, and vanish from the face of the earth. He could lie on some beach, drinking tasty beverages and watching pretty girls in skimpy bathing suits or-what? Popov didn't know exactly what sort of retirement he could stomach, but he was certain he could find something. Maybe use his talents to trade in stocks and bonds like a real capitalist, and thus spend his time enriching himself further. Perhaps that, he mused, sipping his morning coffee and staring out the window, looking south toward Wall Street. But he wasn't quite ready for that life yet, and until he was, the fact that he didn't know the nature of his missions' purpose was troublesome. In not knowing, he couldn't evaluate all the dangers to himself. But for all his skill, experience, and professional training, he hadn't a clue as to why his employer wanted him to let the tigers from their cages, out in the open where the hunters were waiting. What a pity, Popov thought, that he couldn't just ask. The answer might even be amusing.

JUNE 27, 1976 : EBOLA BREAKS OUT IN SUDAN
A factory storekeeper in the Nzara township of Sudan becomes ill on this day in 1976. Five days later, he dies, and the world’s first recorded Ebola virus epidemic begins making its way through the area. By the time the epidemic is over, 284 cases are reported, with about half of the victims dying from the disease.
Symptoms of Ebola hemorrhagic fever generally begin about four to 15 days after a person is infected with the virus. The average victim will first notice flu-like symptoms, such as a high fever, aching and general weakness. Usually this is followed by diarrhea, vomiting and the eruption of rashes all over the body. Then the person may begin bleeding from any and all body orifices and internal organ damage begins. Within seven to 10 days, exhaustion, dehydration and shock set in.
After the storekeeper in Nzara died, a second man in town died on July 6. His brother became sick soon after, but managed to recover. The brother’s co-worker went to the hospital on July 12 with symptoms and was dead two days later; the co-worker’s wife died five days after that. A week later a male neighbor died. Eventually, another 48 infections and 27 deaths were traced back to the neighbor.
Given this pattern of infection and the fact that hospital workers also started to develop symptoms, doctors realized that transmission of the virus required only close contact. At Maridi Hospital in southern Sudan, 33 of the 61 nurses ended up dead from Ebola fever.
The World Health Organization finally arrived in October and helped to contain the epidemic. Once it became clear that isolating the victims would stop the spread, the epidemic ended almost as quickly as it had appeared. There have been a handful of other Ebola outbreaks in the years since 1976. Scientists still do not know what causes the disease to return or how to cure it.

Sir Leonard Woolley, (born April 17, 1880, London—died Feb. 20, 1960, London), British archaeologist whose excavation of the ancient Sumerian city of Ur (in modern Iraq) greatly advanced knowledge of ancient Mesopotamian civilization. His discovery of geological evidence of a great flood suggested a possible correlation with the deluge described in Genesis.
From 1907 to 1911 Woolley served with an archaeological expedition near Wadi Halfa, Sudan, an area rich in Egyptian antiquities. With T.E. Lawrence (“Lawrence of Arabia”), he conducted the principal excavation of the Hittite city of Carchemish in northern Syria (1912–14) and recorded his findings in Carchemish (part 2, 1921, and part 3, with R.D. Barnett, 1953). He then worked at Tell el-Amarna, capital of the Egyptian king Akhenaton.
His excavation of Ur (1922–34), conducted for the British Museum, London, and the University of Pennsylvania, Philadelphia, enabled scholars to trace the history of the city from its final days during the 4th century bc back to its prehistoric beginnings (c. 4000 bc). Woolley’s findings revealed much about everyday life, art, architecture, literature, government, and religion in what has come to be called “the cradle of civilization.”
One of his most dramatic discoveries, royal tombs dating from about 2700 bc, disclosed the practice of the sacrificial burial of a deceased king’s personal retinue. With the help of contributors, he began publishing a projected 10 volumes of Ur Excavations in 1927. His other books include The Sumerians (1928), Ur of the Chaldees (1929), and Digging up the Past (1930).
Woolley also sought to establish a relationship between the civilizations of Mesopotamia and those of Greece and the Aegean. To this end, he excavated at Tell Atchana (ancient Alalakh) in southeastern Turkey north of Antioch (1937–39 and 1946–49). There he discovered the remains of a small kingdom of largely Hurrian population and levels of habitation dating back to the 4th millennium bc. His findings appeared in Alalakh, an Account of the Excavations at Tell Atchana in the Hatay, 1937–1949 (1955) and A Forgotten Kingdom (1953). He was knighted in 1935.

Sir Charles Leonard Woolley (17 April 1880 – 20 February 1960) was a British archaeologist best known for his excavations at Ur in Mesopotamia. He is considered to have been one of the first "modern" archaeologists, and was knighted in 1935 for his contributions to the discipline of archaeology.

Executive Order 10865 - Safeguarding Classified Information Within Industry
February 20, 1960
WHEREAS it is mandatory that the United States protect itself against hostile or destructive activities by preventing unauthorized disclosures of classified information relating to the national defense; and
WHEREAS it Is a fundamental principle of our Government to protect the interests of individuals against unreasonable or unwarranted encroachment; and
WHEREAS I find that the provisions and procedures prescribed by this order are necessary to assure the preservation of the integrity of classified defense information and to protect the national interest; and
WHEREAS I find that those provisions and procedures recognize the interest of individuals affected thereby and provide maximum possible safeguards to protect such interests:
NOW, THEREFORE, under and by virtue of the authority vested in me by the Constitution and statutes of the United States, and as President of the United States and as Commander In Chief of the armed forces of the United States, it is hereby ordered as follows:
SECTION 1. (a) The Secretary of State, the Secretary of Defense, the Commissioners of the Atomic Energy Commission, the Administrator of the National Aeronautics and Space Administration, and the Administrator of the Federal Aviation Agency, respectively, shall, by regulation, prescribe such specific requirements, restrictions, and other safeguards as they consider necessary to protect (1) releases of classified information to or within United States industry that relate to bidding on, or the negotiation, award, performance, or termination of, contracts with their respective agencies, and (2) other releases of classified information to or within industry that such agencies have responsibility for safeguarding. So far as possible, regulations prescribed by them under this order shall be uniform and provide for full cooperation among the agencies concerned.
(b) Under agreement between the Department of Defense and any other department or agency of the United States, including, but not limited to, those referred to in subsection (c) of this section regulations prescribed by the Secretary of Defense under subsection (a) of this section may be extended to apply to protect releases (1) of classified information to or within United States industry that relate to bidding on, or the negotiation, award, performance, or termination of, contracts with such other department or agency, and (2) other releases of classified information to or within industry which such other department or agency has responsibility for safeguarding.
(c) When used in this order, the term "head of a department" means the Secretary of State, the Secretary of Defense, the Commissioners of the Atomic Energy Commission, the Administrator of the National Aeronautics and Space Administration, the Administrator of the Federal Aviation Agency, and, in sections 4 and 8, includes the Attorney General. The term "department" means the Department of State, the Department of Defense, and the Atomic Energy Commission, the National Aeronautics and Space Administration, the Federal Aviation Agency, and, in sections 4 and 8, includes the Department of Justice.
SEC. 2. An authorization for access to classified information may be granted by the head of a department or his designee, including but not limited to those officials named in section 8 of this order, to an individual, hereinafter termed an "applicant", for a specific classification category only upon a finding that it is clearly consistent with the national interest to do so.
SEC. 3. Except as provided in section 9 of this order, an authorization for access to a specific classification category may not be finally denied or revoked by the head of a department or his designee, including, but not limited to, those officials named in section 8 of this order, unless the applicant has been given the following:
(1) A written statement of the reasons why his access authorization may be denied or revoked, which shall be as comprehensive and detailed as the national security permits.
(2) A reasonable opportunity to reply in writing under oath or affirmation to the statement of reasons.
(3) After he has filed under oath or affirmation a written reply to the statement of reasons, the form and sufficiency of which may be prescribed by regulations issued by the head of the department concerned, an opportunity to appear personally before the head of the department concerned or his designee, including, but not limited to, those officials named in section 8 of this order, for the purpose of supporting his eligibility for access authorization and to present evidence on his behalf.
(4) A reasonable time to prepare for that appearance.
(5) An opportunity to be represented by counsel.
(6) An opportunity to cross-examine persons either orally or through written interrogatories in accordance with section 4 on matters not relating to the characterization in the statement of reasons of any organization or individual other than the applicant.
(7) A written notice of the final decision in his case which, if adverse, shall specify whether the head of the department or his designee, including, but not limited to, those officials named in section 8 of this order, found for or against him with respect to each allegation in the statement of reasons.
Sec 4. (a) An applicant shall be afforded an opportunity to cross-examine persons who have made oral or written statements adverse to the applicant relating to a controverted issue except that any such statement may be received and considered without affording such opportunity in the circumstances described in either of the following paragraphs:
(1) The head of the department supplying the statement certifies that the person who furnished the information is a confidential informant who has been engaged in obtaining intelligence information for the Government and that disclosure of his identity would be substantially harmful to the national interest.
(2) The head of the department concerned or his special designee for that particular purpose has preliminarily determined, after considering information furnished by the investigative agency involved as to the reliability of the person and the accuracy of the statement concerned, that the statement concerned appears to be reliable and material, and the head of the department or such special designee has determined that failure to receive and consider such statement would, in view of the level of access sought, be substantially harmful to the national security and that the person who furnished the information cannot appear to testify (A) due to death, severe illness, or similar cause, in which case the identity of the person and the information to be considered shall be made available to the applicant, or (B) due to some other cause determined by the head of the department to be good and sufficient.
(b) Whenever procedures under paragraphs (1) or (2) of subsection (a) of this section are used (1) the applicant shall be given a summary of the information which shall be as comprehensive and detailed as the national security permits, (2) appropriate consideration shall be accorded to the fact that the applicant did not have an opportunity to cross-examine such person or persons, and (3) a final determination adverse to the applicant shall be made only by the head of the department based upon his personal review of the case.
SEC. 5. (a) Records compiled in the regular course of business, or other physical evidence other than investigative reports, may be received and considered subject to rebuttal without authenticating witnesses, provided that such information has been furnished to the department concerned by an investigative agency pursuant to its responsibilities in connection with assisting the head of the department concerned to safeguard classified information within industry pursuant to this order.
(b) Records compiled in the regular course of business, or other physical evidence other than investigative reports, relating to a controverted issue which, because they are classified, may not be inspected by the applicant, may be received and considered provided that: (1) the head, of the department concerned or his special designee for that purpose has made a preliminary determination that such physical evidence appears to be material, (2) the head of the department concerned or such designee has made a determination that failure to receive and consider such physical evidence would, in view of the level of access sought, be substantially harmful to the national security, and (3) to the extent that the national security permits, a summary or description of such physical evidence is made available to the applicant. In every such case, information as to the authenticity and accuracy of such physical evidence furnished by the investigative agency involved shall be considered. In such instances a final determination adverse to the applicant shall be made only by the head of the department based upon his personal review of the case.
SEC. 6. Because existing law does not authorize the Department of State, the Department of Defense, or the National Aeronautics and Space Administration to subpoena witnesses, the Secretary of State, the Secretary of Defense, or the Administrator of the National Aeronautics and Space Administration, or his representative, may issue, in appropriate cases, invitations and requests to appear and testify in order that the applicant may have the opportunity to cross-examine as provided by this order. So far as the national security permits, the head of the investigative agency involved shall cooperate with the Secretary or the Administrator, as the case may be, in identifying persons who have made statements adverse to the applicant and In assisting him in making them available for cross-examination. If a person so Invited is an officer or employee of the executive branch of the Government or a member of the armed forces of the United States, the head of the department or agency concerned shall cooperate in making that person available for cross-examination.
SEC. 7. Any determination under this order adverse to an applicant shall be a determination in terms of the national interest and shall in no sense be a determination as to the loyalty of the applicant concerned.
SEC. 8. Except as otherwise specified in the preceding provisions of this order, any authority vested in the head of a department by this order may be delegated to the
(1) Under Secretary of State or a Deputy Under Secretary of State, in the case of authority vested in the Secretary of State;
(2) Deputy Secretary of Defense or an Assistant Secretary of Defense, in the case of authority vested in the Secretary of Defense;
(3) General Manager of the Atomic Energy Commission, in the case of authority vested in the Commissioners of the Atomic Energy Commission;
(4) Deputy Administrator of the National Aeronautics and Space Administration, in the case of authority vested in the Administrator of the National Aeronautics and Space Administration;
(5) Deputy Administrator of the Federal Aviation Agency, in the case of authority vested in the Administrator of the Federal Aviation Agency; or
(6) Deputy Attorney General or an Assistant Attorney General, in the case of authority vested in the Attorney General.
SEC. 9. Nothing contained in this order shall be deemed to limit or affect the responsibility and powers of the head of a department to deny or revoke access to a specific classification category if the security of the nation so requires. Such authority may not be delegated and may be exercised only when the head of a department determines that the procedures prescribed in sections 3, 4, and 5 cannot be invoked consistently with the national security and such determination shall be conclusive.
