In 1951, he accepted David Ben-Gurion's invitation to immigrate to Israel. Schwimmer was pardoned by President Bill Clinton in 2001 as a favor to Greenspun's son, Brian Greenspun.

Al Schwimmer, a former aircraft engineer who smuggled U.S. airplanes to Israel for its 1948 war of independence, founded its aerospace industry and later became a figure in the Iran-contra affair, died in Tel Aviv on June 10, his 94th birthday.

A spokesman said he suffered complications from pneumonia.

Adolph “Al” Schwimmer, who was born in New York on June 10, 1917, was a TWA flight engineer when he was approached by Jews from Palestine to help them obtain U.S. planes for the Arab-Israeli conflict, which began after the Jewish state of Israel was declared in May 1948.

A veteran of World War II who had flown missions over Europe, Mr. Schwimmer recruited fellow Jewish veterans to help him. He established two aircraft companies, one of which was in Burbank, Calif., and bought and refurbished a few dozen used transport planes, including some that were military surplus items from the war.

The planes were modified in a Lockheed terminal by Mr. Schwimmer and his associates and flown to the nascent Jewish state via Florida and Czechoslovakia.

The FBI suspected that Mr. Schwimmer was part of a ring that was violating a U.S. embargo on the shipment of planes and arms, and nearly apprehended him several times. He fled to Canada and then to Israel, where he joined other volunteer engineers and pilots in the war effort.

In 1949, he returned to the United States to face charges that he had violated the U.S. Neutrality Act by transporting planes to Israel. Tried in federal court in Los Angeles and convicted in 1950, he did not go to prison but was stripped of many of the rights he had held as a U.S. citizen.

“I could no longer vote, I was barred from holding any federal job. I was kicked out of the Air Force Reserve. It was quite stiff,” he told The Washington Post in 2001.

In 1951, he accepted Prime Minister David Ben-Gurion’s invitation to settle in Israel and established Israel Aircraft Industries, a state-run company that later was renamed Israel Aerospace Industries.

Mr. Schwimmer guided the company from an initial focus on repairing and maintaining aircraft for the Israeli air force to producing military and commercial planes. It employed 13,000 workers when he stepped down as president in 1978.

In the 1980s, Mr. Schwimmer was a consultant on technology and industry to his close friend, then-Prime Minister Shimon Peres, when he joined the secret Iran-contra operation that became a political scandal for the Reagan administration when it was exposed in 1986.

Congressional investigators said Mr. Schwimmer served as a middleman in the operation, which involved trading arms to Iran to free an American-held hostage in Lebanon.

The Israeli government stymied U.S. attempts to question Mr. Schwimmer, who lived in Tel Aviv and held Israeli citizenship. Mr. Schwimmer was a 2006 recipient of the Israel Prize, considered the state’s highest honor.

Survivors include his wife, two children and grandchildren.

In 2001, Mr. Schwimmer was pardoned by President Bill Clinton for his role in smuggling planes to Israel five decades earlier.

Mr. Schwimmer said he had never sought a pardon because he did not regret his crimes. “I guess I should be happy,” he told the Los Angeles Times in 2001 after learning of Clinton’s action. “I’ve lived most of my life without a pardon, so don’t expect me to throw a party now.”

AV-8B Harrier II V/STOL Aircraft

In 1998, the McDonnell Douglas AV-8B Harrier II was the only fixed-wing vertical/short takeoff and landing (V/STOL) aircraft in the free world. Its ability to take off vertically makes it one of the most maneuverable combat aircraft in service, and it can zoom out of the range of enemy fire extremely quickly.

Based on the 1957 British-designed Hawker-Siddley "Kestrel," the AV-8B Harrier II was developed by a team representing McDonnell Douglas, British Aerospace and Rolls-Royce. Production of the St. Louis, Mo.-built AV-8B began in 1981, and more than 340 Harrier IIs were produced. They carried more fuel than the AV-8As and had higher lift and better cruise characteristics.

In 1991, Harrier IIs were the first U.S. Marine Corps tactical aircraft to arrive for Operation Desert Storm over the Persian Gulf. During the 42 days of combat, 86 Harrier IIs flew 3,380 combat sorties

OPINION & ORDER

WOOD, J.

Plaintiff brought this action seeking, among other things, specific performance of an alleged offer of a Harrier Jet, featured in a television advertisement for defendant's "Pepsi Stuff" promotion. Defendant has moved for summary judgment pursuant to Federal Rule of Civil Procedure 56. For the reasons stated below, defendant's motion is granted.

I. Background

This case arises out of a promotional campaign conducted by defendant, the producer and distributor of the soft drinks Pepsi and Diet Pepsi. (See PepsiCo Inc.'s Rule 56.1 Statement [of Uncontested Facts] ("Def. Stat .") 2.) The promotion, entitled "Pepsi Stuff," encouraged consumers to collect "Pepsi Points" from specially marked packages of Pepsi or Diet Pepsi and redeem these points for merchandise featuring the Pepsi logo. (See id. 4, 8.) Before introducing the promotion nationally, defendant conducted a test of the promotion in the Pacific Northwest from October 1995 to March 1996. (See id. 5-6.) A Pepsi Stuff catalog was distributed to consumers in the test market, including Washington State. (See id. 7.) Plaintiff is a resident of Seattle, Washington. (See id. 3.) While living in Seattle, plaintiff saw the Pepsi Stuff commercial (see id. 22) that he contends constituted an offer of a Harrier Jet.

B. Plaintiff's Efforts to Redeem the Alleged Offer

On or about March 27, 1996, plaintiff submitted an Order Form, fifteen original Pepsi Points, and a check for $700,008.50. (See Def. Stat. ? 36.) Plaintiff appears to have been represented by counsel at the time he mailed his check; the check is drawn on an account of plaintiff's first set of attorneys. (See Defendant's Notice of Motion, Exh. B (first).) At the bottom of the Order Form, plaintiff wrote in "1 Harrier Jet" in the "Item" column and "7,000,000" in the "Total Points" column. (See id.) In a letter accompanying his submission, plaintiff stated that the check was to purchase additional Pepsi Points "expressly for obtaining a new Harrier jet as advertised in your Pepsi Stuff commercial." (See Declaration of David Wynn, Mar. 18, 1999 ("Wynn Dec."), Exh. A.)

On or about May 7, 1996, defendant's fulfillment house rejected plaintiff's submission and returned the check, explaining that:

The item that you have requested is not part of the Pepsi Stuff collection. It is not included in the catalogue or on the order form, and only catalogue merchandise can be redeemed under this program.

The Harrier jet in the Pepsi commercial is fanciful and is simply included to create a humorous and entertaining ad. We apologize for any misunderstanding or confusion that you may have experienced and are enclosing some free product coupons for your use.

(Wynn Aff. Exh. B (second).) Plaintiff's previous counsel responded on or about May 14, 1996, as follows:

Your letter of May 7, 1996 is totally unacceptable. We have reviewed the video tape of the Pepsi Stuff commercial ... and it clearly offers the new Harrier jet for 7,000,000 Pepsi Points. Our client followed your rules explicitly....

This is a formal demand that you honor your commitment and make immediate arrangements to transfer the new Harrier jet to our client. If we do not receive transfer instructions within ten (10) business days of the date of this letter you will leave us no choice but to file an appropriate action against Pepsi....

(Wynn Aff., Exh. C.) This letter was apparently sent onward to the advertising company responsible for the actual commercial, BBDO New York ("BBDO"). In a letter dated May 30, 1996, BBDO Vice President Raymond E. McGovern, Jr., explained to plaintiff that:

I find it hard to believe that you are of the opinion that the Pepsi Stuff commercial ("Commercial") really offers a new Harrier Jet. The use of the Jet was clearly a joke that was meant to make the Commercial more humorous and entertaining. In my opinion, no reasonable person would agree with your analysis of the Commercial.

3. Whether the Commercial Was "Evidently Done In Jest"

Plaintiff's insistence that the commercial appears to be a serious offer requires the Court to explain why the commercial is funny. Explaining why a joke is funny is a daunting task; as the essayist E.B. White has remarked, "Humor can be dissected, as a frog can, but the thing dies in the process...."(7) The commercial is the embodiment of what defendant appropriately characterizes as "zany humor." (Def. Mem. at 18.)

First, the commercial suggests, as commercials often do, that use of the advertised product will transform what, for most youth, can be a fairly routine and ordinary experience. The military tattoo and stirring martial music, as well as the use of subtitles in a Courier font that scroll terse messages across the screen, such as "MONDAY 7:58 AM," evoke military and espionage thrillers. The implication of the commercial is that Pepsi Stuff merchandise will inject drama and moment into hitherto unexceptional lives. The commercial in this case thus makes the exaggerated claims similar to those of many television advertisements: that by consuming the featured clothing, car, beer, or potato chips, one will become attractive, stylish, desirable, and admired by all. A reasonable viewer would understand such advertisements as mere puffery, not as statements of fact, see, e.g., Hubbard v. General Motors Corp., 95 Civ. 4362(AGS), 1996 WL 274018, at *6 (S.D.N.Y. May 22, 1996) (advertisement describing automobile as "Like a Rock," was mere puffery, not a warranty of quality); Lovett, 207 N.Y.S. at 756; and refrain from interpreting the promises of the commercial as being literally true.

Second, the callow youth featured in the commercial is a highly improbable pilot, one who could barely be trusted with the keys to his parents' car, much less the prize aircraft of the United States Marine Corps. Rather than checking the fuel gauges on his aircraft, the teenager spends his precious preflight minutes preening. The youth's concern for his coiffure appears to extend to his flying without a helmet. Finally, the teenager's comment that flying a Harrier Jet to school "sure beats the bus" evinces an improbably insouciant attitude toward the relative difficulty and danger of piloting a fighter plane in a residential area, as opposed to taking public transportation.(8)

Third, the notion of traveling to school in a Harrier Jet is an exaggerated adolescent fantasy.

Mostar - The war in Bosnia and Hercegovina (BiH) caused much pain and destruction. Many people lost family, friends, and homes and some cities became divided. One of the best known of these is Mostar, the largest city in Hercegovina with 109,000 inhabitants. In 1522 Mostar became the headquarters of the Ottoman administration of Hercegovina. Many military missions against Venetian cities were launched from the city, which came under Austrian control from 1878-1918, and then became part of Yugoslavia. Today it is a part of BiH.

According to a pre-war consensus, Mostar’s population consisted of 20 % Bosnian-Serbs, 40 % Bosniacs and 40 % Bosnian-Croats. There are practically no longer any Bosnian-Serbs in the city, they are living in the mountains south and east of the city. Bosniacs, make up 55 % of the city’s inhabitants live east of the river. Bosnian-Croats make up the remaining 45 %, and live on the west side of the Neretva.

Mostar has a story to tell. It is the story of the Old Bridge, an elegant single span arch built over the river Neretva by the Ottoman Turks. Mostar is an old city, established in the 15th century when a small settlement began to form around an old Roman wooden bridge over the Neretva river, but the name Mostar comes from the old white limestone bridge Stari Most (most means bridge, and stari means old - hence Mostar) which was finished in 1566 after nine years construction for the Ottoman emperor Sultan Sleiman the Magnificent.


On November 9, 1993, during bitter civil war in the city, the bridge was shelled by a Bosnian Croat tank from Mt. Hum. One of its last roles had been to allow Muslim defenders of the "left bank" cross the river and take supplies to their supporters and the population that had remained there. It withstood many centuries, but it could not survive this concentrated effort to demolish it. After several direct hits, this magnificent piece of history crashed into the waters below.

This scene of the Priestess performing some kind of ritual for their minds reminds me of a letter I mailed sometime in 2003. I guess that was the second half of 2003. Can't remember for certain. I do remember that I was living in that apartment in Redmond and that I mailed the letter in 2003. I wrote a letter to the Chief of Naval Operations and sent it to some kind of special projects department
