Commander, Air Group
Commander, Air Group, or CAG, refers to the Commander of the Air Wing aboard an aircraft carrier of the U.S. Navy. The term traces its origins to 1938 when the first Carrier Air Group was formed. Air Groups were redesignated as Carrier Air Wings, or CVWs in the 1970s, but the head of the air wing is still referred to as the CAG. Initially, the CAG was the most senior commanding officer of the three embarked squadrons and was expected to personally lead all major strike operations, co-ordinating the attacks of the carrier's fighter, bomber, and torpedo planes in combat. AUSTIN - Gov. George W. Bush announced the formation of a presidential exploratory committee Tuesday, saying only a total flop in his support would keep him from seeking the GOP nomination next year.
"A giant thud. A huge yawn. It turned out it was my mother they were interested in," Bush responded when asked what could keep him from running.
Bush is the eldest son of former President George Bush and first lady Barbara Bush.
Bush said his exploratory committee's first task will be to raise money while he tends to the state Legislature, whose session ends at the end of May. Bush said he and his wife, Laura, will then travel the country to see if there really is grass-roots support for his campaign.

It kept getting worse.
The horror arrived in episodic bursts of chilling disbelief, signified first by trembling floors, sharp eruptions, cracked windows. There was the actual unfathomable realization of a gaping, flaming hole in first one of the tall towers, and then the same thing all over again in its twin. There was the merciless sight of bodies helplessly tumbling out, some of them in flames.
Finally, the mighty towers themselves were reduced to nothing. Dense plumes of smoke raced through the downtown avenues, coursing between the buildings, shaped like tornadoes on their sides.
Every sound was cause for alarm. A plane appeared overhead. Was another one coming? No, it was a fighter jet. But was it friend or enemy? People scrambled for their lives, but they didn't know where to go. Should they go north, south, east, west? Stay outside, go indoors? People hid beneath cars and each other. Some contemplated jumping into the river.
For those trying to flee the very epicenter of the collapsing World Trade Center towers, the most horrid thought of all finally dawned on them: nowhere was safe.

NEW YORK -- Investigators of the massive blast at the World Trade Center were stymied Saturday by the severity of the damage as the city awakened to an emotional and economic aftershock.
New York City Police Commissioner Raymond W. Kelly said it may be days before investigators can sift through the rubble at the epicenter of Friday's explosion, which killed five and injured more than 1,000 at the soaring business and trade center in lower Manhattan.
Forensic investigators were barred by engineers from entering the area until sections of the underground parking garage where the blast originated could be shored up.
But even in the absence of forensic reports, police and other officials agreed that a massive bomb or bombs probably caused the violent explosion. Three levels of the parking garage were devastated.
"There is a great crater in there, and it is difficult to imagine what else could have caused it," said New York Gov. Mario Cuomo, who toured the site Saturday morning.
"If it looks like a bomb and smells like a bomb, then it's probably a bomb. . . . The answer is to find out who did it, apprehend the people who did it and punish them."

ADEN, Yemen - Investigators found bomb-making equipment in an apartment near the port of Aden and believe two former occupants may have carried out the suicide bombing that killed 17 sailors aboard the USS Cole, security officials said Tuesday.
U.S. authorities would not comment directly on the disclosure. But the ambassador, Barbara Bodine, described the investigation as advancing "a quantum leap."
"We are very hopeful we are going to get to the bottom of this," she said.
Bodine declined to comment on details of the case or speculate on possible links to larger terrorist groups, including that of Afghan-based militant Saudi millionaire Osama bin Laden. She stressed that the investigation would continue.
"We want this investigation to go further . . . to see how far back we can walk this. And those kinds of investigations can sometimes take some time," she said.

PEARL HARBOR (NNS) -- USS Texas (SSN 775), the second Virginia-class submarine to be homeported in the Pacific, arrived at Naval Station Pearl Harbor during an inner-fleet transfer from Groton Submarine Base Nov. 23.
"This is a very exciting time for Texas and her crew," said Cmdr. Robert Roncska, commanding officer, USS Texas. "The crew performed above and beyond my expectations and I am very proud that we are here now and in the Aloha spirit."
Measuring 377 feet long, weighing 7,800 tons when submerged and with a complement of more than 130 crew members, Texas is one of the Navy's newest and most technologically sophisticated submarines.

The F-14 made its first combat debut flying cover during Operation Frequent Wind in April 1975. The fighter squadrons VF-1 and VF-2 were deployed on board USS Enterprise (CVN-65) with Carrier Air Wing 14. The cruise began on September 17, 1974 and ended May 20, 1975. The two squadrons flew combat air patrols over South Vietnam during the operation but did not encounter any North Vietnamese MiGs, though they were fired upon by enemy anti-aircraft guns.
Soviet intercepts and American hostages in Iran
During the rest of the 1970’s the F-14 did not see any combat, F-14s primarily intercepted Soviet aircraft coming too close to the carrier groups, and VF-142 was the first Atlantic Fleet F-14 squadron to intercept a Soviet Tu-95 Bear bomber on April 23, 1976. In 1979, VF-111 and VF-51 participated in efforts to free the American hostages in Iran. VF-41 and VF-84 were on station during the crisis in 1980 as well.

Enterprise sailed for workups and refresher training, 4–28 March 1974, the first portion of which was spent in the workups, with the weekends of 9–10, 16–17 and 23–24 March, being spent in San Diego. During this period the ship was also used by a number of different squadrons for carrier qualifications, as well as a test platform for both F-14As and S-3As. During that time, Lieutenant Commander Grover Giles, pilot, and Lieutenant Commander Roger McFillen, RIO, VF-1, made the maiden F-14A Tomcat landing on board Enterprise on 14 March 1974. Later that day, Giles and McFillen were joined by a pair of Tomcats from the Naval Air Test Center (NATC) Patuxent River, Maryland.
Enterprise spent the remainder of March through mid–April 1974 conducting a “Readiness Improvement Training Period,” followed by further carrier qualifications for both CVW-14 and other unattached squadrons.
Enterprise deployed to the western Pacific on 17 September 1974. Her transit was “literally quiet,” in that the ship made most of it under electronic emissions control (EmCon) restrictions, enabling her to avoid many Soviet forces attempting to intercept and track her.

America was founded on the principles of liberty and the rule of law. And throughout our Nation's history, the preservation of individual rights has been dependent upon the dedication of our people to liberty and the institutionalization of its principles in the law of the land.
Our forefathers' dedication to liberty is clearly expressed in this Nation's great Charters of Freedom: the Declaration of Independence, the Constitution and the Bill of Rights. These documents, which are the very foundation of American law, guarantee certain inalienable rights and privileges to every citizen. Among these are: freedom of speech, freedom of the press, freedom of religion, freedom of contract, the right to assemble and petition, the right of property ownership, and the right to due process of law.
This year marks the Nation's twenty-fourth annual celebration of Law Day, U.S.A.—a special day for reflection on our heritage of individual freedom and for rededication to maintaining, through law, the principles of liberty which govern this land.
Now, Therefore, I, Ronald Reagan, President of the United States of America, invite the American people to celebrate Friday, May 1, 1981, as Law Day, U.S.A., and to mark its observance with programs and ceremonies as befits our great heritage of liberty under law.
I urge clergymen of all faiths to bring to public attention through sermons and suitable programs the moral and ethical dimensions of law and liberty.

Both fire-warning lights glared a brilliant red. The plane was out of control. The hydraulic gauges still showed plenty of pressure. The nose slammed up and down with an evil perversity, and the machine rolled left. He jammed the stick full right, but the left roll continued. He looked at Morgan. His head was gone. Blood spurted in little fountains from the stump of his neck. The canopy glass was gone on the right side, and the wind howled through the cockpit. The stick was firm, yet the plane did not respond. His body slammed back and forth as the G forces and the wind tore at him. With the altimeter racing down, he fumbled for the ejection handle between his legs. It wasn't there! His hands went to the primary handle over his head, but it too was gone! He couldn't tear his eyes from the wildly spinning altimeter. Maddened by the roar of the hurricane wind, he screamed.
The scream woke him. The darkness and the panic were real. Unable to orient himself, he fought the sheets. One fist struck the bulkhead, and the pain sobered him. He fumbled for the bunk light switch.
He kicked the sheets aside and put his feet on the floor. Sweat covered his brow. He lit a cigarette with trembling hands. Three o'clock in the morning. Sammy Lundeen was flying somewhere over North Vietnam. Morgan McPherson was in a body bag in the ship's morgue.
He had drunk too much bourbon. His head throbbed and his hands still shook. He levered himself upright and fumbled for some aspirin in the medicine cabinet. He wet a face towel and lay down again with the cool cloth on his forehead. He left the light on. He needed the light.
He concentrated on the sounds of the ship working in the seaway. Metal rubbing on metal, the great weight of the ship rolling ever so gently back and forth as it met the swells, the rhythm of movement. He could also hear the sounds of men and machinery. From the engineering spaces below his room came the ringing of hammer blows. He silently cursed the fellow with the hammer, some boilertender, no doubt, delicately adjusting a precision instrument.

Eminent domain
Eminent domain (United States, Canada), compulsory purchase (United Kingdom, New Zealand, Ireland), resumption/compulsory acquisition (Australia) or expropriation (South Africa and Canada's common law systems) is the inherent power of the state to seize a citizen's private property, expropriate property, or seize a citizen's rights in property with due monetary compensation, but without the owner's consent. The property is taken either for government use or by delegation to third parties who will devote it to public or civic use or, in some cases, economic development. The most common uses of property taken by eminent domain are for public utilities, highways, and railroads[citation needed], however it may also be taken for reasons of public safety, such as in the case of Centralia, Pennsylvania. Some jurisdictions require that the government body offer to purchase the property before resorting to the use of eminent domain.
The term "condemnation" is used to describe the formal act of the exercise of the power of eminent domain to transfer title to the property from its private owner to the government. This use of the word should not be confused with its sense of a declaration that property is uninhabitable due to defects. The latter usually does not deprive the owners of the title to the property condemned but requires them to rectify the offending situation or have the government do it for the owner at the latter's expense.
Condemnation via eminent domain indicates the government is taking ownership of the property or a lesser interest in it, such as an easement. In most cases the only thing that remains to be decided when a condemnation action is filed is the amount of just compensation, although in some cases the right to take may be challenged by the property owner on the grounds that the attempted taking is not for a public use, or has not been authorized by the legislature, or because the condemnor has not followed the proper procedure required by law.
The exercise of eminent domain is not limited to real property. Governments may also condemn personal property, such as supplies for the military in wartime or franchises. Governments can even condemn intangible property such as contract rights, patents, trade secrets, and copyrights. Even football teams may be seized by eminent domain.
History
Eminent domain (ED) is an inherent attribute of sovereignty, and the Fifth Amendment's Taking or Just Compensation clause only imposes limitations on its exercise; i.e., the taking must be for public use and just compensation must be paid. Some historians have suggested that these limitations on the taking power were inspired by the need to permit the army to secure mounts, fodder and provisions from local ranchers and the perceived need to assure them compensation for such takings. Similarly, soldiers forcibly sought housing in whatever homes were near their military assignments. To address the latter problem, the 3rd Amendment was enacted in 1791 as part of the US Constitution's Bill of Rights. It provided that the quartering of soldiers on private property could not take place in peacetime without the landowner's consent. It also required that, in wartime, established law had to be followed in housing troops on private property. Presumably, this would
mandate "just compensation", a requirement for the exercise of eminent domain in general per the 5th Amendment to the Constitution In addition, all US states have legislation specifying ED procedures within their respective territories.
The most common reason ED is exercised in the US is for building new or larger roadways, airports or government buildings, although during the second half of the 20th century, takings for urban redevelopment have become common.
After his victory in 1066, William the Conqueror seized virtually all land in England. Although he maintained absolute power over the land, he granted fiefs to landholders who served as stewards, paying fees and providing military services.
Terminology
At the time the United States was created, it and the several states continued to use the British common law, including the principle of eminent domain. The term "eminent domain" was taken from the legal treatise, De Jure Belli et Pacis, written by the Dutch jurist Hugo Grotius in 1625, who used the term dominium eminens (Latin for supreme lordship) and described the power as follows:
"... the property of subjects is under the eminent domain of the state, so that the state or he who acts for it may use and even alienate and destroy such property, not only in the case of extreme necessity, in which even private persons have a right over the property of others, but for ends of public utility, to which ends those who founded civil society must be supposed to have intended that private ends should give way. But it is to be added that when this is done the state is bound to make good the loss to those who lose their property."
Some U.S. states, including New York and Louisiana use the term appropriation as a synonym for the exercising of eminent domain powers.
The term compulsory purchase, also originating in the mid-19th century, is used primarily in England and Wales (see compulsory purchase order), and some other jurisdictions that follow the elements of English law. Originally, the power of eminent domain was assumed to arise from natural law as an inherent power of the sovereign.
United States
The power of governments to take private real or personal property has always existed in the United States, being an inherent attribute of sovereignty. This power reposes in the legislative branch of the government and may not be exercised unless the legislature has authorized its use by statutes that specify who may use it and for what purposes. The legislature may delegate the power to private entities like public utilities or railroads, and even to individuals for the purpose of acquiring access to their landlocked land. Its use was limited by the Takings Clause in the Fifth Amendment to the U.S. Constitution in 1791, which reads, "...nor shall private property be taken for public use, without just compensation". The Fifth Amendment did not create the national government's right to use the eminent domain power, it simply limited it to public use.
The U.S. Supreme Court has consistently deferred to the right of states to make their own determinations of public use, although the reason why the constitutional term "public use" should not be subject to judicial interpretation, the same as other constitutional terms, has not been explained. In 1832 the Supreme Court ruled that eminent domain could be used to allow a mill owner to expand his dam and operations by flooding an upstream neighbor. The court opinion stated that a public use does not have to mean public occupation of the land; it can mean a public benefit. In Clark vs. Nash (1905), the Supreme Court acknowledged that different parts of the country have unique circumstances and the definition of public use thus varied with the facts of the case. It ruled a farmer could expand his irrigation ditch across another farmer's land (with compensation), because that farmer was entitled to the "the flow of the waters of the said Fort Canyon Creek...
and the uses of the said waters... [is] a public use." Here in recognizing the arid climate and geography of Utah, the Court indicated the farmer not adjacent to the river had as much right as the farmer who was, to access the waters. However, until the 14th Amendment was ratified in 1868, the limitations on eminent domain specified in the Fifth Amendment applied only to the federal government and not to the states. That view ended in 1896 when in the Chicago B. & Q. Railroad v. Chicago case the court held that the eminent domain provisions of the Fifth Amendment were incorporated in the Due Process Clause of the Fourteenth Amendment and thus were now binding on the states. This was in-tune with the beginning of what is known as the "selective incorporation" doctrine.
An expansive interpretation of eminent domain was reaffirmed in Berman v. Parker (1954), in which the U.S. Supreme Court reviewed an effort by the District of Columbia to take and raze blighted structures, in order to eliminate slums in the Southwest Washington area. After the taking, held the court, the taken and razed land could be transferred to private redevelopers who would construct condominiums, private office buildings and a shopping center. The Supreme Court ruled against the owners of a non-blighted property within the area on the grounds that the project should be judged on its plans as a whole, not on a parcel by parcel basis. In Hawaii Housing Authority v. Midkiff (1984), the Supreme Court approved the use of eminent domain to transfer a land lessor's title to its tenants who owned and occupied homes built on the leased land. The court's justification was to break up a housing oligopoly, and thereby lower or stabilize home prices, although
in reality, following the Midkiff decision, home prices on Oahu escalated dramatically, more than doubling within a few years.
The Supreme Court's decision in Kelo v. City of New London, 545 U.S. 469 (2005) affirmed the authority of New London, Connecticut, to take non-blighted private property by eminent domain, and then transfer it for a dollar a year to a private developer solely for the purpose of increasing municipal revenues. This 5-4 decision received heavy press coverage and inspired a public outcry that eminent domain powers were too broad. As a reaction to Kelo, several states enacted or are considering enacting state legislation that would further define and restrict the state's power of eminent domain. Allodial title
Allodial title is a concept in some systems of property law. It describes a situation where real property (land, buildings and fixtures) is owned free and clear of any encumbrances, including liens, mortgages, and tax obligations. Allodial title is inalienable, in that it cannot be taken by any operation of law for any reason whatsoever.
In common legal use, allodial title is used to distinguish absolute ownership of land by individuals from feudal ownership, where property ownership is dependent on relationship to a lord or the sovereign. Webster's first dictionary (1825 ed) says allodium is "land which is absolute property of the owner, real estate held in absolute independence, without being subject to any rent, service, or acknowledgement to a superior. It is thus opposed to feud."
True allodial title is rare, with most property ownership in the common law world—primarily, the United Kingdom, the United States, Canada, Australia, New Zealand and the Republic of Ireland—described more properly as being in fee simple. In particular, land is said to be "held of the Crown" in England and Wales and the Commonwealth realms. In England, there is no allodial land, all land being held of the Crown; even in the United States most lands are not allodial, as evidenced by the existence of property taxes. Some of the Commonwealth realms (particularly Australia) recognise native title, a form of allodial title that does not originate from a Crown grant.
Legal concept
Allodial lands are the absolute property of their owner and not subject to any service or acknowledgment to a superior. An allodial title is the opposite of a feudal tenure such as fee simple. The derivation of the word is still doubtful, though it is probably compounded of the Germanic all, whole or entire, and odh, property. Allodial tenure seems to have been common throughout northern Europe, but is now unknown in common law jurisidictions apart from the United States.
England and Wales
Proof of ownership
Until the 18th century, almost all common law property ownership depended on proving a link of possession from a royal grant of title to the property owner. Although the feudal system was rapidly disappearing from England in the 18th century, to be replaced with a system of taxation, in theory the feudal chain of title still exists, although it is a formality.
However, proving ownership in absence of the documents was an impossibility, and forgeries of crown grants were common and difficult to detect. Moreover, it was nearly impossible to determine if land was subject to common law encumbrances (i.e. mortgages). This led to the establishment in the 18th century of land registry systems, where a central office in each county was responsible for the filing of land deed, mortgages, liens and other evidence of ownership, transfer or encumbrance. Under land registry, deeds and charges were not recognized unless they were filed, and persons who filed were given priority over previous transactions that had not been filed. Moreover, under statutes of limitation, only documents that had been filed in the past 40 years had to be consulted to determine the chain of ownership.
United States
In the United States, "To say that land is owned 'allodially' is a fiction. All land under United States government jurisdiction is subject to expropriation by way of eminent domain".[citation needed]
Before 1774, all land in the American colonies could also be traced to royal grants, usually one grant creating each colony. The original grantee (recipient of the land) then sold or granted parcels of land within his/her grant to private citizens and other legal entities. However, when the colonies won the Revolutionary War, they did not want to retain a feudal system of land ownership. The Treaty of Paris (1783), which ended formal hostilities and recognized American independence, also had the effect of ending any residual rights held by the original grantees or the Crown. Essentially, this merely recognized that no person holding land in the new United States owed any allegiance or duty to the Crown or any English noble. There is no specific reference to allodial title in the text of the treaty. Some states created a form of allodial title while others retained the tenurial system with the state as the new ultimate landholder.
Apart from land that was formally owned at the time of the Revolutionary War, most American landholders can trace their title back to grants by the federal or state governments of land obtained by purchase (Louisiana Purchase, Florida, Alaska), treaty (the Ohio Valley, New Mexico, Arizona, and California), or annexation (Texas, Hawaii). However, in reality, previous grants prior to those territories becoming U.S. possessions were recognized. In fact, in Dartmouth College v. Woodward, the United States Supreme Court ruled that a New Hampshire law that attempted to revoke the land grant to Dartmouth College from King George III was unconstitutional.
Many state constitutions (Arkansas, Wisconsin, Minnesota, New York) refer to allodial title, but only to clearly distinguish it from feudal title, which appears to be illegal throughout the United States. The conditions under which the government can compel the sale of privately owned real property for public benefit are established by eminent domain laws of either the federal or state governments, respectively. The Fifth Amendment to the United States Constitution requires just compensation for eminent domain compelled sale. The right of the several states to tax real estate is preserved in the Constitution. In addition, the government powers of police power and escheat have been retained in the American legal system.

Land tenure
Land tenure is the name given, particularly in common law systems, to the legal regime in which land is owned by an individual, who is said to "hold" the land. The sovereign monarch, known as The Crown, held land in its own right. All private owners are either its tenants or sub-tenants. The term "tenure" is used to signify the relationship between tenant and lord, not the relationship between tenant and land.
Over history, many different forms of land ownership, i.e., ways of owning land, have been established.
A landholder or landowner is a holder of the estate in land with considerable rights of ownership or, simply put, an owner of land.
Tenure
Historically in the system of feudalism, the lords who received land directly from the Crown were called tenants in chief. They doled out portions of their land to lesser tenants in exchange for services, who in turn divided it among even lesser tenants. This process--that of granting subordinate tenancies--is known as subinfeudation. In this way, all individuals except the monarch were said to hold the land "of" someone else.
Historically, it was usual for there to be reciprocal duties between lord and tenant. There were different kinds of tenure to fit various kinds of duties that a tenant might owe to a lord. For instance, a military tenure might be by knight-service, requiring the tenant to supply the lord with a number of armed horsemen. The concept of tenure has since evolved into other forms, such as leases and estates.
Modes of ownership and tenure
There are a great variety of modes of land ownership and tenure:
Traditional land tenure. For example, most of the indigenous nations or tribes of North America had no formal notion of land ownership. When Europeans first came to North America, they sometimes simply disregarded traditional land tenure and simply seized land; more often, they accommodated traditional land tenure by recognizing it as aboriginal title. This theory formed the basis for (often unequal and often abused) treaties with indigenous peoples.
Feudal land ownership, a system of mutual obligations under which a royal or noble personage granted a fiefdom — some degree of interest in the use or revenues of a given parcel of land — in exchange for a claim on services such as military service or simply maintenance of the land in which the lord continued to have an interest. This pattern obtained from the level of high nobility as vassals of a monarch down to lesser nobility whose only vassals were their serfs.
Ownership of land by swearing to make productive use of it. In several developing countries as Egypt, Senegal, ... this method is still presently in use. In Senegal, it is mentioned as "mise en valeur du zones du terroir" and in Egypt, it is called Wadaa al-yad.
Life estate. Under common law, this is an interest in real property that ends at death. The holder has the use of the land for life, but typically no ability to transfer that interest or to use it to secure a mortgage loan.
Fee tail. Under common law, this is hereditary, non-transferable ownership of real property. A similar concept, the legitime, exists in civil and Roman law; the legitime limits the extent to which one may disinherit an heir.
Fee simple. Under common law, this is the most complete ownership interest one can have in real property, other than the very rare Allodial title. The holder can typically freely sell or otherwise transfer that interest or use it to secure a mortgage loan. This picture of "complete ownership" is, of course, complicated by the obligation in most places to pay a property tax and by the fact that if the land is mortgaged, there will be a claim on it in the form of a lien. In modern societies, this is the most common form of land ownership.

Fee simple
A fee simple (or fee simple absolute) is an estate in land, a form of freehold ownership. It is the most common way real estate is owned in common law countries, and is ordinarily the most complete ownership interest that can be had in real property short of allodial title, which is often reserved for governments. Fee simple ownership represents absolute ownership of real property but it is limited by the four basic government powers of taxation, eminent domain, police power, and escheat and could also be limited by certain encumbrances or a condition in the deed. How ownership is limited by these government powers often involves the shift from allodial title to fee simple such as when uniting with other property owners acceding to property restrictions or municipal regulation.
Common law and history
In English common law theory, the Crown has radical title or the allodium of all land in England, meaning that it is the ultimate "owner" of all land. However, the Crown can grant an abstract entity—called an estate in land—which is what is owned. The fee simple estate is also called "estate in fee simple" or "fee-simple title" and sometimes simply freehold in England and Wales. In the early Norman period, the holder of an estate in fee simple could not sell it, but instead could grant subordinate fee simple estates to third parties in the same parcel of land, a process known as "subinfeudation." The Statute of Quia Emptores adopted in 1290 abolished subinfeudation and instead allowed the sale of fee simple estates.
The concept of a "fee" has its origins in feudalism. According to William Blackstone, the great common law commentator, fee simple is the estate in land that a person has when the lands are given to him and his heirs absolutely, without any end or limit put to his estate. Land held in fee simple can be conveyed to whomsoever its owner pleases; it can be mortgaged or put up as security as well. The owner(s) of real property in fee simple title have the right to own the property during their lifetime and typically have a say in determining who gets to own the property after their death. In a sense, one might say fee simple owners "own" the property "forever"; however, only holders of an allodial title on land really do own the land forever, and the land is not subject to property tax.
Historically, estates could be limited in time, such as a life estate, which is an interest in lands that terminates upon the grantee's (or another person's) death, even if the land had been granted to a third party, or a term of years (a lease for a specified term, such as in an estate for years). It also could be limited in the way that it was inherited, such as by what was called an "entailment" which created a fee tail. Traditionally, fee tail was created by words of grant such as "to N. and the male heirs of his body", which would restrict those who could inherit the property. When all those heirs ran out the property would revert to the original grantor's heirs. Most common law countries have abolished entailment by statute.
Duration
An estate in fee simple was, and still is, the largest estate known to the law. It denotes the maximum of legal ownership, the greatest possible aggregate of rights, powers, privileges, and immunities which a person may have in land. It is an estate of potentially infinite duration in the holder and the holder's successors. The three hallmarks of the fee simple estate are that it is alienable, devisable, and descendible.
Creation and Characteristic of Fee Simple
Common law rules requiring words of general inheritance to create fee simple by conveyance has been abolished by statute in most states in the United States. It used to be the rule that in order to convey an estate in fee simple, the deed or will must state "to B and his heirs." Anything short of those magic words transferred a smaller estate.
Modern deeds usually follow a standardized form. There is a presumption that the testator intends to convey his or her property in fee simple, unless the will indicates an intention to him a smaller estate, like a life estate. Today, there is a very strong policy favoring the free and unfettered alienability of land.
Life estate
Many common law jurisdictions retain the possibility of creating a life estate, although this is uncommon. In the U.S., life estates are most commonly used in the context of either giving a right to someone in a will to use property for the remainder of that person's (or another person's) life, or reserving to a grantor who is selling property the right to continue using the property for the remainder of his/her life. The right to ownership after the death of the subject person would be called the remainder estate. In England and Wales fee simple is the only freehold estate that remains and a life estate can only be created in equity.
Types of fee simple
If previous grantors of a fee simple estate do not create any conditions for subsequent grantees to own the conveyed property in fee simple title, which is commonly the case these days, then the title is called fee simple absolute. Other fee simple estates in real property include fee simple defeasible (or fee simple determinable) estates. A defeasible estate is created when a grantor places a condition on a fee simple estate (in the deed). Upon the happening of a specified event, the estate may become void or subject to annulment. Two types of defeasible estates are the fee simple determinable and the fee simple subject to a condition subsequent. If the grantor uses durational language in the condition such as "to A as long as the land is used for a park" then upon the happening of the specified event, the estate will automatically terminate and revert to the grantor or the grantor's estate; this is called a fee simple determinable. If the grantor uses
language such as "but if alcohol is served" then the grantor or the heirs have a right of entry, but the estate does not automatically revert to the grantor; this is a fee simple subject to a condition subsequent. In the United States many of these concepts have been modified by statute in some states. Generally speaking, fee simple determinable was preferred by courts in the Common Law of the early United States. Recently, that trend has reversed, and most courts in the United States today will find a fee simple subject to condition subsequent (instead of a fee simple determinable) in situations where the conveying document's language is unclear.
Rent
It is often said that no rent or similar obligations are due from the owner of property in fee simple. That is only partially true. For example, a rentcharge may exist requiring a freeholder to pay a fixed sum of money closely resembling rent, and many jurisdictions have created financial obligations that may be imposed on a freehold estate. For instance, in England and Wales, the estate charge. In the United States, fee simple owners are subject to property tax and its funds directed to the municipality's general fund. Other local tax assessments called "specials" may be assessed in addition to the property tax to be applied to specific purposes such as road and water/sewer improvements. Real estate owned as a condominium is usually similarly owned in fee simple, but typically subject to rules in the declaration of condominium or created by the condominium association, such as paying required monthly fees for maintaining the property's common areas.

PEARL HARBOR (NNS) -- USS Texas (SSN 775), the second Virginia-class submarine to be homeported in the Pacific, arrived at Naval Station Pearl Harbor during an inner-fleet transfer from Groton Submarine Base Nov. 23.
"This is a very exciting time for Texas and her crew," said Cmdr. Robert Roncska, commanding officer, USS Texas. "The crew performed above and beyond my expectations and I am very proud that we are here now and in the Aloha spirit."
Measuring 377 feet long, weighing 7,800 tons when submerged and with a complement of more than 130 crew members, Texas is one of the Navy's newest and most technologically sophisticated submarines.

AUSTIN - Gov. George W. Bush announced the formation of a presidential exploratory committee Tuesday, saying only a total flop in his support would keep him from seeking the GOP nomination next year.
"A giant thud. A huge yawn. It turned out it was my mother they were interested in," Bush responded when asked what could keep him from running.
Bush is the eldest son of former President George Bush and first lady Barbara Bush.
Bush said his exploratory committee's first task will be to raise money while he tends to the state Legislature, whose session ends at the end of May. Bush said he and his wife, Laura, will then travel the country to see if there really is grass-roots support for his campaign.

In law, especially criminal law, a motive is the cause that moves people to induce a certain action. Motive in itself is seldom an element of any given crime; however, the legal system typically allows motive to be proven in order to make plausible the accused's reasons for committing a crime, at least when those motives may be obscure or hard to identify with.
