Suspect ID'd in Wales case

The Justice Department has filed court documents that for the first time name a Bellevue airline pilot as the subject of a grand-jury investigation into the killing of federal prosecutor Thomas Wales.
Until now, prosecutors have filed documents under seal in the investigation.
The pilot had been prosecuted by Wales in a fraud case and has been targeted by authorities since Wales, 49, was shot to death at his Queen Anne home late on Oct. 11, 2001.
The pilot's lawyer said naming his client was an abusive tactic by authorities who are frustrated at being unable to solve the high-profile case. Larry Setchell said his client was being unfairly targeted and added, "I'm going to prove he's innocent."
Special prosecutor Steven Clymer named the pilot in a recent motion opposing the release of personal property seized from the pilot and a former business associate in a 2000 fraud case involving a military-helicopter-rebuilding business. Felony charges against the pilot were dropped after the business, as a corporation, pleaded guilty to a misdemeanor and paid a $10,000 fine.
Typically, seized personal property is returned to its owners after a case is dismissed. In his motion, Clymer said the Justice Department has a "compelling, continued need" for the property in the Wales homicide investigation.
Clymer's filing is unusual because prosecutors rarely reveal grand-jury matters. Before he did so, Clymer first had to get permission from a federal judge.
The filing included letters that show a disagreement between the pilot's lawyer and Wales three months before Wales was shot through his basement window while at work at his computer.
The pilot wanted the seized materials back so he could try to salvage several hundred thousand dollars he had sunk into the helicopter venture, and was upset at what he saw as unfair delays by Wales, according to the letters and sources close to the case.
The U.S. Justice Department and the FBI have made the Wales case a top priority and are offering a $1 million reward for information. If it is shown that Wales was killed as a result of his job, he would be the first federal prosecutor slain in the line of duty.
In a recent interview, the pilot's former business partner said he has appeared before the grand jury investigating the Wales case and has answered questions about the pilot.
The Seattle Times is not naming the pilot because the newspaper's general policy is to name a suspect only after he has been charged with a crime.
Federal investigators think the summer 2001 dispute between Wales and the pilot's lawyer over the company property was another in a series of frustrations that pushed the pilot to track down and shoot Wales.
The conflict began in 1997 when Wales began investigating the pilot and others for allegedly using forged records to certify that a rebuilt helicopter was airworthy. In 2000, Wales filed charges against the pilot. Setchell has said prosecutors previously told him that his client would not be indicted.
The pilot also became angry when Wales, in the plea agreement with the company filed in court, linked the pilot to fraud, even though the pilot had left the company and charges against him personally had been dropped.
Clymer's recent pleading also outlined point by point how the disagreement over the pilot's seized property escalated:
On June 28, 2001, the pilot and a former co-owner of the helicopter company reached a settlement that gave the pilot the company's sole helicopter and related records. Other company assets and records went to the other man.
The next day, the government dropped charges against the two men and the company pleaded guilty. Setchell immediately sent a letter to Wales, asking the government to release the helicopter and related records to his client.
In a July 2 letter, Wales agreed to let the pilot recover the helicopter itself but said both men would have to agree on who was entitled to the different records and items before Wales would release them.
Three days later, the pilot, through his lawyer, informed Wales that his former partner must not be left alone with any documents related to the helicopter.
Wales rejected that proposal in a July 10 letter, saying the government did not want to embroil itself in the growing dispute between the two men. In a switch, Wales said the government instead would follow its normal policy and simply release property to the person from whom it was seized. Agents had seized many of the records from the pilot's embittered former partner.
In a letter two days later, the pilot's lawyer said Wales' decision was "unacceptable" and showed "neglectful disrespect" that could lead to more "complicated issues."
On Aug. 6, 2001, Setchell wrote Wales again, asking that the government control the helicopter records until the pilot's former partner was willing to cooperate.
Wales was shot about two months later, Clymer noted in the pleading.
In the midst of this dispute, the pilot filed a wrongful-prosecution action against Wales and the Justice Department and sought more than $125,000 for his legal fees.
U.S. District Court Judge John Cougenour dismissed the lawsuit. The pilot is appealing.

Pilot's challenge to prosecution rejected

A federal appeals court has found that a Bellevue airline pilot wasn't wrongfully prosecuted in a fraud case handled by Thomas Wales, the Seattle federal prosecutor who was fatally shot three months after the case was resolved.
The decision has been closely watched by Wales' former colleagues in the U.S. Attorney's Office in Seattle, largely because the pilot has been identified in court papers as a prime suspect in Wales' death.
"We feel that Tom Wales' reputation as a prosecutor was questioned by this appeal and was completely vindicated," Assistant U.S. Attorney Peter Mueller, who argued before the appeals court, said yesterday in an interview.
Wales was killed Oct. 11, 2001, shortly after the pilot brought his wrongful-prosecution action seeking more than $128,000 in legal fees from the government.
The appellate ruling denying the pilot's request was handed down Aug. 28 by a three-judge panel of the 9th U.S. Circuit Court of Appeals.
The unanimous decision, which came 20 days after the case was argued, was swift, considering that 9th Circuit judges usually take months to issue opinions.
"It was unusually quick," Mueller said.
