§ 948q. Charges and specifications
(a) Charges and Specifications.— Charges and specifications against an accused in a military commission under this chapter shall be signed by a person subject to chapter 47 of this title under oath before a commissioned officer of the armed forces authorized to administer oaths and shall state—
(1) that the signer has personal knowledge of, or reason to believe, the matters set forth therein; and
(2) that such matters are true in fact to the best of the signer’s knowledge and belief.
(b) Notice to Accused.— Upon the swearing of the charges and specifications in accordance with subsection (a), the accused shall be informed of the charges and specifications against the accused as soon as practicable.

§ 817. Art. 17. Jurisdiction of courts-martial in general
(a) Each armed force has court-martial jurisdiction over all persons subject to this chapter. The exercise of jurisdiction by one armed force over personnel of another armed force shall be in accordance with regulations prescribed by the President.
(b) In all cases, departmental review after that by the officer with authority to convene a general court-martial for the command which held the trial, where that review is required under this chapter, shall be carried out by the department that includes the armed force of which the accused is a member.

Regional Organization

There was a bunch of stuff in my dreams last night, but I only remember one part. I was also very tired when I woke up, but couldn't go back to sleep. The part of the dream I do remember is where I was walking down some stairs. It seemed to be outside, as in stairs leading down the outside of a building, a factory maybe. I am thinking it was at the end of something, a conclusion of something. I turned around after going down a couple of the stairs and was organizing some stuff, books maybe. I couldn't get them all together or something and I think I was going to have to make a second trip to bring them all down. Within the boxes and books, I pulled out a hat and put it on. It was a U.S. Navy Officer's cover.
Today I am also thinking back to that dream I had in my last days at Microsoft. I told a friend about it. I dreamed that someone had set off two bombs and I was watching the towering clouds from the explosions rising high into the atmosphere. I was baffled at how people were going around their normal business like nothing had happened. There was one person I recognized, a guy that was on the same team as I. I didn't understand why no one was concerned.

I'm still not really sure why Butte, Montana. Maybe that is where my home is that I cannot remember. That would make sense though. On more than one occasion I have just taken off and driven to Montana. I didn't do anything. I just drove there, probably spent less than a half-hour, always in Missoula, and then turned around and drove back. As for my home that I can't remember, that would make sense why I have had the same dream over and over for the past decade. The dream is always the same in the theme and the location, but the details change a little bit every time. The theme of the dream is that one day, I suddenly find out that I still own a house that I used to live in near Greer, SC. On a sidenote, I moved to Greer and bought that house in Country Club Estates, after I moved from Central, SC, while I was still working for UFP. Any fan of Tom Clancy, such as me, can tell you that "Admiral Greer" was the one who recruited "Jack Ryan" into the CIA.
Anyway, in the dream, I would suddenly find that I still had that home to go back to, which was great to know because I really missed the place. It was a very peaceful location and I really enjoyed living there. It was always the same in the dream. I could go back there anytime I wanted, even that very minute, and go home. Over and over I dreamed that I could go home at that very minute to that place I had forgotten about but that had not forgotten me.

Wild Weasel is a nickname for aircraft of the United States Air Force tasked with the Suppression of Enemy Air Defenses (SEAD) mission. Initially known by the operational code "IRON HAND" when first authorized on August 12, 1965, the term "Wild Weasel" derives from Project Wild Weasel, the USAF development program for a dedicated SAM-detection and suppression aircraft. Originally named "Project Ferret", denoting a predatory animal that goes into its prey's den to kill it (hence: "to ferret out"), the name was changed to differentiate it from the code-name "Ferret" that had been used during World War II for radar counter-measures bombers.

Ladies and gentlemen, during the past 4 years we have made great progress in rebuilding our national defense and in confronting the challenge of effective defense management. Credit rightly goes to our civilian defense leadership, particularly Defense Secretary Caspar Weinberger. It also goes to our men and women in uniform and to the American people for their support in our efforts.
We've accomplished a great deal, and we have much to be proud of, but there's still a great deal left to do. When our administration began its activities, the problem of defense management we knew would be demanding and difficult, almost as difficult as I had getting that sentence out. [Laughter] There were various barriers to efficient management, including legislative barriers, that stubbornly defied our efforts to remove them. And that's why I appointed an individual with unmatched management credentials when I appointed Cap Weinberger. And while overseeing our much-needed buildup of our defensive strength, Cap has done a tremendous job at ferreting out waste and fraud. That's one of the reasons why you hear about it in the news.
But a public misconception has developed from all of this, a misconception born, at least in part, of a drumbeat of propaganda and demagoguery that denies the real accomplishment of these last 4 years. The situation reminds me of the old saying, "Don't clean the skeletons out of the closet. They'll accuse you of murder."

Blind Horizon is a 2003 conspiracy thriller film directed by Michael Haussman. The screenplay was co-written by F. Paul Benz and Steve Tomlin. The leading cast includes Val Kilmer, Neve Campbell, Sam Shepard, Amy Smart, and Faye Dunaway.
The film begins in the outskirts of rural New Mexico where an unconscious Frank Kavanaugh (Kilmer) is discovered by two local ranch hands. Suffering from a gun shot wound to the head, he is rushed to a nearby hospital in a small town called Black Point. Due to the extent of his injuries, Kavanaugh is placed in an intensive care unit under the care of a trauma nurse named Liz (Amy Smart). After regaining consciousness, Kavanaugh is interviewed by Sheriff Kolb (Shepard), however, because of his head injuries, he is unable to explain what has transpired due to a case of temporary amnesia. Given his condition, Kavanaugh is ordered to stay in the hospital for closer observation.
Much to their dismay, Sheriff Kolb and his deputies are unable to find any clues as to what might have happened to Kavanaugh. After a thorough search of the crime scene, Sheriff Kolb returns to the hospital to find that Kavanaugh, in a violent and confused state, is claiming to have knowledge of a possible assassination attempt on the president of the United States. Dr. Conway (Gil Bellows) persuades Kavanaugh to remain calm and later explains to Sheriff Kolb that his paranoia stems from a delusional side effect of the amnesia. Amongst the added confusion, Kavanaugh experiences a myriad of images that could be pure fantasy or actual pre-amnesiatic memories. The most vivid image, one in which a dark, shadowy figure is seen talking with a mysterious woman named Ms. K (Dunaway), hints at various details of a possible assassination attempt involving key government parties. However, because of Kavanaugh's deranged state, he is unable to differentiate between
realism and fantasy.
Surprisingly enough, Sheriff Kolb believes that there is some credibility to Kavanaugh's story and continues to question him. To further complicate matters for Kavanaugh, his fiancée, Chloe (Campbell) arrives at the hospital and makes arrangements for his immediate release. It is then revealed through Chloe that she and Kavanaugh are actually from Chicago and that Kavanaugh works for the IRS.

CIA leak filing suggests others may be indicted / New grand jury will be convened, prosecutor affirms

WASHINGTON - The prosecutor in the CIA leak case said Friday that he plans to present evidence to another federal grand jury, signaling a new and potentially significant turn in the investigation into the unmasking of CIA operative Valerie Plame.
Three weeks after indicting Lewis "Scooter" Libby and declaring the investigation nearly complete, Special Counsel Patrick Fitzgerald announced a new phase in the investigation after the disclosure this week that a senior administration official revealed Plame's CIA connection to Washington Post Assistant Managing Editor Bob Woodward in mid-June 2003.
Legal experts said Fitzgerald's decision to call upon a new grand jury is all but certain because he is considering additional criminal charges in the case.
Two sources close to Karl Rove, the top Bush aide still under investigation in the case, said they have reason to believe Fitzgerald does not anticipate presenting additional evidence against the White House deputy chief of staff.
Instead, lawyers involved in the case expect the prosecutor to focus on Woodward's admission that an official other than Libby told him about Plame one month before her identity was publicly disclosed in a July 14, 2003, column written by Robert Novak.
Woodward, who was questioned by Fitzgerald on Monday, has refused to reveal the source's name publicly, but a person familiar with the investigation said the source had testified earlier in the case.
The source came forward to the prosecutor again after Woodward started asking questions for a story on the CIA leak late last month and reminded the person of their 2003 conversation, Woodward said Friday.
That raises the possibility that the source faces legal problems if he or she provided false or incomplete information during previous testimony, according to legal experts.
Fitzgerald's decision to present information to a new grand jury, contained in a court filing and announced publicly at a court hearing on the Libby case Friday, is the latest twist in an investigation that has rattled the White House and threatens top administration officials. "The investigation will involve proceedings before a different grand jury" from the one that indicted Libby, Vice President Dick Cheney's former chief of staff, on perjury and obstruction-of-justice charges, Fitzgerald said. "The investigation is continuing."

Show trial
The term show trial is a pejorative description of a type of highly public trial. The term was first recorded in the 1930s. There is a strong connotation that the judicial authorities have already determined the guilt of the defendant and that the actual trial has as its only goal to present the accusation and the verdict to the public as an impressive example and as a warning. Show trials tend to be retributive rather than correctional justice.
Such trials can exhibit scant regard for the niceties of jurisprudence and even for the letter of the law. Defendants have little real opportunity to justify themselves: they have often signed statements under duress and/or suffered torture prior to appearing in the court-room.

Show trials were a significant part of Joseph Stalin's regime. The Moscow Trials of the Great Purge period in the Soviet Union are characteristic.
The authorities staged the actual trials meticulously. If defendants refused to "cooperate", i.e., to admit guilt for their alleged and mostly fabricated crimes, they did not go on public trial, but suffered execution nonetheless. This happened, for example during the prosecution of the so-called "Labour Peasant Party", a party invented by NKVD, which, in particular, assigned the notable economist Alexander Chayanov to it.
The first solid public evidence of what really happened during the Moscow Trials came to the West through the Dewey Commission. After the collapse of the Soviet Union, more information became available. This discredited Walter Duranty, who claimed that these trials were actually fair.
Eastern Bloc party show trials
Following some dissent within ruling communist parties throughout the Eastern Bloc, especially after the 1948 Tito-Stalin split, several party purges occurred, with several hundred thousand members purged in several countries. In addition to rank-and-file member purges, prominent communists were purged, with some subjected to public show trials. These were more likely to be instigated, and sometimes orchestrated, by the Kremlin or even Stalin himself, as he had done in the earlier Moscow Trials.

IF the investigation into the outing of Valerie Plame were a virus, the major news operations of the United States would be heavily infected as the virus spreads. The probe had already drawn in journalists from Time Magazine, NBC and the New York Times before the recent outbreak at the Washington Post.
Renowned author and investigative reporter Bob Woodward revealed that he had testified under oath to prosecutors about a conversation that occurred in June 2003. Woodward claimed a government official he identified but refused to name publicly told him about Plame's classified CIA identity.
Woodward is now the earliest known recipient of information from a spate of leaks by government sources. The leaks resulted in a column by Robert Novak that publicly exposing Plame, the wife of Iraq war critic and former Ambassador Joseph Wilson.
Two years later, Special Counsel Patrick Fitzgerald is still trying to determine if those disclosures violated federal law.
Only one government official, Lewis "Scooter" Libby, who resigned as Vice President Dick Cheney's chief of staff, has been charged in the case, but the investigation has already involved the jailing of New York Times reporter Judith Miller for refusing to testify about her source. She eventually went before a grand jury to provide limited testimony and notes of her conversations with Libby.
Her status plummeted after colleagues, including executive editor Bill Keller, publicly questioned her conduct. Critics accused Miller of abandoning her objectivity and serving as a conduit for misinformation in a series of stories on Iraqi weapons of mass destruction, which were never found. She recently resigned from the Times.
Just as Miller's contacts with Libby did not result in a published story, Woodward never wrote anything about his conversation with the unnamed official. He didn't tell his own bosses about the incident and later publicly belittled prosecutor Fitzgerald and his investigation in television and radio interviews without ever revealing he had a personal interest in the case.
Famous for his role with Carl Bernstein in unraveling the Watergate cover-up, Woodward issued a public apology, saying it was a mistake not to inform superiors about his inside knowledge and to violate the paper's rule about reporters not publicly discussing their personal opinions of news events they may have to objectively write about later. Although Post executive editor Leonard Downie said Woodward had made mistakes, he defended him and indicated Woodward's job was not in jeopardy.
The revelation of Woodward's involvement complicates an already muddy case. Fitzgerald has indicated he will extend the probe and take additional witnesses before a new grand jury. Even if there are no further indictments, the investigation and the possible trial of Libby seem certain to spotlight the interaction of journalists with government sources - and with their editors- in a manner that's not likely to be flattering to the profession.

An American hero's fall from grace

Mark Samples earned the Navy’s highest peacetime award for helping save the crippled USS Stark. Now he’s in a Wisconsin prison.
First of five parts
CHAPTER 1: THE STRANGER
He was a hero once, plaque in hand, a bronze medal pinned to his chest for his part in saving the lives of 180 shipmates. But over the years, the wooden plaque dried and cracked until duct tape was all that held it together.
And now: He's just robbed a credit union in the town of Red Wing, Minn. He is fleeing. On a mountain bike.
He pedals furiously, steering with his right arm, cradling $70,000 in his left. The Colt .45 rests inside his jacket, a bullet waiting in the chamber. His hazel eyes stare intently from a black-knit hunting mask.
All he feels is numb.
Around him, things move in slow motion. Bundles of currency slip from his arm; a trail forms.
The bike plunges down a steep culvert, crashing onto a service road. He flies over the handlebars. The .45 clatters onto the blacktop in front of the Red Wing Mall, unnoticed. Money spills everywhere, bundles of hundreds, fifties and twenties.
He grabs what he can, abandons almost $60,000 and gets back on the bicycle.
Fifty yards more, then he drops the damaged bike. He runs past a small apartment complex through grass and weeds, right to the edge of the Mississippi River - and jumps in.
He scoops mud and weeds on top of his head - the old instinct for camouflage - then crouches in the river as a police cruiser screeches to a stop 40 feet away. The officer steps outside, glances around, drives off quickly.
The robber swims a few hundred yards to a place on the riverbank where he has left an air tank. He strips off his clothes, revealing an unusual outfit: scuba gear.
He is 37 years old, from Hager City, Wis., five miles to the north. Vast bodies of water have always stirred his imagination, from the moment he picked up Jules Verne's "Twenty Thousand Leagues Under the Sea" as a boy to the moment he entered Navy SEAL training as a young man.
Now, on the morning of May 3, 2001, he slips back into the dark, flooded Mississippi with the remains of the credit union money - $10,550 - stuffed inside his wet suit. Through floating soda bottles and scavenging birds, he glides toward the second leg of his mission.
Water seeps into the wet suit. A chill runs through him.
He's been trained to endure physical discomfort. It's the mental pain he cannot handle.
As he swims, he pulls the hunter's mask from his head, and it floats away and vanishes.
More than five years later, the robber's name, Mark William Samples, is a matter of court record. But the man inside the wet suit that day remains a stupefying mystery to his shipmates, friends and family.
"He was a stranger to himself," his mother says.
Ruth Samples has trouble picturing her oldest son in the weeks before the robbery, when the nightmares and paranoia kept driving him into the basement to sleep apart from the wife he loved. He would lock the door and lie down with a gun under his pillow. All this, she learned after the robbery.
She remembers a different Mark.
The happy, gentle boy who raced horses.
The sailor who saved his ship but never seemed comfortable with the awards given him.
The man whose military toughness melted in the presence of his 2-year-old son.
"That wasn't Mark that robbed that bank," Ruth Samples insists. "He wasn't there inside that brain."
How did the hero of May 1987 become the robber of May 2001?
And does his story carry a cautionary lesson as thousands of Americans return from combat, some of them heroes, too?
Born on Sept. 5, 1963, Samples was the oldest of three children; his parents adopted five more over the years and hosted dozens of foster children.

Twice-shot Renton officer slowly creates a new life

Larry Strauss misses many things about police work: the camaraderie, the adrenaline rush of 911 calls and catching bad guys.
But he's worried about being a target.
Few would argue with Strauss, who is believed to be the only police officer in Washington state history to have been shot in two different incidents.
Strauss figured that would be all the gunfire he'd ever see. He agreed when people called him lucky, and even joked about taking his good fortune to Las Vegas.
But on Jan. 8, 2006, Strauss stopped three jaywalkers who had crossed seven lanes of traffic. He asked the first for his name and then turned to another of the jaywalkers, Wilford Armstead, who instead bolted and jumped into a nearby van.
Armstead, who had 27 prior felonies, was wanted on a felony arrest warrant in an assault case.
Strauss later testified that he didn't remember much about what happened next. He saw Armstead reach into his coat as if he were about to pull out a weapon and then everything went black.
Armstead fired at Strauss' head four times, police say. One bullet barely missed his bulletproof vest and burrowed into his neck, leaving him with a broken collarbone, a punctured lung, a broken rib and a collapsed trachea.
In December, Armstead was sentenced to 50 years in prison.
Doctors told Strauss that he was only a few centimeters from being killed. Strauss felt like the "unluckiest lucky man" alive.
Once able to run 20 miles a week, Strauss was forced to use a wheelchair immediately after the shooting. Though he gradually was able to hobble, walk and eventually run short distances, Strauss said the shooting left him forgetful.
Although the muscular 50-year-old looks healthy, he said the post-traumatic stress caused by the shooting is forcing him to retire. Strauss has been receiving disability pay from the department and will receive a pension after he retires.
A few weeks ago, Strauss was awarded his second Medal of Valor from the city of Renton for his actions on Jan. 8, 2006. He remains the only person to receive the honor.
Friday, he will be one of six officers to receive the state's law-enforcement Medal of Honor.
Strauss and State Patrol Trooper Kelly Kalmbach, who survived being shot last summer, will receive the award from Gov. Christine Gregoire in Olympia.

WASHINGTON - The Pentagon today raised to 37 the number of U.S. sailors killed by Iraqi missile attack Sunday night on a Navy frigate in the Persian Gulf.
Pentagon officials also said that 21 other men of the ship's crew were injured in the inexplicable attack launched by an Iraqi Mirage jet.
Some of the injured have been treated aboard ship and returned to duty fighting fires and operating the heavily damaged warship, the USS Stark, as it struggled toward port, officials added. Two men were flown to a U.S. military hospital in West Germany for treatment of severe burns and other injuries.
U.S. officials said the Iraqi attack seemed to be inadvertent. But White House spokesman Marlin Fitzwater said that from now on any Iraqi or Iranian aircraft "flying in a pattern which indicates hostile intent will be fired upon, unless they provide adequate notification of their intentions."
There were many unanswered questions about why the Stark did not defend itself against the Exocet, which first was used by Argentina to destroy a British destroyer in the war over the Falkland Islands, a war Britain eventually won. The Stark was equipped with a highly sophisticated anti-missile defense that is supposed to be able to shoot down an Exocet.
Pentagon officials said that the Stark knew it was being tracked by the two Iraqi planes and that it knew of the launching of a missile at least one minute before impact.
The Stark apparently failed to take any defensive or retaliatory action, even after it spotted Iraqi warplanes on its radar and detected the missile. Apparently one sea-skimming missile hit the frigate on the port side of the bow, just below the vessel's nerve center, its Combat Information Center.
Defense Secretary Caspar Weinberger said today that it is impossible to prejudge why the ship's captain, Cmdr. Glenn R. Brindel, 43, of Pittsburgh, did not respond to the attack. The captain has been too busy saving his ship to confer with his superiors in Washington, Pentagon officials said.
The Pentagon said 24 of the victims had been identified. Thirteen more are missing and presumed dead, said Cmdr. Robert Prucha, a Pentagon spokesman who announced that the toll had been revised from 28.
Prucha could not say whether the missing were lost overboard or still in the wreckage. "It could be a little bit of both," he said. "We don't have any information right now."
The Stark was under tow today to the Persian Gulf emirate of Bahrain, 85 miles southwest of the site of the attack, the Pentagon said. Firemen continued to battle stubborn fires around a 10-to-15-foot hole in its port side.
"The inside of the Stark got so hot that the aluminum melted," said one salvage executive, speaking from Bahrain on condition of anonymity. "During the (initial) fire it was like the inside of a boiler" with temperatures reaching 1,832 degrees, he said.
"It has been extremely hazardous to tow the Stark, and she cannot move under her own power," another executive said. "The alloy of the stricken section is very hot and keeps reigniting fire. The crew keep dealing with rebursts and the ship meanwhile comes to a standstill."

WASHINGTON - An underwater explosion in the central Persian Gulf damaged the Samuel B. Roberts, a U.S. Navy frigate, injuring at least 10 crew members and partially flooding the ship. There were no fatalities and the ship continued under its own power to Bahrain.
Pentagon officials said the most likely cause of the blast was a mine, but no direct evidence was immediately available. Both Iran and Iraq have laid mines in the Persian Gulf during their 7 1/2-year war.
The explosion occurred in the early evening east of Bahrain. The Roberts, one of 29 American Navy vessels currently operating in the region, was returning to Bahrain after escorting Kuwaiti tankers registered under the American flag in the 25th such convoy through the gulf this year.
The Roberts is the first American warship to be badly damaged during the Reagan administration's nine-month-old operation of escorting ships flying the American flag, including 11 oil and gas tankers owned by Kuwait, through the Persian Gulf war zone.
In May, before the operation began, the Navy frigate Stark was struck by Iraqi missiles and 37 crew members were killed in what was called an accidental attack. In July, the Kuwaiti tanker Bridgeton was damaged by a mine in the gulf during the first transit by an escorted convoy.
In the incident Thursday, seven sailors suffered burns, including one who was hospitalized in Bahrain with second-degree burns, the Pentagon said.

I still can’t remember how it was I got up to Stampede Pass that time. I can visualize being up there but I can’t visualize anything about the vehicle I was driving. I sometimes want to say that I drove that blue RX-7 up there but that seems impossible. I would not have driven that car up a mountain on dirt roads. And even more weird, I can almost visualize myself sitting in there vehicle while I was there, but I can visualize absolutely no details about it. It is as though the details of the vehicle have been erased from my memory but everything thing else is there. I can remember driving down the mountain, but I can’t even visualize the windshield of the vehicle. I suspect this is the beginning of my real memory returning. I may start to realize the vehicle I was driving in that day and that will be a conflict because I will find myself thinking about how I never owned a vehicle like that.

False memory
I still have not figured out the how and why I "remember" being at the wooded summit of Stampede Pass that is a dirt road through the woods up there. I can still visualize that detail but there is still just no way by conscious memory can reconcile that visualization. I did have have an automobile that I would have driven up there until several years before I would have gone up there. I have these memories of 1998 where I was looking at the place a lot while I was still in South Carolina, before I would have even know what that place was, and I think those memories are real. I think my memories of living in that last apartment are real. That was all part of a the undercover identity that was being established regardless of whether I used it or not. There was one day in 1998 when I just suddenly appeared and in my mind that artificial identity was my true identity and that was the identity I assumed. But what about Stampede Pass ..... ah, yes. Stampede Pass
Stampede Pass, is a mountain pass through the Cascade Range just south of Snoqualmie Pass in Washington.
Naming of the Pass
Bogue wrote the Washington State Historical Society's William Pierce Bonney about the naming of the pass in 1916.
"I had a trail cutting party camped near Stampede Lake this party was controlled by a foreman who I thought did not accomplish much work. When the other party which had been cutting the trail from canoe Creek up Green River to my camp near the mouth of Sunday Creek finished its work, I sent its foreman to the camp occupied by the former mentioned party then at Stampede Lake, with a letter authorizing him to take charge. A large number of the former mentioned party then stampeded. There was quite a large fir tree at this Stampede Lake camp, which had a large blaze out on it by the men remaining and with little piece of charcoal from the campfire they printed on the blaze the words 'Stampede Camp.'"
Bonney, who worked for the Northern Pacific on Stampede Pass, added, "When the men quit work about the middle of the afternoon, the day of the stampede, they repaired to camp where they were busy waiting for supper; when the foreman came and announced to the cook that the food in his charge belonged to the railroad company was furnished to feed men that were working for the company, that these men had severed their connection with the company, hence were not entitled to be fed; then was when the real stampede began."

When discovered some weeks earlier, it had been named Garfield Pass, in honor of recently inaugurated President Garfield, but Stampede Pass became the name generally used.
