Statement on Signing the Animal Drug User Fee Act of 2003

November 18, 2003

Today, I have signed into law S. 313, the "Animal Drug User Fee Act of 2003." The Act is designed to expedite the animal drug development process, while continuing to ensure the safety and effectiveness of animal drugs.

Section 4(a) of the Act purports to require the Secretary of Health and Human Services to submit legislative recommendations to the Congress and to establish procedures by which the Secretary must formulate such recommendations. The legislative power does not extend to requiring the Executive submit legislative recommendations to the Congress nor to specifying procedures by which the Executive must formulate any legislative recommendations that the Executive makes. The executive branch shall execute section 4(a) in a manner consistent with the Constitution's exclusive commitments to the President of the authority to submit for the consideration of the Congress such measures as he judges necessary and expedient and the authority to supervise the unitary executive branch.

Michael Phillip Anderson (December 25, 1959 – February 1, 2003) was a United States Air Force officer and NASA astronaut. Anderson and his six fellow crew members were killed in the Space Shuttle Columbia disaster when the craft disintegrated during its re-entry into the Earth's atmosphere. Anderson served as the payload commander and lieutenant colonel in charge of science experiments on the Columbia. Anderson was posthumously awarded the Congressional Space Medal of Honor.

Any large city on earth is as far removed form the original state of things to which man has adapted as in the moon. Though man has a poor record in using his knowledge, I’m hopeful that through a moon colony he would take an intelligent interest in his modification. Moon colonization could give us an example of a small society functioning in a completely engineered, article environment.

Thus far, intelligence has been a great cross for humanity. It has done much damage. Our quest should be to seek a brotherhood of intelligence. The moon colonists would be better suited for this task than earthbound adventurers.

There are no more physical frontiers on earth. Man can stultify this drive for problem solving. But it would lead man to despair if he quailed before the difficult.

SEATTLE — Steve Ballmer, Microsoft Corp.'s energetic No. 2 executive, was promoted to president Tuesday, formally recognizing his role as Chairman Bill Gates' most trusted lieutenant.

Ballmer, 42, a close friend of Gates from their student days at Harvard University, joined Microsoft in 1980, five years after its founding, and has run its finance, recruiting and sales operations, amassing a fortune in stock currently worth about $13.5 billion.

Ballmer, most recently executive vice president of sales and support, long has been seen as the only logical choice to step in should anything happen to Gates, who tried to dispel any notion that he would take a less active role.

"I'm very excited about my job," Gates said in a conference call with reporters. "If anything, this makes it even more attractive, so there's nothing in here where I'm backing off at all. My commitment is the same as it's always been."

He said the appointment would allow him to spend more time with software developers working on "architectural breakthroughs" for a new generation of devices such as television set-top boxes, smart phones and tablet computers.

Ballmer becomes Microsoft's first president since the departure of Mike Hallman in 1992 and will take over responsibility for virtually all the company's operations.

Ballmer said the new position would give him an internal platform to "beat the drum louder about our total fixation on customer satisfaction and customer delight."

Under the reorganization, Executive Vice President and Chief Operating Officer Bob Herbold will report to Ballmer, as will group vice presidents Pete Higgins, Paul Maritz and Jeff Raikes and Senior Vice President Bill Neukom, the company's top attorney.
