SPOKANE — Serial killer Robert Yates of Spokane, who faces the death sentence as well as multiple life terms, is not entitled to a new hearing or a review of his case, the state Supreme Court said today.

The court rejected Yates’ petition that listed 25 different errors in his convictions, including jury bias, ineffective counsel and procedural errors. Also rejected was a claim that his death sentence was “disproportional” because other persons convicted of multiple murders received life sentences.

None of those claims warrant a new hearing, the court said.

“Yates has failed to establish any meritorious claims,” the majority decision, written by Justice Susan Owens, said in dismissing what is known as a personal restraint petition.

Yates, a Spokane factory worker and former military helicopter pilot, pleaded guilty in 2000 to 13 murders in Spokane County and received a total of 408 years in prison as a result of a plea deal. In 2002, he was sentenced to death by a Tacoma jury for two separate convictions for murders in Pierce County, the 1997 slaying of Melinda Mercer and the 1998 slaying of Connie Ellis.

He has long argued that the plea agreement should have kept him from the death penalty for any murder in Washington State, but the state Supreme Court has already upheld the sentence in the direct appeal from those Pierce County convictions.

In the personal restraint petition, Yates’ attorneys made some of the same arguments the earlier appeal rejected, the court said. He also misrepresents the state’s system of comparing cases where the convicted murderer receives the death penalty to those where a murderer receives a life sentence, Owens wrote. The factors considered in the review — nature of the crime, aggravating circumstances, criminal history and personal history — aren’t vague and Yates knew what they were.

His attorneys argued that Yates’ case should have been compared to that of Gary Ridgway, the so-called Green River killer, who received life sentences as a result of a plea deal. The court said that comparison was made, but just because prosecutors exercise their discretion to offer plea deals doesn’t make his sentence disproportionate.

Death penalty cases don’t require mathematical precision, Owens wrote. Instead the law says the death penalty can’t be imposed “wantonly or freakishly”. If the facts in a case are similar to some facts in other cases where capital punishment is imposed, the sentence is proportionate.

In his petition, Yates argued that his trial lawyers made several major mistakes, including a failure to present more testimony from family and friends during the penalty phase, before the jury decided he should get the death penalty. But trial counsel said they were leery of calling some of his family members because “most were understandably conflicted” and worried about what they might say on cross-examination. That’s not unreasonable, Owens wrote, because prosecutors could have argued Yates victimized his own family through his actions.

His attorneys also said the Pierce County jury that convicted and sentenced him was drawn from a pool that under-represents the community’s minority population. Statistically that was true, but they didn’t prove those numbers meet the test of not being “fair and reasonable” representation, and the county’s process for selecting a jury pool had previously been upheld.

Yates also claimed his right to a fair and public trial was violated because portions of the jury selection were closed to the public and some jury questionnaires were sealed. The court said the evidence suggests the court was only closed to the public while the panel was being seated, and prospective jurors were questioned in open court and could be challenged based on those answers.

The argument that the state’s death penalty statute is unconstitutional was rejected, based on previous cases that have upheld the law.

Yates remains on death row at the Washington State Penitentiary in Walla Walla.

After I left Redmond Washington in February 2004 and moved to Spokane Valley, look at your maps if you want to know how to get there, I was living at a long-term hotel where I planned to stay until I found other employment and then I was going to rent an apartment. Just about every day I saw a chief petty officer in a khaki United States Navy uniform pass by my window. I guess they had him in the unit next door to mine. I saw him often enough that I identified the chief petty officer insignia on the shirt collar of his uniform.

They certainly went to great lengths to discredit me. I mean, am I not discredited even to this very day?

But hey, let's give the Devil some credit where credit is due. I was never a chief petty officer of the United States Navy.

Between 1990 and 1993 contiguously I was a chief warrant officer of the United States Marine Corps.

Robert Yates: Son, husband, athlete, father, pilot, teacher, murder suspect

Robert Lee Yates threw fast pitches in high school, but didn't have much of a curve. He dreamed in college of being a doctor, but those dreams fell apart about the same time as his first marriage. He worked his way up to an elite post flying helicopters in the Army, but left two years shy of full retirement.

Yates was different things to different people. A stand-up guy, say his high-school friends. A heck of a teacher, say Army subordinates. A family guy. A single parent. A john. Meticulous. Religious.

Spokane authorities now say Yates is a serial killer. European newspapers call him the "notorious Washington Ripper." Investigators from 30 states and two countries have called about him, wondering if he can be linked to their unsolved killings.

March 1999 - Yates picks up a prostitute in his Honda Civic for oral sex, according to court documents.

September 1999 - Investigators interview Yates in connection with the serial slayings. He is one of hundreds interviewed and asked for blood samples. Yates refuses to give a blood sample for a DNA test. He sweats, police say.

January 2000 - Detectives track down the white Corvette, parked in the garage of Jones' sister, who works for the Spokane police. They take some carpet fibers for testing.

March 26-April 1, 2000 - Yates trains with his National Guard unit in Eagle County, Colo.

April 2-15, 2000 - Yates trains with the National Guard at the Yakima Training Center.

April 5, 2000 - The fibers removed from the white Corvette match fibers found on Jennifer Joseph's shoes and a towel found near her body, police say.

April 10, 2000 - A search warrant is signed for the Corvette. Police later say they found a button matching one missing from Joseph's jacket and traces of blood on a seat and seat-belt buckle.

April 18, 2000 - Yates is arrested on the way to work.

Robert L. Yates Jr. played baseball and sang in the high-school choir in Oak Harbor, met his future wife while attending Walla Walla Community College, spent 18 years in the Army and flew helicopters before settling in Spokane.


Yates joined the Washington Army National Guard in April 1997 and was a helicopter pilot, carrying the rank of warrant officer 4.

The father of four daughters and a son, Robert Yates Jr. led a relatively ordinary and unremarkable life that was characterized by exemplary military service. Yates grew up on Whidbey Island, Washington, where his mother died while he was still in high school. Records show that he was allegedly repeatedly sexually abused by an older neighbor boy when he was approximately six-years-old, and it isn't clear whether he received psychiatric help or counseling. Following graduation from high school, he enrolled at Walla Walla College but dropped out after only two years. In 1975 he obtained a job as a guard at the Washington State Penitentiary in Walla Walla, where he worked for only six months. The following year he married a young woman named Linda, and later enlisted in the Army where he served his country for 19 years as a helicopter pilot, opting to leave less than a year before becoming eligible for retirement benefits. He flew an OH-58D Kiowa, the type of helicopter that the Army uses for reconnaissance missions. Yates served in Germany, participated in Desert Storm, served in relief efforts after the devastation of Hurricane Andrew, and flew in a UN peacekeeping mission to Somalia. In addition to holding a military pilot's license, Yates was also rated commercially to fly transport planes and helicopters. During his military service, Yates received a number of distinguished awards and medals including three meritorious service medals, three Army commendation medals, three Army achievement medals, and two Armed Forces expeditionary medals. After receiving an honorable discharge, Yates went to work for an aluminum smelter. He also joined the Washington National Guard.

While serving in the National Guard, Yates attained the rank of Chief Warrant Officer 4 and was the only commander the Guard had east of the Cascade Mountains for the OH-58 Kiowa scout helicopter, making him a valuable commodity, so-to-speak. He was characterized by his fellow guardsmen and guardswomen as a true professional who was very proficient in his job. He was also characterized as brave, and it became well known that he scouted hostile territory, often drawing enemy fire, while serving in Somalia.

Father of 5 tied to serial deaths

SPOKANE - The killer was viewed as a monster, as a shadow man who murdered prostitutes and dumped them in out-of-the-way places like Hangman Valley.

But Robert Lee Yates Jr. is a husband of almost 24 years. He is a father of five who has never been convicted of a felony. He is a 47-year-old, slightly balding man who combs his hair from right to left and lives in a split-level home that has a basketball hoop.

Now he's been charged with first-degree murder, suspected of killing Jennifer Joseph, a 16-year-old girl who worked as a prostitute. The evidence is small but damning: A mother-of-pearl button. Bloodstains on the seat-belt buckle of his Corvette. Carpet fibers. DNA.

By the end of yesterday, the Spokane Homicide Task Force announced that it thinks it has found a serial killer. Yates is the leading suspect in the deaths of at least 12 women and maybe 18. Preliminary DNA results and other evidence link Yates to the deaths, said Spokane County Sheriff Mark Sterk, who wouldn't elaborate.

But a law-enforcement source said investigators have been able to link some of the victims to one another - and then allegedly to Yates - through ballistic matches on bullets taken from some of the bodies.

Yates' arrest will almost certainly pique the interest of police in other areas where he lived. While in the Army, Yates lived in New York, Massachusetts and Alabama, and overseas he lived in Germany and Somalia. He joined the Washington Army National Guard in April 1997 and trained one weekend a month at Fort Lewis.

Police in Watertown, N.Y., where Yates was stationed at Fort Drum in the early 1990s, said detectives may travel to Spokane to interview Yates about the unsolved slaying of Tina Hosmer Smith 10 years ago.

Killings began in 1990

The Spokane deaths started in 1990: three that year, one in 1992, one in 1995, one in 1996. Joseph and Heather Hernandez were found the same day, Aug. 26, 1997.

Then the deaths picked up. Darla Sue Scott, found in nearby Hangman Valley in Nov. 5, 1997. Four more in December 1997, five in 1998. Those 10 deaths have been linked to the same killer, but the task force isn't saying how.

Most of the women at some time sold sex. They used drugs. Fourteen were found in Spokane, two in Tacoma and one in south Kitsap County. Melody Murfin just hasn't been found.

This mystery has haunted the community and the state. Were these deaths tied to the Green River killer? Or the missing prostitutes from Vancouver, B.C.? Police looked into these possibilities and came up with nothing conclusive.

People called in more than 6,000 tips to the task force. Serial killer Henry Lee Lucas confessed, but his confession didn't pan out. Neither did a sailor who admitted to a cross-country killing spree last week, nor a man charged with killing his daughter in Spokane.

Now there's Yates. In Spokane, he lived in a subdivision with winding roads and surprise dead-ends and sport-utility vehicles and icicle lights just waiting for the holidays. His house is five miles south of the area where most of the women disappeared.

Yesterday, a crowd gathered around a TV screen in the Spokane Public Safety Building to see Yates in his initial appearance.

He wore drab, olive coveralls. When he was charged with first-degree murder, he scratched at his face. As the court commissioner read the six-page summary of facts, he looked at the ceiling, sometimes straight ahead.

He didn't say much. "Yes." "Yes, it is." "Yes, I am." "No, I don't have anything to say at this time, thank you."

He confirmed he had lived in Spokane for four years and had worked at Kaiser Aluminum since December 1998.

He has a speeding ticket for his Corvette. He was charged with misdemeanor assault, in November 1998, for assaulting his then-19-year-old daughter in their home.

That same month, Spokane police saw Yates pick up a known prostitute. He and the woman in the car told the officer he was driving her home at her father's request. Police interviewed him Sept. 15, 1999, but at that time Yates was just one of many people police were keeping an eye on in connection with the case. He didn't become a "person of interest" until the results of the tests on his car carpet came in.

Court documents released yesterday indicate the Corvette, which Yates bought in September 1994, produced a wealth of evidence linking him to Jennifer Joseph.

According to the prosecutors' statement of facts, Yates frequented prostitutes in the East Sprague Avenue area. Joseph was last spotted there in a white car with a white man.

Yates sold his white Corvette two years ago. But detectives tracked down the car's new owner in January and were given permission to remove carpet fibers. Tests completed early this month showed fibers from that car matched fibers found on Joseph's shoes. Tests showed DNA from bloodstains from the car's passenger seat and seatbelt was 850 times more likely to be from an offspring of Joseph's parents than from a random Caucasian. A mother-of-pearl cuff button was found in the car. It matched another from the jacket Joseph wore. Bond for Yates was set at $1.5 million.

Pat McClenahan watched all of the court hearing yesterday. His boss gave him the day off because his father had died Tuesday night. Now this. His sister was one of the 10 women linked to a serial killer. Shawn McClenahan had once been a phlebotomist, a professional, but she started using painkillers after carpal-tunnel surgery, and she slipped into cocaine, heroin and prostitution. She was found the day after Christmas 1997.

He came to the hearing to see this person face to face. He wants some closure to this.

"She was no angel," he said. "But she wasn't the way people think of girls this happens to - I don't like to use the word prostitute. She was wonderful. She loved everybody."

The women from Spokane worked near East Sprague Avenue, which doesn't look so much like a red-light district as it does like leftovers. There's a sign advertising a meeting place for the local Hell's Angels, the Nomads branch. There's Sonnenberg's, the oldest meat market in town, since 1891. Tattoo shops, a parrot shop, a place with bridal gowns in the window.

This is the place where many women disappeared, and Lynn Everson knows most of them. She is an outreach worker with the Spokane Regional Health District, and she hands out condoms and Tootsie Rolls and hugs to women from a Winnebago.

She points at their pictures and says one wanted to go back to school. Another got a job and almost kicked heroin.

She is talking about this, and the phone rings, someone telling her that Jennifer Joseph is the person tying this man to the killings.

"I only had contact with her once," Everson tells the person. "She was fairly young and very new."

Part II: A Corvette Plays A Key Role

The investigation into the killings intensified. The task force began electronic surveillance of East Sprague Avenue, shooting hundreds of hours of videotape. Despite the extra effort, it wasn’t long before the serial killer struck again. The victim, 47-year-old Michelyn Derning, had been missing for several days by July 7, 1998, when her body was found.

In January 1999, the task force announced that two murders in Tacoma, Washington, 300 miles away, were both linked to the Spokane killer. And then the killings suddenly stopped. Months passed. Sheriff Mark Sterk tried to fight those who wanted to cut his budget.

In the first 18 months of the serial killer case, investigators had amassed a lot of physical evidence. They had DNA samples from several crime scenes, as well as ballistics. But what they needed was a prime suspect. They found one by reexamining one of their earlier leads: the white Corvette.

Police took every registered Corvette owner out of the state of Washington and Idaho, about 3,000. They whittled that down to about 47 potential suspects. Task Force detective Rick Grabenstein tracked down one car, which had been sold by one of the 47 men. He grabbed some carpet fibers from the car. Those fibers were sent to a lab, and compared with fibers taken from the original Jennifer Joseph crime scene. They matched almost exactly.

On April 10, 2000 a search warrant was issued for the car. Police discovered blood on the passenger seatbelt, and a missing button from the blouse belonging to Jennifer Joseph. On April 18, 2000 the Spokane police arrested Robert Yates, Jr. for Joseph’s murder.

“And if things do go from bad to… to worse, no one will ever know. Project Blue was uninfiltrated to the very end, we’re sure of that. A new virus, a mutation… our opposite numbers may suspect, but there won’t be time enough. Share and share alike, Len.”

Starkey was looking at the monitors again. “My daughter gave me a book of poems some years ago. By a man named Yeets. She said every military man should read Yeets. I think it was her idea of a joke. You ever heard of Yeets, Len?”

“I think so,” Creighton said, considering and rejecting the idea of telling Starkey the man’s name was pronounced Yates.

“I read every line,” Starkey said, as he peered into the eternal silence of the cafeteria. “Mostly because she thought I wouldn’t. It’s a mistake to become too predictable. I didn’t understand much of it—I believe the man must have been crazy—but I read it. Funny poetry. Didn’t always rhyme. But there was one poem in that book that I’ve never been able to get out of my mind. It seemed as if that man was describing everything I dedicated my life to, its hopelessness, its damned nobility. He said that things fall apart. He said the center doesn’t hold. I believe he meant that things get flaky, Len. That’s what I believe he meant. Yeets knew that sooner or later things get goddam flaky around the edges even if he didn’t know anything else.”

“Yes, sir,” Creighton said quietly.

“The end of it gave me goosebumps the first time I read it, and it still does. I’ve got that part by heart. ‘What rough beast, its hour come round at last, slouches towards Bethlehem to be born?’”

Creighton stood silent. He had nothing to say.

“The beast is on its way,” Starkey said, turning around. He was weeping and grinning. “It’s on its way, and it’s a good deal rougher than that fellow Yeets ever could have imagined. Things are falling apart. The job is to hold as much as we can for as long as we can.”

“Yes, sir,” Creighton said, and for the first time he felt the sting of tears in his own eyes. “Yes, Billy.”

Starkey put out his hand and Creighton took it in both of his own. Starkey’s hand was old and cold, like the shed skin of a snake in which some small prairie animal has died, leaving its own fragile skeleton within the husk of the reptile. Tears overspilled the lower arcs of Starkey’s eyes and ran down his meticulously shaved cheeks.

“I have business to attend to,” Starkey said.

“Yes, sir.”

After negotiating a price for her services, she told her "date" to drive to a parking lot behind a clinic on East 400 Fifth Street. While en route to the location, the "date" told her that he was a helicopter pilot with the National Guard. Smith said that she asked the man if he was the "psycho killer," and he had responded that he was not. He told her that he had five kids and would not do something like that. After arriving in the parking lot, the man paid her $40 for oral sex. They went to the rear of the van and got onto the raised mattress, where the man pulled down his pants and she performed oral sex on him for approximately 5 to 7 minutes. During the entire time, she said, his penis did not become erect. At one point after the 5 to 7 minute period, the man hit her over the head with something, but she wasn't sure what he hit her with. The blow nearly caused her to lose consciousness. She fell backward and struggled to keep her senses intact. The man told her to return his money to him, and she struggled to find a door handle to the sliding side door. To her horror she could not find one. She made her way to the front of the van, all the while trying to retrieve the money the man had given her from her pants pockets. With blood dripping from her head, she made it to the front seat area and out the passenger door.

Congress OKs $40 billion spending package; Senate authorizes use of force

WASHINGTON — The Senate and House in quick succession today approved $40 billion in emergency aid to help the victims and hunt down the perpetrators of this week's terrorist attacks. The Senate also gave its official consent for the president to use force against those responsible for the attacks.

The spending bill cleared Congress as President Bush, accompanied by a contingent of New York lawmakers, boarded Air Force One to visit the World Trade Center site in New York that was reduced to rubble in the terrorist strike Tuesday.

"This was a bipartisan effort that stretched from one end of the country to the other, and it's going to help New York tremendously," said Sen. Charles Schumer, D-N.Y.

The Senate vote on the bill, which doubled the amount originally requested by the president, passed 96-0. The House vote, prolonged so lawmakers could attend a memorial service at the National Cathedral, was 422-0.

Senators followed with a 98-0 vote on the second measure, which authorized the president to use "necessary and appropriate force" in retaliating against the terrorists forces that used hijacked jetliners to crash into the World Trade Center and the Pentagon.

The House was expected to vote late today or Saturday on that measure, crafted to show support for the president while protecting the constitutional role of Congress in overseeing military actions.

Cody Allen and Nick Ryder are two long-time friends who had served together in Vietnam. Their private investigation business was based on Cody's boat, The Riptide, in King Harbor, Los Angeles. Faced with their first big case, they decide to recruit another old pal from 'Nam, the bespectacled, rather nerdish but much likeable electronics genius Murray "Boz" Bozinsky. Along with his hoard of computer equipment, Murray had developed a strange-looking orange robot called "The Roboz", which had numerous unpredictable bugs but occasionally proved useful. Vehicle-wise, beyond the Riptide itself, the trio had an array of transport, including Nick's ancient, pink Sikorsky S-58T helicopter "The Screaming Mimi", which had a huge gaping mouth painted on the front, and had habit of cutting out at just the wrong moment; The Ebb-Tide--Cody's speed boat; Nick's classic Corvette; and most commonly, Cody's GMC Jimmy truck. Their investigations into cases often found them treading on the toes of Lt. Ted Quinlan, who saw them as nothing but trouble-makers.

The story in this movie deals with the perseverance of Spaniards to take back their country from the French who have conquered Spain under Napoleon as he marched over Europe. A huge cannon, perhaps the largest in the world at that time, is discarded by the army as they retreat from the French invaders. A "ragtag" group of Spanish loyalists find "The Gun" and begin to restore it so they may tow it across Spain to the French stronghold in Avila and use it to open the giant walls for an invasion. Luckily Britain has sent someone to retrieve the cannon for England so they can have it to fight the French also AND to make sure that the French don't get the gun! A shoemaker and his voluptuous girl friend are the leaders of the peasants trying to get the gun to Avila. The Brit can't get help to get the giant gun back to his ship without the peasants and the shoemaker won't help him unless they all go blast Avila open first. The Brit has the knowledge needed to fire the weapon and the shoemaker leads the manpower which can move the huge cannon so a deal is struck to go to Avila and then help will be provided to get the gun to the English ship. The story follows the hardships and struggles of moving such a giant weapon across Spain and how it has to be hidden from the French.

The Washington State Supreme Court has rejected Spokane serial killer Robert Yates' appeal of his death sentence for the murder of two women in Pierce County.

Yates filed a boilerplate appeal with 25 separate requests for relief of his death sentence verdict from Pierce County on issues ranging from ineffective counsel, juror bias and public trial rights.

"None of Yates' claims of error clearly merit either oral review by this court," the court wrote in its decision to reject his appeal.

As part of a plea agreement in 2000, Yates pled guilty to 13 counts of first-degree murder and a single count of attempted murder. He also admitted killing an additional three people, two in Walla Walla County and another woman in Skagit County. As a result of the plea agreement Spokane County prosecutor Steve Tucker, the death penalty was taken off the table and he was sentenced to 408 years in prison.

Two years later, Yates was convicted in Pierce County of two additional counts of first degree murder. In that case he went to trial, was convicted and subsequently sentenced to death. The court upheld his death sentence in 2007 and, a year later, Yates filed his appeal, which the court rejected Thursday.

Yates was convicted in 2002 in Pierce County for the murders of Melinda Mercer and Connie LaFontaine Ellis. Mercer was killed in 1997 while Ellis was killed a year later. Both of the women were found near Camp Murray, where Yates participated in training as a Washington Army National Guard helicopter pilot.
