Aiding and Abetting the Investment of Dirty Money: Mens Rea and the Nonracketeer under RICO Section 1962 (a)
Section 1962(a) of the Racketeer Influenced and Corrupt Organizations Act (RICO) prohibits the investment by a racketeer of income earned from racketeering crimes. Traditionally, this section has been applied only to racketeers. In two recent cases, however, the courts have faced the question of holding nonracketeers, such as lawyers and investment advisors acting in the ordinary course of their business, liable for aiding and abetting the investment of such "dirty money." In at least one of these cases, the court ruled that nonracketeers could be held liable. The central problem raised by such a conclusion is whether such persons, whose actions in aid of investments may be blameless except for the origin of the money being invested, act with the requisite mens rea to criminalize their conduct. This Note examines the proper standard for mental culpability for nonracketeers under the statute. It first briefly reviews the RICO statute as a whole and the
courts' broad constructions of it. Focusing on Section 1962 (a) and the nonracketeer, the Note then finds in the legislative history an intent to apply a standard that would require a nonracketeer to have a "stake in the enterprise" in order to be held liable. The Note goes on to examine the "stake in the enterprise" concept as developed in federal criminal law, specifically in cases involving sellers of goods to criminals, and concludes that mere knowledge of the identity of the investor and the source of the funds is insufficient for nonracketeer liability. Under the "stake in the enterprise" concept, there must be intent to profit from the criminality of the racketeer's activities. Finally, the Note, looking again to the seller-of-goods cases for guidance, examines what evidence is necessary to prove such intent.

Boeing Unveils Unmanned Phantom Ray Demonstrator
ST. LOUIS, May 10, 2010 -- The Boeing Company [NYSE: BA] today unveiled the fighter-sized Phantom Ray unmanned airborne system, a test bed for advanced technologies.
“We are on a fast track, and first flight is in sight,” said Darryl Davis, president of Boeing Phantom Works. “Phantom Ray is on schedule to fly in December, about two years after this project began. This is a tremendous accomplishment for Boeing and the Phantom Ray team.”
Phantom Ray is scheduled to begin taxi tests this summer. The first flight in December will be followed by up to nine additional flights over approximately six months. Phantom Ray is designed to support potential missions that may include intelligence, surveillance and reconnaissance; suppression of enemy air defenses; electronic attack; strike; and autonomous aerial refueling.
“The initial flights will take Phantom Ray through its paces for the flight test profile. Beyond that, the missions and systems tested will be determined by future warfighter needs,” said Craig Brown, Phantom Ray program manager for Boeing.
Phantom Ray, which evolved from the X-45C program, is one of several programs in the Phantom Works division of Boeing Defense, Space & Security. Phantom Works uses rapid prototyping initiatives to design, develop and build advanced aircraft and then demonstrate their capabilities.
Key Phantom Ray suppliers include General Electric-Aviation (propulsion and power distribution), Honeywell (brake system), Woodward-HRT (flight control actuation system), Crane Hydro-Aire (brake controls) and Heroux-Devtek (landing gear).

At the park, they intercept Matt Lane as he is leaving the park. As they draw their weapons, bystanders are startled and begin to run away. Lane is defiant – "Too bad, you missed a good game," he mocks them, but when Gibbs demands to know where the bomb is, he tells him that he will never find it. Ziva quickly scans the park, and suddenly spots the red barbeque grill that Lane used at Haskell's party. They notice three propane tanks under the grill. "Helluvalot of gas for cheeseburgers," mutters Gibbs, and Ziva realizes, "He's using the heat build-up to detonate the explosives!" "You're too late!" taunts Lane, but Gibbs and Ziva, followed by Tony, rush into the park, yelling to everyone to clear the area. To squeals and cries of dismay, everyone rapidly complies. Ziva runs up to the chained grill, and sees that the temperature gauge has almost reached 700 degrees, and is beginning to crack. Alarmed, she turns and sees Tony with his back to the grill,
scanning the area. She runs at him screaming, "Tony!" and hits him with a flying tackle as he turns in surprise, knocking him to the ground as the bomb explodes. As Tony catches his breath, Ziva is lying on top of him, face to face. He whispers, "This is nice – I miss the old Ziva." She smiles, and replies knowingly, "I can tell." "Don't flatter yourself," he whispers back. "That's just my knee."
As the area is being investigated, Ziva is incredulous. "Matt Lane planted a bomb, and then stayed behind to umpire a game?" The men are unsurprised, and Gibbs explains, as if it is all the explanation that is needed: "It's baseball." Suddenly the field lights come up, and the men turn to the field, mesmerized. "Niiice," whispers Tony reverently. "Do you two need a moment?" inquires Ziva sarcastically, and Tony tells McGee that "she will understand . . . eventually." "Will I?" asks Ziva, and impatiently, she walks onto the field and picks up a tossed-aside glove and ball. Picking up another discarded glove, she invites Gibbs: "Come on – have a catch?" Gibbs takes the glove and walks a few yards away. Tony and McGee watch expectantly as Ziva tosses the ball experimentally, and then tosses it – expertly – straight into Gibb's glove. Gibbs grins in surprise, and tosses it back as Tony looks on in amazement and McGee chortles, "Hey, you DO know
something about baseball!" Ziva smiles a bit wistfully as she looks at the ball, and then winds up for another toss. "Yeah – my father taught me," she replies, and tosses it again to Gibbs. (END)

Mine collapse traps 34 copper workers in Chile

Rescuers scrambled Friday to dig out 34 copper mine workers trapped nearly 1,000 feet (300 meters) below ground after a tunnel caved in.
Authorities were hopeful the miners managed to reach an underground shelter that contains oxygen, food and other supplies after the collapse Thursday afternoon at the San Jose mine in northern Chile.
A day later, however, attempts to contact them through chimneys and vents have been unsuccessful.
Labor Minister Camila Merino said the shelter has enough oxygen to last the workers two more days - though other miners said there was only enough for another 24 hours.
Rescuers were able to descend only about 200 feet (64 meters) into the mine, and were forced to pause the rescue effort for hours while they waited for heavy digging and other special equipment to be brought in.

Tsar Bomba
Tsar Bomba, literally "Tsar-bomb", is the nickname for the AN602 hydrogen bomb (codenamed "Ivan"[citation needed] by its developers) — the largest, most powerful nuclear weapon ever detonated, and currently the most powerful explosive ever detonated in human history.
Developed by the Soviet Union, the bomb was originally designed to have a yield of about 100 megatons of TNT (420 PJ); however, the bomb yield was reduced by half in order to limit the amount of nuclear fallout that would result. One bomb was built and tested on October 30, 1961, in the Novaya Zemlya archipelago. The weapon never entered service.
A mock bomb was stored in the Russian Nuclear Weapons Museum in Sarov.
The Tsar Bomba was a three-stage hydrogen bomb with a yield of 57 megatons (Mt). This is equivalent to ten times the amount of all the explosives used in World War II combined, including Little Boy and Fat Man, the bombs that destroyed Hiroshima and Nagasaki. A three-stage H-bomb uses a fission bomb primary to compress a thermonuclear secondary, as in most H-bombs, and then uses energy from the resulting explosion to compress a much larger additional thermonuclear stage. However, there is evidence that the Tsar Bomba had a number of third stages rather than a single very large one.
The initial three-stage design was capable of approximately 100 Mt, but at a cost of too much radioactive fallout. To limit fallout, the third stage, and possibly the second stage, had a lead tamper instead of a uranium-238 fusion tamper (which greatly amplifies the reaction by fissioning uranium atoms with fast neutrons from the fusion reaction). This eliminated fast fission by the fusion-stage neutrons, so that approximately 97% of the total energy resulted from fusion alone (as such, it was one of the "cleanest" nuclear bombs ever created, generating a very low amount of fallout relative to its yield). There was a strong incentive for this modification since most of the fallout from a test of the bomb would fall on populated Soviet territory.
The Tsar Bomba was flown to its test site by a specially modified Tu-95V release plane, flown by Major Andrei Durnovtsev, which took off from an airfield in the Kola peninsula. The release plane was accompanied by a Tu-16 observer plane that took air samples and filmed the test. Both aircraft were painted with a special reflective white paint to limit heat damage.
The bomb, weighing 27 tons, was so large (8 metres (26 ft) long by 2 metres (6.6 ft) in diameter) that the Tu-95V had to have its bomb bay doors and fuselage fuel tanks removed. The bomb was attached to an 800 kilogram fall-retardation parachute, which gave the release and observer planes time to fly about 45 kilometres (28 mi) from ground zero.
The Tsar Bomba detonated at 11:32 on October 30, 1961 over the Mityushikha Bay nuclear testing range (Sukhoy Nos Zone C), north of the Arctic Circle on Novaya Zemlya Island in the Arctic Sea. The bomb was dropped from an altitude of 10.5 kilometres (6.5 mi); it was designed to detonate at a height of 4 kilometres (2.5 mi) over the land surface (4.2 kilometres (2.6 mi) over sea level) by barometric sensors.
The original U.S. estimate of the yield was 57 Mt, but since 1991 all Russian sources have stated its yield as 50 Mt. Khrushchev warned in a filmed speech to the Communist parliament of the existence of a 100 Mt bomb (technically the design was capable of this yield). The fireball touched the ground, reached nearly as high as the altitude of the release plane, and was seen and felt almost 1,000 kilometres (620 mi) from ground zero. The heat from the explosion could have caused third degree burns 100 km (62 miles) away from ground zero. The subsequent mushroom cloud was about 64 kilometres (40 mi) high (nearly seven times higher than Mount Everest) and 40 kilometres (25 mi) wide. The explosion could be seen and felt in Finland, breaking windows there and in Sweden. Atmospheric focusing caused blast damage up to 1,000 kilometres (620 mi) away. The seismic shock created by the detonation was measurable even on its third passage around the Earth. Its Richter
magnitude was about 5 to 5.25. The energy yield was around 7.1 on the Richter scale, but since the bomb was detonated in air rather than underground, most of the energy was not converted to seismic waves.
Since 50 Mt is 2.1×1017 joules, the average power produced during the entire fission-fusion process, lasting around 39 nanoseconds, was about 5.4×1024 watts or 5.4 yottawatts (5.4 septillion watts). This is equivalent to approximately 1.4% of the power output of the Sun.
The Tsar Bomba is the single most physically powerful device ever utilized throughout the history of humanity. Its size and weight excluded a successful delivery in case of a real war.
