Nightmare at 20,000 Feet
STUPID Christians.
Truly the dumbest of all dumb humans.
You look up at the stars in the night sky and you are TERRIFIED.
You are terrified because there *must* be a cause.
Your simple and feeble brain just CANNOT come to terms with the fact that it all simply happened.
You are terrified because there is no one to blame.

In May 2007, senators from both the Democratic Party and the Republican Party drafted legislation that would openly present an internal CIA investigative report. One of the backers, Senator Ron Wyden stated "The American people have a right to know what the Central Intelligence Agency was doing in those critical months before 9/11.... I am going to bulldog this until the public gets it." The report investigates the responsibilities of individual CIA personnel before and after the 9/11 attacks. The report was completed in 2005, but its details have never been released to the public

Einstein Chronology for 1905
January 6: Second anniversary of marriage to Mileva Maric.
Early March: Begins to submit one-paragraph reviews of recent scientific papers on heat theory to the Beiblätter zu den Annalen der Physik — mainly summaries, with occasional critical remarks. By the end of the year 21 of these reviews were published.
March 14: His 26th birthday.
March 17: Sends Annalen der Physik his photoelectricity paper, “On a Heuristic Point of View concerning the Production and Transformation of Light.” Received March 18, published June 9.
May 14: First birthday of son, Hans Albert.
April 30: Submits his University of Zurich doctoral dissertation, “A New Determination of Molecular Dimensions.” (Published in 1906.)
May: Sends Annalen der Physik his Brownian Motion paper, “On the Movement of Small Particles Suspended in Stationary Liquids Required by the Molecular-Kinetic Theory of Heat.” Received May 11, published July 18.
Mid-May: Conceives special relativity theory (he later recalled that he sent the paper in for publication five or six weeks after the idea came to him).
June: Sends Annalen der Physik his special relativity theory paper, “On the Electrodynamics of Moving Bodies.” Received June 30, published 26 September.
July 27: Doctorate is approved unanimously by University of Zurich Philosophy II faculty (the degree was formally awarded January 15, 1906).
August: Sends Annalen der Physik his doctoral dissertation on size of molecules, received August 19, published with slight revisions February 8, 1906. This would become one of Einstein’s most frequently cited papers. It shows how to use fluid phenomena to determine Avogadro’s Number, which is related to the size of atoms (and for skeptics, their reality).
Late summer: Travels to Serbia with Mileva and their son, visiting friends and Mileva’s family.
September: Sends Annalen der Physik his mass-energy equivalence paper, “Does the Inertia of a Body Depend upon Its Energy Content?” Received September 27, published November 21. This paper contains the concept which would later be written E=mc².

Making the Exhibit: Who and How
Einstein: Image and Impact is based on a 16-panel travelling exhibit designed by the Center for History of Physics of the American Institute of Physics for the Institute for Advanced Study, Princeton, New Jersey on the occasion of the Einstein Centennial 1879-1979. Expert historians were enlisted to write and check the text, and copies were sent to roughly a thousand sites around the US and abroad in cooperation with the State Humanities Commissions. The exhibit was reformatted for the Web in 1996. Since then additional information about Einstein's life has come to light and has been incorporated in the text, with the advice of leading historians. In 2003-2004 in preparation for the 2005 World Year of Physics and Einstein Great Papers Centennial, the exhibit was reformatted for a better appearance and functionality on current browsers and provided with more supplementary materials.

I wasn't writing very much as this point about my new thoughts, although I did start writing a lot in my journal about it around this time. I think back and I was primarily puzzling over my memories of the places I "remembered" that I used to live. I think it was actually Wexford Drive that got me thinking that my memories were completely false. I started searching on the internet for something about Wexford and I found something right away and even before I began reading about John Barry, I knew that the detail about Wexford was going to have some profound meaning to me. I also think there is some part of my true identity that is very bored and has been locked into a room with only a small window to try to yell through. The people who locked me in there are at least now standing outside the door and listening to me as best they can but I don't understand why they won't let me out.

Ex-Sen. Larry Craig, arrested for trying to solicit sex in airport restroom, improperly used campaign funds in defense
THE ASSOCIATED PRESS Friday, March 4, 2016, 11:04 PM
Former Idaho Sen. Larry Craig improperly used campaign funds to pay for his legal defense after his arrest in a 2007 airport bathroom sex sting, a federal appeals court ruled Friday.
The ruling upheld a lower court decision that said Craig must reimburse the government $197,535 and pay a civil penalty of $45,000 for violating federal election laws.
Craig was arrested at the Minneapolis-St. Paul International Airport in 2007 after an undercover police officer said the lawmaker tapped his foot to signal under the bathroom stall that he wanted sex.
The senator quietly pleaded guilty to disturbing the peace and paid a fine — but after news of the incident leaked, Craig insisted his actions were misconstrued and said he was not gay.

Bart approaches the ballet room with trepidation.
Bart: OK...steady, Bart. Taking ballet doesn't make you any less of a man.
[opens the door; all the little girls point and laugh]
Teacher: All right, girls, today we learn the dance of the Faerie Queens. You can either be a faerie, or a queen. It's wide open.
Bart: [groans]
Teacher: Ah! And what have we here? A young man maybe who thinks he can be the next Baryshnikov?
Bart: [surly] I don't want to be the next _anything_. I'm only taking this stupid class because they made me.
Teacher: So, he has fire in the belly! But it will take more than bellyfire to be the next Baryshnikov.
Bart: Look, Boris, I think ballet's for sissies.
Teacher: Ha ha ha! Ballet is for the strong, the fierce, the determined, but for the sissies, never! Now, put on this fuchiatard: you are a faerie.

Senator pleaded guilty, reportedly after bathroom stall incident
(CNN) -- A Republican senator pleaded guilty earlier this month to a misdemeanor disorderly conduct charge stemming from his arrest at the Minneapolis-St. Paul International Airport, according to state criminal records.
Roll Call newspaper reported Monday that Sen. Larry Craig of Idaho was apprehended June 11 by a plainclothes police officer investigating complaints of lewd behavior in an airport men's room.
Roll Call reports on the U.S. legislature.
Craig denied any inappropriate conduct in a prepared statement, and said he now regrets his guilty plea.
"At the time of this incident, I complained to the police that they were misconstruing my actions. I was not involved in any inappropriate conduct," he said. "I should have had the advice of counsel in resolving this matter. In hindsight, I should not have pled guilty. I was trying to handle this matter myself quickly and expeditiously."
Congress is currently in recess, and Craig's office said he was on vacation in Idaho with his family, with no public appearances scheduled.
Craig, 62, paid a $500 fine when he entered his guilty plea on August 8 in Hennepin County Municipal Court in Bloomington, Minnesota, according to state criminal records.
CNN confirmed that Craig was sentenced to 10 days in jail but that sentence was stayed.
Minnesota law defines disorderly conduct as brawling, disturbing a meeting or engaging in "offensive, obscene, abusive, boisterous or noisy conduct."
According to Roll Call, the arresting officer alleged that Craig lingered outside a rest room stall where the officer was sitting, then entered the stall next door and blocked the door with his luggage.
According to the arrest report cited by Roll Call, Craig tapped his right foot, which the officer said he recognized "as a signal used by persons wishing to engage in lewd conduct."
The report alleges Craig then touched the officer's foot with his foot and the senator "proceeded to swipe his hand under the stall divider several times," according to Roll Call.
At that point, the officer said he put his police identification down by the floor so Craig could see it and informed the senator that he was under arrest, before any sexual contact took place.
Idaho's senior senator is married with three grown children and nine grandchildren. A former rancher, Craig was first elected to the Senate in 1990, after serving a decade in the House. His seat is up for re-election in 2008.
Last fall, Craig's office publicly denied assertions by Internet blogger Mike Rogers that the senator is gay. Craig's office dismissed speculation about the senator's sexuality as "completely ridiculous."
In 1982, Craig denied rumors that he was under investigation as part of a federal probe into allegations that lawmakers on Capitol Hill had sexual relationships with congressional pages, saying the "false allegations" made him "mad as hell."
He was never implicated in that investigation, which eventually led to ethics charges against two other congressmen.
In recent years, Craig's voting record has earned him top ratings from social conservative groups such as the American Family Association, Concerned Women for America and the Family Research Council.
He has supported a federal constitutional amendment banning same-sex marriage, telling his colleagues that it was "important for us to stand up now and protect traditional marriage, which is under attack by a few unelected judges and litigious activists."
In 1996, Craig also voted in favor of the Defense of Marriage Act, which denies federal recognition to same-sex marriages and prevents states from being forced to recognize the marriages of gay and lesbian couples legally performed in other states.
Craig has also opposed expanding the federal hate crimes law to cover offenses motivated by anti-gay bias and, in 1996, voted against a bill that would have outlawed employment discrimination based on sexual orientation, which failed by a single vote in the Senate.
Craig has endorsed former Massachusetts Gov. Mitt Romney in the 2008 presidential race. The senator was named in February, along with Sen. Robert Bennett of Utah, as Romney's liaison to build support among GOP senators.
Monday night, Romney's presidential campaign announced Craig was stepping down.
"He didn't want to be a distraction, and we accept his decision," the Romney campaign said in a statement. Access to a YouTube video in which Craig praised Romney was also blocked.

Ex-Sen. Larry Craig appeals ruling on his use of campaign funds
Michael Doyle - McClatchy Washington Bureau
The police officer who arrested Idaho Republican Sen. Larry Craig in 2007 was frankly dismayed at the lawmaker.
“I guess I’m gonna say I’m just disappointed in you, sir,” the officer told Craig, a transcript shows. “I expect this from the guy that we get out of the ‘hood. I mean, people vote for you.”
This week, Craig’s own attorneys are citing the officer’s scolding as they appeal a trial judge’s decision that the former senator improperly used campaign funds to pay personal legal expenses. The judge ordered Craig to repay $197,535, plus an additional $45,000 fine.
In a 30-page legal brief, where every word carries weight, Craig’s attorneys are implicitly using the police officer’s admonishment to reinforce their key point about their client’s 2007 status as an elected official.
“The expenditures at issue occurred in relation to Sen. Craig’s status as a senator,” Craig’s brief argues. “They did not constitute personal use.”
The brief and accompanying documents filed late Tuesday at the U.S. Court of Appeals for the District of Columbia Circuit move the long-simmering Craig case closer to the day of reckoning. A three-judge panel could order an oral argument after the Justice Department files its own brief in several weeks.
Often called the nation’s second-highest court, the D.C. Circuit might set precedent for other politicians with its eventual ruling in the case now called Craig v. Federal Election Commission. In particular, the case raises questions about how campaign funds can be used.
“It does matter beyond Sen. Craig,” his attorney, Andrew D. Herman, said in an interview Wednesday. “I suspect the D.C. Circuit is going to want to take a close look at this.”
Craig is now a 69-year-old registered lobbyist, whose recent clients have included Western Pacific Timber, Murray Energy Corp. and the Western New York Healthcare Association.
In 2007, he was a veteran lawmaker and stalwart conservative. First elected to the House of Representatives in 1980, Craig won election to the Senate in 1990.
On June 11, 2007, while returning to Washington, Craig was arrested at the Minneapolis-St. Paul International Airport following an encounter in a men’s room with an undercover officer. Craig pleaded guilty to a misdemeanor charge of disorderly conduct.

[Physics FAQ]
Original by Philip Gibbs May 1997.
Why is the sky blue?
A clear cloudless day-time sky is blue because molecules in the air scatter blue light from the sun more than they scatter red light. When we look towards the sun at sunset, we see red and orange colours because the blue light has been scattered out and away from the line of sight.
The white light from the sun is a mixture of all colours of the rainbow. This was demonstrated by Isaac Newton, who used a prism to separate the different colours and so form a spectrum. The colours of light are distinguished by their different wavelengths. The visible part of the spectrum ranges from red light with a wavelength of about 720 nm, to violet with a wavelength of about 380 nm, with orange, yellow, green, blue and indigo between. The three different types of colour receptors in the retina of the human eye respond most strongly to red, green and blue wavelengths, giving us our colour vision.
Tyndall Effect
The first steps towards correctly explaining the colour of the sky were taken by John Tyndall in 1859. He discovered that when light passes through a clear fluid holding small particles in suspension, the shorter blue wavelengths are scattered more strongly than the red. This can be demonstrated by shining a beam of white light through a tank of water with a little milk or soap mixed in. From the side, the beam can be seen by the blue light it scatters; but the light seen directly from the end is reddened after it has passed through the tank. The scattered light can also be shown to be polarised using a filter of polarised light, just as the sky appears a deeper blue through polaroid sun glasses.
This is most correctly called the Tyndall effect, but it is more commonly known to physicists as Rayleigh scattering—after Lord Rayleigh, who studied it in more detail a few years later. He showed that the amount of light scattered is inversely proportional to the fourth power of wavelength for sufficiently small particles. It follows that blue light is scattered more than red light

Statement on Requesting Federal Election Commission Action To End the Soft Money System in Domestic Politics
June 5, 1997
Today I have asked the Federal Election Commission to act, within its current legal authority, to end the soft money system. Currently, both parties compete to raise large sums from corporations, individuals, and labor unions. There is too much money in politics, and the problem worsens with every election. This escalating arms race must stop, and I am determined that we will reform campaign finances, by every means we can.
Such an action by the FEC cannot be a substitute for comprehensive campaign finance reform legislation, which is currently before the Congress. In my State of the Union Address, I challenged Congress to act by July 4th and pass bipartisan reform. That deadline is now one month away, and there is still time for Congress to move forward on this priority. I call on Congress to pass legislation that institutes voluntary spending limits, provides free broadcast time to candidates who abide by those limits, restricts special interest contributions, addresses independent expenditures, and bans soft money.
It is clear that the current campaign finance system has been overwhelmed by an unprecedented volume of money. If we are to restore the public's faith in our institutions and the political system, we must reform the campaign finance system. This request to the FEC makes clear my determination that, one way or another, we will see reform, and we will end the soft money. I want to work in the coming days with Members of Congress to pass bipartisan and comprehensive campaign finance reform.

Executive Order 10694 - Authorizing the Secretaries of the Army, Navy, and Air Force To Issue Citations in the Name of the President of the United States to Military and Naval Units for Outstanding Performance in Action
January 10, 1957
By virtue of the authority vested in me as President of the United States and as Commander in Chief of the armed forces of the United States, it is hereby ordered as follows:
1. The Secretaries of the Army, the Navy, and the Air Force, respectively, are hereby authorized to issue a citation in the name of the President of the United States, as public evidence of deserved honor and distinction, to any organization, detachment, installation, ship, aircraft, or other unit for outstanding performance in action on or after October 16, 1941, in the case of the Navy or Marine Corps, and on or after December 7, 1941, in the case of the Army or the Air Force. Such citations may also be issued to units of armed forces of co-belligerent nations serving with the armed forces of the United States for outstanding performance in action on or after December 7, 1941; provided that such units shall meet the standards established for the armed forces of the United States.
2. Appropriate insignia of such form and design as may be determined by the Secretary concerned may be displayed by any organization, detachment, installation, ship, aircraft, or other unit to which such citation is issued.
3. After any unit is cited pursuant to paragraph 1 hereof for outstanding performance in action, a ribbon identifying such citation shall be issued and shall become a permanent part of the uniform of those persons assigned or attached thereto who were actually present and participated in the action for which the unit was cited, or in one of the actions if more than one action is mentioned in the citation, whether they thereafter serve with such unit or with a different unit. Such persons are authorized to wear an appropriate additional device for any subsequent citation for which they are eligible, made either to the same unit or to a unit to which they are subsequently assigned. If authorized by the Secretary concerned, persons assigned to a unit subsequent to an action for which it was cited, may wear the citation ribbon while so assigned.
4. This order supersedes Executive Orders No. 9050 of February 6, 1942, and No. 9396 of November 22, 1943.

XXXIV President of the United States: 1953-1961
70 - Remarks at The Citadel, Charleston, South Carolina.
April 12, 1955
General Clark, Members of this distinguished audience, and members of the Corps of Cadets of The Citadel:
I would need scarcely search for words in order to express to you something of the great feeling of honor I have in the receipt of this honor through such a distinguished institution and at the hands of one of my oldest friends in the military services. I am sure that you must feel yourselves how moved I am by the circumstances of this meeting.
Quite naturally, with my background, a ceremony such as this carries me back forty and more years. I see myself marching. Incidentally, I see myself again resenting the presence of VIP's that interrupted some vacation or period of my own and who had me out in full dress, marching for the edification of an audience and of that particular VIP.
There was one redeeming feature, occasionally, about such occasions. Sometimes this VIP had the wit and the knowledge to suggest to the Commander that it might be sort of recompense to the Corps if punishments were remitted. But of course that was in the years gone by, and I am not certain what the custom is now. And of course, I am not really familiar any longer with the rank of the individual that has the right to ask such a great favor. But, moreover, since I am now, by vicarious graduation, a sort of member of this body, whether or not he might consider it effrontery on my part to ask, I wouldn't know.
But passing those things, if I could attempt to leave with you young men a message this morning, it would be one truly of congratulation. I am informed that 95 percent of this graduating class is going into some element of the military services, either Reserves or Active. I suppose that that sort of percentage applies throughout the years. Certainly I have met many of your alumni throughout the years that I served with in the Army.
Now, what I want to speak to you for just a minute is of both the opportunities of men who are going into the Armed Services, Active and Inactive, and something about the scope of the responsibilities and problems that you will meet.
First of all, the opportunities. You are given that most priceless of opportunities: to work directly and specifically for the welfare of the United States of America, and there is no greater honor that is achievable by any American.
And secondly, what I want to say to you is the scope of the understanding you must achieve if you are now to do the task far transcends what your illustrious Commandant or Superintendent and I understood when we were waiting on the plain at West Point forty or more years ago receiving our diplomas and entered into the regular service.
Today, a man to do his duty in the military services must study humanity first of all--what makes humans tick. Not only as regards to your own companies, to be for them the leader and the model, but since you must be one of the principal apostles of peace, you must try to understand other people. You must try to understand the heart of America and how to translate that heart to other peoples. You must know something of economics, and of course your profession will make you know something of law and engineering and many of the sciences; but above all, we come back to it: you must try to understand people.
How else, I ask you, are we to achieve peace in this world, unless there be a magnificent growth of understanding? Mere knowledge is not enough. The highest star man in this Corps of Cadets, unless he strives for understanding and achieves understanding, by which to interpret and to relate among themselves all the facts that he may have learned in science and social science and the humanities, cannot be a leader.
And I know that in this institution just as in all others, we have our devoted educators trying to get over to all of their students that thought: let us strive to understand--understand each other, and our Nation to understand others, and help them to an understanding of ourselves.
I do not mean to say for an instant that all of these opportunities, all of these responsibilities--all of these things--are exclusive to the soldier, to the sailor, to the air man, to the Marine. Of course not. But since the man in the services holds up his right hand and swears to uphold the Constitution of the United States and to serve her to the depths of his ability, through life unto death, it comes home, possibly, to him a little more sharply than it does to others.
Now already, my friends, I have violated my promise that I was not going to keep you here long, but if I could just leave with you this thought: America is bound to watch you. They know you are a graduate of The Citadel. You know they know you have the early phases of your preparation for the highest form of citizenship. They are going to watch you. They will expect much of you.
And for my part, now that I know I am one of your alumni, I know you are going to succeed--each of you.
Thanks again for the great compliment of your review, and I think it would be not out of place to say that my eye since early youth has been accustomed to the sight of good soldiers-neat, soldierly-appearing people that show the evidences of training. I have seen no body that excels this one, and I congratulate you and all that are responsible for it. I congratulate the great State that supports you.
Good luck to you, and thanks again for this great honor.
Note: The President spoke on the Parade Grounds, immediately after receiving an honorary degree of Doctor of Laws. His opening words "General Clark" referred to General Mark W. Clark, President of The Citadel.

Awarded for actions during the World War II
The President of the United States of America, authorized by Act of Congress, July 9, 1918, takes pride in presenting the Distinguished Service Cross (Posthumously) to Captain (Air Corps) Colin Purdie Kelly, Jr. (ASN: 0-20811), United States Army Air Forces, for extraordinary heroism in connection with military operations against an armed enemy while serving as Pilot of a B-17 Heavy Bomber in the 14th Bombardment Squadron, 19th Bombardment Group (H), FAR EAST Air Force, while participating in a bombing mission on 10 December 1941, near Aparri, Cagayan, Philippine Islands. With his airplane a focal point of fire from the strong hostile naval forces, Captain Kelly exhibited a high degree of valor and skill in placing three direct hits upon an enemy battleship, resulting in its destruction. En route to his home airfield upon completion of his mission, his airplane was set afire by the attack of two enemy fighters, but Captain Kelly, the last to leave the burning plan was killed in the resulting crash. The personal courage and zealous devotion to duty displayed by Captain Kelly on this occasion, at the cost of his life, have upheld the highest traditions of the military service and reflect great credit upon himself, the Far East Air Force, and the United States Army Air Forces.

From Wikipedia, the free encyclopedia
Colin Purdie Kelly, Jr. (July 11, 1915 – December 10, 1941) was a World War II B-17 Flying Fortress pilot who flew bombing runs against the Japanese navy in the first days after the Pearl Harbor attack. He is remembered as one of the first American heroes of the war for sacrificing his own life to save his crew when his plane became the first American B-17 to be shot down in combat.
Death
On December 10, 1941, Kelly's B-17C, USAAF 40-2045, (19th BG / 30th BS), took off from Clark Field in the Philippines. During its bombing run, with Sergent Meyer Levin as bombardier, Kelly's plane slightly damaged the Japanese cruiser Natori. On its return flight, the bomber was then engaged by the Tainan Air Group A6Ms which had been patrolling over Vigan. They attacked it, followed it, and attacked again. At last near Clark Field it began to burn, and Kelly ordered his crew to bail out; the aircraft then blew up, killing him. The attackers did not see this, and initially were credited only with a probable "kill", shared jointly by Toyoda, Yamagami, Kikuchi, Nozawa, and Izumi. Saburo Sakai, who has often been credited with destroying this aircraft, was indeed a Shotai leader engaged in this fight with the bomber, but he and his two wingmen do not appear to have been given official credit for its despatch.
Early reports misidentified the Japanese heavy cruiser Ashigara, which was present, as the battleship Haruna, which was not, and also mistakenly reported that Kelly had crashed his plane into the smokestack of Haruna, becoming the first suicide pilot of the war.

Julia: I want you to tell me.
Bob: I didn't tell you before because I wasn't sure whether it was real or not. But I am sure now. It is real. There's a man out there. Or a... a gremlin, or... whatever. If I described him to you, you'd really think I was gone.

That's Swimming Distance.
I've been trying to remember the visits I made to Ashdown in the early 1990s.
I recall the visit I made during Memorial Day 1990. I remember my Ashdown Class of 1984 high school reunion in August 1994.
So this one time I am thinking of now must have been before that visit in 1994 and after that Memorial Day 1990 visit.
I was driving my red 1990 Mazda RX-7 that time. I have been trying to remember when I bought that car. I had that car when I took out Bobbilynn to see the 1990 film "Kindergarten Cop" at the theatre in Anderson South Carolina. That movie is listed as premiering in December 1990 but I think we must have seen it in early 1991. Can't recall for certain. I might have written she was over at my duplex apartment on Wexford in Taylors South Carolina in January or February 1991. I think I wrote she was over at my place in February but I don't recall if I wrote about which year that was. I think that must have been 1991. I was driving that RX-7 then. I guess I could have bought the car in 1990. Can't recall for certain. I bought it used and I have been thinking I got it in 1991. I traded in that Honda Civic car for it.

Or I do understand. But I don't understand why they aren't working harder to complete whatever is their assignment that will allow me to finish my assignment. Or something like that. I have to wait. But why should I have to wait? Why is it that I have to sacrifice so much in terms of losing all these years away from the people I care about? Why is this all so backwards? I am the crime victim. I am the target of the identity thieves. Why can I not even go home? Why am I again a Prisoner of War as a member of the United States Navy and on an official United States federal undercover assignment? Why is this all so backwards?

There was one day I was sitting there in that homeless shelter in Seattle’s Pioneer Square and the thought occurred to me that I had never actually lived at any of the addresses as I “remembered” any of it. One of the first clues I started to research was to find out if there was any special meaning to the name Wexford other than what I actually “remembered.” Even before I discovered the source of the name Wexford – relative to the U.S. Navy – I knew it was going to be something profound. Even before the page came up describing that County Wexford, Ireland, was the birth place of John Barry, I knew it was going to mean something very important to me. John Barry, in some sources, is considered the father of the U.S. Navy and I have also read that he was given the first officer’s commission in the U.S. Navy. From there, I was equally puzzled over why I later lived off a road named Dresden that was near a park named Sheffield.

ACLU: Sex In Restroom Stalls Is Private
In an effort to help Sen. Larry Craig, the American Civil Liberties Union is arguing that people who have sex in public bathrooms have an expectation of privacy.
Craig, of Idaho, is asking the Minnesota Court of Appeals to let him withdraw his guilty plea to disorderly conduct stemming from a bathroom sex sting at the Minneapolis airport.
The ACLU filed a brief Tuesday supporting Craig. It cited a Minnesota Supreme Court ruling 38 years ago that found that people who have sex in closed stalls in public restrooms "have a reasonable expectation of privacy."
That means the state cannot prove Craig was inviting an undercover officer to have sex in public, the ACLU wrote.
The Republican senator was arrested June 11 by an undercover officer who said Craig tapped his feet and swiped his hand under a stall divider in a way that signaled he wanted sex. Craig has denied that, saying his actions were misconstrued.
The ACLU argued that even if Craig was inviting the officer to have sex, his actions wouldn't be illegal.
"The government cannot prove beyond a reasonable doubt that Senator Craig was inviting the undercover officer to engage in anything other than sexual intimacy that would not have called attention to itself in a closed stall in the public restroom," the ACLU wrote in its brief.
The ACLU also noted that Craig was originally charged with interference with privacy, which it said was an admission by the state that people in the bathroom stall expect privacy.
