Victims of Fort Hood shooting in Texas seek 'terrorism' declaration

SAN ANTONIO (Reuters) - Lawyers for 40 military personnel and civilians killed or wounded in an attack at the Fort Hood military post in Texas by a former Army psychologist filed a petition on Tuesday with the Pentagon asking the incident be declared an act of terrorism.

Attorney Neal Sher told Reuters the designation could make military personnel in the 2009 attack eligible for the Purple Heart medal and civilians eligible for the Medal for Defense of Freedom.

Certain military benefits could also be granted to individuals who are determined to have been wounded in the course of a terrorist attack, Sher said.

Then Army Major Nidal Hasan, an American-born Muslim, opened fire on unarmed soldiers preparing for deployment on Nov. 5, 2009, killing 13 people and wounding 32 others in what he later called retaliation for U.S. wars in the Muslim world.

Hasan, now on the military's death row, said during his trial that he was motivated by al Qaeda, Taliban and other groups considered by the United States as supporting terrorist activities.

Sher said new language in the 2015 National Defense Authorization Act allows the secretary of defense to determine if an attack was motivated by a foreign terrorist organization. The final decision on who receives military decorations is up to the Department of Defense.

"As far as we're concerned, it would just be outrageous for them not to give these people the award," he said.

A Pentagon spokesman said the military is looking at how the Fort Hood attacks and other incidents that have come after the Sept. 11, 2001 attacks on the United States fit its criteria.

"We anticipate a determination on all such incidents, including the attack at Fort Hood in 2009, in the near future," Pentagon Spokesman Lieutenant Commander Nate Christenson, a Pentagon spokesman, said in an email.

Love him or hate him, when it comes to book sales, Howard Stern has set the bar high. The radio broadcaster, whose "Miss America" reached stores Nov. 7, sold more copies in the first week than Colin Powell and O.J. Simpson did in their first weeks combined.

Sales of "Miss America" leveled off last week at Barnes & Noble, but not before an estimated 4,000 fans kept the self-proclaimed "King of All Media" signing copies for 7 1/2 hours Saturday at the chain's Carle Place, N.Y., store. The book remained B & N's top seller for the second week.

Who are Stern's main competitors in this busy fall publishing season? Powell and Microsoft chairman Bill Gates.

FOR its lead title this fall, Viking is spending $1 million, one of its largest promotional budgets ever, to tell the world about Bill Gates.

That's right. The same Bill Gates of Microsoft whose name is itself a marketing strategy. The same Bill Gates whose preppy face appears regularly on the covers of publications around the world. The same Bill Gates who has spent $150 million to market Windows 95, his latest software product.

Nonetheless, beginning today, Viking and Microsoft will kick off a media blitz for Mr. Gates's new book, "The Road Ahead," that may rival Random House's efforts to push Gen. Colin L. Powell, who recently finished a heavily publicized 23-city tour for his memoir, "My American Journey."

"We don't take anything for granted," said Jonathan Lazarus, vice president of strategic relations at Microsoft, which is providing technical support for the marketing efforts. "Our goal is to get this book read by the most people possible."

As part of their tack, Microsoft and Viking have tried to whet appetites for "The Road Ahead" by guarding the book's contents as fiercely as grizzlies protecting their cubs. No early review copies were sent out, and the books have been shipped in unmarked boxes to deter interception, then locked in regional storehouses until this week.

Everyone with access to the book -- even the 20 or so foreign publishers now scurrying to translate it for their countries -- had to sign confidentiality agreements.

In fact, it was not until yesterday, in an approved excerpt in The Sunday Times of London, that Mr. Gates's forecasts about the information superhighway and his plan to rule the road were made public. As a marketing vehicle, The Times was well tested: this summer, for the introduction of Windows 95, Microsoft paid for an entire daily press run of The Times and gave it away to readers. In the United States, the first excerpts appear in the Nov. 27 edition of Newsweek, which reaches newsstands today.

The book is yet another weapon to help Microsoft -- already the leader in the software industry -- battle for position in the Internet arena. That fact was not lost on Viking or its parent, the Penguin Group, a division of Pearson P.L.C., which presented marketing proposals from each of its offices abroad as well as in the United States when bidding for the book.

Part of the strategy, in addition to a printing of 850,000 books in North America and several hundred thousand overseas, is a very expensive marketing technique called a "one day lay down." The idea is to place a book on sale in a number of countries on the same day -- in this case, Nov. 24

Atlanta Park Reopens -- Service Held For Victims Of Bombing; FBI Hunts For Suspect

ATLANTA - Centennial Olympic Park reopened this morning as thousands determined to put Saturday's tragic bombing behind them streamed into the site carrying carnations and heavy hearts and hoping to rekindle the Olympic spirit.


The FBI also released a transcript of the 911 call that warned Atlanta police of the bomb. The call was received 30 minutes before the explosion, but word of it was never relayed to officers at the scene.

Tubbs said the call, in its entirety, consisted of an American man with no distinctive accent saying: "There is a bomb in Centennial park. You have 30 minutes."

With that, the caller hung up.
