President Signs Terrorism Insurance Act

THE PRESIDENT: Thank you all. Thank you. Good morning and welcome to the White House. Today we're taking action to strengthen America's economy, to build confidence with America's investors, and to create jobs for America's workers. The Terrorism Risk Insurance Act will provide coverage for catastrophic losses from potential terrorist attacks. Should terrorists strike America again, we have a system in place to address financial losses and get our economy back on its feet as quickly as possible.

With this new law, builders and investors can begin construction in real estate projects that have been stalled for too long, and get our hard-hats back to work. (Applause.)

I appreciate members of my Cabinet who are here who worked on this bill -- Paul O'Neill, and Don Evans and Elaine Chao. Thank you all for coming.

I appreciate the members of Congress who are here, particularly those on the stage with me who worked hard to get the bill passed -- Chairman Paul Sarbanes, Chris Dodd from Connecticut who did a lot of work to get the bill done. (Applause.) Senator Harry Reid worked hard on this piece of legislation, as well. I appreciate Chairman Mike Oxley from the House who also worked, along with Senator Dodd, to get this important piece of legislation passed. Mike, thank you for your leadership on this issue. (Applause.)

As well, we're joined by other key players from the House of Representatives, Sue Kelly, Chris Shays, John LaFalce, and Ken Bentsen. These members of Congress put the interests of the country ahead of partisanship, and as a result of their hard work I'm able to sign the bill today. I want to thank you for your leadership. (Applause.)

I also want to thank the union leaders who are here today, people with whom we've worked hard to get this done; leaders who put the interest of their membership right on the line -- Doug McCarron -- appreciate your leadership, Doug. He's the General President of the United Brotherhood of Carpenters and Joiners. Frank Hanley is the General President of the International Union of Operating Engineers, is with us today. Joe Hunt is the General President of the Iron Workers International Union. Ed Sullivan, who is the President of the Building and Construction Trades Department of the AFL-CIO; Terry O'Sullivan, who is the General President of the Laborers International Union of North America.

I appreciate the workers from the United Brotherhood of Carpenters and Joiners and Iron Workers, and the Building and Construction Trade Department of the AFL-CIO, who are with us today representing thousands of people who are going to go back to work thanks to this piece of legislation. Thanks for your leadership, and thanks for your presence. (Applause.)

The attacks of September the 11th, 2001, devastated lives, leveled buildings and seriously, seriously disrupted our economy. Businesses suffered. The stock market halted trading. Many insurance companies stopped covering builders and real estate owners against the risk of attack. Premiums skyrocketed. Protections were diminished. Across America, hospitals and office buildings and malls and museums and construction jobs and many transportation companies have had difficulty finding terrorism insurance.

More than $15 billion in real estate transactions have been canceled or put on hold because owners and investors could not obtain the insurance protection they need. Commercial construction is at a six-year low, and thousands of hard-hat workers have been kept off the job. Commercial mortgage-backed securities have seen their bond ratings lowered, hurting many Americans invested in the bond market, including teachers and police officers and firefighters, who have lost money in their pension plans.

By helping to ensure that terrorism insurance is affordable and available, the Terrorism Risk Insurance Act will permit many construction projects to move forward and to help this economy grown. Billions of dollars in investments will be more secure. The nation's hard-hats will get back to work, being able to put food on the table for their families. Investors in markets will have greater confidence that our economy is strong enough to withstand a future attack. And that's important.

This new law will also help the economy in the legal system by discouraging abusive lawsuits. Civil cases resulting from a terrorist attack will be combined in a single federal court. Lawyers will be prevented from shopping for courts with a reputation for outrageous awards. Judgments and rulings will be more consistent.

It's important for our taxpayers to understand that taxpayer dollars will not be used to pay punitive damages. I'm grateful to the members of Congress who put the interest of the workers and taxpayers ahead of lawyers. I look forward to working with the new Congress on stronger measures to prevent abusive lawsuits. And today I'm taking steps to ensure that no taxpayer dollar will be spent on legal settlements without the approval of the Secretary of the Treasury. The Secretary will work to ensure that settlements are fair to victims, not windfalls for the legal class of America. The act of Congress I sign today will encourage greater competition in the insurance market and add strength to our economy.

But there's more to do. I'll work with Democrats and Republicans in the next Congress to pass a growth-in-jobs package early next year.

My administration is determined to make America safer, to make our economy stronger. And we're making progress on both fronts. America has entered a new kind of war, requiring aggressive action abroad and active defense at home. Yesterday I signed into law the new Department of Homeland Security, to organize our government for the long-term challenge of protecting America. Today, with terrorism insurance, we're defending America by making our economy more secure. Both these achievements show the unity of our nation in a time of testing, and our resolve to lead America to a better day.

I'm now pleased to sign the Terrorism Risk Insurance Act of 2002. (Applause.)

New Law Aids Victims of Terrorism

Bush gives victims, their kin the means to collect judgments against the frozen assets of the seven nations that the U.S. says sponsor terrorism.

WASHINGTON — Edwena Hegna waited 18 years for a measure of justice in her husband's slaying by terrorist hijackers.

On Tuesday, she finally got it when President Bush signed into law a bill letting victims of terrorism collect multimillion-dollar judgments from about $4 billion in frozen assets of suspected terrorist groups and the seven nations that the U.S. accuses of sponsoring terrorism.

"I know my husband's looking down," she said after attending the bill signing at the White House. "The sense of relief after 18 years is just so overwhelming."

The provision was part of a terrorism insurance bill that Bush has touted as an economic stimulus measure. The core of the bill will provide federal backup insurance against damage caused by future attacks.

"We're defending America by making our economy more secure," Bush said.

But it was the lesser-known provision dealing with the frozen assets that drew victims of terrorism and their families to the White House.

"One way to confront terrorist organizations is to hit them in the pocketbook," said Rep. Vito Fossella (R.-N.Y), a leading sponsor of the bill in Congress.

It is unknown how many people are affected by the provision, but it is estimated to be in the hundreds. The lawsuits range from terrorist bombings in Israel to kidnappings in Iraq and confinements in Kuwait and Libya.

Hegna, who is 61 and now lives in Arizona, had written Bush, reminding him that his father, then the vice president under President Reagan, had promised that "justice would be served" as the flag-draped casket bearing her husband's body arrived home in 1984.

Charles Hegna, 50, father of four and an auditor for the U.S. Agency for International Development, was flying from Kuwait to Pakistan when Hezbollah militants hijacked the plane to Tehran. Hegna was beaten, shot in the stomach and shoved out of the airplane door to the tarmac. As he lay on the ground, the terrorists shot him again. Earlier this year, Hegna's family won a $42-million judgment against Iran in federal court.

Six years ago, Congress gave victims of terrorism the right to sue countries on the State Department list of nations that sponsor terrorism -- Cuba, Iran, Iraq, Libya, North Korea, Sudan and Syria. Currently, no Syrian funds are blocked.

However, Americans who have won court cases for attacks on them or their families have had difficulty collecting.

The State Department resisted releasing the assets, contending that they can provide an important bargaining chip in U.S. diplomacy. Officials were also worried that releasing the funds could provoke attacks on U.S. property abroad.

"Assets are blocked in the national interest, so they can be used as leverage and bargaining chips with states not friendly with the U.S.," said a State Department official who spoke on condition of anonymity. The assets "are also used to assist our foreign policy in dealing with successor regimes that turn out to be friendly to the U.S."

The legislation is expected to pave the way for release of the funds, according to the families of victims and their attorneys.

"Finally, the victims are going to see justice," said Dan Wolf, a Washington attorney representing Americans who allege they were seized and used as "human shields" on potential targets in Iraq when President Saddam Hussein's regime invaded Kuwait in 1990. All were released shortly before the Persian Gulf War.

Wolf's clients include Jack Frazier, a former Santa Ana resident waiting to collect $1.7 million 12 years after he was held hostage by the Iraqis.

"Even if we don't get the money by Christmas, it'll still be a good Christmas present," said his wife, Deanna. "Jack isn't doing well at all. He will never get over what happened. He sometimes feels like a forgotten man."

When Iraq invaded Kuwait in August 1990, Frazier was a field superintendent for the Bechtel Corp. at an Iraqi oil refinery outside of Baghdad.

At the time, he suffered from a mild case of diabetes that he controlled with medication. Iraqi soldiers took away his medicine, however, and Frazier's condition worsened during his almost three months in captivity. When he was released in October 1990, he had lost sight in his right eye.

His medical problems worsened over the years, and he is mostly confined to a wheelchair and has problems feeding himself, his wife said. Today, the couple live in Lake Havasu City, Ariz., where Frazier is in a care facility. "We've gone through gangbusters to get justice for Jack," said his wife. "We never expected justice from Hussein. But we also didn't expect our government to side with Hussein when we tried to collect his award from the court."

Warren Edward Buffett

Warren Edward Buffett, (born August 30, 1930, Omaha, Nebraska, U.S.), American businessman and philanthropist, widely considered the most successful investor of the 20th century, having defied prevailing investment trends to amass a personal fortune of more than $60 billion.

Known as the “Oracle of Omaha,” Buffett was the son of U.S. Rep. Howard Homan Buffett from Nebraska. After graduating from the University of Nebraska (B.S., 1950), he studied with Benjamin Graham at the Columbia University School of Business (M.S., 1951). In 1956 Buffett returned to Omaha and in 1965 took majority control of the textile manufacturer Berkshire Hathaway Inc., turning it into his primary investment vehicle. From the 1960s through the ’90s the major stock averages rose by roughly 11 percent annually, but Berkshire Hathaway’s publicly traded shares gained about 28 percent per year. Though Buffett’s success with Berkshire Hathaway made him one of the world’s wealthiest men, he eschewed lavish spending and criticized governmental policies and taxation that favoured the rich over the middle or lower classes.

In June 2006 Buffett announced that he planned to donate more than 80 percent of his wealth to a handful of private charitable foundations. The main recipient was the Bill & Melinda Gates Foundation—created by Microsoft founder Bill Gates and his wife—which focused on issues of world health and education. Gates and Buffett had maintained a close friendship since the early 1990s, and the foundation was slated to receive Buffett’s funds in increments that would eventually raise its assets to an estimated $60 billion.

Intel Exec Stands By Testimony

WASHINGTON — Intel Corp. executive Steven McGeady, under cross-examination Tuesday in the Microsoft antitrust trial, acknowledged that Intel blundered when it developed multimedia technology for a soon-to-be-replaced version of Microsoft's Windows operating system. But he refused to yield on his contention that the technology was shelved because of Microsoft's threats.

A Microsoft lawyer spent the afternoon attacking McGeady as a poorly-informed malcontent in an attempt to undo his testimony that Microsoft Chairman Bill Gates threatened to withhold vital support for Intel microprocessors unless Intel ceased development of multimedia software known as native signal processing, or NSP.

The thrust of McGeady's testimony was that even Intel, which shares dominance of the personal computer world with Microsoft, was not immune from bullying when Microsoft perceived incursions on its turf--any software connected to Windows.

McGeady's testimony is considered especially significant because unlike other government witnesses to date, he represents not a competitor, but a Microsoft partner--and one of the high-tech world's most powerful forces. Intel microprocessors are the brains of more than 80 percent of the world's desktop computers, and like Microsoft, the company is being sued by federal regulators for abuse of its market power.

McGeady testified that consumers were hurt by Intel's decision to sideline NSP because it delayed the availability of software that improved the clarity of pictures and sound delivered over the Internet on Windows-based computers.

He also said Microsoft would have damaged the openness of the Internet by adding proprietary elements, called extensions, to the basic language of Web pages, Hypertext Markup Language (HTML).

His notes of a November 1995 meeting quote a Microsoft official as saying the company planned to "kill HTML by extending it."

Object-oriented programming (OOP) is a programming paradigm that represents the concept of "objects" that have data fields (attributes that describe the object) and associated procedures known as methods. Objects, which are usually instances of classes, are used to interact with one another to design applications and computer programs.


Object orientation eases maintenance by the use of encapsulation and information hiding. One of the most common sources of errors in programs is when one part of the system accidentally interferes with another part. For example, in the very earliest days of programming, it was common for developers to use "go to" statements to jump to arbitrary locations within only a few routines and functions. Critics called this "spaghetti code" because it is disorganized. Structured programming addresses this by encouraging the use of procedures and subroutines. Appropriate usage sections off responsibility for individual blocks to implement separate functionality. So, for example, one would know that the square root function was separate from the launch missiles function, and a change to one could not affect the other.

Object-orientation takes this to the next step. It essentially merges abstract data types with structured programming and divides systems into modular objects which own their own data and are responsible for their own behavior. This feature is known as encapsulation. With encapsulation, not only can the "square root" and "launch missiles" functions not interfere with each other, but also the data for the two are divided up so that changes to one object cannot affect the other. Note that all this relies on the various languages being used appropriately, which, of course, is never certain. Object-orientation is not a software silver bullet.

In addition to providing ease of maintenance, encapsulation and information hiding provide ease of evolution as well. Defining software as modular components that support inheritance makes it easy both to re-use existing components and to extend components as needed by defining new subclasses with specialized behaviors. This goal of being easy to both maintain and reuse is known in the object-oriented paradigm as the "open closed principle". A module is open if it supports extension (e.g. can easily modify behavior, add new properties, provide default values, etc.). A module is closed if it has a well defined stable interface that all other modules must use and that limits the interaction and potential errors that can be introduced into one module by changes in another.

Plot Summary


The crew aboard the USS Elmira are working on a project, code named Operation Honeymoon. At the operation's core is the testing of the Magnetic Analyzer Computing Synchrotron, or MACS for short, which is a smart computer designed to do among other things determine where missiles are going to land. Civilian Jason Eldridge is the scientific mastermind aboard in charge of MACS' operation. His friend aboard, Lieutenant Ferguson Howard, sees other possible uses for MACS. He wants to know if MACS, if given the proper data, can accurately predict games of chance, such as those found in casinos. After discussing the situation, Fergie and Jason decide the game which MACS can predict the most accurately is roulette. They decide to test MACS' abilities, and possibly get rich, at their next port of call where there is a casino, namely Venice. They plan on using a system of Morse Code light signals from the ship to shore to transmit the information. Although they go ahead with their plan, they are sidetracked by female distractions. Jason runs into his old girlfriend, hot dog heiress Pam Dunstan, who he left three years earlier because he felt he couldn't support her in the lifestyle to which she was accustomed. He is dismayed to learn that she is in Venice to get married to the pompous Tommy Dane, who works for the State Department. And Fergie meets a beautiful young girl named Julie Fitch, for who he instantly falls. He doesn't tell her of his naval occupation since her father is a naval admiral also in town. But problems for Jason and Fergie really begin when Admiral Fitch sees the transmission of messages to and from the ship, which he believes is enemy communication.

I was stationed aboard the United States Navy guided-missile frigate USS Taylor FFG 50 from about 19 December 1984 to sometime in January 1986. I don't recall precisely when I departed the ship for my assignment to Basic Electricity and Electronics School in Orlando Florida, for my second assignment to that school, but I think I left the Taylor in January 1984 and I feel certain that is correct. I left the ship when it was back in the shipyards in Bath Maine.

So anyway, before I left, and sometime during my assignment to the FFG 50, I worked in the Ship's Control department and I was a non-rated Seaman and I was supervised by the Boatswain Mates of that department and there was a large group of other non-rated sailors such as myself who worked for the Boatswain Mates.

Among that group of my peers was a United States Navy sailor who, the story goes, was formerly a sailor of Her Majesty's Royal Navy from England. He had served in Her Majesty's Royal Navy, the story I heard goes, and then he signed up for the United States Navy and there he was working in the same department as I on the United States Navy guided-missile frigate USS Taylor FFG 50.

One day, I do not recall the precise day, we were walking up the gangplank, or brow, onto the ship, from the pier. That was probably a day in the summer of 1985. I do not recall the precise day and since I watched the scene referenced below I have thought again, as I have before, that day could have been the summer of 1985. I was promoted to Petty Officer sometime in the latter half of 1985 and I was still working out of the Ship's Control department even though I was a Fire Controlman 3rd Class Petty Officer, so I am certain that incident would have been before I was promoted, so that makes it sometime probably in the summer of 1985 or earlier but not much earlier. I did not even watch that 3 July 1985 film "Back to the Future" until some time in 1986, as best I can recall. As best I can recall, the first time I saw that film was in the barracks lounge of the Fire Controlman barracks when I was attending Fire Controlman Class A school in Great Lakes Illinois. I can visualize myself sitting there in that lounge as it was on the television. I wondered about the probability of that film being on broadcast television that soon, about a year later, and so that is possible, but then I started to wonder if that lounge in that United States Navy barracks had the HBO cable television service available. I don't recall. But I feel certain that is where I saw it. I think I was aware of it being in the theatres in 1985 but, I have thought this morning, I thought the advertisements I saw for it seemed stupid and that might be why I didn't go out of my way to see it in the theatre. Also, we might have been out to sea when it was in the theatre and we were gone for a while in the summer of 1985 and we made a lot, it seemed, of short deployments off the coast of the United States including what seemed to be a deployment down to Key West Florida for what seemed to be forever. We weren't gone long enough to earn the Sea Service Deployment Ribbon so we weren't gone that long. I have thought to myself this morning about how I might not have seen it in the theatres because it seemed stupid and that seems more relevant because I think of that in the context of how I thought after I did watch it the first time that it was not really that stupid after all and I did really enjoy watching it.

Anyway again, there was that day walking up the brow and that sailor who was supposedly a former Royal Navy sailor. I don't know if that was true but he did present a convincing personality of a British person. He was walking ahead of me that day on the brow and I started to kick him in the rear as he was walking ahead of the brow in front of me. I wasn't kicking him very hard and I wasn't trying to but any person watching me anywhere, on the ship or on the pier or any other place who could see me, including him because he turned around every time I kicked him, could clearly see that I was kicking him in the rear as we walked up the brow.

Popov hadn't done this in ages. but he rembered how. His employer had been written about more than many politicians which was only just, Popov thought, as this man did far more important and interesting things for his country and the world-but these articles were mainly about business, which didn't help Popov much beyond a further appreciation of the man's wealth and influence. There was little about his personal life, except that he'd been divorced. A pity of sorts. His former wife seemed both attractive and intelligent, judging by the photos and the appended information on her. Maybe two such intelligent people had difficulty staying together. If so, that was to bad for the woman, the Russian thought. Maybe few American men liked having intellectual equals under their roof. It was altogether too intimidating for the weak ones - and only a weak man would be troubled by it, the Russian thought.

But there was nothing to connect the man with terrorists or terrorism. He'd never been attacked himself, not even a simple street crime, according to the New York Times. Such things did not always make the news, of course. Perhaps an incident that had never seen the light of day. But if it lead been so major as to change the course of his life - it would had to have become known, wouldn't it?

Probably. Almost certainly, he thought. But almost was a troubling qualifier for a career intelligence officer. This was a man of business. A genius both in his scientific field and in running a major corporation. There, it seemed, was where his passions went. There were many photos of the man with women, rarely the same one twice, while attending various charity or social functions - all nice women, to be sure, Popov noted, like fine trophies, to be used and mounted on the wall in the appropriate empty space, while he searched after another. So, what sort of man was he working for?

Popov had to admit that he really didn't know, which was more than troubling. His life was now in pawn to a man whose motivations he didn't understand. In not knowing, he could not evaluate the operational dangers that attached to himself as a result. Should the purpose be discerned by others, and his employer discovered and arrested, then he,Popov, was in danger of arrest on serious charges. Well, the former KGB officer thought, as he returned the last of the periodicals to the clerk, there was an easy solution to that. He'd always have a bag packed, and two false identities ready to be used. Then, at the first sign of trouble, he'd get to an international airport and be off to Europe as quickly as possible, there to disappear and make use of the cash he'd banked. He already had enough to ensure a comfortable life for a few years, perhaps longer if he could find a really good investment counselor. Disappearing off the face of the earth wasn't all that hard for one with proper training, he told himself, walking back out on Fifth Avenue. All you needed was fifteen or twenty minutes of warning… Now how could he be sure to get that?…

The German federal police were as efficient as ever, Bill Tawney saw. All six of the terrorists had been identified within forty-eight hours, and while detailed interviews of their friends, neighbors, and acquaintances were still underway, the police already knew quite a lot and had forwarded it to the Austrians, from there to the British Embassy in Vienna, and from there to Hereford. The package included a photo and blueprints of the home owned by Furchtner and Dortmund. One of the couple, Tawney saw, had been a painter of moderate talent. The report said that they'd sold paintings at a local gallery, signed, of course, with a pseudonym. Perhaps they'd become more valuable now, the Six man thought idly, turning the page. They'd had a computer there, but the documents on it were not very useful. One of them, probably Furchtner, the German investigators thought, had written long political diatribes, appended but not yet translated-Dr. Bellow would probably want to read them, Tawney thought. Other than that, there was little remarkable. Books, many of them political in character, most of them printed and purchased in the former DDR. A nice TV and stereo system, and plenty of records and CDs of classical music. A decent middle-class car, properly maintained, and insured through a local company, under their cover names, Siegfried and Hanna Kolb. What had turned them loose? The German police had no explanation for that. A neighbor reported that a car had visited their house a few weeks before-but who had come and to what purpose, no one knew. The tag number of the car had never been noted, nor the make, though the interview transcript said that it had been a German-made car, probably white or at least light in color. Tawney couldn't evaluate the importance of that. It might have been a buyer for a painting, an insurance agent-or the person who had brought them out of cover and back into their former lives as radical left-wing terrorists.

2nd Husband statue dedication set

The Amarillo Globe-News

The dedication of a second statue of astronaut Rick Husband is set for 2 p.m. Saturday in the area between City Hall and the Amarillo Civic Center Complex.

The first statue - a 71Ž2-foot bronze likeness - was dedicated Jan. 19 at Rick Husband Amarillo International Airport. Sculptor Mark Lundeen of Loveland, Colo., created the artwork.

The Center City location was chosen to give more people a reminder of Husband's accomplishments, said Garet von Netzer, president of the Center City of Amarillo board.

Husband, a native of Amarillo, commanded the Space Shuttle Columbia, which disintegrated during its final approach Feb. 1, 2003. All seven astronauts aboard the shuttle died, including Willie McCool of Lubbock.

Back in the year 2003 I wrote a letter on my computer at home and I printed it out on to paper and I put that letter in a stamped envelope for the postal service and I sent that letter through the United States Postal Service. I had the envelope of the letter addressed specifically to the Chief of [ Naval ] Operations United States Navy and I referenced a special projects branch I had found on the internet.

I wrote about a computer program I created for the guided missile computer complex system that would transfer memory from one of the computers to the other when we were in the Persian Gulf in 1988. We had two identical systems in place. They were twins you could say. The transfer of code was problematic and the solution was not obvious.

I mailed the letter to the Chief of Operations United States Navy and told them I should have received the Silver Star.
