§ 3005. Counsel and witnesses in capital cases
Whoever is indicted for treason or other capital crime shall be allowed to make his full defense by counsel; and the court before which the defendant is to be tried, or a judge thereof, shall promptly, upon the defendant’s request, assign 2 such counsel, of whom at least 1 shall be learned in the law applicable to capital cases, and who shall have free access to the accused at all reasonable hours. In assigning counsel under this section, the court shall consider the recommendation of the Federal Public Defender organization, or, if no such organization exists in the district, of the Administrative Office of the United States Courts. The defendant shall be allowed, in his defense to make any proof that he can produce by lawful witnesses, and shall have the like process of the court to compel his witnesses to appear at his trial, as is usually granted to compel witnesses to appear on behalf of the prosecution.

§ 817. Art. 17. Jurisdiction of courts-martial in general
(a) Each armed force has court-martial jurisdiction over all persons subject to this chapter. The exercise of jurisdiction by one armed force over personnel of another armed force shall be in accordance with regulations prescribed by the President.
(b) In all cases, departmental review after that by the officer with authority to convene a general court-martial for the command which held the trial, where that review is required under this chapter, shall be carried out by the department that includes the armed force of which the accused is a member.

[When I just read something Bill Clinton read about not wanting to "pile on" to Cheney's shooting incident, I remembered this. The day I went back to Microsoft to ask for my job back, he was at this Costco, which I could see from the window at my cube. I thought that was quite the coincidence, and I hoped it was a good sign, albeit something extraordinary that defied my logic. I remember now too that it was on the other side of the street from that Costco where I went face first into the concrete after my bike slipped on a slick bridge. I had a black eye for a week. I still remember the date for some reason: Feb 1, 2002. I think I remembered it because I had another accident on Dec. 23, 2001, when I was biking around Lake Washington. At the 30 mile point of that 60 mile trip, I hit a patch of ice and went down hard and fast. One minute I was riding along, the next minute I was looking at my feet as I went sliding across the road. Damn that hurt. I
dislocated my shoulder because my elbow hit first or right about the same time as my knee. I could barely raise my arm if at all for weeks after that. It was pretty uncomfortable riding the remaining 30 miles back home. And the whole way there and for a time afterwards, I could almost hear something, it was unusal, the way you can feel like there is something on your tongue as that saying goes, but with this, I could almost hear a "thud" sound for a while after, the sound of me hitting the ground.

I had that dream again about the house I bought in South Carolina back in the early '90s. I loved that place, it was quiet and relaxing. That house is always the central element in dreams I have sometime. There are usually variations to the situation, but the house is always there. And there is usually another element to the dream. In the dream, I discover that I still own the house and I can go back there any time I want, even at the very moment I realize it is still there. It is a great feeling to know I can sleep there that very night if I want to.

Nazi propaganda
Propaganda, the coordinated attempt to influence public opinion through the use of media, was skillfully used by the Nazi Party in the years leading up to and during Adolf Hitler's leadership of Germany (1933–1945). Nazi propaganda provided a crucial instrument for acquiring and maintaining power, and for the implementation of their policies, including the pursuit of total war and the extermination of millions of people in the Holocaust.
Chronology
In opposition (1919-33)
Nazi leader Adolf Hitler devoted two chapters of his 1925/26 work Mein Kampf, itself a propaganda tool, to the study and practice of propaganda. He claimed to have learnt the value of propaganda as a World War I infantryman exposed to very effective British and ineffectual German propaganda. The argument that Germany lost the war largely because of British propaganda efforts, expounded at length in Mein Kampf, reflected then-common German nationalist claims. Although untrue – German propaganda during World War I was mostly more advanced than that of the British – it became the official truth of Nazi Germany thanks to its reception by Hitler.
Mein Kampf contains the blueprint of later Nazi propaganda efforts. Assessing his audience, Hitler writes in chapter IV:
"Propaganda must always address itself to the broad masses of the people. (...) All propaganda must be presented in a popular form and must fix its intellectual level so as not to be above the heads of the least intellectual of those to whom it is directed. (...) The art of propaganda consists precisely in being able to awaken the imagination of the public through an appeal to their feelings, in finding the appropriate psychological form that will arrest the attention and appeal to the hearts of the national masses. The broad masses of the people are not made up of diplomats or professors of public jurisprudence nor simply of persons who are able to form reasoned judgment in given cases, but a vacillating crowd of human children who are constantly wavering between one idea and another. (...) The great majority of a nation is so feminine in its character and outlook that its thought and conduct are ruled by sentiment rather than by sober reasoning. This
sentiment, however, is not complex, but simple and consistent. It is not highly differentiated, but has only the negative and positive notions of love and hatred, right and wrong, truth and falsehood."
As to the methods to be employed, he explains:
"Propaganda must not investigate the truth objectively and, in so far as it is favourable to the other side, present it according to the theoretical rules of justice; yet it must present only that aspect of the truth which is favourable to its own side. (...) The receptive powers of the masses are very restricted, and their understanding is feeble. On the other hand, they quickly forget. Such being the case, all effective propaganda must be confined to a few bare essentials and those must be expressed as far as possible in stereotyped formulas. These slogans should be persistently repeated until the very last individual has come to grasp the idea that has been put forward. (...) Every change that is made in the subject of a propagandist message must always emphasize the same conclusion. The leading slogan must of course be illustrated in many ways and from several angles, but in the end one must always return to the assertion of the same formula."
Hitler put these ideas into practice with the reestablishment of the Völkischer Beobachter, a daily newspaper published by the Nazi Party (NSDAP) from February 1925 on, whose circulation reached 26,175 in 1929. It was joined in 1926 by Joseph Goebbels's Der Angriff, another unabashedly and crudely propagandistic paper.
During most of the Nazis' time in opposition, their means of propaganda remained limited. With little access to mass media, the party continued to rely heavily on Hitler and a few others speaking at public meetings until 1929. In April 1930, Hitler appointed Goebbels head of party propaganda. Goebbels, a former journalist and Nazi party officer in Berlin, soon proved his skills. Among his first successes was the organization of riotous demonstrations that succeeded in having the American anti-war film All Quiet on the Western Front banned in Germany.
In power (1933-39)
Before World War II, Nazi propaganda strategy stressed several themes. Their goals were to create external enemies (countries that allegedly inflicted the Treaty of Versailles on Germany) and internal enemies (Jews). Hitler and Nazi propagandists played on the anti-Semitism and resentment present in Germany. The Jews were blamed for things such as robbing the German people of their hard work while themselves avoiding physical labour.

Until the conclusion of the Battle of Stalingrad on February 4, 1943, German propaganda emphasized the prowess of German arms and the humanity German soldiers had shown to the peoples of occupied territories. Pilots of the Allied bombing fleets were depicted as cowardly murderers, and Americans in particular as gangsters in the style of Al Capone. At the same time, German propaganda sought to alienate Americans and British from each other, and both these Western nations from the Soviets. One of the primary sources for propaganda was the Wehrmachtbericht, a daily radio broadcast that described the military situation on all fronts.
After Stalingrad, the main theme changed to Germany as the sole defender of what they called "Western European culture" against the "Bolshevist hordes". The introduction of the V-1 and V-2 "vengeance weapons" was emphasized to convince Britons of the hopelessness of defeating Germany.

USS GEORGE H.W. BUSH, At Sea (NNS) -- Sea and air assets assigned to the George H.W. Bush (CVN 77) Carrier Strike Group (CSG) successfully sunk the former U.S. Navy re-supply ship USNS Saturn (T-AFS 10) in a sinking exercise (SINKEX) in the Atlantic Ocean, Oct. 27.
Ships from Destroyer Squadron 22 and aircraft from Carrier Air Wing (CVW) 8, along with Patrol Squadron (VP) 10 and VP 45, participated in the real-world tactical training exercise with surface-to-surface, air-to-surface and surface-to-air live fire, said Commander, Destroyer Squadron 22 Capt. Jeffrey Wolstenholme, who was responsible for the coordination, planning and execution of the two-day SINKEX.
The guided-missile destroyer USS Mitscher (DDG 57) and the guided-missile cruisers USS Philippine Sea (CG 58) and USS Gettysburg (CG 64) launched missiles, 5-inch guns, Close-In Weapons System (CIWS) and 25-mm and .50-cal weapons. In addition, aircraft and helicopters from CVW 8 launched from Bush and employed bombs and air-to-surface missiles during the exercise.
The sinking exercise focused on integrated strike group operations, command and control procedures, pre-planned responses to maritime threats and surface action group operations. As the strike group prepares for a combat deployment in spring 2011, the sinking exercise provided a unique opportunity to practice combat scenarios, to include tactics and procedures. The exercise was planned to scale up the attacks during the course of the two days, Wolstenholme said.
Saturn was transferred from the British Fleet Auxiliary to Military Sealift Command Dec. 13, 1983. Saturn was in service for more than 25 years and was deactivated April 6, 2009.

RB-47H Shot Down
On July 1, 1960, a Soviet MiG fighter north of Murmansk in the Barents Sea shot down a 6-man RB-47 crew. Two young USAF officers survived and were imprisoned in Moscow's dreaded Lubyanka prison. Capts. McKone and Olmstead were accused by the Russians of espionage, punishable by death, for allegedly violating the Soviet Sea frontier, although their plane had been many miles away from it at all times. They managed, however, to resist all Soviet efforts to obtain "confessions" through cajolery, trickery and threats of death, and were finally and unexpectedly released after seven months of imprisonment.
The Soviet Union had a history of shadowing, escorting and occasionally shooting down American planes flying over international waters near its borders; in the 10 years between 1950 and 1960, about 75 U.S. Navy and Air Force aircrewmen in 10 separate incidents lost their lives flying routine reconnaissance missions.
The RB-47H reconnaissance plane (S/N 53-4281) was assigned to the 343th Strategic Reconnaissance Squadron, 55th Strategic Reconnaissance Wing based at Forbes Air Force Base, Kan., and temporarily flying out of Brize-Norton Royal Air Force Base in England. The plane was crewed by Maj. Willard Palm, aircraft commander; Capt. Freeman Bruce Olmstead, pilot; Capt. John McKone, navigator; and three reconnaissance officers (Ravens): Maj. Eugene Posa, Capt. Dean Phillips and Capt. Oscar Goforth (this was Capt. Goforth's first and only operational mission). Note: Each crewmember was advanced one rank after this incident as indicated above.
The planned route of the flight took the plane northward from England over international waters where the plane turned east and entered the Barents Sea northeast of Norway and continued a track in international waters approximately 50 miles from the Soviet Kola Peninsula. While the RB-47H was conducting its reconnaissance mission, a Soviet MiG-19 fighter assigned to the 206th Air Division based at Murmansk paralleled the USAF plane at a distance. The MiG fighter then turned toward the RB-47 on an intercept course, but passed about three miles behind it. The radar course plotted by Capt. McKone called for a turn to the northeast at about 50 miles off Holy Nose Cape at the bottom of the Kola Peninsula; however, the Soviet MiG had returned and was now flying in close formation (40 feet) off the right wing of the RB-47. As the RB-47 (flying at 30,000 feet and 425 knots) started its turn to the left, the MiG (piloted by Vasily Polyakov) broke right towards
the Soviet shoreline (away from the RB-47), turned back towards the USAF plane and started shooting. Capt. Olmstead immediately returned fire, but the RB-47 was no match for the nimble MiG and after a brief fight, the RB-47 was shot down about 6 p.m. (local time) over international waters in the Barents Sea.
The MiG shot up the left wing, engines and fuselage in its initial firing pass, causing the RB-47 to enter a spin which Maj. Palm and Capt. Olmstead were able to pull out of; however, the MiG made a second firing pass at the plane and finished the job. Maj. Palm and Capt. Olmstead attempted to save the plane once again, but the damage was too serious and the bail out order was given.
At least three of the six crewmen -- Capt. Olmstead, Capt. McKone and Maj. Palm -- managed to eject from the stricken plane. The three reconnaissance officers (Ravens) seated in the converted bomb bay of the plane were (probably) unable to get out of the spinning plane. Maj. Palm apparently died of exposure in the frigid water, but Capts. Olmstead and McKone were able to climb into their survival rafts and lasted long enough to be picked up by a Soviet fishing vessel after more than six hours in their tiny rafts.

§ 2388. Activities affecting armed forces during war
(a) Whoever, when the United States is at war, willfully makes or conveys false reports or false statements with intent to interfere with the operation or success of the military or naval forces of the United States or to promote the success of its enemies; or Whoever, when the United States is at war, willfully causes or attempts to cause insubordination, disloyalty, mutiny, or refusal of duty, in the military or naval forces of the United States, or willfully obstructs the recruiting or enlistment service of the United States, to the injury of the service or the United States, or attempts to do so— Shall be fined under this title or imprisoned not more than twenty years, or both.
(b) If two or more persons conspire to violate subsection (a) of this section and one or more such persons do any act to effect the object of the conspiracy, each of the parties to such conspiracy shall be punished as provided in said subsection (a).
(c) Whoever harbors or conceals any person who he knows, or has reasonable grounds to believe or suspect, has committed, or is about to commit, an offense under this section, shall be fined under this title or imprisoned not more than ten years, or both.
(d) This section shall apply within the admiralty and maritime jurisdiction of the United States, and on the high seas, as well as within the United States.
